Auction Terms
Sale Method
The real estate will be offered in three tracts. All bids will
be open for advancement until the Auctioneer announces
that the real estate is sold or that the bidding is closed. The
property will sell in the manner that generates the most
dollars for the Seller. Bidding increments are solely at the
discretion of the Auctioneer. Tie bids, if any, may be open
between the two bidders only at the discretion of the Auctioneer. No absentee or telephone bids will be accepted without
prior approval of the Auctioneer or Seller. All decisions of the
Auctioneer are final.
Approval of Bids
Final sale is subject to the Seller’s approval or rejection of all
bids.
Minerals
All mineral interests owned by the Seller will be conveyed to
the Buyer(s).
Taxes
Real Estate taxes for 2012 due and payable in 2013 will be
paid by the Seller. Buyer will assume all future taxes.
Possession
Possession will be granted on January 1, 2013.
Agency
Farmers National Company and its representatives are acting as Agents of the Seller.
Conditions
Each sale is subject to all easements, covenants,and restrictions of record, disclosed on the COMMITMENT FOR TITLE
INSURANCE issued by Nebraska Title Company. Prospective bidders may obtain a copy of the COMMITMENT from
Farmers National Company prior to the auction. Bidders are
responsible for conducting, at their own risk, their own inspections, inquiries, and due diligence concerning the property. All property will be sold on an “AS IS-WHERE IS” basis
without warranty or guarantee, either expressed or implied,
by the Seller or its Agent.
Earnest Payment
A 10% earnest money payment will be required on the day
of the auction. The payment may be in the form of cash, wire
transfer, cashier’s check, personal check, or company check
approved by the Agent. All funds will be deposited and held
by the Agent or a designated closing company in their trust
account.
Contract and Title
Immediately upon conclusion of the auction the high
bidder(s) will enter into a real estate contract and deposit
with the Auction Company the required earnest payment.
Seller or Seller’s Agent shall deliver a COMMITMENT FOR
TITLE INSURANCE from the Nebraska Title Company
providing for issuance of title insurance at closing. The cost
of title insurance and escrow closing services will be shared
equally by the Seller and Buyer(s).
Buyer Premium
Buyer will be responsible for a 2% Buyer Premium. The
Buyer Premium will be added to the final bid price to establish the total real estate contract price which will be payable
from Buyer(s) at closing.
Closing
The sale closing shall be held on or before December 3,
2012. The balance of the purchase price will be paid by Buyer at closing in cash, or other readily available funds, or by
wire transfer at the discretion of the Seller and/or its Agent.
Survey
Upon written request of Buyer delivered to Agent within ten
days of the auction, the Seller shall provide a property survey
sufficient to provide good title where there is not an existing
legal or where new boundaries are created. The Seller and
Buyer(s) will each pay one-half of the survey cost.
Announcements
Information provided herein was obtained from sources
deemed reliable including the Douglas County Assessor and
the Farm Service Agency, but neither Seller nor Agent has investigated or independently verified the information. Neither
the Agent nor the Seller makes any guarantee or warranty
as to the accuracy of the information presented herein. All
sketches, dimensions, and acreage figures are approximate
or “more or less”. All maps are for location purposes only and
not intended to represent a survey of the property. Bidders
are urged to personally inspect the property and its condition
