Menu should strictly be followed. The supplier can only make deviations to the daily menu afier informing
the Procuring Enti$ of such deviation one (1) day before the actual serving. Such deviation on the menu
should not be lower in quality, quantity, price and nutritional value than the original menu;
Drinking water should always be available;
To ensure that only those who are entitled to get food from the caterer will be served, Meal ticket shall be
prepared and distributed by the caterer;
The Supplier/Caterer shall pay the Procuring Entity for liquidated damages (LD), and not by way of penalty
an amount equal to one{enth (1/10 of one percent ('l7o) of the cost of the unperformed/undelivered portion
of the Goods/Services for every day of delay. The Procuring Entity shall deduct the liquidated damages from
payments 0r any money due or which become due the SupplierlCaterer under this Contract and /or collect
such liquidated damages from the retention money or other securities posted by the Supplier/Caterer
whichever is convenient to the Procuring Entity. Once the Cumulative amount of liquidated damages
reaches ten percent (10%) of the Contract, the Procuring Entity shall rescind this Contract, without prejudice
to other courses of Action and remedies open to the Procuring Entity;
10, Contract duration or completion period shall commence on December 8-L2, 20L4. The contract
completion period shall be FIVE days;
11, The Procuring Entity shall pay base on the Actual Number of persons appeared in the attendance.
It is the responsibility of the End-user/Committee on Foods to inform the Caterer/Supplier of the
Actual Attendance on the First day of the Seminar;
12. lnspectorate Team including the member of Commission on Audit will checUinspect the Venue & the foods
being served.
