SITE CONTEXT
GENERAL PLAN: Commercial

DESCRIPTION OF EXISTING PROPERTY AND USES: The site is improved with a multi-unit tenant
commercial building, which includes the subject 1,044 square-foot full-service restaurant. The property
is located at the northeast corner of Honolulu Avenue and Glenwood Avenue. Additional uses on the
site includes a 1,800 square-foot liquor store, 585 square-foot salon, 540 square-foot barber shop, 675
square-foot cleaners, 756 square-foot restaurant, and a 3,496 square-foot laundry.

this permit application.

REQUIRED FINDINGS
Pursuant to Section 30.42.030 of the Glendale Municipal Code, a conditional use permit may be granted
only if the following findings of fact can be made:
A. That the proposed use will be consistent with the various elements and objectives of the general
plan.
B. That the use and its associated structures and facilities will not be detrimental to the public health or
safety, the general welfare, or the environment.
C. That the use and facilities will not adversely affect or conflict with adjacent uses or impede the
normal development of surrounding property.
D. That adequate public and private facilities such as utilities, landscaping, parking spaces and traffic
circulation measures are or will be provided for the proposed use.
Further, this request requires that additional findings of fact be made, as follows:
For applications involving the sale, serving or consumption of alcoholic beverages, the following
criteria shall be considered in making the findings in subsection a. through d. above:
1.
That where an existing or proposed on-site use is located in a census tract with more than the
recommended maximum concentration of on-site uses or that where an existing or proposed offsite use is located in a census tract with more than the recommended maximum concentration of
off-site uses, both as recommended by the California Department of Alcoholic Beverage Control,
such use does not or will not tend to intensify or otherwise contribute to the adverse impacts on
the surrounding area caused by such over concentration;
2.
That where the existing or proposed use is located in a crime reporting district with a crime rate
which exceeds twenty (20) percent of the city average for Part I crimes, as reported by the
Glendale Police Department, such use does not or will not tend to encourage or intensify crime
within the district;
3.
That the existing or proposed use does not or will not adversely impact any church, public or
private school or college, day care facility, public park, library, hospital or residential use within
the surrounding area;
4.
That adequate parking and loading facilities are or will be provided for the existing or proposed
use, or other reasonable alternatives satisfy the transportation and parking needs of the existing
or proposed use; and
5.
That, notwithstanding consideration of the criteria in subsections 1 through 4 above, the existing
or proposed use does or will serve a public necessity or public convenience purpose for the
area.
ANALYSIS OF CUP REQUEST
The existing full-service restaurant has been in operation since 1982. The use is in-keeping with the
City's General Plan. However, sale, service, and consumption of alcoholic beverages are conditionally
permitted. The sale of alcoholic beverages should not require any new City services, harm public safety
and welfare, or be in conflict with existing or anticipated surrounding land uses. Adequate parking exists
to serve the use.
The business has been operating without a valid Conditional Use Permit (CUP) for two years. The last
CUP renewal was granted in 2003, valid for a period of three years until August 1, 2006. At that time the
applicant was required to reapply for a new CUP and obtain approval from the Zoning Administrator in

order to continue selling all types of alcoholic beverages at the restaurant. However, the business
operator did not fulfill this requirement. Currently, the applicant is seeking to correct this violation by
requesting approval from the Zoning Administrator for a new CUP to sell all types of alcoholic beverages
at the existing full-service restaurant.
The existing restaurants request to sell all types of alcoholic beverages does not require any new City
services, harm public safety and welfare, or be in conflict with existing or anticipated surrounding land
uses. Adequate parking exists to serve the use, and the continuation and legalization of the alcoholic
beverage service is not anticipated to intensify parking demand to any significant degree.
According to the Glendale Police Department, the census tract in which the property is located allows for
seven on-sale alcohol establishments. Currently there are thirty on-sale establishments. The fact that
there is an over-concentration of licenses did not appear to be an issue for the Police Department or
Neighborhood Services. Moreover, the number of crimes in the census tract, 158 (82 percent), is within
87 percent of the citywide average. The subject site did not report any police service calls within the last
calendar year. While there have been previous incidents reported at the existing full-service/banquet
hall located on the abutting property to the east, the subject use is a small scale restaurant. The owner
does not offer his restaurant for private or large scale banquet-hall type parties. Overall, the proposed
establishment has not proven to be detrimental to the surrounding area. Notwithstanding, residential
uses across the alley to the rear of the site should be taken into consideration. The Police Department
reviewed the applicant's proposal and did not have any major concerns. It is unlikely that the
establishment will have any serious issues with transportation and parking. As previously mentioned,
this is a small scale restaurant and there is on-site parking for its patrons.
RECOMMENDATIONS:
Staff believes that all of the findings can be made in a positive manner, due to the project's small
scale, the lack of any likely impacts and the community benefit derived from a healthy network of
support services for the business and residential communities and the fact that alcohol sales is
consistent with restaurant uses in the C1 zone. Staff recommends approval of the conditional use
permit.
Staff suggests that the hearing officer consider the following conditions:

Limit hours of alcohol sales, service and consumption to 11 a.m. to 10 p.m., Monday
through Sunday. These hours would allow the operator flexibility of serving alcoholic
beverages for lunch and dinner.
Require renewal of the conditional use permit in three years.
No separate bar shall be allowed.

Manuel Mier/Paul & Helen Kenagy Family Trust is in the process of renewing their
Conditional Use Permit to allow the sale, service and consumption of alcoholic beverages
at an existing full-service restaurant.
El Sol Mexican Restaurant is located in census tract 3006 which allows for 7 On-Sale
establishments. There are currently 30 On-Sale establishments in this tract. Based on part
I crime statistics for census tract 3006 in 2007, there were 158 crimes-82O/o above the city
wide average of87.
Within the last calendar year, there have been no calls for police service at this location.
