AZOA LEGISLATIVE ACTIVITIES: THE YEAR IN REVIEW
Donald G. Isaacson, the AZOA’s legislaƟve aƩorney
and lobbyist, prepared the following summary of
acƟviƟes.
The 2009 legislative session was completed in the early
hours of July 31st. A special session was immediately
then called to conduct further budget work. As I write,
the Legislature is still engaged in special session. I’m
writing to let you know the activities that Dr. Anne e
Hanian and I undertook on behalf of the AzOA in the
fall of 2008 and in the 2009 legislative session.
OPTICIAN REGULATIONS
The Arizona Board of Dispensing Opticians
a empted in draft regulations last year to secure
direction and control over opticians working for
optometrists in many locations. On behalf of the
AzOA, we objected to the regulatory effort and
successfully advocated for a change in the proposed
Opticians Board regulations. The change further
clarified that opticians employed by optometrists are
exempt from the regulation of the Arizona Board of
Dispensing Opticians.
MANDATORY VISION SCREENING &
COMPREHENSIVE VISION EXAMS
This subject began during the 2008 legislative
session. A bill was introduced in the Arizona
Legislature which would have established a $3 million
fund at the Arizona Department of Health Services
which would have funded a group called “Protect
Blindness” to train vision screeners at each Arizona
public school. The AzOA objected to this approach in
2008 and effectively stopped the legislation. In fall of
2008 and 2009, Dr. Hanian, Dr. Glonek and I worked
with Rep. Cloves Campbell, the original sponsor of
the vision legislation, to develop a model which more
closely followed the AOA and AzOA approach, namely
to require a comprehensive eye exam for school
children. The comprehensive eye exam would have
been required for a child entering public or private
school and could be performed by an optometrist,
MD or DO. Because of the focus of this past session
on the budget and the concern regarding increased
unfunded costs, this legislation was introduced, but
was not scheduled for a hearing. The AzOA has been
effective in changing the debate from vision screening
to comprehensive vision exams.
Later in the 2009 session, an announcement was
made by another group of their intention to seek
legislation for computerized vision screening. This
vision screening would be mandated for every public
school child and the testing would be in the form of a
computer game.

Meeting

Washington D.C. this June. This
year, the annual Congressional Advocacy Conference was
held the two days prior. The timing for this conference
was excellent because of the current debate on national
healthcare reform. More than 500 ODs and optometry
students met with Senators and Congressmen to discuss
Optometry’s concerns. We discussed current proposed
legislation to ensure that Optometry providers are
included in any federal healthcare programs and
Medicaid. Our message is pro-patient in that it increases
patient access to vision care without increasing costs, a
valid concern in these times. While we anxiously await
information on what national healthcare reform will be,
we have to work hard to make sure we are included in
all of these programs. It was exciting to see Optometry’s
presence and influence in Washington. I sincerely want
to thank all of the Docs who took the time to a end, as
it was extremely important work. We will be keeping
you apprised of the progress Congress is making and its
impact on Optometry, so stay tuned.
The other big event in June was the House of
Delegates passing Board Certification. While the Arizona
delegation voted against, the resolution did pass. This
is upse ng to many members, but was something the
House believed to be necessary. The Board will work
hard to support your views and keep you informed of
any developments as this moves forward.
Midwestern University Arizona College of
Optometry’s first class begins their journey August 31.
Dean Hector Santiago is very excited to start the year
and work with the AzOA. We welcome all students and
they will all have free membership in the AzOA. With
all of the wonderful events coming up: Eye exams at
the VFW Convention, Diabetes Walks and our Sedona

Conference. I hope many of us will be able to meet
many of these students and welcome them to our
Optometry family. These students will be the future of
our profession, and I am excited to meet them and show
them what a wonderful profession it is!

LEGISLATIVE UPDATES: BY DR. ANNETTE HANIAN
Understanding Current Federal Legislation
Very often we get concerned about our local politics or
major issues like Board Certification. The AOA and AZOA
are working on several Federal issues that affect us on a
daily basis here in Arizona. The AOA backs several bills,
which I have outlined below:
The AOA has endorsed HR 1884, the National
Health Service Corps Improvement Act of 2007, introduced by Representatives Bart Gordon (D-TN) and Joe
Pi s (R-PA). HR 1884 is aimed at expanding access to
eye and vision care in medically underserved communities across America. This bipartisan bill will end the
misguided exclusion of doctors of optometry from the
National Health Service Corps (NHSC) student loan repayment and scholarship programs. The NHSC provides
loan forgiveness and incentives to a ract providers to
health professional shortage areas. The legislation seeks
to build on this successful incentive program to develop
new links between highly qualified doctors of optometry
and communities in rural and urban areas with limited
access to eye and vision services.
The Contact Lens Consumer Health Protection
Act (HR 2012) would direct a Federal crackdown on the
prescription verification abuses of the unscrupulous Internet and mail order contact lens sellers that are improperly filling and even overfilling contact lens orders.
HR 2012 was introduced by Reps. Mike Ross (D-AR), Edward Whi ield (R-KY), Tom Allen (D-ME), John Boozman,
O.D. (R-AR) and other leaders in Congress on health and
consumer safety issues. The bill is designed to address
complaints forwarded to Capitol Hill and the U.S. Federal Trade Commission concerning deficient prescription
verification practices of third-party sellers – operating
online or through mail order – that can place the visual
health of patients at risk.
Reps. Jan Schakowsky (D-IL), John Boozman,
O.D. (R-AR), Albert Wynn (D-MD) and Mary Bono (R-CA)
have joined together to introduce the Optometric Equity in Medicaid Act (HR 1983), an AOA-backed bill to

expand eye and vision care services accessible through
the Medicaid program. HR 1983 seeks to close forever
a loophole in Federal law that can be used by state bureaucrats and Medicaid third-party payers to restrict access to eye care services. The bill specifically recognizes
that optometrists are fully able to provide medical eye
care services to Medicaid patients – just as they now do
for Medicare and private-pay patients throughout the
country.
The AOA supports the Vision Care for Kids Act
of 2007, S. 1117 / HR 507, a bi-partisan bill designed to
ensure that no child is left behind in the classroom due
to a treatable vision problem. S. 1117 / HR 507 recognizes the link between healthy vision and learning and
would establish a Federal children’s vision treatment
grant program that will bolster initiatives in the states.
Also, the legislation seeks to encourage children’s vision
partnerships with non-profit entities, including groups
as commi ed to the cause of safeguarding the sight of
America’s children as state optometric associations. It is
easy to see how these Federal bills, if passed, will have
a positive effect on our practices and on eye care for
Arizonans.

The Rules of Politics
FIRST RULE OF POLITICS: ALWAYS WATCH YOUR BACK
I am sure even the least political of you have heard that the
State Legislature spent the last 5 months doing nothing
else but trying to balance our State budget. The State
Senate had only one week to vote bills out of commi ee;
which means that any bills voted on were priorities to
someone or some group.
One of the few bills voted out of commi ee during
that week was S1264: Healthcare Professional Disclosure
Bill. This is the so-called “Truth in Advertising” bill that
has been supported by Ophthalmology. It would require
all non-MDs (or non-DOs) to clarify the actual degree that
the doctor holds in any communications, business cards,
ads, etc with the public. Think of the implications for
Optometry, our patients and the future legislation that
could come of this if it passed.
This is a reminder and a wake-up call to all of our
doctors.The Legislation commi ee and our lobbyist are
acting defensively against this type of legislation as well
as actively promoting Optometry to the Legislators.
AZOA LEGISLATIVE ACTIVITIES:

The AzOA will be initiating discussions with the proponent
of this legislation in an effort to promote the AzOA model
of comprehensive vision exams.
DEFENSIVE MANDATES
Arizona optometrists benefit from four mandates
in state legislation. These mandates give patients of
optometrists the opportunity to see an optometrist
or ophthalmalogist of their choice in four types of
vision programs – Blue Cross/Blue Shield program;
individual health insurance; group health insurance; and
publicly funded programs. Each year, in recent years,
these mandates have come under a ack as part of a
broader a ack on all mandates. The argument is that
all mandates, in total, have increased the cost of health
insurance and therefore, if mandates are eliminated then
health insurance costs will decrease. This year a number
of mandates were eliminated, but AzOA successfully
defended maintaining optometry choice for eye care
patients.

1. When/how did
you first realize you
wanted to be an
optometrist?
My
sophomore
year in college at
Penn State I was
deciding between
majoring in Biology
and Engineering, I weighed my options,
and I picked Physiology because I thought
Optometry was a great fit for me. It has
worked out pre y well so far.
2. Are you native to Arizona or did you
move here from somewhere else?
I was born in Pennsylvania and lived in a
small town actually named Hometown.
Hometown has a population of only
about 3,000 people. Optometry gave
me the opportunity to travel. I did an
externship at the Alaska Native Medical
Center in Anchorage which introduced
me to Indian Health Services. After my
residency in Connecticut, I worked for
the White Mountain Apache Tribe in the
White Mountains in Eastern Arizona. After
Whiteriver, I moved to Sedona and worked
in Presco , until I bought Flagstaff Eye Care
in 2006.
3. Early bird or night owl?
I think I’m both, I don’t sleep much, and
I’ve heard that I will be ge ng substantially
less sleep in about a month.
4. What do you do to relax?
I relax by fi ng multifocal contact lenses,
cage fighting, long walks on the beach and
beer.
