Movin’Out creates opportunities for persons with disabilities and their families to purchase and maintain their own homes. A wonderful example is the following testimonial:
My wife and I grew up with severe disabilities. Everything regular people do is a
struggle for my wife and me. We even met at a conference for the National Alliance
for the Mentally Ill or NAMI. We never thought it would be possible for us to have a
home of our own. We were always embarrassed about our living and financial situation. One day my case worker mentioned Movin’Out and how another client who I
knew had gotten a home and was happier than he had ever been, even though it was
just for the last year or two of his life.
This put seeds in our minds but we still were not sure it would work for us after a

This year started with me practicing a solid daily routine of expressing gratitude – both
as a way of anchoring my day as well as a way of sending some goodness out to various
friends and clients on an individual basis.
As the market has accelerated, the brakes were put on my routine and I am feeling offbalance. In an effort to kick-start that practice, I will use this column to express my
gratitude for a few keys things that occurred in the last month.
I was fortunate to represent you all in Washington DC from May 12 through May 16 while attending the
National Association of REALTORS® Midyear Legislative and business meetings. We met with our Wisconsin
Congressional delegation to discuss issues affecting our business as well as our buyers and sellers. We were
able to make an impact as they make critical decisions in this legislative cycle. Additionally, as an NAR director, I was privileged to participate in the 800-member board meeting on May 16. A few highlights:
1. A partnership was approved to give brokerages a single place to input listing data; more to come over the
next 36 months as this plan is developed further
2. An advisory board was created to oversee the REALTOR® Commitment to Excellence in an effort to promote excellent customer service – both externally and internally
3. The Strategic Thinking Committee released its report on negative game changers that could affect our real
estate markets – all in an effort to keep us on our toes and aware (realtor.org/dangerreport)

While attending these meetings I learned a few fun facts:
1. NAR is the largest trade association in the world (1,189,000 members).
2. While REALTORS® make up 50% of the real estate licensees in the country, 92% of the real estate transactions are handled by REALTORS® . We rock!
3. NAR is annually among the top 5 lobbying organizations in the country
While bigger isn’t always better in every arena, I am grateful for the efforts put forth by countless individuals
who passionately support this dedicated organization that makes a difference for our businesses individually.
Locally, we are making things happen at RASCW as well. We are pleased to welcome Attorney Robert Procter
as our new Government Affairs Director. You will see more on this elsewhere in the REALTOR® Review.
Having served for two years on our Board of Directors alongside Robert, suffice it to say that I am thrilled to
have his passion and wealth of knowledge applied in this way to RASCW’s benefit. With gratitude, we wish
Phil Salkin all the best as he pursues new adventures in Arizona with his retirement. We are very fortunate to
not be missing a beat with this smooth transition.
My "attitude of gratitude" is engaged – may you look for those moments of thankfulness both large and small
in the days ahead. It will make a difference, I guarantee it!

Welcome Robert Procter
After thirteen years of service to our association, Government
Affairs Director Phil Salkin and his wife Mary have elected to
retire to the warmer climate of Arizona. We wish them well in
their new location and know they are looking forward to the
opportunity for more travel.
We also wish to welcome Robert Procter of Axley Brynelson LLP. RASCW and
the WRA are very pleased to have entered into a contract with Robert to provide government affairs services to our associations. Robert brings an outstanding background and expertise. We are very excited to have him represent us in

Webber Named Leukemia & Lymphoma Society Woman of the Year
Sandy Webber has been named the Madison Woman of the
Year by the Wisconsin Chapter of the Leukemia & Lymphoma
Society. The Man and Woman of the Year campaign is a
fundraising competition in which nominees compete for the
title by raising money for treatment and research funding to
cure blood cancers. Sandy is shown with Charlotte, a brave
young lady who has been battling cancer since age 2 on the
evening of receiving her award. Please congratulate and
thank Sandy for her efforts on behalf of us all.

All members of the South Central Wisconsin MLS
have access to MLS listings from eight other MLSs
in Wisconsin via WIREX. There is no additional
charge for WIREX. Currently, there are 80,000+
active listings in the WIREX database. To put this in
perspective, our MLS currently has 18,000 active
listings. WIREX covers all counties in Wisconsin
with the exception of Florence, Forest, Iron,
Langlade, Lincoln, Oneida, and Vilas Counties. Click

Currently, Wisconsin real estate and appraiser
licensees must complete continuing education (CE)
every two years to maintain their license. In addition,
they must show completion of CE to maintain their
license. The WRA does not support a provision in
the Wisconsin state budget that creates a four-year
renewal of professional licenses under the Department
of Safety and Professional Services (DSPS).

A REALTOR® Supported Service Project
Foster care children often relocate, toting their possessions in plastic garbage bags because they cannot
afford suitcases of their own. Suitcases for Kids is an international nonprofit organization that collects and
distributes new and gently used suitcases, duffle bags and backpacks for these children.
In 2006 RASCW started its involvement in this campaign and to date has provided over 1596 bags to various
human services organizations in Dane, Columbia, Crawford, Grant, Iowa, Lafayette and Richland Counties.

In 1999, Wisconsin enacted the comprehensive planning law referred to as 'Smart Growth.'
In compliance with the law, local municipalities, counties and townships have created comprehensive land use plans intended to guide future land use decisions. Comprehensive Plans
are now important tools to planning departments, providing a foundation for a range of decisions including annexation, urban service district expansions, how land sub-divisions occur
and rezoning/change in use.
As market activity for vacant land with commercial potential improves, REALTORS® should
consult these comp plans when opportunities arise to list land for commercial development.
It is no longer possible to make a judgment about development possibilities of a vacant parcel based solely on the current zoning designation.
But what happens when a comprehensive plan is inconsistent with current zoning and indicates a future 'down zoning' of the property? For example, a vacant parcel may have a long
standing zoning designation of commercial from a previous use, but the comprehensive plan
map says the parcel should be future low density residential – a likely lower value use. These
"consistency" issues are surprisingly common and have resulted in numerous lawsuits – in
Wisconsin and elsewhere. Municipal officials tend to favor comprehensive plan designations,
while property owners often want to utilize the zoning entitlements.

The Wisconsin Smart Growth law placed a burden on local municipalities to eliminate, by
January, 2010, all inconsistencies between comp plan designations and other land use regulations like zoning. Because inconsistencies persisted, the State Legislature and Governor Doyle passed and signed into law Act 372. The Act 372 gave local
governments a pass on correcting inconsistencies and attempted to clarify that comprehensive plans are "guides" – not regulation. From Act 372:
"Comprehensive plan means a guide to the physical, social and economic development of a local government unit…. The
enactment of a comprehensive plan by ordinance does not make the comprehensive plan by itself a regulation".
According to Tom Larson of the Wisconsin REALTORS® Association, the Act 372 legislation of 2009 was "intended to clarify that the day after a local community adopts a comprehensive plan, the community’s zoning and subdivision regulations are
not invalid if they are not consistent with the newly adopted comprehensive plan."
But did Act 372 really correct the 'consistency' glitch in the Smart Growth law? Some local officials we’ve talked to still
maintain that the comprehensive plan trumps older zoning regulation.
Vacant land can be one of the more difficult areas of commercial real estate practice. Contracts that are contingent on government approvals often have very lengthy time periods to close, often involve amendments and extensions to the purchase
agreement. The requirement of government approvals veers into a murky realm of overlapping rules and regulations – only
one of which can be the inconsistency between comp plans and zoning. If you run into this issue on one of your listings, a
copy of Act 372 may be a helpful tool.
