REGULAR MEETING

January 8, 2008 - (Revised 09/02/08)
The Regular Meeting was called to order in the boardroom of the district office by Chairman Phil
Hamm at 5:30 PM with the following members present: Mr. Bryan Brock, Dr. Dave Drotzmann,
Mrs. Maria Duron, Mr. Don Rankin and Mrs. Karen Sherman. Also in attendance were:
Superintendent, Dr. Fred Maiocco; Deputy Superintendent ofInstructional Services, Dr. Mark
Mulvihill; Assistant Superintendent of Human Resources, Mr. Wade Smith; Business Manager,
Mr. James Thompson.
ACTION ITEM
The following candidates were interviewed to fill a vacancy on the school board: Mr. Kelly
Bissinger, Mr. Jason Middleton and Mr. Don Skeen. A motion was made by Mr. Don Rankin,
seconded by Mrs. Karen Sherman and passed 6-0 in favor of appointing Mr. Jason Middleton to
fill vacant Hermiston School Board position #4. Business Manager James Thompson
administered the Oath of Office immediately following the appointment.
President Hamm recessed the meeting for a reception honoring the educators and administrator
ofthe year. Those honored were: Robert Doherty, ALMS; Tiffany Crain, Desert View; Jan
Nichols, HHS; Barry Trapp, HHS; Cassie Anderson, Highland Hills; Cindy Beatty, Rocky
Heights; Terry Russell, Sandstone; Lorrie Wade, Sunset; Dawn Johnston, West Park.
Administrator of the Year is Dr. Mark Mulvihill.
The meeting reconvened at 7:00 PM.
The Pledge of Allegiance was said by those present.
APPROVAL OF MINUTES
Regular Meeting December 4, 2007 - A motion was made by Dr. Dave Drotzmann, seconded by
Maria Duron and passed unanimously, that the Board of Education approve the minutes of the
Regular Meeting of December 4,2007.
ADOPTION OF AGENDA
There were no changes to the agenda.
PUBLIC COMMENTS: There were no public comments.
COMMUNICATIONS:
Board of Education - Vice Chairman Karen Sherman read a thank you note to the Board from
the Festival of Trees committee thanking them for their continued support.
Superintendent - Superintendent Fred Maiocco read a proclamation of appreciation to the
members of the Umatilla County School District 8R and proclaimed the month of January to be
School Board Recognition Month.
Dr. Maiocco presented and reviewed the 2008 Hermiston School District Annual Report.
Business - Business Manager James Thompson presented the monthly financial report for the
district.
Human Resources - Assistant Superintendent Wade Smith reported that year over year district
enrollment is down. While this doesn't seem to be a great concern at this time because the
enrollment is still above the budgeted level, administration is closely monitoring the enrollment
figures.
Oregon School Employees Association - No Report
HAT - Deb Sprong reported that bargaining training is set for the end of January with actual
bargaining beginning in February. She also reported that the Ed Council has decided on two
calendar options which will be presented to the schools for selection.
ESD - No Report
Student Delegate - Austin Drinkwater outlined current Leadership projects:
• Leadership team is winding down for this semester.
• Winter sports are in full swing and doing well.
• The annual Film Festival will be held Feb. 14- 16. The ceramics class
will be making awards for the festival.
CONSENT ITEMS
Chairman Hamm asked if there were any items that needed to be pulled for discussion. There
were none.
A motion was made by Maria Duron, seconded by Don Rankin and passed unanimously that the
Board of Education approve the Consent Items.

Calendar update - Deputy Superintendent Mulvihill reviewed the January calendar. He drew
special attention to the Breakfast of Champions on January 8, Distinguished Service Award
Banquet on January 15, Community Forum at West Park on January 17, and the Board Work
Session at Highland Hills Elementary on January 22.
Chairman Hamm called for a 10 minute recess at 7:50 PM prior to the Executive Session.

Chairman Phil Hamm called the meeting to order at 5:35 p.m. and immediately moved into Executive Session.
Hermiston School Board members present: Mr. Don Rankin, Mr. Jason Middleton, Mrs. Maria Duron, Mrs.
Karen Sherman and Mr. Bryan Brock. Also in attendance were: Superintendent, Dr. Fred Maiocco; Assistant
Superintendent, Wade Smith; Assistant Superintendent, Bryn Browning; Business Manager, Mr. James
Thompson.
ORS 192.660(a): To consider the employment of a public officer, employee, staff member or individual agent.
Negotiations as per ORS 192.66(d): To conduct deliberations with persons designated by the governing body to
carry on labor negotiations.

Chairman Hamm recessed the executive session at 6:32 p.m.

APPROVAL OF MINUTES
Regular Meeting July 1, 2008 - A motion was made by Dr. Dave Drotzmann, seconded by Don Rankin and
passed unanimously, that the Board of Education approve the minutes of the Regular Meeting of July I, 2008.
ADOPTION OF AGENDA - Superintendent Maiocco reported one revision to the agenda: two additional
recommendations to item 5.4.1 - Personnel Appointments - Certified.
PUBLIC COMMENTS: There were no public comments.

ACTION ITEM 3.1.1: ELECTION OF BOARD OFFICERS AND COMMITTEE APPOINTMENTS
Chairman Phil Hamm called for nominations for the position of Board Chairman for the 2008-2009 school year.
Karen Sherman nominated Dr. Dave Drotzmann. A motion was made by Karen Sherman, seconded by Jason
Middleton and unanimously passed to close the nominations. A motion was made by Don Rankin, seconded by
Bryan Brock and unanimously passed to elect Dr. Dave Drotzmann as Board Chairman for the 2008-09 school
year.
Newly elected chairman Dr. Dave Drotzmann called for nominations for the position of Vice Chairman for the
2008-2009 school year. Phil Hamm nominated Karen Sherman. A motion was made by Phil Hamm, seconded by

A motion was made by Phil Hamm, seconded by Jason Middleton and unanimously passed to appoint Don
Rankin as a member ofthe Hermiston School Board Negotiations Committee.
COMMUNICATIONS:
Superintendent
Superintendent Maiocco recognized Mr. James Thompson, Hermiston School District Business Manager, as the
recipient of the Certificate of Achievement for Excellence in Financial Reporting awarded by the Government
Finance Officers Association ofthe United States and Canada. The Certificate of Achievement is the highest
form of recognition in the area of governmental accounting and financial reporting, and its attainment represents a
significant accomplishment by a government and its management.
Chairman Dave Drotzmann thanked Phil Hamm, for his past service and commitment as shown through his many
hours of service to the Hermiston School District. Dr. Drotzmann also thanked the board for their vote of
confidence as he begins his term as chairman.
Assistant superintendent Bryn Browning commended Tricia Baker and Neely Kirwan for another successful
summer school program. The numbers of students participating and credits earned has increased significantly
from last year.
Assistant Superintendent Wade Smith gave special recognition to all those involved in district transportation,
technology and maintenance for their tireless efforts this summer.
Oregon School Employees Association - Bonnie Luisi reported that a picnic for classified employees has been
scheduled for August 19 at Sandstone Middle School. Information regarding the new OEBB insurance program
will be presented and activities will be provided for all family members. Bonnie was asked to relay the board's
appreciation to the maintenance department for all the work they accomplished this summer.
HAT - John Larson reported that HAT is actively involved in the "Say Yes for Kids Campaign". They are also
working to make sure that all HAT employees receive the needed information on the insurance change.
ESD - Mary Apple, Director of Regional Programs, gave a brief overview of the programs and opportunities at
the ESD.

Expanded Options Program
The Board is committed to providing additional options to students enrolled in grades 11 and 12 to
continue or complete their education, to eam concurrent high school and college credits and to gain early
entry into post-secondary education. The district's Expanded Options Program will comply with all
requirements of Oregon law.
Eligible Students
Eligible students may apply to take courses at a post-secondary institution through the Expanded Options

Student Notification
Prior to February +D. of each year, the district shall notify all high school students and the students'

It is a priority for the district to provide information about the Expanded Options Program to high school
students who have dropped out of school. The district shall establish a process to identify and provide
those students with information about the program. The district shall send information about the program
to the last-known address of the family of the student.
Enrollment Process
Prior to Maroh 1May 15 of each year, a student who is interested in participating in the Expanded Options
Program shall notify the district of his/her intent to enroll in post-secondary courses during the following

school year. A high school transfer student or returning dropout has 20 business days from the date of
emollment to indicate interest.
The district shall review with the student and the student's parent the student's current status toward
meeting all state and district graduation requirements and the applicability of the proposed post-secondary
course to the remaining graduation requirements.
A student who intends to participate in the Expanded Options Program shall develop an educational
learning plan in cooperation with an advisory support team. An advisory support team may include the
student, the student's parent and a teacher or a counselor. The educational learning plan may include:

The student's short-term and long-term learning goals and proposed activities; and
2.
The relationship of the post-secondary courses proposed under the Expanded Options Program and
the student's lea..Tjng goals.
A student who emolls in the Expanded Options Program may not emoll in post-secondary courses for
more than the equivalent of two academic years. A student who first emolls in the Expanded Options
Program in grade 12 may not emoll in post-secondary courses for more than the equivalent of one
academic year. If a student first emolls in a post-secondary course in the middle of the school year, the
time of participation shall be reduced proportionately. If a student is emolled in a year-round program and
begins each grade in the sununer session, sununer sessions are not counted against the time of
participation.
Duplicate Courses
The district will establish a process to determine duplicate course designations. The district will notify an
eligible student and the student's parent or guardian of any course the student wishes to take that the
district determines is a duplicate course, within 20 business days after the student has submitted a list of
intended courses.
A student may appeal a duplicate course determination to the Board based on evidence of the scope of the
course. The scope of the course refers to the depth and breadth of course content as evidenced through a
planned course statement, including content outlines, applicable state content standards, course goals and
student outcomes, The Board's designee will issue a decision on the appeal within 30 business days of
receipt of the appeal. If the appeal is denied by the Board, the student may appeal the district's
determination to the Superintendent of Public Instruction.
Expanded Options Program Annual Credit Hour Cap
The number of quarter credit hours that may be awarded by a high school under the Expanded Options
Program is limited to an amount equal to the number of students in grades 9 through 12 enrolled in the
high school multiplied by a factor of 0.33. For example, the cap for a high school with 450 students in
grades 9 through 12 would be 148.5 (450 X 0.33 = 148.5). (The caps must be established separately for
each high school.)

At the district's discretion, the district may choose to exceed both the individual high school level cap and
the aggregate district level cap. If the district chooses not to exceed the cap it will establish a process for
selecting eligible students for participation in the program. The process will give priority for participation
to students who are "at risk." An "at-risk student" means (I) a student who qualifies for a free or reduced
price lunch program; or (2) an at-risk student as defined by rules adopted by the State Board of Education
if it has adopted rules to define an at-risk student. An "at-risk" student includes a student who meets state
or federal thresholds for poverty as indicated by eligibility for services under any of the following
provisions of the No Child Left Behind Act: (I) Title I - Improving Academic Achievement of the
Disadvantaged, Part A - Improving Basic Programs Operated by Local Educational Agencies; (2) Title I,
Part C - Education of Migratory Children; (3) Title I, Part D - Prevention and Intervention Programs for
Children and Youth Who are Neglected, Delinquent, or At-Risk; (4) Title III - Language Instruction for
Limited English Proficient and Immigrant Students; and (5) and Title X - Repeals, Redesignations, and
Amendments to Other Statutes, Part C - Education of Homeless Children and Youth Program (amending
subtitle B of title VII of the McKinney-Vento Homeless Educational Assistance Act).
Post-Secondary Institution Credit
Prior to beginning a post-secondary course, the district shall notify the student of the number and type of
credits that the student will be granted upon successful completion of the course. If there is a dispute
between the district and student regarding the number or type of credits that the district will or has granted
to a student for a particular course, the student may appeal the district's decision using an appeals process
adopted by the Board,
Credits granted to a student shall be counted toward high school graduation requirements and subject area
requirements of the state and the district. Evidence of successful completion-of each course and credits
granted shall be included in the student's education record. A student shall provide the district with a copy
of the student's grade in each course taken for credit under the Expanded Options Program. The student's
education record shall indicate that the credits were earned at a post-secondary institution.
Financial Agreement
The district shall negotiate in good faith a financial agreement with the eligible post-secondary institution

Student Reimbursement
Students are not eligible for any state student financial aid, but students may apply to the district for
reimbursement for any textbooks, fees, equipment or materials purchased by the student that are required
for a post-secondary course loIpon satisfaetofy eompletion of the eollege eomse.. All textbooks, fees,
equipment and materials provided to a student and paid for by the district are the property of the district.
Transportation Services
The district will not provide transportation services to eligible students who attend post-secondary
institutions within the education service district boundaries of which the district is a component district.
Special Education Services
The district of a student participating in the Expanded Options Program shall be responsible for providing
any required special education and related services to the student. "Related services" may includes
transportation and such developmental, corrective and other supportive services as are required to assist a
student with a disability to benefit from special education and is consistent with Oregon administrative
rules on special education. "Special education" means specifically designed instruction consistent with
Oregon administrative rules to meet the unique needs of a student with a disability by adapting, as
appropriate, the content, methodology, or delivery of instruction to address the unique needs of the student
that result from the student's disability and to ensure access of the student to the general curriculum. If a
post-secondary institution intends to provide special education and related services to an Expanded
Options Program participant, the institution shall enter into a written contract with the district of the
student. The contract shall include the following at a minimum:

Graduation Requirements
The Board will establish graduation requirements for the awarding of a regular high school diploma which
meet or exceed state standards. The Board will also establish minimum credit requirements for the
awarding of an alternative certificate. Students in grades 9 through 12 must complete at a minimum 24
credits, three credits of mathematics, and four credits of English. The district may award a diploma to a
student who does not satisfy these requirements if the student has exceeded the academic content standards
for or displays proficiency in mathematics or English, as demonstrated on Oregon state assessments.!
Students receiving their diploma in 2012 will need to complete three credits of science, three credits in
either arts, applied arts or a second language, six credits of electives and a portfolio of essential skills.
Students who receive their diploma in 2014 must complete their math credits at the Algebra I level or
higher.
A student may satisfy graduation requirements in less than four years. The district will award a diploma to
a student fulfilling graduation requirements in less than four years upon the student's request and, if
required, if the student's parent or guardian cousents.
A modified diploma will be awarded to students who have met specific requirements established by the
State Board of Education and have demoustrated an inability to meet the full set of academic standards
even with reasonable modifications and accommodations. To be eligible for a modified diploma a student
must have a documented history of an inability to maintain grade level achievement due to significant
learning and instructional barriers or a documented history of a medical condition that creates a barrier to
achievement.
Alternative certificates will be awarded to a student who does not satisfy the requirements for a diploma or
modified diploma if the student meets minimum credit requirements established by the district.
Alternative certificates will be awarded based on individual student's needs and achievement. A student
who receives a modified diploma or alternative certificate will have the option of participating in a high
school graduation ceremony with the student's class.
'These graduation requirements apply to students who receive a high school diploma on or after July I, 2009.

The district will award to students with disabilities a document certifying successful completion of
program requirements. No document issued to students with disabilities educated in full or in part in a
special education program shall indicate that the document is issued by such a program. When a student
who has an individualized education program ("IEP") completes high school, the district will give the
student an individualized summary of performance.
Eligible students with disabilities are entitled to a Free Appropriate Public Education ("FAPE") until the
age of21, even if they have earned a modified diploma, certificate of attendance or completion or a
General Education Development document. The continuance of services for students with modified
diplomas is contingent on the IEP team determining services are needed.
Students and their parents will be notified of graduation and diploma requirements.
The district will issue a high school diploma, upon request, to a person who served in the Armed Forces2,
as specified in Oregon law, if the person was discharged or released under honorable conditions and has
received either a General Educational Development, a post-secondary degree or has received a minimum
score on the Armed Services Vocational Aptitude Battery.

The Board expects the superiotendent to establish a clear understanding of working relationships in the school
system with all staff.
Lines of direct authority will be those approved by the Board and shown on district organization charts.
Staffwill be expected to refer matters requiring administrative action to the administrator to whom they are
responsible. That administrator will refer such matters to the next higher administrative authority. when necessarv.
Additionally. all staff are expected to keep the person to whom they are immediately responsible informed of their
'activities by whatever means the person in charge deems appropriate.
Lines of authority should not restrict the cooperative working relationship of all staff members in developing the
best possible district programs and services. In addition. this policy does not restrict protected labor relations
communications of bargaining unit members. The established lines of authority represent direction of authority and
responsibility. When the staff are working together. the lines represent avenues for a two-way flow of ideas to
improve the program and operations of the school system.

Medical ExaminationslDrug Testing
The district may require medical examinations after an employment offer has been made to a job applicant
and before the applicant begins hislher employment duties. Any such requirement will ensure that all
entering employees in the same job category will complete a medical examination regardless of disability.
All offers of employment may be made contingent on medical examination results.
~v1edical examinations
will be conducted by a heaJth-care professional or health-care provider selected by
the district. District-required preemployment medical examination expenses will be paid by the district.
The successful applicant must be qualified and must be able to perform the essential functions of a position
with or without reasonable accommodations. The district may withdraw an offer of employment should
the medical examination reveal that the individual does not satisfy certain employment criteria under the
following conditions:
1.
The exclusionary criteria as job related and consistent with business necessity;
2.
There is no reasonable accommodation that will enable the individual with a disability to perform the
essential functions of the job;
3.
The medical condition poses a direct threat to the health or safety of others in the workplace and
cannot be eliminated or reduced to an acceptable level by a reasonable modification of policies,
practices, procedures or by the provision of auxiliary aids or services;
4.
The requested or necessary accommodation would impose an undue hardship on the district unless
funding is available through other sources. Individuals with a disability may be offered an
opportunity of paying for a portion of the costs that constitutes an undue hardship or of personally
providing the accommodation.
,;preemployment drug testing shall be required for all successful applicants for positions with the district.
"The district will determine the type of drug test and where the test is to be conducted. All tests will be
conducted at a Department of Health and Human Services (DHHS) certified laboratory. The district will
determine the preemployment drug testing service provider. The district will pay for preemployment drug
testing expenses. A positive test result will be confirmed by using state-of-the-art g<ls chromatography/
mass spectrometry (GCIMS) analysis. Applicants who test positive will not be hired.
Information the district receives regarding medical examinations and drug testing will be collected and
maintained on separate forms and in separate files apart from personnel files. All such records will be kept
confidential, maintained for a minimum of one year and released only in accordance with provisions of the
Americans with Disabilities Act or other applicable laws.

Education records are those records maintained by the district that are directly related to a student.
The primary reason for the keeping and maintaining of education records for students is to help the
individual student in hislher educational development by providing pertinent information for the student,
hislher teachers and hislher parents. These records also serve as an importaut source of information to
assist students in seeking productive employment and/or post-high school education.

education evaluation services.
