Dear Friends,
T
his past year was Community Legal Aid’s first full year in operation following the consolidation of Legal
Assistance Corporation of Central Massachusetts and Western Massachusetts Legal Services in July 2011. As
we continue to build and implement systems to support our reconfigured organization, we are proud to report that
CLA’s dedicated staff was able to provide desperately needed legal services to over 5,000 people in Berkshire,
Franklin, Hampden, Hampshire, and Worcester County in its inaugural year.
Faced with declining revenue from one of our main funding sources – the Interest on Lawyers’ Trust Accounts
(IOLTA) program – CLA continued to diversify its funding base and was fortunate to be able to expand the size of its
advocacy staff over the last year. With new funding from the U.S. Department of Housing and Urban Development
and the Mass. Attorney General’s HomeCorps program, CLA was able to deploy ten lawyers to a comprehensive and
expansive foreclosure defense project covering our five­county region. Because of the efforts of these lawyers, many
individuals and families with children have been able to remain in their homes and avoid the effects of foreclosure.
Another significant initiative was the start of an extensive strategic planning process. The process has two core focus
areas: community needs assessment and development planning. In assessing community need, CLA conducted
sixteen listening sessions in which key stakeholders gave us feedback about our services and about additional civil
legal needs in their communities. Results from these sessions will inform CLA’s advocacy priorities for the next several
years. With regard to development planning, a CLA board­led working group met on a number of occasions to assess
the organization’s past fundraising and communications efforts, as compared to those of other non­profit
organizations. As a result of these sessions, CLA made the decision to retain a well­respected fund development
consultant and communications strategist who will spend the next several months helping us create a realistic, yet
ambitious, fund development and communications strategy that we feel will serve the organization well going
forward.
We thank our supporters, whose valuable time and resources have been critical components of our success and our
ability to make a difference in so many lives in central and western Massachusetts. As we look forward to the coming
year, we are excited about CLA’s prospects for continuing to increase our revenue and broaden our impact throughout
the five counties we serve.

he mission of Community Legal Aid is to protect and advance the legal
rights of low­income, elderly, and other disenfranchised people in order
to secure access to basic needs and to challenge institutional barrier to social and
economic justice.
Community Legal Aid provides free, high­quality civil legal services to the
low­income and elderly residents of Berkshire, Franklin, Hampden, Hampshire,
and Worcester Counties. Through the organization’s advocacy, the five­county
region’s most disadvantaged residents obtain safe and stable housing, secure
needed medical care for their children, access unemployment compensation and
benefits to stabilize their income, and break free from domestic violence.
Community Legal Aid helps ensure that justice is secured for the most
vulnerable members of our community.

Randy thanks you.
R
andy is a lifelong truck driver. He works long, hard
shifts and is happy to do it to earn an honest day’s
pay. Randy first came to Community Legal Aid after
being denied unemployment insurance benefits. He had
worked for a trucking company, often working over 60 hours in
a week, but was only paid for up to 40 hours each week. In
violation of the wage and hour laws, Randy’s employer refused
to pay for time Randy spent on travel, required paperwork, or
required maintenance on the company truck. This meant that
Randy did not get paid for many hours he worked, and he never
got overtime pay. Randy put up with the violations because he needed
work and it was a difficult time to look for a new job in a bad
economy. Eventually, Randy couldn’t take the mistreatment any
longer and felt that he had to quit. Randy was shocked when he was
denied unemployment benefits. Randy met with Community Legal Aid Attorney Melissa Pomfred, who helped him
gather documents and prepare for his unemployment appeal hearing. Melissa represented Randy at his hearing, which
he won. Melissa also helped Randy file a wage claim with the Attorney General’s office.

Randy went back to work for another trucking company. Before long, unfortunately, he needed help from Melissa
again. The new trucking company stripped away pay and benefits until its employees were no longer being paid
minimum wage, let alone the overtime pay required by law. Again, Randy was denied unemployment benefits and had
to appeal. Melissa helped Randy gather documents and extensively prepared him for the appeal hearing. Randy won at
this hearing, but didn’t receive his benefits because of a dispute over when his appeal had been filed. Melissa
successfully got Randy a second appeal hearing which he also won. Randy’ finally started receiving unemployment
benefits which enabled him to pay his rent and other expenses.
Today, Randy works for another trucking company, which he says treats him well and pays wages properly.
When asked what would have happened to Randy, his wife, and their son if he had not received Melissa’s assistance,
Randy says, “We would have lost everything.” His wife, Julie, adds, “We would have been thrown out. We would have
been on the street.” Randy agrees. “No doubt. [Melissa] did one [heck]
of a job.”

Melinda and Evan thank you.
M
elinda* met Chris through friends, and he seemed like a
very nice guy. They moved in together and had a baby,
named Evan. Unfortunately, Chris became physically and verbally
abusive towards Melinda, and he also engaged in violent behavior
towards animals, which Melinda feared he would repeat with their
child. Melinda eventually made the difficult decision to move out
to protect her baby and herself. Melinda knew that Chris should
not be left alone with their baby, and she tried to minimize contact
between them. After Melinda filed for child support, and despite the
fact that she explained her fears for Evan’s safety, the judge told
Melinda that she was eventually going to grant Chris unsupervised
visitation with Evan.

A private attorney referred Melinda to Community Legal Aid, and CLA Senior
Supervising Attorney Tina Paradiso took her case to get her child support, custody, and a safe visitation
arrangement. At the trial, Melinda testified about her observations and fears. The judge awarded her sole legal and
physical custody of Evan, and Chris was given limited supervised visits. Additionally, Chris was ordered to pay
weekly child support.
Today, Melinda lives with Evan and her parents in an apartment. She has a job outside of the home which she enjoys
and which helps provide a better life for Evan. Melinda’s mother supervises Evan’s occasional visits with his father. Of
her experience with Community Legal Aid, Melinda says, “I can’t be more grateful…I couldn’t have asked for a better
outcome…it’s worked out great. Evan still has a relationship with his father but it’s safe…The visits, if they weren’t
supervised—I can’t even imagine. I don’t think [Evan] would be as happy and full of
life. I think it’s ultimately going to be the best for him, emotionally and
physically.”

Racheal thanks you.
W
hen Racheal came to Community Legal Aid, she appeared
to be a strong teenager, well on her way to a bright future.
She worked hard at school, was well­liked by peers and teachers, had an
after­school babysitting job, and dreamed of attending college the next
year. Underneath this surface, however, was an undocumented immigrant
child, abandoned in the United States by the aunt who had cared for
her most of her life.
Racheal was born in Ghana to teenage parents with little money, education, or
opportunity. Unable to care for Racheal themselves, her parents “gave” Racheal to a
paternal aunt. When Racheal was twelve years old, her aunt, a church leader, moved to the
United States with her. Racheal’s aunt established and led a small church for about three years,
but the church did not flourish, and the aunt decided to return to Ghana without Racheal. Racheal was sixteen, her
mother was dead, her father was seriously ill, and her aunt had abandoned her.
During the time it took Racheal to find her way to CLA, she continued to attend school and was cared for by church
members, although she had no formal guardian and no clear future. Fortunately, one of CLA’s immigration attorneys
recognized that Racheal’s circumstances appeared to qualify her for Special Immigrant Juvenile (SIJ) status, which, if
granted, would allow Racheal to apply for permanent legal resident status. Time was an issue; only children under the
age of eighteen are eligible to apply for SIJ status, and Racheal was just months shy of her eighteenth birthday. The SIJ
application process is complex and requires coordination with the court system and immigration authorities. Over a
ten­week period, CLA attorneys Ellen VanScoyoc and Laura Gal accompanied
Racheal to court four times, petitioned for appointment of a legal guardian and
for a court investigation into Racheal’s living and custodial circumstances, and
successfully got the court to issue the documentation that was needed for
Racheal's immigration case. Once the court process was complete, CLA
successfully requested that Racheal be approved for Special Immigrant
Juvenile status. The process was completed days before Racheal’s
eighteenth birthday. Today, Racheal has been accepted to two colleges
and is enjoying the chance to plan her future. When asked to reflect on
her experience with Community Legal Aid, Racheal says, “I thank you
guys. I feel like I’m going somewhere in my life and my future’s getting
brighter.”
