could be
Revere

It could be just coincidence that the
details of the unidentified Project Revere
so closely match those of the SunGard
expansion.
If so, there are some major coincidences.
The city’s development agreement for
Project Revere, which seeks incentives
through City Council Resolution 2015-780,
specifies the creation of jobs will run concurrently with the new agreement and the
prior agreement.
SunGard just happens to be adding jobs
under a prior agreement, Resolution 2013286. That agreement ends at the end of
2016. That deal went under the code name
Project Visor.
Let’s take a look at previously reported
similarities of Project Revere and SunGard.
Project Revere is called one of the world’s
largest privately held software and technology services companies. SunGard Data
Systems Inc. is privately held and calls
itself one of the world’s leading financial
software companies.
Project Revere is an expansion of a company’s operations in Jacksonville. SunGard
operates in two locations on the Downtown
Southbank and the city recently approved
a permit for SunGard to add another floor
of space at the Prudential Building on the
Southbank.
Project Revere has committed to create 250 permanent full-time equivalent
new jobs. SunGard’s additional space can
accommodate 250-275 work positions.
Project Revere will add the jobs at a
Downtown office space on the Southbank.
SunGard occupies the 11th floor at the
Prudential Building at 701 San Marco Blvd.
and is expanding onto the 10th floor.
It also has space in the duPont Center
along Prudential Drive, on the Southbank.

Mayor visits programs before deciding on funding

Just after entering the Southside classroom portable, Mayor Lenny Curry spotted a student deep into a textbook.
“What are you working on?” the mayor
asked.
Social studies, the student said. A subject, the student quickly added, he didn’t
really like.
“But it is good for you,” Curry said. “I
promise.”
In the next room, close to a dozen more
eighth- through 10th-graders were drawing, supervised by a social worker.
It wasn’t a normal classroom. These students had made poor choices and were in
the Alternative Out-of-School Suspension
program, also known as ATOSS.
There are five centers in Duval County,
with the students having to attend up to
five days, depending on their offense.
“Last time I was suspended was in the
eighth grade,” Curry told the students.
Duval County Public Schools Superintendent Nikolai Vitti used that as a launching point to tell the students they were
good kids who just made a bad decision.
They were facing a consequence, but
could learn — and were better off in the
classroom environment than sitting at
home.
Most of the students agreed.
“If I was home I’d just be bored,” one
girl said.
Another said being in school meant he
could do his classwork.
ATOSS is part of the anti-crime Jacksonville Journey initiative. This year, ATOSS
received $800,000, but it could end up with
more.
Curry spent much of Monday afternoon
touring Journey-related programs, saying
he wanted to see more than spreadsheets
and descriptions of the programs. He
wanted to see the people doing the work
and learning about their impact.
The mayor also has some decisions to
make. His budget included additional
Journey funding of about $3 million, bringing the program’s total to $5 million.
The new money has been spent down
to about $2.3 million. The spending so far
includes a library-related program slated
tonight at City Council to receive an additional $266,000.
Curry made no funding decisions Monday, saying he’d do so “very soon.” Instead,

Washington distributor plans for Westside site
A Washington-based gaming,
sports and entertainment collectibles wholesaler could open a
Jacksonville distribution center in
Westside Industrial Park, according to building plans.
GTS Distribution, which is
privately held, would open a
33,000-square-foot office and
warehouse at 8291 Forshee Drive,
according to a permit application.
Duckworth Construction Co. is
the contractor for improvements
of more than 3,000 square feet of
offices and almost 30,000 square
feet of warehouse space.

GTS is based in Lynnwood,
Wash., near Seattle, and has 10
distribution centers, according to

The nearest to Jacksonville is

in the Eastern U.S. along with
Atlanta, Boston and Allentown,
Pa. The others are in Michigan,
Arizona, California, Washington
and Hawaii.
GTS calls itself a leading
wholesale distributor of gaming,
toys, sports and entertainment
collectibles. It does not sell to the

general public. Its customers are
retail and specialty stores.
GTS Distribution was formed
in 2005 upon the merger of
Talkin’ Sports and Gamus Distribution. The building plans refer
to the tenant as Gamus LLC.
Gamus Distribution began in
1976 as Georgia Music Inc., a
family-owned business distributing trading cards, hobby supplies
and sheet music that expanded to
three Southeastern U.S. facilities.
Talkin’ Sports had five locations serving the West Coast.
GTS Distribution says it offers
products in four major categories:
trading cards, games, toys and
hobby supplies.
At the same time, GTS Distribution will gain a neighbor.
GTS Distribution will occupy
units A-C, while The Grimes
Companies, based in Jacksonville, will move into 40,000 square
feet in Units D-F at the building.

The firm moved the last week

The firm practices family and
criminal law.
Barry Zisser, who recently
turned 81, started the firm in 1963
and Elliot joined in 1971. Barry
Zisser has become of counsel.
Elliot Zisser, 68, said starting
anew past the normal retirement
age “is kind of cool.” His succession plan is for his son, Jonathan, who has a partnership interest in the firm, to carry on the
52-year tradition “of the Zisser
law office.”
“It is continuing something
that has been part of the Jacksonville legal scene a long time,”
he said.

to expand under the 2013 deal,
pledging to add 120 jobs by the
end of this year. (It added 92 new
jobs as of the end of 2014, almost
a year ago. City records don’t
reflect the 2015 additions to date.)
Back to the concurrent agreements, Project Revere refers to
the unidentified prior agreement
and the new agreement to run
concurrently, and the city will
monitor both.
With SunGard, the concurrent
year would be 2016.
As for the jobs, SunGard’s
prior agreement calls for 170 new
jobs to be created in three years
through year-end 2016 at an
average salary of about $48,340
a year.
The new agreement with Project Revere calls for 250 jobs to be
created by year-end 2020 at an
average salary of $54,719.
Meanwhile, SunGard said in
2013 it anticipated a two-phase
expansion and taking the extra
floor at the Prudential Building.
If it is Project Revere, that space
could be part of the new deal.
As for incentives, SunGard was
approved in 2013 for a city and
state Qualified Target Industry
Tax Refund of up to $1.02 million, based on the number of jobs
created. The city is responsible
for up to $204,000.
Project Revere requests city
and state incentives of $1.83 million, including $1.25 million in
QTI refunds.
The city would be responsible
for $330,000, comprising up to
$250,000 for QTI and $80,000 for a
Recapture Enhanced Value grant.
The state would pick up the
remaining $1 million in QTI and
up to $500,000 in a training grant.
There’s also the matter of
Wayne, Pa.-based SunGard’s
pending acquisition by Jacksonville-based Fidelity National
Information Services Inc. That
deal is expected to be completed
by the end of the month.
Would SunGard apply for
incentives and an expansion in
light of a merger? Project Revere
makes room for that.
Its development agreement
said that its use of the word “company” will include any parent,
holding or subsidiary company
or any other business related by
virtue of a merger, purchase or
acquisition by the company.
FIS has said it would immediately begin to integrate SunGard
into its system upon the acquisition, but didn’t have insights into
SunGard’s real estate perspective.

it was just a tour.
A little more than an hour after
visiting the teenagers, Curry was
on to visit children much, much
younger.
It was a stop at the Little Wise
Kids Early Learning Center in
Arlington, but most of the attendees weren’t available. It was naptime for many of the 73 children,
the rooms dark with soft piano or
gospel music being played in the
background.
After carefully making their
way through the sleeping children, Curry and the visiting contingent heard about the program
and its standards from Katrina
Wise, the facility’s owner.
She said she opened Little Wise
Kids in 2009 when she wasn’t
happy with the type of service
she saw being provided to her
own children.
There wasn’t enough specialized care for children of different
ages.
“I didn’t like what I saw,” she
said.
And at those early ages, children “are like sponges” absorbing information and needing special attention, Wise said.
Additional city funding, she
suggested, could be used to fill
the gaps state vouchers don’t
fully cover for parents to place
their kids in early learning facilities.
For many who have trouble
making ends meet, even as little
as $40 a month makes a big difference, she said.
Curry’s final stop of the day
was Downtown at the Main
Library. There were no children
to visit this time, just classrooms
and materials the library has
invested in to help learning and
literacy for all ages.
However, this stop was slightly
different — the Library Enhancement Access Program, also
known as LEAP, already is slated for part of that extra Journey
money. City Council is scheduled
to decide on it tonight, but the
money would be used to enhance
education opportunities in six
urban-core ZIP codes.
The program had 13 students in sixth through 10th grades Monday,
many of whom spent the afternoon with a social worker while spending time in the program and away from regular classrooms.
The program would help parents and caregivers build preliteracy skills in children up to
5 years old and increase the language and digital literacy of people ages 16-24.
With the money, the library is
hiring four additional staff members and buying mobile equip-

Court OKs 45-year term in murder case
Duval man sought second reduction in crime he committed as teen

Continuing to grapple with decades-long
sentences for juveniles who commit serious crimes, a divided state appeals court
refused Monday to order a new sentence for
a man serving 45 years in prison for crimes
he committed at age 15.
The ruling by the 1st District Court
of Appeal came five years after the U.S.
Supreme Court, in a case known as Graham
v. Florida, banned life sentences without a
“meaningful opportunity” for release for
juveniles convicted of non-homicide crimes.
That Supreme Court decision helped
touch off years of litigation and a 2014 state
law that revamped juvenile sentencing.
The inmate in Monday’s ruling, Thomas
Kelsey, was sentenced in March 2010 in
Duval County to two life sentences and 25
years in prison after being convicted on two
counts of sexual battery, armed robbery and
armed burglary with an assault or battery.
The crimes occurred in 2002, when Kelsey
was 15.
The U.S. Supreme Court decision in the
Graham case, which came after Kelsey
received the life sentences, led to him being
re-sentenced in 2014 to 45 years in prison
for each crime, with the sentences running
simultaneously.
In the appeal decided Monday, Kelsey
sought another re-sentencing based on Flor-
ida Supreme Court rulings and the 2014
juvenile-sentencing law.
A three-judge panel of the appeals court,
in a 2-1 ruling, rejected the request, though
it also asked the Florida Supreme Court to
take up the issue.
“Our precedents have not held that a
45-year sentence for a non-homicide is a de
facto life term to which Graham applies; nor
has our Supreme Court,’’ said the majority opinion by appeals court judges Scott
Makar and Thomas Winokur.

the Graham case and in a 2012 case dealing with juveniles convicted of committing
murders were based on arguments that

Scott aide: State can
afford incentives, cuts

The state has more than enough
money to cover Gov. Rick Scott’s
push for business incentives and
tax cuts while funding agency
requests, his budget chief said in
a memo Monday.
As Scott embarked on a statewide tour to push for his proposed $1 billion in mostly business-friendly tax cuts, Office of
Policy & Budget Director Cynthia
Kelly wrote that rather than the
$635.4 million surplus state economists have predicted for the next
fiscal year, “a more appropriate
‘surplus’ “ is $1.6 billion.
Kelly’s projection, first reported
by the Tampa Bay Times, is based
on the state being on track to
bring in a record $29.8 billion in
general revenue next year, including $1.3 billion in “new” revenue.
“Bottom line, there is more than
sufficient revenue to fund all of
the state’s mandatory increases,
as well as the governor’s priorities for your agencies, the Florida
Enterprise Fund and the proposed $1 billion in tax cuts,” Kelly
wrote in a memo to Scott’s agency
heads.
Kelly also noted that an increase
in revenue the past couple of
years has come as the state has
made about $900 million in tax
cuts.
The intent of Kelly’s memo was
to reduce fears by agencies leaders that they’ll have to make cuts
to accommodate Scott’s requests.

comments from

quickly exceed the surplus projected in a long-range financial

by the Legislature’s chief economist.
Economists have noted that
about two-thirds of the projected
2016-2017 budget year surplus
will come from one-time, nonrecurring money. They have also
predicted the surplus will drop to
$583.7 million the following year
and $222.2 million the year after
that, due in part to the continuing
cost of recent tax cuts supported
by Scott and Republican lawmakers.
After Scott announced his proposed tax-cut package Thursday,
Senate President Andy Gardiner
told reporters that while many
of the governor’s proposals are
already moving in bills by members of his chamber, lawmakers
will need to see the rest of Scott’s
budget proposals before making
any commitments.
“At the top of our list is going
to be the tax cuts, certainly, but
we’ve just got to figure the balance,” Gardiner said Thursday.
Gardiner has said $250 million
would be a starting point in discussions on tax cuts when law-
makers return to Tallahassee in

regular session. That session will
include crafting the 2016-17 budget, which will take effect July 1.
The bulk of Scott’s proposed
cuts, which would be amassed
over a two-year period, involve
permanently eliminating the
income tax on manufacturing and
retail businesses, a cut the governor’s office estimates at $770
million.
Scott’s proposals also would
make permanent the elimination
of a tax on manufacturing equipment, reduce a commercial lease
tax and extend a temporary elimination of sales taxes on college
textbooks.
For most Floridians, the cuts
will be seen through a pair of
sales-tax “holidays,” which total
just over $70 million. A 10-day
back-to-school “holiday” would
lift sales taxes on certain school
supplies, clothes and some electronics. A separate nine-day period would be set aside to remove
sales taxes on hurricane supplies.
House Minority Leader Mark
Pafford, D-West Palm Beach, predicted last week that fulfilling
Scott’s requests would require
spending cuts to areas such as the
environment and education.
Scott’s tax-cut tour started
Monday with stops in Melbourne,
Clearwater and Miami. Additional stops this week will be made
in West Palm Beach, Fort Myers,
Jacksonville and Panama City. He
will be in Jupiter with the state
Cabinet today.

at ‘billionaire bully’
for attack ads

Attorney General Pam Bondi
defended Florida’s environmental record and called former New
York City Mayor Michael Bloomberg a “billionaire bully” after
she became a target of a political
committee he’s funded.
Bondi and three other state
attorneys general are the focus
of political ads for participating
in a multi state lawsuit that challenges an Obama administration
rule aimed at reducing carbon
emissions from power plants.
The Bloomberg-backed Independence USA PAC on Friday
launched an ad campaign of
at least $10 million criticizing
Republicans Bondi, Bill Schuette
of Michigan and Brad Schimel of
Wisconsin and Missouri Democrat Chris Koster for joining the
West Virginia-led lawsuit opposing the White House’s Clean
Power Plan.
“Florida has a great and conscientious track record of improving
its air quality and protecting its
environment,” Bondi said in a
statement.
“Now a billionaire bully is
attacking Florida, and 26 other
states, for having the audacity of
defending their citizens against
the EPA’s heavy-handed and
unlawful regulations, which will
drastically increase Floridians’
power bills — something this billionaire clearly cares little about,”
the statement said.

The 2014 state law attempted to address
the fallout from the U.S. Supreme Court rulings by setting new sentencing guidelines.
Appeals court Judge Robert Benton, in
a dissenting opinion Monday, wrote that
Kelsey should be re-sentenced under the
2014 law. Under that law, he wrote Kelsey
is entitled to a review of his 45-year sentence after 20 years in prison. Also, Kelsey
would be entitled to another review 10
years after that if the 45-year sentence had
not changed.
Kelsey, now 28, is an inmate at Jefferson
Correctional Institution, according to the
state Department of Corrections website.

NOTICE OF INTENT
TO ISSUE PERMIT
The Department of Environmental
Protection gives notice of its intent to
issue a permit to Blanchard Terminal
Company LLC, Mr. Timothy J. Aydt,
President, 539 South Main Street,
Findlay, OH 45840, for discharging of
0.432 MGD maximum daily flow of
hydrostatic test water generated from
the testing of terminal equipment. The
hydrostatic test water is proposed to
discharge from four Outfalls (D-001,
D-002, D-003, and D-004) to the Lower
St. John’s River (WBID 2213C - Class
III marine water). The facility is located at latitude 30°24’46.08” N, longitude
81°36’28.14” W on 2101 Zoo Parkway,
Jacksonville, Florida 32226 in Duval
County.
The intent to issue and application file
are available for public inspection during normal business hours, 8:00 a.m. to
5:00 p.m., Monday through Friday, except
legal holidays, at the FDEP Northeast
District Office, 8800 Baymeadows Way
West, Suite 100, Jacksonville, Florida
32256, at phone number (904) 256-1700.
The Department will issue the permit with the attached conditions unless
a timely petition for an administrative
hearing is filed under Sections 120.569
and 120.57, Florida Statutes, within
fourteen days of receipt of notice. The
procedures for petitioning for a hearing
are set forth below.
A person whose substantial interests are affected by the Department’s
proposed permitting decision may petition for an administrative proceeding
(hearing) under Sections 120.569 and
120.57, Florida Statutes. The petition
must contain the information set forth
below and must be filed (received by the
Clerk) in the Office of General Counsel of
the Department at 3900 Commonwealth
Boulevard, Mail Station 35, Tallahassee,
Florida, 32399-3000.
Under Rule 62-110.106(4), Florida
Administrative Code, a person may
request an extension of the time for filing
a petition for an administrative hearing. The request must be filed (received
by the Clerk) in the Office of General
Counsel before the end of the time period
for filing a petition for an administrative
hearing.
Petitions filed by any persons other
than those entitled to written notice
under Section 120.60(3), Florida
Statutes, must be filed within fourteen
days of publication of the notice or within
fourteen days of receipt of the written
notice, whichever occurs first. Section
120.60(3), Florida Statutes, however, also
allows that any person who has asked
the Department for notice of agency
action may file a petition within fourteen
days of receipt of such notice, regardless
of the date of publication.
The petitioner shall mail a copy of the
petition to the applicant at the address
indicated above at the time of filing.
The failure of any person to file a petition or request for an extension of time
within fourteen days of receipt of notice
shall constitute a waiver of that person’s
right to request an administrative hearing under Sections 120.569 and 120.57,
Florida Statutes. Any subsequent intervention (in a proceeding initiated by
another party) will be only at the discretion of the presiding officer upon the filing of a motion in compliance with Rule
28-106.205, Florida Administrative Code.
A petition that disputes the material
facts on which the Department’s action
is based must contain the following information, as indicated in Rule 28-106.201,
Florida Administrative Code:
(a) The name and address of each
agency affected and each agency’s file or
identification number, if known;
(b) The name, address, and telephone
number of the petitioner; the name,
address, and telephone number of the
petitioner’s representative, if any, which
shall be the address for service purposes
during the course of the proceeding; and
an explanation of how the petitioner’s
substantial interests will be affected by
the determination;
(c) A statement of when and how
the petitioner received notice of the
Department’s decision;
(d) A statement of all disputed issues of
material fact. If there are none, the petition must so indicate;
(e) A concise statement of the ultimate
facts alleged, including the specific facts
the petitioner contends warrant reversal
or modification of the Department’s proposed action;
(f) A statement of the specific rules
or statutes the petitioner contends
require reversal or modification of the
Department’s proposed action; and
(g) A statement of the relief sought
by the petitioner, stating precisely the
action petitioner wishes the Department
to take with respect to the Department’s
proposed action.
Because the administrative hearing
process is designed to formulate final
agency action, the filing of a petition
means that the Department’s final action
may be different from the position taken
by it in this notice. Persons whose substantial interests will be affected by any
such final decision of the Department
have the right to petition to become a
party to the proceeding, in accordance
with the requirements set forth above.
In addition to requesting an administrative hearing, any petitioner may
elect to pursue mediation. The election
may be accomplished by filing with the
Department a mediation agreement
with all parties to the proceeding (i.e.,
the applicant, the Department, and
any person who has filed a timely and
sufficient petition for a hearing). The
agreement must contain all the information required by rule 28-106.404,
Florida Administrative Code. The agreement must be received by the Clerk in
the Office of General Counsel of the
Department at 3900 Commonwealth
Boulevard, Mail Station 35, Tallahassee,
Florida 32399-3000, within ten days
after the deadline for filing a petition,
as set forth above. Choosing mediation
will not adversely affect the right to a
hearing if mediation does not result in a
settlement.
As provided in Section 120.573, Florida
Statutes, the timely agreement of all parties to mediate will toll the time limitations imposed by Sections 120.569 and
120.57, Florida Statutes, for holding an
administrative hearing and issuing a
final order. Unless otherwise agreed by
the parties, the mediation must be concluded within sixty days of the execution
of the agreement. If mediation results in
settlement of the administrative dispute,
the Department must enter a final order
incorporating the agreement of the parties. Persons seeking to protect their substantial interests that would be affected
by such a modified final decision must
file their petitions within fourteen days
of receipt of this notice, or they shall
be deemed to have waived their right
to a proceeding under Sections 120.569
and 120.57, Florida Statutes. If mediation terminates without settlement of the
dispute, the Department shall notify all
parties in writing that the administrative hearing processes under Sections
120.569 and 120.57, Florida Statutes,
remain available for disposition of the
dispute, and the notice will specify the
deadlines that then will apply for challenging the agency action and electing
remedies under those two statutes.
