Legal Aid: Critical Help for Critical Moments
2013-2014
MISSION
MidPenn Legal Services is a legal emergency room for the poor. We
are a non-profit law firm providing free civil legal assistance to lowincome families in crisis.
Executive Director’s Message
It has been 10 years but it seems like only yesterday that I
was granted the privilege to serve as Executive Director. The
passion and commitment that was present when I took the
reins of this law firm remains strong despite facing the
challenges of decreased funding, shrinking staff size and
trying to serve increasing numbers of eligible clients.
We have risen to the challenge of trying to do more with
less, while maintaining a commitment to quality service. We
have had to accept the hard reality that we can’t serve
everyone who needs legal aid. We can, however, provide the
highest quality of service for those that we are able to serve. We have also learned
that we can’t do it alone. To achieve the dream of access to justice for all, we must
work with others who have a similar commitment. We are grateful for the many
volunteer attorneys that handle cases, staff clinics and provide us with financial
support. We are also grateful for the financial support that we receive from local bar
associations, United Ways, and county and local governments.
As we look forward to the next decade, all of us at MidPenn would like to thank
each of you for your support as we work to make the vision of providing the highest
quality of civil services for low-income people a reality.

President’s Message
The world is a complicated place. For those of us in the
practice of law, at times it appears that everyone has an attorney.
A poor person may stand alone before the law. They may be
a parent caring for a child, an adult caring for a parent, or a sick
person trying to get medical care. A poor person deserves as
much access to justice as any government entity, any business,
or any person of means. At MidPenn our goal is to help as many
poor people and survivors of domestic violence get the legal
representation they need.
We thank all of our funders and financial donors. We also thank our many
volunteers, including pro bono attorneys and their staff. Without this support we
could not get the job done for our clients. As we look forward, we are excited by the
opportunity to continue to represent our clients and to improve access to justice in
central Pennsylvania.

Two Days Before the Tax Sale
With Her Limited Income Grandma Thought She Had No Options
Carol Robson didn’t have a support system. She wasn’t from the area and most of
her family has passed on. Her daughter had fallen victim to drugs and was in jail. In 2007 she
was granted legal custody of her grandson, Evan, now 11, an honor student, who never
missed a day of school. He knew something was bothering his “Mom-Mom.”
They both lived on Carol’s monthly Social Security check of $728 and some food
stamps. Both parents were unable to help with financial support. Carol watched every dollar
closely and thought all her bills were current. When the letter arrived from the Tax Bureau she
was paralyzed with fear. Her son had been helping her with the property taxes but without
telling her, he had stopped. She had to pay $6000 or lose her home. “I thought about Evan.
I’m all he has. Where would we live?”
She called the Tax Claim Bureau and believed she had to come up with at least $400
per month. She froze. She finally confided her problem to a neighbor who recommended she
call MidPenn. She called only two days before the sale date.
MidPenn attorneys acted quickly and were able to work out an arrangement with the
Tax Claim Bureau which had a Senior Citizens Tax Deferral Option program. The next day
Carol dropped off a completed application and her first monthly payment of $50. “It was a
miracle and I am so grateful for the help. The MidPenn attorneys were wonderful. I never
thought a crisis like this would happen to me. It feels altogether different when it is you that is
in the situation. MidPenn’s help lowered my blood pressure.”
Bound and Determined to See His Child
MidPenn Helped Dad Be a Part of His Daughter’s Life
Antonio Phillips was resolute; he was going to be part of his daughter’s life. He and
Kaniya’s mother had parted. From the beginning it had been difficult to see his little girl. He
repeatedly requested visitation only to be denied at the last minute. Antonio had a court order
but the mom moved without leaving a forwarding address. She refused to take his phone calls.
She had a new boyfriend and she did not want Antonio around.
They both lived in Harrisburg but it would sometimes be over a year between visits.
Antonio had grown up without a father. He knew it was important to be involved. He wasn’t
trying to take his daughter away from her mom; he just wanted to be present as a parent.
MidPenn Family Law Attorney Shana Walter helped him locate her. After many false
leads a contempt of court petition was successfully served. Kaniya was now five years old but
Antonio did not even know where his little girl went to school. The mother continued to obstruct
Antonio’s efforts right up to the custody hearing.
The judge informed the mother that she was required to furnish the father with access
to his child and to keep him informed on critical matters. Antonio was at last provided a partial
custody schedule leading to alternate weekend take away visits. The Dauphin MidPenn
Custody Attorney position is supported by the Dauphin County Bar Foundation along with the
Dauphin County Commissioners; Metro Bank; Citizens Bank; McNees, Wallace & Nurick;
Rhoads & Sinon; the Wells Foundation and many other business leaders, law firms, local
foundations and attorneys.
On Not Falling Through the Cracks
Medical Legal Partnership Rescues Family At Risk
Wanda Romero always worked hard. She had come from Puerto Rico long ago
determined to make a better world for her daughter. Wanda quit her 7 AM to 3 PM shift at
McDonald’s when she absolutely couldn’t go on. She was only 48 years old but her kidney
disease made her swollen legs incredibly painfully and affected her vision as well - she was
going blind. She and her 17 year old daughter teetered on the very edge of homelessness as
they struggled to meet the rent. Wanda did not have health insurance. Beginning in January
of 2012 she ended up in the emergency room about once a month. She didn’t know what else
to do.
In 2008 MidPenn had established a Medical Legal Partnership, the first in
Pennsylvania, to assist people like Wanda who fell through the cracks. The MLP attorney had
an office at a health care site and was part of a team approach to solving problems. Current
funding levels no longer support an on-site presence but MidPenn continues to accept
referrals. MidPenn and Attorney Schultz also became part of an innovative multidisciplinary
heath care team at the Lancaster General Hospital which provides intensive services to lowincome patients with complex medical needs.
The team helped Wanda obtain Medicaid and she finally had regular health care.
When the family was evicted for non-payment of rent Attorney Schultz helped them get rooms
at a transitional housing site. Wanda’s claim for Social Security Disability was initially denied.
MidPenn advocates prepared her case to present to an Administrative Law Judge.
It took 18 months to get to a hearing but with the proper medical evidence in place
benefits were approved which dramatically changed the family’s economic picture and allowed
Wanda and her daughter to reunite. Wanda’s health challenges continue but she has regular
medical care and a roof over her head. She retained her dignity and kept her family intact.
When the Breadwinner Gets Hurt
Attorney and Intern Help Family Get Temporary Benefits
Rich Thompson was a mental health technician at a psychiatric hospital in Centre
County. His wife was going to Penn State full time and they had a thirteen year old son. In
November of 2013 Rich blocked a chair which had been hurled at a co-worker. He caught the
full impact and suffered serious nerve damage to his left arm. An orthopedic physician put him
on medical leave.
“I couldn’t dress myself,” says Rich. “I couldn’t use the bathroom without assistance.”
Months later his doctor released him to return to work but the company claimed that he had
been terminated. He could reapply, and he did, but they never responded. He applied for jobs
on a daily basis but had to file for unemployment benefits. The hospital contested his claim.
The family’s savings were gone. “We were skipping meals. We pawned our few family
keepsakes.”
Attorney Dan Palchick and Ryan Cummins, a Certified Legal Intern took the case. At
the Referee Hearing the hospital admitted to placing Rich on medical leave. He soon received
five months of benefits that were applied to back bills. “I really appreciate the help I got at
MidPenn. I have two degrees but I’m not a lawyer. Dan and Ryan knew the right questions to
ask.”
After working a number of temporary jobs, Rich recently was hired for a full time
position in his chosen field. “I’m going to work seven days a week until we are caught back up.
I don’t want to worry anymore about putting food on the table.”
It was a valuable experience for Ryan. “It is a very emotional situation for the client.
We brought a level headed approach and the knowledge that allowed him to tell his side of the
story.”
The Kindergarten Crisis
Jasmin Had Lost Custody Just as Her Little Girl was to Start School
Jasmin Cotto is a single mom who thought she was doing the right thing. Her little girl
Jaslene, 5, was about to start school. The dad had partial custody on alternate weekends.
Jaslene was registered to enter kindergarten in Lancaster in the fall.
While visiting family in New York, Jasmin learned of a promising job opportunity but
one that would require her to relocate. She notified the dad two months ahead of the proposed
move and offered to work with him so that his visits would not be affected.
The dad immediately filed for primary custody and obtained a court order to remove
Jaslene from her mother and move in with him and his new girlfriend in Ephrata. Jaslene, who
had never lived with anyone but her mother, was now also registered to attend kindergarten in
Ephrata.
Jasmin contacted MidPenn where she learned that there was a legal process to follow
when one parent seeks to relocate. She gladly gave up her plans of moving in order to regain
custody of her daughter. The Lancaster MidPenn Family Law Attorney, Katie Zimmermann,
filed an emergency petition and the original status quo was restored and Jaslene was returned
home. At a subsequent custody conference a settlement was reached and Jasmin entered
school in Lancaster as had originally been planned.
“I was so relieved,” said Jasmin. “I felt like my life had suddenly gone totally out of
control. My little girl is so glad to be back home.” Jasmin is employed as a crossing guard and
Jaslene is doing well in kindergarten. The Lancaster MidPenn Family Law Attorney position is
funded by the Safe At Home Campaign of the Lancaster Bar Association Foundation.
