Whereas, the LTO-BAC caused to be published an " Invitation to Apply for
Eligibility and to Bid" for the Procurement of 3 Units Crossover Utility V chicles,
which was advertised and posted in the "Government Electronic Procurement System
(G-EPS)" and LTO Website and, in a newspaper of nationwide general circulation on 4
and 6 December 2015 respectively in compliance with Executive Order No. 40 and
Republic Act (R.A.) 9184;
Whereas, t11e pre-bidding conference and bidding proper were scheduled on 11
and 23 December 2015 respectively;
Whereas, the pre-bidding conference held on 11 December 2015 was attended by
Toyota"Quezon Ave., Inc. (TQA) and after discussing with the prospective bidder the
terms and conditions stated in the BDS wi_th some other suggestions/clariftcations, the
pre-bidding conference was adjourned with the participant concurring with all the
conditions set forth by the BAC;
Whereas, Bid Bulletin No2. 1 and 2 were issued to specify Scctio11 VII.
Technical Specifications and adjust the time of deadline of submission of bids;
Whereas, the bidding proper held on 23 December 2015 was attended by the
prospective bidder Toyota Quezon Ave., Inc.;
, W~1ercas, the LTO-BAC had adopted the Two (2) envelope system consisting of
the 1 echmcal Component and Financial Component;

Whcre~1s, the LTO-BAC opened the aforesaid two (2) envelopes and found that
1 oyota Quezon Ave., Inc., had complied with all the requirements and announced that
the BAC TWG will prepare the post-evaluation report;

Whereas, the BAC TWG had conducted post-evaluation and found that the bid proposal
submitted by Toyota Quezon Ave. , Inc. was a single calculated, respo nsive and
complying bid, which is most advantageous to the government, copy of the post
evaluation is hereto attached for reference;
Whereas, the LTO-BAC, upon re-evaluation of the aforesaid proposal, had
decided to reconunend to the Assistant Secretary, the award for the "Procurement of
Tlu-ee (3) Units Crossover Utility Vehicles" to Toyota Quezon Ave., lnc. with a total bid
price of Three Million Four Hundred Twelve Thousand I~'ive Hundred Pesos
(Php3,412,SOO.OO);
PREMISES CONSIDERED, the LTO Bids and Awards Committee hereby
resolve to recommend that the "Procurement of Three (3) Units Crossover Utility
Vehicles" amounting to Three Million four Hundred Twelve Thousand five Ilundred
Pesos (Php3,412,500.00) be awarded to Toyota Quezon Ave., Inc., subject to the terms
and conditions set forth in the corresponding contract.

The GOODS suppl ied under this Contract shall be fully insured by the Supplier in a
freely convertible currency against loss or damage incidental to manufacture or
acquisition, transportation, storage, and delivery. The GOODS remain at the risk
and title of the Supplier until their fina l acceptance by the PROC URING ENTITY.
Transportation Where the Supplier is required under Contract to deliver the GOODS Cir. CIP or
DDP, transport of the GOODS to the port of destination or such other named place
of destination in the Philippines, as shall be specified in this Contract. shall be
arranged and paid for by the Supp li er, and the cost thereof shal l be inc luded in the
Contract Price.
Where the Supplier is required under this Contract lo transport the GOODS to a
speci!ied place of destination within the Philippines, defined as the Project Site,
transport to such place of dest ination in the Phi lipp ines, inc ludi ng insurance and
storage, as shall be specified in this Contract, shall be anangcd by the Supplier, and
related costs shall be included itt the Contract Price.
Where the Supplier is required under Contract to deliver the GOODS CIF. CIP or
DDP, GOODS are to be transpo1ted on carriers of Phi li ppine reg istry. In the event
that no caiTicr of Phil ippine registry is available, GOODS may be shipped by a
carrier which is not of Philippine registry provided that the Supplier obtains and
presents to lhe PROCURING ENTITY certification to this effect from the nearest
Phi lippine consulate to the port of dispatch . In the event that ca1Tiers of Ph ilippine
registry are avai lable bu1 their schedule delays the Supplier in its performance of
th is Contract the period from when the GOODS were first ready for shipment and
the actual date of shipment the period of delay will be considered force majeure in
accordance with GCC Clause 20.
The PROCURING ENTITY accepts no liability for the damage of GOODS during
transit other than those prescribed by INCOTERMS for DDP Deliveries. In the case
of GOODS supplied from within the Philippines or supplied by domestic Suppliers
risk and title will not be deemed to have passed to the PROCU RING ENTITY unt il
their receipt and final acceptance at the final destination.
Patent Rights The Supplier shall indemnify the PROCURING ENTLTY against all third-parly
claims of infringement of patent, trademark, or industria l des ign rights arising (i·om
