John W. Allen is a partner at the firm of Varnum Attorneys LLP in Kalamazoo, Michigan. He is a
graduate of the University of Michigan, A.B. (1969) and J.D. (1972), and has completed the University of

He has also served as the President of the Western District of Michigan, Federal Bar Association,
and serves as Chair of its Special Workgroup on Attorney-Client Privilege.
He co-chaired the State Bar of Michigan Special Task Force on Attorney-Client Task Force. He
has served on the Michigan Bar Standing Committee on Professional and Judicial Ethics (the Ethics
Committee), and Chaired the Ethics Committee in 1998-2001, and Chaired the State Bar of Michigan
Special Committee on Grievance in 2001-2007.
Rebecca Weinstein Bacon Bio (brief)
Rebecca Weinstein Bacon is a trial lawyer with a national practice. She litigates and tries high-stakes cases in state
and federal courts. Rebecca represents clients in a variety of cases including products liability, class action, mass
torts, consumer fraud, and breach of contract. Following graduation from Columbia Law School, Rebecca worked in
the New York office of O’Melveny & Myers and joined Bartlit Beck in 1999.
Rebecca excels at translating complex legal and factual information into simple and persuasive terms, both in court
and in writing – at the trial court and appellate levels. She is also adept at navigating large-scale discovery to hone in
on information critical to winning the case. She is often entrusted with preparing critical witnesses for deposition or
trial testimony.

Hon. Cynthia A. Baldwin A member of Law Review at Duquesne Law School, Fulbright Lecturer and Guest Scholar at the Brookings Institution, Justice Baldwin was a trial judge in the Allegheny County Court of Common Pleas for 16 years before being appointed to the Pennsylvania Supreme Court by Governor Rendell. A distinguished public servant, she previously served as Attorney‐in‐Charge and Deputy Attorney General, Western Regional Office of Attorney General, Bureau of Consumer Protection. Justice Baldwin was a member of the Board of Trustees of The Pennsylvania State University from 1995 until 2010 and chaired the board from 2004‐2007. She is also a director emerita of the Duquesne University Board of Directors. She is a member of and formerly chaired the board of the Association of Governing Boards of Colleges and Universities (AGB) in Washington, DC and is a member of the Board of Directors of Koppers Holdings Inc. in Pittsburgh chairing the Nominating and Governance Committee and is a member of the National Association of Corporate Directors board, Three Rivers Chapter. Justice Baldwin was a professor at Duquesne University School of Law and has lectured and taught extensively both in the United States and internationally. Among her many awards are the History Makers Award in Government from the Senator John Heinz History Center in 2010, the International Women’s Forum Women Who Make a Difference award in 2009 and the Athena Award in 2007. Kay Baxter, Partner
Kay is a founding partner of Swetman Baxter Massenburg, LLC, and practices in its
New Orleans office. A 1994 graduate of Loyola University's School of Law, she is
admitted to practice in Louisiana, Arkansas, Mississippi and Texas. While she has
successfully practiced in many areas of the law, she has always been a litigator. Kay’s
practice focuses on the defense of toxic torts, occupational disease and environmental

John F. Beach
John F. Beach is a shareholder at the Columbia, South Carolina law firm of Ellis Lawhorne &
Sims. He has been practicing law since 1982, primarily as a business litigator in court,
arbitration, and before various administrative tribunals. John represented his first clients in
arbitration around 1989 and has regularly practice in that forum ever since. John was an
arbitrator once, but hopes to never perform that function again, as he has found it is a lot easier to
convince others to render a certain decision than it is to render a decision oneself.

Justice Brent D. Benjamin was elected to a twelve-year term on
the Supreme Court of Appeals in November 2004. He is a native of
Marietta, Ohio. Justice Benjamin is a graduate of The Ohio State
University, from which he holds both a bachelor’s degree and a law
degree. After graduation from law school in 1984, he settled in
Charleston, West Virginia. Since his election, Justice Benjamin has
been a regular presenter and instructor on a variety of legal issues in
various forums, including the National Press Club, in Washington,
D.C. As part of Constitution Day activities in 2009, he moderated a
symposium on “Blogging and the First Amendment” at Marshall
University. Justice Benjamin served as Chief Justice in 2009, during
which the Court accomplished several initiatives, including
establishing an Access to Justice Commission, a Compliance Committee on Prisons and Jails,
an acclaimed statewide Domestic Violence Registry, a statewide Mental Hygiene Registry, and
a Northern Panhandle Re-Entry Court. In 2009, the Court also expanded pre-incarceration
Treatment Courts, including Drug Courts, from a handful of counties to coverage of over half the
State’s population. As Chief Justice, Justice Benjamin was active not only in Bar-related
matters, but also on children’s issues and drug issues. He led West Virginia’s delegations to the
2009 Children’s Summit and to the 2009 Drug Court Professionals Summit. He spoke at
regional meetings of the West Virginia State Bar; he participated in regional Judicial
Roundtables on Child Abuse and Neglect and in regional Summits on Domestic Violence and
Firearms; and he worked to enhance and expand court outreach, judge-media relations, and
public education about the role of the judicial branch. During his time as Chief Justice, the Court
issued an educational DVD, The Foundation of Justice: The Supreme Court of Appeals of West
Virginia. Before his election, Justice Benjamin was a principal attorney with Robinson and
McElwee, PLLC, in Charleston. His twenty-year practice at that firm involved general civil
litigation in state and federal courts, including toxic torts and complex litigation. His civil rights
practice focused on protecting children from physical and sexual abuse. He has practiced in the
United States Court of Appeals for the Fourth Circuit, the United States District Court for the
Southern District of West Virginia, the Supreme Court of Appeals of West Virginia, and before
various courts in the Commonwealth of Kentucky. Justice Benjamin is a 1999 graduate of
Leadership West Virginia. Away from his judicial duties, Justice Benjamin is also a current
member of the Hocking College Archaeological Mission and the Amenmesse Project, and has
participated in archaeological excavations in the United States and Egypt, including the recent
re-excavation of Tomb TT-320 (the “Royal Cache Tomb”) and, currently, KV10 and KV63 (the
first intact tomb to be discovered in the Valley of the Kings since the discovery of the tomb of
Pharoah Tutankhamun). Justice Benjamin attends Christ Church United Methodist, in
Charleston. He is the father of Paul, Mary, Laura, Amanda, and Evan
Randy Bibb has more than 30 years' experience defending products liability and toxic tort
claims and lawsuits across the United States. He has served as lead trial counsel
representing product manufacturers in more than 100 jury trials in courtrooms from
Florida to Washington State. Today much of his practice is devoted to defending motor
vehicle manufacturers in personal injury and wrongful death lawsuits alleging unintended
acceleration, inadvertent vehicle movement, passive and active restraint systems and
numerous other defect theories.
In addition to his trial practice, Mr. Bibb has argued a number of significant appeals
including the adoption of the learned intermediary doctrine in Tennessee, preservation of
the right to contribution after Tennessee’s adoption of comparative fault and preclusion
of third-party comparative fault in worker's compensation cases.
Mr. Bibb earned both his undergraduate and law degrees from Vanderbilt University. He
is a member of the American, Tennessee and Nashville Bar Associations, the Defense
Research Institute and the International Association of Defense Counsel where he was a
member of the faculty of the IADC Trial Academy in 2008. Mr. Bibb is a Fellow of the
Nashville Bar Foundation and of the American Bar Foundation.
Douglas S. Brooks, a partner of LibbyHoopes, P.C. in Boston, focuses his practice
primarily in the areas of white collar criminal defense and complex civil litigation. He
has successfully tried criminal and civil cases in both federal and state courts.
Doug has successfully defended clients in criminal prosecutions and government
investigations involving a variety of serious charges, including allegations of: healthcare
fraud (including False Claims Act and anti-kickback allegations concerning medical
device and pharmaceutical companies), public corruption, securities fraud,
environmental crime, and tax fraud. Doug has also defended clients facing investigation
and enforcement actions undertaken by the Securities Exchange Commission, the
Massachusetts State Ethics Commission, U.S. Customs and Border Protection, the
Department of Labor, the Federal Deposit Insurance Corporation, the Department of
Housing and Urban Development and the Massachusetts Securities Division. In
addition, Doug has defended clients involved in administrative proceedings initiated by

Doug has extensive experience handling complex civil litigation as well. He is currently
representing an airport security screening company in litigation arising out of the
September 11, 2001 terrorist attacks, one of the largest civil actions in the nation. Doug
also represents and counsels various corporate clients - including several local banks in connection with a wide variety of business disputes and compliance-related issues.
Doug's practice also includes handling appeals. He has successfully briefed and argued
both criminal and civil matters before the First Circuit Court of Appeals, the District of
Columbia Circuit Court of Appeals, the Supreme Judicial Court of Massachusetts, the
Massachusetts Appeals Court, and the Massachusetts Appellate Division.
In addition to his courtroom work, Doug has significant experience conducting
comprehensive internal corporate investigations and advising these clients as to their
rights and legal obligations stemming from the findings of the investigations.
Each year from 2004 through 2011, Doug has been named one of the top lawyers in
New England by Super Lawyers, a joint publication of Boston Magazine and Law &
Politics. The Super Lawyers comprise the top 5% of lawyers in the state.
Chase Bryan is a partner in the Jackson, Mississippi office of Forman Perry Watkins Krutz and
Tardy. He has 20 years of experience litigating cases in state and federal court. His diverse
practice includes commercial litigation, bank and lender liability litigation, intellectual property
litigation, environmental and toxic tort claims, personal injury defense and insurance and
financial products litigation. He also defends bank officers and directors in FDIC and OCC

Chase is a 1992 graduate of the University of Mississippi law school and has an undergraduate

LEE COGGIOLA Lee Coggiola is currently Disciplinary Counsel for the South Carolina Supreme Court, formerly Chief Staff Attorney for the South Carolina Court of Appeals. Before coming to the Court of Appeals she served as the Chief Public Defender of Richland County. Her Bar memberships include the South Carolina Supreme Court, United States District Court, District of South Carolina, Fourth Circuit Court of Appeals and the United States Supreme Court. She is a graduate of the University of Miami and received her JD from the University of South Carolina School of Law in 1988. Prior to attending law school she spent eleven years with IBM in systems and marketing. Since admission to the Bar she served as Law Clerk to the Honorable Carol Connor, Assistant Public Defender, Assistant Appellate Defender, and Of Counsel at Nelson Mullins Riley and Scarborough. Cohen Carlton Fields Miami, FL Jeff Cohen handles all aspects of appellate litigation. Mr. Cohen primarily represents corporate defendants in high exposure, often highly publicized cases. As a fine art & antiques valuer for the first 13 years of his career and thence as a loss adjuster for
the past 30 years, Mark works primarily for the London Market Insurers and Lloyds Underwriters,
specialising in high value/complex insurance claims, liabilities and losses involving fine arts and
antiques. He has extensive contacts with many museums, cultural organisations, specialist
dealers, restorers, conservators, shippers, private collectors, etc., in the U.K. and overseas, as
well as police organisations, including Interpol, Europol, FBI etc. He has been a regular contributor
and lecturer on theft of fine art and antiques to insurance, police and other cultural organisations.
Mark has specialist experience in the claims and recovery procedures involving theft of major
works of art. Many recoveries have been achieved by him, and notably include the Marquis of
Bath’s Titian painting valued at £8 million, two Tate Gallery Turner paintings in Germany valued at
£24 million, a collection of works in Madrid including 2 Goya’s valued in excess of £15m, the Duke
of Buccleuch’s Leonardo da Vinci “Madonna with the Yarnwinder” valued in excess of £40m….all
of which arose by his direct involvement, on behalf of London Underwriters. A connected series of
recent recoveries during 2011 arising from participation in Police covert operations include the
Firle Sevres porcelains (£1m plus), the Newby Hall Chippendale table worth £250,000, Tompion
clock worth £200,000.

Asim K. Desai is the managing partner of Carlson, Calladine & Peterson LLP’s Los Angeles office where he

Blaine Edwards is the Assistant General Counsel for Superior Energy Services, Inc. Superior is a major oilfield service company with operations in all of the major oil and gas producing states in the United States and in over 15 countries around the world. As the AGC for Superior, Blaine is responsible for global litigation, risk management analysis, and major job problems. Bill Garcia is Regional Counsel with Liberty Mutual Insurance’s Enterprise Legal
Services Organization, which is part of the Company’s corporate legal department. He
oversees and manages outside counsel in the Western Region, encompassing Alaska,
California, Colorado, Idaho, Hawaii, Montana, Nevada, New Mexico, Oregon, Texas and
Wyoming, The western region is also responsible for managing the Company’s
Canadian law firm partners in Alberta, British Columbia, Northwest Territories,
Saskatchewan and Yukon. Bill held a similar role for Safeco Insurance prior to Liberty
Mutual’s acquisition. From 2002 through 2006 he served as the Managing Attorney of
Safeco’s Seattle, Washington staff legal office.
Prior to joining Liberty Mutual, Mr. Garcia was in private practice, where his work
focused on the defense of matters through trial, arbitration and mediation of liability,
insurance and commercial claims for a variety of entities.
Bill has represented food and food product distributors; product manufacturers and
distributors; general contractors and subcontractors; heavy equipment leasing
companies; service as assigned defense counsel and insurance coverage counsel for
specialty, commercial and personal lines carriers; and service as personal counsel to
businesses with large self-insured retentions or who were self-insured.
He has performed significant work for non-profit and privately operated entities such as

churches, schools (preschool through high school), day care facilities and assisted care
living facilities in misconduct, general liability, premises liability, insurance coverage and
employment matters. Bill has also handled a full variety of lawsuits involving automobile
accidents,
trucking

and
uninsured/underinsured claims.
Mr. Garcia’s experience includes service as national counsel for an importer and
distributor of medical supplies in the MDL Latex Glove cases and service as national
counsel for a commercial excess insurer in environmental coverage matters. He served
as the primary state-wide defense and coverage counsel for two insurers and a food
service company while in practice in Washington; and state-wide coverage counsel for
an insurer while in practice in California.
Bill has served as an arbitrator in mandatory and uninsured/underinsured arbitrations
and as a court appointed settlement guardian ad litem. He is scheduled to speak twice
in 2012 on ‘Redefining the Billable Hour’ and ‘Improving the Attorney-Client Relationship
and Meeting the Client's Diversity and Other Corporate Goals through an Effective
Relationship Partner. He has spoken previously on a variety of topics including: why
inclusion and diversity matter to corporate and insurance clients; selection of counsel
and control of litigation in self-insured retention situations; preparing successful
responses to requests for proposals for legal services; ethical billing; inclusion and
diversity within corporate legal departments; corporate retention of outside counsel;
resolution of minors’ claims in wrongful death matters; handling arbitrations; and
handling abusive discovery tactics in civil litigation.
Mr. Garcia completed service on the Advisory Board of the Washington State Bar
Association’s Leadership Institute (co-chair 2009 – 2011) in December, 2011. He is a
member of the International Association of Defense Counsel (IADC) and serves as Chair
of the Insurance Executive Committee. He has completed terms on the Board of
Directors of the King County Bar Foundation, the Board of Directors of the Latino Bar
Association of Washington (LBAW) and was a member of the fundraising committee for
LBAW when the Hispanic National Bar Association (HNBA) held its national conference
in Seattle, Washington in 1997. Bill completed Lean Six Sigma Green Belt training in the
spring of 2008.
Mr. Garcia has been a member of the Washington State Bar Association since 1993. He
is also a member of California State Bar Association (inactive status). He is a 1985
graduate of the Lewis & Clark Law School in Portland, Oregon and a 1982 graduate of
Saint Mary’s College of California in Moraga, California. He is the proud father of a
seventeen year old son and a fifteen year old daughter.
Daniel Gerber co-chairs Goldberg Segalla’s Global Insurance Services Practice Group across the firm’s
11 offices in New York, Pennsylvania, New Jersey, Connecticut, and London. He maintains
an international practice in complex insurance coverage and reinsurance matters, and he has previously
acted as a mediator, arbitrator, and umpire of insurance and reinsurance disputes. In addition, he advises
insurance and reinsurance companies on the effective use of social media platforms and mitigating the
risks associated with these strategies.
Dan is the current Chair of the Insurance and Reinsurance Committee of the International Association of
Defense Counsel (IADC). He also chairs the Defense Research Institute’s (DRI) Social Media Task Force
and has drafted DRI’s social media guidelines and strategic plans. He previously chaired the DRI Counsel
Meeting Task Force and drafted its current counsel meeting guidelines. He has served on DRI’s Annual
Meeting Steering Committee and is the immediate past Chair of DRI’s Insurance Roundtable. He is
currently Vice-Chair of DRI’s Life, Health and Disability Committee. In addition, Dan is the past Chair of
the 3,500-member Torts, Insurance and Compensation Law Section of the New York State Bar
Association, and he has served in the New York State Bar House of Delegates. He is an ARIAS U.S.certified arbitrator and is designated on the Res Loquitor “Select List” of Life, Health and Disability
Insurance attorneys. He possesses an AV rating from Martindale Hubbell and has been selected for
inclusion in Super Lawyers and Business First's Who's Who in Law. He currently serves on the Advisory
Board for the LexisNexis Insurance Law Center.
Dan is a frequent author and national lecturer on topics in his areas of concentration. He has authored
chapters on reinsurance, discovery in insurance litigation, risk shifting, life insurance, and transactional
insurance. He is an author for Appleman on Insurance (Third Edition) and New Appleman's Insurance
Law Practice Guide, and he is a regular contributor to Mealey’s Emerging Insurance Disputes. He is the
co-editor of the Insurance and Reinsurance Report blog, which was ranked as a Top 50 Insurance Blog
by LexisNexis, and several publications, including Reinsurance Review; CaseWatch: Insurance; and Life,
Health, Disability, and ERISA Quarterly. Dan tweets daily on reinsurance and insurance industry issues,
and he may be found on Twitter at InsureReReport. He also is the creator, manager, and administrator of
two groups on LinkedIn: Insurance and Reinsurance Arbitration and Mediations, and Bermuda Insurance
Claims and Underwriting Forum.
He is admitted to the United States Supreme Court, as well as all federal and state courts in New York

Alessandro P. Giorgetti graduate at Milan State University in 1983 in private international law. The
same year he was admitted to the Milan Bar and six years later he studied commercial law at the
Robinson College, Cambridge (UK).
He is member of the special Bar for the Supreme Courts, where he handled some leading cases that
changed the law.
Mr Giorgetti has acquired quite an expertise in handling Italian product liability cases abroad,
especially for medical devices and mechanical machinery. Notwithstanding this specialisation he is
also active in financial institutions litigation, D&O and professional liabilities with a special
emphasis on medical malpractice.
He also practises in the field of reinsurance litigation, acting as principal consultant or litigator in
some of the major cases involving Italian cedants.
He works in English and French and is an active member of the IBA as well as of IADC of this later
organisation he has been the International Vice-President.
He is also a member of the Defence Research Institute as well as of DRI Europe, of which he is the
chair of the Italian Chapter and belongs to the Association of Fellows and Legal Scholars of the
Center for International Studies of Salzburg (A).
Alessandro P Giorgetti authored several articles in legal journals as well as book chapters on Italian
Law.
In 1997 he translated into Italian and updated the book “Personal Injury Awards in EU and EFTA
Countries“ published as “Il risarcimento dei danni alla persona nei paesi dell’Unione Europea e
dell’EFTA” (IFA-Pubbliass, 1997) and in April 2008 he published the monography "Il contenzioso

Colleen Mullen Goff is Senior Vice President, General Counsel and Corporate Secretary of
Zachry Holdings, Inc. She is responsible for the coordination of legal services, including all
claims and litigation, and management of the Zachry Legal Department, which includes Legal
Affairs, Corporate Compliance, Alternative Dispute Resolution and Corporate Records. She
attended the Universidad Iberoamericana, Mexico City, the University of New Mexico, and
received her Bachelor’s (with high honors) and Master’s degrees in Latin American Studies from
the University of Texas at Austin, where she was inducted into Phi Beta Kappa. Her law degree
is from St. Mary’s University, where she was elected to Phi Delta Phi.
She has practiced with Zachry since 1984 in the areas of construction contract formation and
claims litigation, including work in the petrochemical, refinery and power industries, and in
employment law and benefits.
She is a member of the State Bar of Texas (served on Construction Law Council Board 3 years),

Forum (2011 President Austin/San Antonio Chapter), the Association of Corporate Counsel, the

David Gold received his BA from UCLA, and his JD from Loyola Law School, Los
Angeles. He was admitted to the California bar in 1983, and spent ten years litigating
environmental and asbestos coverage matters before going in house at CIGNA
Corporation as Chief Counsel. When ACE purchased the Property and Casualty
business from CIGNA, he went to ACE and continued to be the chief legal officer for
ACE’s environmental and asbestos run-off books of business. In 2004, Berkshire
Hathaway took over the claim handling responsibility for ACE’s run-off books of
business, including a majority of the asbestos, environmental and other long term
exposure claims pursuant to a finite reinsurance cover issued by National Indemnity
Company to ACE. David was hired by Berkshire’s reinsurance division, as President of
Resolute Management, Mid-Atlantic.
David remains with Berkshire Hathaway, and presently is responsible for the day to day
running of the ACE book including the Westchester line of coverage, and several other
run off books of business that are subject to various reinsurance covers issued by
Berkshire Hathaway.
SARA J. GOURLEY, a litigation partner in the Chicago office of Sidley Austin LLP, is
widely-recognized for defending life sciences companies in multi-district product liability
litigation. Ms. Gourley is currently serving as defense counsel in some of the most
important litigation facing the life sciences industry, including coordinating the defense
of on-going claims aimed at a widely-distributed diabetes medicine. She is a frequent

Represented plaintiff Sensormatic Electronics Corporation, a subsidiary of
Tyco International, in patent infringement, trade secret misappropriation and
breach of contract suit. Sensormatic sued defendants for infringing two of its
patents and misappropriating trade secrets. Following a three-week bench
trial, the Court entered judgment in favor of Sensormatic on all counts and
enjoined defendants from continuing to infringe Sensormatic’s
patents. Affirmed on appeal in the Federal Circuit.

Lead Paint Litigation (2005-present)
Represented defendant NL Industries in trial and appellate proceedings in
Rhode Island. The AG sued to declare past sale of lead paint a “public
nuisance” throughout State of Rhode Island, seeking compensatory and
punitive damages as well as abatement. In a landmark decision, the Supreme
Court of Rhode Island in June 2008 ordered dismissal of the AG’s lawsuit after
nine years of litigation, resulting in a complete defense victory. Currently
representing NL in products liability actions in Illinois and Wisconsin state
courts.

Briefed appeal for federal criminal appellant in successful appeal of denial of
motion to suppress before the D.C. Circuit. Panel vacated and remanded to

Peter J. Hersha has served as Vice President of the Nationwide Trial Division since June
1999. Peter’s responsibilities include leadership of approximately 700 Nationwide Trial
Division personnel in 65 law offices located in 30 states. The Trial Division defends
insureds of the various Nationwide property & casualty insurance companies when they
are sued as a result of occurrences that are covered by their liability insurance policies.
The Trial Division currently has about 23,000 pending litigated cases and over the
course of a year Trial Division attorneys, paralegals, and support staff will handle about
46,000 cases.
Peter earned his bachelor’s degree in communications/journalism at St. John Fisher
College in Rochester, New York, in 1978. He graduated from the Syracuse University
College of Law in 1981.
Peter worked in his father’s law office for a short time before joining Nationwide in 1982
in Syracuse. He became chief trial counsel in the office’s New York City unit in 1984.
Peter moved to Columbus, Ohio in 1987 to become chief claims counsel in the Office of
Claims where he worked on the creation of the Nationwide Trial Division. He joined the
Trial Division as a director in 1989. He has helped the organization evolve to become a
preferred provider of legal services to Nationwide and its customers.
Peter currently servies on the board of directors of the National Foundation for Judicial
Excellence (Chicago, Illinois) and CATCO, the Contemporary American Theatre
Company (Columbus, Ohio). He previously served on and chaired the Board of the
Homeless Families Foundation (Columbus, Ohio).
Peter and his wife, Robin, and son, Matthew, reside in Columbus, Ohio.
Bruce Kahn is a commercial attorney whose practice focuses on the construction and real estate
industries. He presently handles complex surety claims for Chartis, Inc. as a Complex Claims
Director and in-house counsel. Prior to joining Chartis, Inc, Bruce practiced at Peckar &
Abramson, Kaye Scholer, and Kalkines Arky Zall & Bernstein in New York City, primarily as a
litigator.
He is a magna cum laude graduate of Albany Law School, where he was managing editor of the
Albany Law Review. He also holds a master of business administration degree from Cornell
University’s S. C. Johnson School of Business.
Paul W. Kalish is co-chair of Crowell & Moring LLP’s Insurance and Reinsurance practice. He
represents both insurer and reinsurer clients in a variety of matters, including: (1) serving as
national counsel for insurers with regard to various tort (implants, asbestos, pharmaceuticals),
environmental and other types of coverage-related matters; (2) representing insurers and
reinsurers in liquidation matters, such as the Midland Insurance Company and Home Insurance
Company liquidation proceedings; and (3) representing insurers sued for unfair claims handling
practices and negligent undertaking in connection with the handling of thousands of underlying
claims.
In addition to his insurance and reinsurance practice, Paul also represents defendants in
underlying litigation, with regard to asbestos, silica and other mass tort claims. In that regard, he
was a member of the Steering Committee of the federal asbestos multi-district litigation ("MDL
875") in the U.S. District Court for the Eastern District of Pennsylvania. And since 2000 he has
served as counsel for the Coalition for Litigation Justice, a group formed by insurers to address

David W. Kash is a partner in the firm of Ryan Rapp & Underwood, PLC. He received his BS
with honors in Commerce (Accounting) from DePaul University in 1977 and his JD from
Chicago-Kent College of Law with honors in 1981. He is admitted to practice in both Arizona

Dr. Sebastian Lach is Partner in Hogan Lovells' Munich office. He is a member of the Litigation

Eric G. Lasker is a partner in the Washington, D.C. law firm, Hollingsworth, LLP,
where he specializes in toxic torts, environmental, pharmaceutical products liability, and
alien tort statute (ATS) litigation. Mr. Lasker’s recent practice has included the defense
of a multi-billion dollar natural resource damages claim arising from groundwater
contamination, the defense of environmental damages, property damages, and personal
injury claims brought by several thousand farmers in South America from alleged

it's got both intimacy and reach all at once. For the cost of a phone call, I can take you around the world.
But I'm right there with you in your car, in your living room or kitchen or office, in your iPod. Radio itself is

Tell Me More, Martin also served as contributor and substitute host for NPR newsmagazines and talk

subjects as the Congressional budget battles, the U.S. embassy bombings in Africa, racial profiling and

William R. (“Billy”) Martin
Billy Martin is a renowned trial lawyer consistently named as one

Gary McConnell is Vice President and Associate General Counsel of Bayer
Corporation. He joined Bayer in 1997 in the litigation group where he has
held positions of increasing responsibility. For the past ten years he has had
responsibility for the management of much of the litigation against the
company.
He has had a major role in the management of mass tort
litigation brought against Bayer, including the Baycol, PPA, GM rice,
YAZ/Yasmin and blood products mass tort cases.
Prior to joining Bayer, Gary was engaged in the private practice of law in St.
Louis, Missouri. He concentrated his practice in defense of product liability,
medical malpractice, and admiralty cases. He has tried cases in state and

John Meeks Biography
John R. Meeks is the Vice President of the Institute for Court Management at the
National Center for State Courts. He was the Director of the Supreme Court of Ohio
Judicial College from 1996–2006 and a Senior Attorney at the Supreme Court of Florida
Office of the State Court Administrator from 1989–1996. A member of the Florida Bar,
he practiced law in Pensacola, Florida, from 1985–1989. Meeks is a past president of the
National Association of State Judicial Educators (August 2006–August 2007). He has
also served that organization as president-elect, vice president, Midwest regional director,
chair of the education and bylaws committees, and a member of several committees,

Jack graduated Kean University with a BA in political science, minor in public
administration and certification to teach social studies in the secondary level. After
working with handi-capped children he and his wife signed up with the Peace Corps.
They served for two and a half years before returning home with their first born.
Shortly after, Jack started what is now a 30 year career as an insurance adjuster. His
experience has been in primary, excess and reinsurance. The primary focus has been
product liability. He currently works for York Risk Services Group managing the
firearms liability program.
Paul L. Nettleton – Bio
Paul Nettleton is a trial and appellate practitioner. Paul has been board certified by The Florida
Bar as a specialist in appellate practice for more than 15 years. He has handled hundreds of appeals in
the Florida appellate courts, federal appellate courts and the United States Supreme Court. He has
presented oral arguments in the Florida Supreme Court and all five Florida District Courts of Appeal, as
well as in multiple federal circuit courts. He has also handled numerous administrative appeals arising
out of environmental permitting and rulemaking proceedings in both state and federal administrative
agencies. Paul has served multiple terms as a member of The Florida Bar’s Appellate Certification

Overholt is a judicial administration leader who has served California’s justice system for more than three decades⎯as the Interim Administrative Director of the Courts, Chief Deputy Director of the Administrative Office of the Courts, and chief executive officer of two of California’s largest trial courts. Mr. Overholt is a past member of the Judicial Council of California, the policymaking body for the state’s court system, by appointment of the Chief Justice. Lucian T. Pera is a partner with the Memphis, Tennessee, office of Adams and

Martin Stern serves as the Appellate Team Leader for Adams and Reese, overseeing its
fast-growing appellate practice and also focusing on class action, products liability and
constitutional litigation. Martin has argued numerous appeals, ranging from the appeal of
a $1 billion punitive damage award for a major oil and gas company to working on the
team that won Kennedy v. Louisiana, where the United States Supreme Court handed down
its landmark decision holding that the death penalty is unconstitutional for non-homicide
crimes.

Jack Straw is one of the most experienced British and
European politicians. During his long career including
continuous Cabinet-level roles from 1997 – 2010 he has
taken a leading part in many momentous political decisions
in both national and international politics. He has a
reputation for clear thinking and professional, pragmatic

After a prominent radical role in national student politics in the 1960s, he qualified as
a barrister and first entered Parliament as a Labour MP representing Blackburn in
1979. He had a number of Shadow Cabinet roles before becoming Home Secretary

and Leader of the House of Commons and Lord Privy Seal in 2006. He served as Lord
High Chancellor and Secretary of State for Justice from 2007 until 2010.

Blackburn has a sizeable Muslim community). His deft personal style combines with

After three decades in Parliament and successive Cabinet positions, Jack Straw is one
of the most experienced and insightful British and international political figures.
Jack Straw read law at Leeds University and in the 1960s became a national student
leader known for radical positions, to the point of being described by the Foreign
Office as a "troublemaker acting with malice aforethought" for his political activity
involving Chile. After qualifying as a barrister he had various media roles and
entered Parliament in 1979 as the MP for Blackburn. He was Shadow spokesman on
Education, then Environment and Shadow Home Secretary before being appointed
Home Secretary after the Labour Party won the 1997 general election. His time as
Home Secretary had its fair share of controversies (including new measures to
increase police powers to deal with suspected terrorists) but also saw the European

Convention in Human Rights incorporated into British law.
Appointed Foreign Secretary in 2001, he soon played a leading role in the dramatic
and difficult foreign policy problems arising from the 9/11 terrorist attacks in New
York and then the interventions in Afghanistan and then Iraq. He publicly defended
these decisions, although later in January 2010 he told the Iraq Inquiry in London
that the 2003 decision to go to war “had haunted him”. In 2006 he was appointed
Leader of the House of Commons and Lord Privy Seal with responsibility for
parliamentary reform. He returned to the Opposition benches after Labour lost the
2010 general elections
Jack Straw has attracted publicity for some of his policy positions concerning Muslim
issues, not least his call in 2006 for Muslim women not to wear the full veil: “I felt
uncomfortable about talking to someone 'face-to-face' whom I could not see”. His
close relations with his very diverse Blackburn constituency (including his position as
honorary vice president of Blackburn Rovers football club) mean that he has given a
lot of thought to sensitive community relations issues in a modern democracy. In
2009 on the BBC’s Question Time TV programme he was a member of the panel
which included British National Party leader Nick Griffin.
Although often criticized for his firm approach to a number of civil liberties questions
concerning suspected terrorists and then his high-profile role in supporting the Iraq
intervention, Jack Straw remains a popular figure in the UK and Europe, not least for
his wry sense of humour: as Home Secretary he joked that his large department was
“full of civil servants working diligently on projects that might ruin my career”.
His disarmingly understated, professional style as well as his formidable intellect and
practical experience in so many policy areas give him a unique profile, not only in the
UK and European Union but also at the international level. Few active politicians
today match his insight and breadth of senior policy knowledge. He has many
striking personal anecdotes and thoughtful examples of what works in politics – and

Catherine Templeton is the Director of the S.C. Department of Health and
Environmental Control, after serving a short tenure as the Director of S.C.
Department of Labor, Licensing and Regulation. She was appointed by Governor
Nikki Haley. Templeton came to LLR and DHEC from the Ogletree Deakins law
firm where she practiced primarily in the areas of labor and employment, with
emphasis on litigation.
Prior to law school, Templeton served as a Human Resources Manager at Milliken
& Company. While at the University of South Carolina, Templeton served on the Honor Council and as the
Associate Editor of the American Bar Association Real Property, Probate & Trust Journal. Before joining

Chief Justice Jean Hoefer Toal began her service as an Associate Justice on the Supreme Court of South
Carolina on March 17, 1988. She was the first woman to serve as a Justice of the South Carolina
Supreme Court. She was installed as Chief Justice on March 23, 2000.
Chief Justice Toal received her B.A. degree in philosophy in 1965 from Agnes Scott College and her
J.D. degree in 1968 from the University of South Carolina School of Law. Chief Justice Toal practiced
law for 20 years prior to her election to the South Carolina Supreme Court. She also utilized her law
degree in public service. Beginning in 1975 she served in the South Carolina House of Representatives
for 13 years, where she became the first woman in South Carolina to chair a standing committee of the
House of Representatives.
Chief Justice Toal serves on the Board of Trustees of the American Inns of Court Foundation, is Past
President of the Conference of Chief Justices, and is Past Chair of the Board of Directors of the National
Center for State Courts. She and two of her law clerks also are authors of the book Appellate Practice in
South Carolina.
In addition to her work on the bench, Chief Justice Toal has become chief advocate for South Carolina's
Judicial Automation Project, which is integrating technology initiatives into the eight levels of the South
Carolina court system.
In 2004, Chief Justice Toal received the prestigious Margaret Brent Women Lawyers of Achievement
Award from the American Bar Association's Commission on Women in the Profession. In 2011, Chief
Justice Toal was named the first recipient of the National Center for State Courts' (NCSC) Sandra Day

Michael B. Victorson is a member of Jackson Kelly PLLC, resident in the firm’s office in
Charleston, West Virginia. He is the Leader of the firm’s Pharmaceutical, Toxic Tort and
Product Liability Practice Group, representing clients in matters pending in both state
and federal courts. Mr. Victorson has served for many years as the defense liaison
counsel in state-wide asbestos personal injury matters in West Virginia, where there is
an active and ongoing docket. Additionally, he has been national liaison counsel for a
major pharmaceutical company in personal injury litigation, consolidated for handling by
the Judicial Panel on Multidistrict Litigation (MDL).
Mr. Victorson handles litigation involving toxic torts and chemical exposures, including
class actions. He has represented clients in matters involving alleged exposures to
silica, benzene, diesel fumes, PCB’s and various other chemicals, as well as
pharmaceutical and medical device litigation. He has served on the Board of Defense
Trial Counsel of West Virginia, been chair of that group’s Product Liability Committee
and is a frequent speaker and presenter.

Peter D. Webster is a shareholder in the Tallahassee, Florida, office of Carlton
Fields, engaging principally in appellate practice. He was a judge on the Florida First
District Court of Appeal from 1991 to 2011; a state circuit judge in Jacksonville and
Green Cove Springs, Florida, from 1986 to 1991; a lawyer with the Jacksonville firm
of Bedell, Bedell, Dittmar, Smith & Zehmer and successors, specializing in trials and
appeals in state and federal courts, from 1975 to 1985; and a law clerk to The
Honorable Gerald B. Tjoflat, then a United States District Judge for the Middle
District of Florida, from 1974 to 1975. His undergraduate degree is in international
affairs, magna cum laude, from Georgetown University in Washington, D.C. He
received his J.D., with distinction, from Duke University in Durham, North Carolina,
and an LL.M., in the judicial process, from the University of Virginia. He was for
nine years an adjunct professor at Florida Coastal School of Law in Jacksonville. He
is president of the American Judicature Society; a trustee of the American Inns of
Court Foundation; a member of the National Center for State Courts Lawyers’
Committee; and has served as a member of the Florida Judicial Council and chair of
several Florida Supreme Court and Florida Bar committees. He is currently a member
of the Florida Supreme Court Commission on Professionalism.

Robert M. Wilcox has served as Dean of the University of South Carolina School of Law
since July 1, 2011. He had previously served as Associate Dean for Academic Affairs from
2006-2011.
He earned his undergraduate degree from Duke University and his law degree from
University of South Carolina in 1981. He practiced at Dow, Lohnes & Albertson in D.C. and
Atlanta before joining the USC Law School faculty in 1986. Currently, his primary area of
teaching and research is in the field of professional responsibility. He is a former editor of the
ABA Real Property, Probate & Trust Journal. From 2003-08, he served as Director of the
Nelson Mullins Riley & Scarborough Center on Professionalism, a USC School of Law-based
clearinghouse of information and research pertaining to improvement of the character,
competence and conduct of legal professionals. He is the author South Carolina Rules of
Professional Conduct (with Nathan Crystal) and has written numerous articles pertaining to legal
ethics and professional responsibility.
Dean Wilcox serves on the South Carolina Chief Justice's Commission on the Profession
and the South Carolina Commission on Judicial Conduct. He helped create guidelines for the
South Carolina Lawyer Mentoring Program. He is a frequent presenter at continuing legal
education seminars.
U.S. DISTRICT JUDGE JAY C. ZAINEY
HONORABLE JAY C. ZAINEY was appointed by President George W. Bush to the United
States District Court for the Eastern District of Louisiana on February 19, 2002. He is the
past President of the Louisiana State Bar Association. As State Bar Association President,
he created the Community Action Committee and the Committee to Provide Legal Services
for the Disabled. These two committees are purportedly the first of their kind in the nation.
Jay is a 1969 graduate of Jesuit High School, and currently serves on the Board of Visitors
of the Ave Maria Law School in Naples, Florida.
Jay is co-founder of SOLACE, a Louisiana State Bar Association program, which provides for
services to members of the bar association and the entire legal community who experience family
tragedies, and who otherwise have special needs. There are currently approximately 7500 volunteer
attorneys throughout the state who participate in the SOLACE Program. SOLACE Programs have
now been developed in Rhode Island, Delaware, Georgia, Puerto Rico, Louisville and St. Louis and
plans are underway to start programs in other locations.
In May 2004, Jay organized the Homeless Experience Legal Protection (H.E.L.P.) Program. In this
program, over 450 attorneys provide legal consultation services and notary services at four homeless
centers in New Orleans. He has initiated similar programs in Baton Rouge, Lafayette, Opelousas,
Lake Charles and Shreveport, Louisiana; Atlanta and Savannah, Georgia; Norfolk and Virginia
Beach, Virginia; Hartford, Connecticut; Bloomington, Indiana; Columbia, South Carolina;
Nashville and Memphis, Tennessee; Lubbock, Texas; Jackson, MS; New York City, New York;
Chicago, Illinois; Los Angeles, California; Pittsburgh, Pennsylvania; Mobile, Alabama; and, Detroit,
Michigan. Plans are underway to start H.E.L.P. Programs in numerous other major cities. The
Program has been instrumental in assisting many members of the homeless community
escape the bonds of homelessness, rebuild their lives, and restore their dignity. H.E.L.P.
volunteers are also assisting members of the homeless community obtain their birth
certificates, identification cards and social security benefits. The program operates legal
clinics at homeless shelters, using volunteer attorneys to bring legal consultation and
services directly to homeless individuals. Homeless individuals generally lack access to
legal services and to the courts because homelessness engenders a fear of the system and
makes it highly unlikely that they will voluntarily visit a courthouse or seek out an
attorney. HELP clinics address this problem by making legal services available to the
homeless, on a regular and reliable basis, in the surroundings in which the clients are
comfortable. Recently, Jay has assisted in creating a Homeless Court in New Orleans
Jay has also worked with the Louisiana State Bar Association Committee to Provide Legal
Services for the Disabled in providing pro bono legal services to people with disabilities
and their families, and has assisted Tulane Law School develop its Disability Law Society,
one of the first of its kind in the country.
In October, 2004 Jay and his wife Joy founded the God’s Special Children Program. The
program includes a monthly mass for people with special needs, their families and friends.
The group is also addressing preparation and receipt of the sacraments , bible study,
parents’ retreats and a buddy program in which members of CYO’s, Catholic Youth
Ministries and Catholic High School students interact with children with special needs.
Jay and Joy co-founded St. Andrew’s Village, a faith-based long term living community for
adults with disabilities. St. Andrew’s Village recently purchased a 100 acre tract of land
in Abita Springs, and will provide a loving environment for many of God’s special angels.
Jay proudly serves as President of the Board of St. Andrew’s Village.
Besides serving as president of the Louisiana State Bar Association, Jay is also past
president of the Jefferson Bar Association, Past-Chairman of the Pro Bono Project, Bar
Association, is Past-President of the Judge John C. Boutall American Inn of Court and he
is currently a member of the Executive Board of the New Orleans Chapter of the Federal.
He also currently serves on the American Bar Association’s Hurricane Katrina Task Force,
and has written a chapter in “Lawyer’s Working to End Homelessness,” a book published
by the American Bar Association’s Commission on Homelessness and Poverty. In 2011,
Chief Justice John Roberts appointed Judge Zainey to serve on the Federal Judiciary
Commission Codes of Conduct Committee.
Jessalyn H. Zeigler is a Member/Shareholder of Bass, Berry & Sims PLC in Nashville, Tennessee. Jessie is the Co‐Chair of her firm’s Food & Beverage Industry Group and Assistant Practice Group leader for her firm’s Products, Torts & Insurance practice group. Her products liability practice includes pharmaceutical, medical device, food, supplements, automotive, and commercial products defense. Mr. Zulkey serves as General Counsel Emeritus and Senior Counsel of Baker & McKenzie
International. He has been at Baker & McKenzie for his entire career. After having been a
litigator in the firm’s Chicago office since 1973 and a Partner since 1980, he became the firm’s
first General Counsel in 1994. He has concentrated his practice in the areas of Insurance, Risk
Management, Professional Liability, Partnership Law, Employment Disputes and Law Firm
Governance and also serves as an arbitrator and mediator. Mr. Zulkey is listed in Euromoney
Legal Group’s current publication of Guide to the World’s Leading Insurance & Reinsurance
Lawyers, International Bar Association’s Who’sWhoLegal, Naifeh and Smith’s The Best Lawyers
in America in the practice areas of commerical litigation, insurance law and legal malpractice
law – defendants for the last 16 consecutive years, and is a Member of Outstanding Lawyers of

edition. He also serves as an adjunct professor of law at Northwestern University School of Law in

approved arbitrator. He received his JD degree, with honors, from the University of Illinois in

the Law Forum, and has been honored as a Distinguished Graduate. He received his BA degree
from Northwestern University in 1970.
