E
.J. Rossi first moved to the area in 1993 to attend Cuesta College. He received his AA at Cuesta, his BA from
California State University Fresno, and his Masters
from Cal Poly SLO. During his time at Cuesta he met his
lovely wife Tracy and has been committed to the community
of Atascadero ever since. During his time in Atascadero, E.J.
has been connected to the local businesses. He and his wife
were local business owners of the Dance Center of Atascadero
from 2002 – 2006 and he stays involved in his wife’s family
business: Michael’s Optical. E.J. is dedicated to serving the
community through multiple service organizations and has
served as a board member for the Chamber of Commerce,
the Atascadero Performing Arts Center Committee, and
Atascadero Kiwanis.

I
have deep roots in Atascadero. I have lived here for thirty-four years and cannot imagine living anywhere else. I
attended Cal Poly, Cuesta College and Allan Hancock
College, and earned a degree in accounting. My proudest accomplishment is being a Father and a Granddad.
I am an Enrolled Agent, licensed by the Internal Revenue
Service, and a Registered Representative with Cetera
Financial Services. I have more than twenty five years of Tax
& Financial experience. Each year, my continuing education
involves at least thirty hours of federal and state tax law and
at least sixteen hours of securities law. My office provides a
wide range of tax and financial services, including financial
statements, payroll, sales tax, retirement plans, mutual funds,
planning, preparation, and consultation for individuals, sole
proprietors, corporations, partnerships, LLC’s and nonprofits.
I believe in giving back to the community that has given
me so much over the years. I am a member and Honorable
Distinguished Past President of the Atascadero Kiwanis
Club, a charter member of the Atascadero Elks, co-chair of
the Atascadero Boosters Bones BBQ Team, and a Booster of
graphic design solutions to enhance your image

Additional names of candidates for director can be
nominated by petition bearing the genuine signature of at
least twenty five (25) qualified members of the Chamber.
Such petitions shall be filed with the nominating committee
within fifteen (15) days of the date of this notice.
The determination of the nominating committee as to the
eligibility by the petition(s) shall be final.
If legal petitions for additional candidates are presented,
the names of all candidates shall be arranged alphabetically
on a ballot and be mailed to all members. The candidates
with the greatest number of votes will be declared elected. If
you have questions relative to the selection and election of
Directors, please call Chamber President/CEO Linda Hendy,

E.J.’s biggest impact on the community of Atascadero
is in his work as the Principal of Atascadero High School.
Starting in 2007, he began as the Assistant Principal in charge
of Curriculum and Instruction and then in 2008 became the
Principal. He brought a great deal of educational experience
to the school even at his young age, having worked at every
level within the educational system. While going to school,
E.J. worked in preschools, ran after school programs at
elementary schools through the YMCA, and worked at a
high school in the athletics & activities departments. Upon
completing his education, he taught elementary and middle
school math, and was a superintendent/principal, before
coming to AHS. With his wide range of experience and
connection within the community, E.J. has been able to build
upon the tradition of “Greytness” within Atascadero High
School and help develop students into adults who will excel
in both college and careers.
When he is not working or serving on a community service
project, E.J. enjoys spending time with his wife Tracy and
their two kids, Tobi (11) and Corbin (8). Together they
enjoy camping, playing
sports, and serving others.

I am also a Templeton
High School Booster and
a sponsor of local Little
League and Babe Ruth
baseball teams. I have served on the Board of the San Luis
Obispo County Red Cross and the Atascadero Chamber of
Commerce also as an Ambassador of Good Will and Cheer.
I have also been a Board Member & President of the North
County Women’s Shelter. I am currently a Trustee of the
Atascadero Unified School District.
I have been honored as the Atascadero Businessman of
the Year and also the National Republican Congressional
Committee’s Businessman of the year. The California
Teachers Association presented me with their prestigious
Gold Award as an outstanding public servant.
I continue to provide excellence in service and
professionalism that has been the hallmark of my Financial
& Tax Practice for over 27 years.
Although my son Darrick graduated from Atascadero High
School more than fifteen years ago, I remain a passionate
supporter of Greyhound football and do my best to never
miss a game. Go Hounds!
My favorite meal is steak, crab, artichoke, baked potato,
and salad with blue cheese dressing.
My favorite activities, other than watching Greyhound
football, are being with my son & grandchildren, hanging
out in my yard and garden, riding my Harley and cruising in
my classic 1965 Malibu or 1966 GTO.

Centennial Celebration is HERE!

he week-long celebration
of Atascadero’s Colony
Days and Centennial will
be held the week of October
13th to 20th.
A number of events have been held all year long,
beginning with the chamber’s awards and installation
banquet last January and the return just last month of
the marble statue and a stand-alone clock in the Sunken
Gardens.
You’ll begin to notice posters around town about the
Centennial celebration, but for your convenience here is
a short list of all that is happening in the third week of
October:
•Saturday, Oct. 12: Classical Concert featuring
100 year old, recently restored, Steinway Grand Piano
Doors open at 7:00 with concert beginning at 7:30 at
the Community Church.
•Sunday, Oct. 13: Atascadero Quota Club will host
its annual Colony Days Tea in Fellowship Hall at
the Community Church, which is one of the oldest
congregations in the city. From 2 to 4 p.m. residents
who have lived here 40 years and are at least 55 years
old are invited to attend this gathering of pioneers.
Colony Days king and queen, and parade marshal, will
be crowed at this event.
•Thursday, Oct. 17: The official Colony Days Mixer
will be held from 5:30 to 7:30 p.m. at Rabobank.
•Friday, Oct. 18: Local elementary school children
will tour Tent City and learn first-hand about the early
history of their community from on-site actors/docents.
•Saturday, Oct. 19: It is Parade Day that begins at
7 a.m. with the Lions Club Pancake Breakfast in the
Sunken Gardens, the parade at 10 a.m., a vintage
car show at West Mall and El Camino Real starting
at 11 a.m. as well as the Community Photo at noon
on the steps of the Rotunda Building and finally the
Band Field Show and Drumline competition up at
the high school stadium at 2 p.m. Throughout the day
Docent led tours will be held at the Historic Rotunda
Building. There will be concessions in the Sunken
Gardens throughout the day and Tent City will be open
to visitors as well. AND there will be a “Giant Zucchini
Contest” in the Sunken Gardens, too. The Centennial
Gala will conclude the day’s events at the Carlton.

•Sunday, Oct. 20: A Vintage Poker Run will be held
from 10 a.m. to 2:30 p.m. Cars (1979 or older) will begin
at Staples, stop at Wild Horse Winery and Vineyards,
work their way to town with stops at Chalk Mountain
Golf Course and Galaxy Theater and finally finish up
at Atascadero Lake. Also on Sunday Atascadero Elks
will serve their famous barbecue just like they do on
Tuesday nights in the park starting at noon. Call the
Chamber to get your ticket. Take a chair to the lake to
enjoy the food, music and vintage cars coming in from
the poker run. Atascadero Community Band will be
playing in the Centennial Bandstand starting at 11 a.m.
with a dedication ceremony set for noon at which time
Atascadero Kiwanis Club will turn over the bandstand
to the City of Atascadero in a ribbon-cutting ceremony.
•Saturday Oct. 26: Symphony for Colony’s 100th
Birthday at the Pavilion on the Lake beginning at
7:00 pm. Admission is $30 and tickets may be
purchased online at www.SymphonyOfTheVines.com,
at the Atascadero Chamber of Commerce, at Matt’s
Guitars in Templeton, at Boo-Boo Records in San Luis
Obispo or at the door.

A
Beautiful Verdin Clock has been placed in the
Sunken Gardens in honor of Joanne Main. The
Lakeside Wine Festival Committee purchased
the clock in remembrance of Main as well as to recognize
Atascadero’s Centennial. Joanne’s passing in 2011 was a
shock to our community. She was a loving wife, mother,
and grandmother. She was not only a member of the
Wine Festival Committee, but was the President /CEO
of the Atascadero Chamber of Commerce; past President
and active member of Rotary Club of Atascadero; and
served on numerous City Committees.

Another major point hit home in the talk was the absolute

acknowledgement in front of their team?
Finally, the event convened with the sharing ideas by the
audience, including strategies that had worked to promote
welfare and good relationships with their employers,
employees, and co-workers. In the end, smiles bound, and
everyone was able to take away at least one pearl to apply
immediately in their life, work, and community.

ecent stories about the Affordable Care Act
have focused on October 1, 2013 as a day
Californians will be able to compare and shop
online for health plans. Employers should know that
October 1,2013 also is a deadline for notifying employees about their options under the health law. Regardless of size and whether health benefits are already
provided to employees or not, all California employers will need to provide written notice to all current
employees describing the existence of, and options
available, under Covered California as well as the employee’s potential eligibility for tax credits.
The Federal Department of Labor has created
two notification forms: one for employers who
do not (www. http://www.dol.gov/ebsa/pdf/
FLSAwithoutplans.pdf ) offer coverage and one for
employers who do (www. http://www.dol.gov/ebsa/
pdf/FLSAwithplans.pdf ). Employers must provide
this notice to existing employees by October 1, 2013
or within 14 – days of a new hires start date. While
there are no immediate penalties for non-compliance,
there is a chance employers could face civil penalties if
they fail to issue the notice.

Centennial year, created an abundance of decorating
ideas, giving the event a spirit of fun and excitement.
In addition, guests were treated to some of the area’s

of what they have to offer. The Board of Directors
would like to thank the Ambassadors for all their help
and a special thank you to Atascadero High School
Leadership and Community Giving Back volunteers.

Labor Law Corner
The law allows an employer under certain circumstances to
go to court and seek a Temporary Restraining Order (TRO)
against any person whether an employee or some other
person. An employer who has an employee who has suffered
an unlawful violent attack or who has received a credible
threat of violence where the violent act occurred in the work
place or the credible threat might reasonably be expected to
take place in the work place. The TRO can be sought for the
benefit of the employee or other employees at the employer’s
place of business. In addition, under certain circumstances,
the law allows the chief administrative officer (or his or her
designee) of a college to apply for a TRO to protect a student
or other students However, officer or designee must have the
permission of the student. These laws can be found in the
California Code of Civil Procedure Sections 527.8 (a) and
527.85. Finally, the Workers Compensation Board may allow
a claim by an employee or his or her family for injury or death
occurring at work if the person causing the harm or death
acted out of a desire to injury the employee because he or
she was in certain protected categories, such as, for example,
his or her race, religion, gender or gender orientation. The
authority to make this ruling is found in the California Labor
Code at Section 3600(c).
As a consequence, a California employer needs to make
sure its Employee Handbook is up to date with all of the
applicable rules and protections. In addition, the employer
needs to make sure that these rules are enforced and, in this
day and age, that a threat of violence against an employee
is taken seriously and that adequate measures are taken to
protect the safety of its employees.
Finally, an employer’s worker’s compensation insurance
could be triggered by an injury or death that occurs at work

employee or otherwise not connected to the workplace. The

R
ecently, there was an article in the news about a teacher who had taught at a particular private school in San
Diego, California for 16 years whose contract with the
school was not renewed due to concern by the school over
what the teacher’s husband might do to her at the school, and
also what he might do to other teachers, administrators and,
of course, students. Apparently, he had a history of being an
abusive spouse and had, in fact, been the subject of Temporary Restraining Orders issued to protect the teacher from
further violence and abuse. The article appeared under the
catchy description of a victim being punished for the wrongs
of her abusive husband. But, what were the choices that the
employer was facing?
We all remember as well the hair salon in Seal Beach,
California where a number of workers there were killed by
the husband of a hairdresser who entered the shop and shot
the hairdresser and several of her co-workers. The United
States Supreme Court has also interpreted the Second
Amendment of the U.S. Constitution as including a right to
own a gun. There are states -- California is not one --- where
the Legislatures there have enacted laws that say that an
employee may bring a weapon on to an employer’s property.
Usually, the employee must keep the weapon in the trunk of
his or her car, but the employer cannot, in those states, forbid
an employee from bringing the weapon on to the employer’s
premises, i.e., the parking lot..
The law that is discussed below is California law; and,
unless an employer has employees located in certain other
states, the information that follows should control how
things are handled in this state. Thus, for example, there is
no law in California forbidding an employer from adopting
a policy preventing an employee from bringing a firearm
on its premises even if the premise in question is a parking
lot. A properly worded provision in a personnel Handbook
can forbid an employee from bringing a firearm onto
the employer’s premises, and this is true even though the
employee might have a Second Amendment Right to possess
a gun.

and Learn About The
Charles Paddock Zoo
W
e have a wonderful little gem in our own backyard
called the Charles Paddock Zoo, but many residents and visitors don’t know about all the activities that take place behind the scenes every day at the Zoo.
The primary mission of every staff member at the Charles
Paddock Zoo is conservation and helping to propagate
certain endangered animals. The Charles Paddock Zoo is very
proud to be an integral participant of the Species Survival
Program (SSP). The zoo may be small but it is recognized for
doing great work in helping to save certain species of small
and endangered animals.
After conservation, zoo staff focuses on education in order to
produce young ambassadors interested in future conservation
and education. And beyond all that, they work hard every day
to provide an enjoyable environment for visitors.
One of the most exciting events recently at the zoo was the
birth of twin Red Panda cubs. In the United States, there are
currently only about a dozen Red Panda babies, and two of
them are at our zoo! The cubs were born in June, but due to

O
n August 27, the Board of Supervisors unanimously
passed an Urgency Ordinance pertaining to the Paso
Robles Groundwater Basin. This is an issue that has
caused many in the North County to engage and let their
voice be heard. I personally attended several local meetings
and spent many hours researching data and visiting with constituents to hear their concerns. I agree that we need to focus
on the health of the basin by creating a future water supply
that is not solely dependent on the pumping of groundwater.
The County has seen an increase in demand of groundwater
resources over the past several decades involving both rural
residence and agricultural interests.
From a property rights stand point, this was a very difficult
vote for me. First of all, I am not certain that the decision
should have been made using an urgency ordinance. An
urgency ordinance allows the Board of Supervisors to bypass
the public process that is required to pass an ordinance. This
can be a dangerous precedent used to make decisions in haste
when making land use decisions. Secondly, my request that
staff provide us with the economic impact that this ordinance
would have on the North County was never answered due to
time constraints.
With the goal of protecting the health of the water basin
and providing a reliable supply for residents of the basin, I

County came out to show

unfortunate risk of mortality in young cubs, our staff kept
the announcement under wraps until they felt more assured
of the little cubs’ health and survival. Baby Red Pandas aren’t
able to regulate their body temperatures adequately, and
overheating is a major concern. The cubs were born in a
nesting box located inside a specially air-cooled holding area.
Now that the cubs are starting to move around on their own
we are expecting them to venture outside any day now to
make their public debut.
Our little zoo is also an important player in the turtle
conservation world. The small scale of the zoo and the
wonderful climate here are perfect for raising several species
of turtles. Of the top 50 rarest turtle species, we have
approximately a half-dozen at the zoo, including some which
just a few years ago were believed to be extinct in the wild.
Unfortunately for visitors, many species of turtle are shy and
tend to hide from view. We now have several young turtles
that were born in captivity and so are accustomed to being
around people; we expect to have them available to the public
in our new “Turtles in Trouble” display to be completed by
the end of the year.
The Charles Paddock Zoo is always in need of volunteers!
Someone with a clerical background can help with press
releases, paperwork and filing. Those with carpentry,
construction and painting experience are always needed for
projects. We need people who can tell stories and help teach
our young visitors about the zoo and conservation. And, you
wouldn’t believe how many dishes need to be washed every
day at the zoo! The Charles Paddock Zoo is your zoo too,

North County. In the end, the passage of the ordinance
was a compromise between me and some of my colleagues
that wanted to see a more restrictive ordinance. It’s time
now to move forward with solutions that will accomplish
the goals mentioned above. I look forward to working with
agriculturalists, residents, and staff to provide solutions
and implementation. The Final Urgency Ordinance is
now available to view on the County website http://www.
slocounty.ca.gov/site4.aspx.
Some changes to the staff’s report were:
• Exclude San Miguel and Shandon CSDs
• Eliminate the Ag Pond Restriction
• New irrigated crop production planted as of August 27 are
not subject to ordinance
• If you can provide County evidence of a “vested right” your
project is exempt
• Change the offset ratio from 2:1 to 1:1, requiring an Offset
Clearance
• Remove the requirement to destroy the existing well when
a replacement well is permitted
• All new wells must be metered and monitored monthly by
the landowner
This interim ordinance is effective for 45 days of its passage
with the possibility of extensions up to 2 years during which
time the Supervisors are required to consider a permanent
comprehensive ordinance and/or general plan amendment
per California Code.
