Introduction to Metropolitan Region Scheme major amendments
The Western Australian Planning Commission (WAPC) is responsible for keeping the
Metropolitan Region Scheme (MRS) under review and initiating changes where they are
seen as necessary.
The MRS sets out the broad pattern of land use for the whole Perth metropolitan region. The
MRS is constantly under review to best reflect regional planning and development needs.
A proposal to change land use reservations and zones in the MRS is regulated by the
Planning and Development Act 2005. That legislation provides for public submissions to be
made on proposed amendments.
For a substantial amendment, often referred to as a major amendment (made under section
41 of the Act), the WAPC considers all the submissions lodged, and publishes its
recommendations in a report on submissions. This report is presented to the Minister for
Planning and to the Governor for approval. Both Houses of Parliament must then scrutinise
the amendment before it can take legal effect.
In the process of making a substantial amendment to the MRS, information is published as a
public record under the following titles:
Amendment report
This document is available from the start of the public advertising period of the proposed
amendment. It sets out the purpose and scope of the proposal, explains why the
amendment is considered necessary, and informs people how they can comment through
the submission process.
Environmental review report
The Environmental Protection Authority must consider the environmental impact of an
amendment to the MRS before it can be advertised. Should it require formal assessment, an
environmental review is undertaken and made available for information and comment at the
same time as the amendment report.
Report on submissions
The planning rationale, determination of submissions and the recommendations of the
WAPC for final approval of the amendment, with or without modification, is documented in
this report.
Submissions
This document contains a reproduction of all written submissions received by the WAPC on
the proposed amendment.
Transcript of hearings
A person who has made a written submission may also choose to appear before a hearings
committee to express their views. The hearings proceedings are recorded and transcribed,
and the transcripts of all hearings are reproduced in this volume.

Hi Stirling Highway Planners,
I support the rationalisation in Amendment 1210/41.1 think it s wonderful that the Department of
Planning has published lon term plans for the im rovement of this important link. I have observed with
interest, the upgrading of Great Eastern Highway between Koorong Road and Tonkin Highway, and
recognise the importance of good planning across Perth.
With respect to Stirling Highway, I live in Maylands, work in Fremantle, and don't want to see the
Department pandering to the needs of minority groups.
I would like to provide formal support of the amendment. Is it necessary to provide a handwritten
submission, or do emails of support suffice ?

The Western Australian Planning Commission (WAPC) has recently initiated the above
amendment to the Metropolitan Region Scheme and is seeking public comment.
The amendment proposes an overall reduction of the existing Stirling Highway 'Primary Regional
Roads' reservation to limit the reservation to land which realistically may be needed for future
road works. The proposed road reservation includes adequate space for future improvements to
better cater for pedestrians, cyclists and public transport as well as address traffic congestion
and improve road safety, as detailed in the enclosed amendment report.
The purpose of the amendment is to rationalise the existing Stirling Highway reservation and
ensure sufficient land is protected for long term regional and local traffic needs. Presently, the
reservation is too wide in some locations, whilst not wide enough in others. Modifying the existing
reservation will assist budget and priority setting for future highway improvements.
Notices will be published in the Government Gazette, The West Australian, The Sunday Times
and relevant local newspapers. The amending plans and other documents will be on display at
various locations in the metropolitan area. Documents can also be accessed on the PlanningWA
website www.planning.wa.gov.au. The various ways to access more information about this
amendment are summarised on the separate page titled: Howto access further information on Stirling

A highly significant number of small business operate from the highway strip,

North of Jarrad Street, Cottesloe, many properties are presently affected by the existing 80
metre wide 'Primary Regional Roads' reserve, placed in 1963 and larger than necessary.
The amendment proposes to r duce the regional reservation over the above property.
A sketch plan showing the existing reservation boundary (green) and the proposed reduced
reservation boundary (red) is attached for your consideration.
The enclosed Amendment Report includes specific details and reasons for the amendment,
as well as information on the Metropolitan Region Scheme and amendments.
The amendment only proposes changes for land in close proximity to Stirling Highway
(generally less than 40 metres) between Hampden Road/Broadway, Nedlands and Queen
Victoria Street, North Fremantle (see Figure 1 in the attached Amendment Report).

Fremantle Ports interest is in the southe end of the Stirling Highway Access
Corridor which connects with the strategic road freight routes servicing the Fremantle

Metropolitan Region Scheme Amendment 1210/41 does not consider the potential for
extension of Curtin Avenue via a new traffic bridge over the passenger railway line to
join Stirling Highway near Queen Victoria Street. The only reference to the proposed
extension of Curtin Avenue is a note on a drawing that in the future it will be subject
to separate consultation by the Department of Transport.
The planning of the Stirling Highway corridor needs to be considered in the context of
the strategic planning for this wider regional road network and should integrate with
transport planning for strategic road freight routes in this area. Consideration should
also be given to relevant land use planning proposals in the area such as the recently
finalised MRS Amendment for the Beehive Montessori School site in Mosman Park.

Thank you for your letter dated 20 March 2012 seeking our comment on the proposed
rationalisation of Stirling Highway Reservation, We understand the rationalisation is seeking
to overall reduce the reservation to land which realistically may be needed for future road
works. The proposed road reservation will include adequate space for future improvements
to better cater for pedestrians, cyclists, public transport, traffic congestion and improve road
safety,
I have reviewed the information you provided and advise, based on that information, there
are two Aboriginal heritage places currently mapped on our Aboriginal Heritage Information
System (AHIS) that fall within the proposed amendment area boundary. These include DIA
3336 (Victoria Street Station) and DIA 21253 (Mosman Park).
Please find below a link to our Due Diligence Guidelines for assistance that help in
identifying the risk that proposed activities may have on adversely impacting Aboriginal
heritage alues.

As Strata Manager for St Quentins Apart ents, Lot 200, we have received a copy of your letter
of the 20th March outlining the MRS Rationalisation of Stirling Highway.
The MRS amendment 1210/41 Rationalisation of Stirling Highway Reservation has been
reviewed by the Council of Owners of St Quentins Apartments. The following issues have been
identified to reject the proposed increase in reservation area.:
1. The increased reservation boundary (red) would require St Quentins Apartments to be
demolished;
2. The St Quentins building was only recently built and met all local planning authority
requirements, including density and appearance; and
3. The concept of establishing an extra lane on Stirling Rd will not alleviate traffic
congestion on Stirling Hwy.
The Strata Company, through the Council of Owners, agrees with the proposal to increase the
flow of traffic along Stirling Hwy but contests the proposal to increase the reservation
boundary (red) along Stirling Road.

I do not support the proposed rationalization because it will render my double garage
unusable. Besides my property, there are six other adjoining villas, each with a
double garage, that will be similarly affected, making a total of 14 parking spaces that
will be lost.
There is no other space on the strata property that can replace these 14 spaces.
Owners will be forced to park on Forrest St or some other street, leading to greater
congestion on these streets.
There will be great damage to the value of these properties, far beyond the value of
the land resumed. Each villa will be changed from having "double-garage" parking to
street parking.
My estimate is that the value of each property will be diminished b at least a third if
the proposal is adopted, compared to if it is not.
B1 Other expenses will also rise.
Living expenses will also rise. For example, the cost of car insurance will rise as a
result of the cars being street parked instead of garaged.
Cl Less safety for residents, many of whom are seniors.
I am a senior, being over 60 years of age. Many other residents in the other six
affected villas appear more senior than me. Requiring residents to park in Forrest St,
which is quite dimly-lit, will result in less safety, especially at night.
D1 Considerable inconvenience.
There will be considerable everyday inconvenience. For example, residents
returning with groceries or other goods will have to carry them for up to 50 metres
between the street parking and the front door.
Currently, arbage bins are taken out through the rear. This will not be possible if the
rationalization scheme is implemented. They will have to be taken out through the
living room and the front door.
The strata development I am in was conceived with the idea that each villa would
have free access to the rear, which is why there is only a narrow walkway at their
front. It would be very difficult to move large goods, like white goods or furniture,
through the pathway at the front.

E) Inconsistent practices in the past
I am informed that the state government authority has had a road reserve of greater
than 30 metres since 1963. Yet, the strata property development I now live in was
approved and built in 1974. The Shire of Peppermint Grove informs me that at that
time, the plans would probably have been referred to the state authority and
approved by them, although they can find no record of this.
May I submit that I, as a property owner, should not be so severely punished as
would happen under the proposed scheme gi en that the 1974 plans were approved
by competent authorities.

May I also submit that for properties that are severely affected, such as mine would
be, the state consider resuming the entire property so I can buy somewhere else.

(WPM) held on 22 and 23 August 2012 and obtained their instructions and submission.
We understand that the purpose of the Metropolitan Region Scheme Amendment
(MRS) 1210/41 is to rationalise the Primary Regional Roads reservation in the MRS
which presently exists over Stirling Highway, as shown on Figure 1 of the Amendment
Report.
Subject to the Aboriginal Heritage Act 1972 (WA) (AHA) and the MOU the SWALSC
has with the WAPC, we are instructed by our clients to request that monitors are
present for commencement of works.
Where the proximity of the realignment is to a registered site the necessity for s 18
clearances may be required.

AN APPEAL AGAINST THE PROPOSED AMENDMENT.
My husband and I own a property at 261A Queen Victoria Street comprising of a
small town house and a Commercial Kitchen both of which are rented out. The
value of these will be drastically reduced by the proposals currently under
review. In fact to all intents and purposes they will be rendered worthless.
The reason is a very simple one, parking.
When the various properties on the 261A block were built a condition of the
planning permission was that they would have their own parking. This was an
essential requirement because there is no on street parking available adjoining
the block. The only street in which parking is allowed (Jackson Street) is
inadequate even for current requirements and is full at all times.
The current proposal ignores the council's own ruling by completely removing
the very parking on which they sensibly insisted in the first place. No one would
ever buy or rent a house where there was zero parking and so the buildings
would very likely become derelict.
We would therfore be forced to pursue the council for the entire March 2012
value of our property plus appreciation. As no doubt would everybody else
affected.
On a separate issue the proposal also actually takes a chunk out of our Kitchen
Building which would almost certainly mean the whole thing would have to be
demolished anyway.
Beyond the very practical financial threat we are now under, there is the equally
distressing social and cultural one. North Fremantle has long been blighted by
being cut off by major roads but it has recently begun to really get back on it's
feet. Queen Victoria Street is it s heart and we now have thriving shops, pubs and
cafes for the first time in decades. We feel this proposal could very well wipe out
completely all that has been achieved. Demolishing at least one business and
ruining others.
Heritage buildings and walls would also have to be demolished. This would be a
crime as so much of Perth and Fremantle s history and culture has already been
lost. Our own property is bounded on one side by a heritage listed wall,
protected under council guidelines which would have to be destroyed.

And for what? The traffic is not heavy on Queen Victoria Street we drive it every
day and are never held up by buses. The extra bus lane suggested is entirely
unnecessary.
With respect this is a ridiculous idea to which we as residents object in the
strongest possible terms and which we will vigorously resist.
In the mean time we are cursed with the phenomenon of planning blight' in as
much as nobody can sell their property while the procedure progresses. This is
not only ruinous to some residents who depend on their properties for their
Superannuation but puts an immediate brake on all that has been happening to
make North Fremantle an attractive town once more.
Queen Victoria Street and Jackson Street are not the Stirling Highway. Whatever
may be the merits of speeding traffic on the main arteries servicing Perth (and
they are questionable) they should not be allowed to threaten our thriving local
community. We appeal to the W.A.P.C to cancel it s proposals immediately and
remove this distressing threat which has darkened the lives of all those affected.

1. PROPERTY
261A Queen Victoria St North Fremantle being Lot 100 comprising Strata
Lots 1,2,3,4,5,6 and Common Property Lots 7,8,9 on Strata Plan 9334.
Affected directly by increase in land required by MRS for road purposes are
Strata Lots 1, CP lot 7 and parking for Strata Lots 1.2.3.4.
2. BACKGROUND
Land was purchased from C of E in 1976 including church (built 1895) and
church hall (built 1905) for purpose of converting buildings to residences
with additional development of four residential townhouses (built 1979)
Granny flat (built 1990) was added to our church house and a commercial
catering kitchen (built 2001) was added to Strata Lot 1.
Increase in constructed plot ratio to .64 equivalent to R code density R60 (up
from gazetted R25) was granted by Fremantle City Council as reward for
preserving heritage building
This would conform to MRS stated aim of density increase adjacent to
highway.
The intention of development was to provide family and extensions with
financial security. All work was designed and hands-on-built by Bob Gare
as architect with family help.
Over time, four generations of Gare family were accommodated together with
family industry of artist studio and exhibitions, architects office, music band
management and practice, Catering Kitchen and weddings for family and
friends.
3. OBJECTIONS
The proposal as shown on attached drawing 1 virtually demolishes our
daughter s catering kitchen SL1 and removes all on site parking,
(required by local authority) thus severely affecting viability and value of
those units. The parking situation is further exacerbated by the fact that
most houses in Jackson St have only street parking.
Adjacent Lot 1, 261 to 267 Queen Victoria St comprising five connected
heritage listed double storey shops would have to be demolished by the
proposal. See attached drawing 2.
Both properties front Queen Victoria St (not Stirling Highway) so the
proposal is a very considerable affront to the integrity and gateway to the old
town of North Fremantle. The town has in the last few years been
rejuvenated after being depressed for years by Stirling Highway to Stirling
Bridge cutting off the large part of its residential population. It would be a
shame if any of this recent enlivenment were to be eroded in any way. It
should also be noted that the bus lane would remove the stairs serving
church access since 1895 and Jackson St. turning circle would demolish a
section of convict built and original church limestone walls.
4. SUGGESTIONS
At City of Fremantle Library, public information display, we gathered from
John O'Hurley of WAPC that the offending impositions on our and
neighbour s property were due to a proposed short bus lane up to the
Jackson St traffic light/cross walk in Queen Victoria St and a cul-d-sac
turning circle associated with the closure of the Jackson St connection to
Queen Victoria St/Stirling Hwy.
Because of its effect on the heritage shops Lot 1 and our Lot 100 , local
indigenous bush frontage and the fact that a bus stop is provided close by in
Queen Victoria St, it seems this short bus lane, here, could be deleted.
Jackson St, down to its closure from Jewell Pde ser es only four properties,
so the requirement of a full cul.de.sac turning circle seems to be an over kill'
Given that rubbish collection by truck could be jointly arranged at the Jewell
Pde Tee Junction. Smaller vehicles could be provided with a hammer head
solution at the dead end even using the town house crossover as many do
now.
5. PERSONAL
My wife and I are now self funded retirees in our 70's without
Superannuation and with rents from SL2 & 4 being insufficient to sustain us
in our old age, so it is our intention to sell these units, now, to make good.
Unfortunately (and this must apply to others in the same situation), with the
MRS proposal over our heads, the prospect of a satisfactory sale is severely
diminished.

Thank you for your letter dated the 20th of March 2012,
We The Owners Rocco A. & Maria Nardone (for Conpec P/L], would like to
request a mutually agreed site visit for discussion to be made in relation to the
proposed WAPC 2.5metre widening and 8 metre truncation to the above
mentioned property.
Please note there is a two storey building at this site with two tenancies, the top
floor is occupied by Mobile Connections which has direct access from the rear of
the car park.
The ground floor is occupied by a health beauty clinic (Skyn) which has direct
access from the front corner (were the proposed 8 meter truncation is to be
done). This firm employs approx. 6 employees and operates 6 days a week, with
a high volume of clients getting access from the only access point at the front.
The objection we present is on the ground of duty of care to disabled people
access and the safety hazard associated with the proposed works to disabled
people were access to the premises, including disabled car bays, is only available
from the front access way (Facing Stirling Hwy).
On these grounds I would like to ask you to organize a site visit by one of your
authorized representative with my self Rocco A. Nardone.

Dear Secretary,
This letter is written to express our strongest possible objection to
the Proposed Metropolitan Region Scheme (MRS) Amendment
which will severely affect our property at 2/136 Stirling Highway,
North F emantle.
When this scheme is eventually enacted, it will necessitate the
demolition of our building.
This proposal will now hang ominously over any prospect we may
have of keeping our existing tenant, attracting a new tenant or
selling the property.
Our original intention in buying the property in 1987, that of using
the rental proceeds to fund our retirement has now been thrown
into disarray as has the long term strategy of holding the property
indefinitely.
This location is one of the few opportunities to hold an office
warehouse in a Highway position between Perth and Fremantle
which is precisely the reason for our original purchase.
This advantage is now in danger of being denied us.
Our long term tenant of more than 20 years must now ponder the
future prospects of his business as he is near retirement age. The
tenant s only real option will be to move the business to alternative
premises in order to sell out, sacrificing the prime Highway position
which has always been the main consideration in locating here.
We believe that this Amendment will effectively destroy any real
value which our property may have in the future, leaving only one
potential purchaser - The Government of Western Australia, who
may or may not show any interest in purchasing the property in our
lifetimes.
This leaves our future in a rather precarious position to say the
least!
While we fully understand the need for future traffic planning, we
are not of the opinion that the entry of McCabe Street onto Stirling
Highway warrants the amount of injurious affection which will be
visited upon us if this proposal is enacted and once again register
our firm objection to the proposal.

Subsequent to my original submission to Council regarding the
proposed road widening at McCabe Street and Stirling Flighway
and the reservation of a large part of our building, I am submitting
this extra objection to the plan on the following grounds.
1. The fact sheet supplied regarding modifications to the
Scheme Amendment is totally at odds with the information
contained in Metropolitan Region Scheme Amendment
1210/41 in regard to compensation to be paid to landholders
whose property is required for road purposes.
You will notice that I have highlighted sections of the
document where it states land indicated for widening is to be
ceded free of cost to the Crown
Also enclose are two a photocopied pages from the WAPC
document outlining procedure for compulsory acquisition and
compensation.
2. Please explain in detail how you and WAPC expect to treat
landowners in this Scheme when the scheme is implemented
in regards to fair and reasonable payment for land and
existing buildings.
3. Is this inconsistency in the documents an accident or
oversight or is it a government conspiracy to acquire land
free of cost.
4. In the event of the property being confiscated by
Government agencies, are you prepared to defend these
actions in the High Court? WE ARE!!

SVSodifications to proposed Scheme Amendment Wo, 12 to the City's
Local Planning Scheme No. 4
On the 16 of April 2012, the City received correspondence from the Minister for Planning
advising that Scheme amendment No. 12 (the rezoning of the Matilda Bay Brewery area
from Industrial to Development Zone), as adopted by Council on the 26 May 2010, will not
be approved until such time as the amendment can be modified. The Minister goes onto
direct the Council to modify the scheme amendment and advertise the scheme amendment
with the modifications. The first part of the amendment (Part i, the rezoning of the site) is
the same as the originally proposed amendment. The modifications to the amendment are
in Part ii and include modifying the existing provisions in Schedule 11 for DA 18 of the Local
planning Scheme No. 4 s text, to include:
• provisions that require the ceding and leveling of land in the proposed road widening
area on Stirling Highway and McCabe Street as a condition of any future
development approval; and
o the requirement for an internal link road through the area connecting McCabe Street
to Coventry Parade/McCabe Place as part of any structure plan for the area.
BACKGROUND TO SCHEME AMENDMENT O. 12
On 30 October 2009 the Western Australian Planning Commission s (WAPC) Metropolitan
Region Scheme (MRS) Amendment 1168/57 Matilda Bay Brewery Precinct was gazetted.
This amendment rezoned the Matilda Bay Brewery site No's 130 (Lot 220), 136 (Lot 100) and
138 (Lot 8) Stirling Highway, North Fremantle, from the Industrial' zone to the 'Urban' zone
under the provisions of the MRS. The City of Fremantle's Local Planning Scheme No. 4 was
not concurrently rezoned with this amendment therefore making it inconsistent with the
MRS.
The purpose of Scheme amendment No. 12 was to render LPS4 consistent with the MRS.
Scheme amendment No. 12 proposed rezoning land in the Matilda Bay Brewery area (No.
130 (Lot 5, 12, 218, 219, 220, 221, 314 & 253), No. 136 (Lot 100) and No. 138 (Lot 8) Stirling
Highway and No. 2-4 (Lot 9, 10 & 11) McCabe Street, North Fremantle) from 'Industrial' to
'Development Zone' (Development Area 18).
MODIFICATIONS TO SCHEME AMENDMENT NO. 12
As per the Ministers direction the City of Fremantle proposes modifying the Scheme
Amendment No. 12, as follows:
i) Amending the Scheme map in accordance with the Scheme Amendment map
(below) for No. 130 (Lot 5, 12, 218, 219, 220, 221, 314 & 253), No. 136 (Lot 100)
and No. 138 (Lot 8) Stirling Highway and No. 2-4 (Lot 9,10 & 11) McCabe Street,
North Fremantle, from a zoning of Industrial to Development zone and to include
the properties within Development Area 18 - McCabe-Coventry Street, North
Fremantle.
ii) Modify the existing provisions in Schedule 11 for DA 18 with the following
(modifications shown in italics):

as indicated in the proposed metropolitan Scheme
Amendment 1210/41 or as in a fin lized MRS

ceded free of cost to the Crown and to be level with the
existing verge as a condition of d velopment approval.
4. Any structure plan for the land is to include an internal
link road connecting McCabe Street to Coventry
Parade/McCabe Place.
5. Development applications received prior to adoption of
a structure plan, shall be assessed via Mixed Use
provisions of the Scheme. Applications for any form of
residential development and subdivision should be
deferred until the structure plan is adopted in order
that servicing, open space provision, environmental
remediation and other issues are resolved.
The Minister has advised Council that:
(a) The above modifications have been requested bec use land required for future road
widening of Stirling Highway is expected to be ceded free of cost to the Crown and
Main Roads Western Australia and the Western Australian Planning Commission
have identified a requirement for an internal road connecting McCabe Street to
Coventry P rade/McCabe Place in association with widening of Stirling Highway nd
im rovements to the intersection with McCabe Street; and
(b) The amendment is required to be re-advertised as these modifications are considered
to be significant.
The Minister has directed Council to advertise the modifications to Scheme Amendment No.
12 for a period of 28 days in accordance with the provisions of regulation 20(1) of the Town
Planning Regulations 1967. Following advertising Council is required to consider any
submissions received and to make a recommendation in respect of each submission and
forward the submissions and recommendations to the Commission.
MAKING A SUBMISSION
Accordingly, Scheme Amendment No. 12 has been placed on advertising for more than 28
days from Tuesday the 24 April 2012 to 25 May 2012. All comments on the amendment are
welcome. Submissions may be made in writing, before the close of business on the 25 May

Landowners rights to compensation in relation to reserved land
If land is reserved in the Metropolitan
Region Scheme
Land which is affected by a reservation in the
Metropolitan Region Scheme (MRS) will
ultimately be acquired by the government, but
generally can remain in private ownership until
it is actually needed for the public purpose.
There are several options available to the
owners of reserved land:
Am I entitled to compensation?
If your land is reserved in the MRS, you may be
able to make a claim for compensation for
injurious affection if:
n you are the owner of the property when it is
first reserved in the MRS and you wish to
sell the property on the open market at a
reduced price;
or
a Retain ownership and continue with the
quiet enjoyment of the property until it is
needed for the public purpose. You may
complete any development or subdivision of
the property that was approved prior to the
reservation coming into effect.
D Sell the property on the open market to
another person(s). The Western Australian
Planning Commission (WAPC) recognises
that due to the reservation this may be
difficult and, subject to acquisition priorities
and the availability of funds, would be willing
to consider the purchase of a reserved
property if an owner is unable to achieve a
private sale on the open market.
0 the WAPC has either refused a
development application over the property
or has approved a development application
over the property subject to conditions that
are unacceptable to the applicant.
How do I claim compensation?
1 If you have chosen to sell the property on
the open market at a reduced price, complete a
notice of intention to sell form which is
available from the Department of Planning. The
.department will establish the extent of the
reservation and forward the notice to the Board
of Valuers.
a Offer the property for sale to the WAPC.
Subject to acquisition priorities and the
availability of funds, the WAPC would be
willing to consider the early acquisition of a
reserved property. In such cases the
property is purchased at the current market
value had the property not been affected by
the reservation, with the value being
determined by independent valuations of the
property.
n Make a claim for compensation for injurious
affection following the WAPC s refusal of a
development application or approval of a
development application subject to
conditions that are unacceptable. In such
cases the WAPC may elect to purchase the
property instead of paying compensation
with the purchase price being determined in
the same way as a negotiated purchase.
The Board of Valuers will determine the sworn
unaffected and affected values of the property.
You may wish to meet with the board to raise
any matters you believe are relevant to the
value of the property.
Following the determination by the board:
n You will be notified of the unaffected value
of the property.
D You pay a valuation fee to the WAPC, after
which you will be notified of the affected
value of the property - this will represent the
minimum sale price.
a You then arrange the sale of the property
(either privately or through an agent). Note
the sale price must not be less than the
affected value determined by the board.
H When the property is sold, you may make a
claim for compensation for injurious
affection for the difference between the sale
price and the unaffected value as
determined by the board.
a If the property does not sell within one year
of the board s valuation, you may ask the
board for a revaluation of the property. The
sale process is then repeated.
n Once compensation has been paid, a
caveat will be lodged on the certificate of
title to identify that compensation has been
paid. Please note that compensation is only
payable once.
Alternatively, you may ask the WAPC to
purchase the property, as you have been
unable to sell the property privately.
2 If the WAPC has refused your development
application or approved it subject to
unacce table conditions and the property is
reserved in the MRS, you may make a claim for
compensation for injurious affection within six
months of the WAPC s decision on the
application.
In such a case the WAPC will either pay
compensation or may elect to purchase the
property in lieu of paying compensation.
If the WAPC elects to purchase the property,
valuations are obtained for the market value of
the property as at the date of the election to
purchase had the property not been reserved
in the MRS. Please note that the date of
valuation is fixed at the date of election to
purchase.
What is compulsory acquisition?
A situation may arise where a property is
needed as a priority for a public purpose and
the owner is unwilling to sell the property to the
WAPC.
In such a case, the property may be
compulsorily acquired (or resumed) for that
public purpose.
Where a property has been resumed by the
WAPC, you have the right to make a claim for
compensation in respect of the land resumed.
The WAPC will have the resumed land valued
and following the checking of the compensation
claim will make you an offer of compensation
for the resumed land.

1. lam Julian Louis Slier, a director and shareholder of Jeta Pty Ltd (" Jeta").
2. I am duly autho ised to make this submission.
3. Jeta is the owner of a unit located on the ground floor of the development located at Lot 70 Stirling
Highway, Claremont.
4. I received a booklet entitled "Rationalisation of Stirling Highway Reservation" containing a plan described
as "Extract of Proposed Changes: Plan Number 1.7147 (243-b). The plan is entitled "Reduction in land
required for road purposes No. 392 (Lot 70) Sti ling Highway, Claremont Proposed area required 159 m2
subject to survey".
5. The proposed "rationalisation" will adically affect the amenity of the unit which we own. It is located on
the ground floor of the development and the garden and lawn in front of it abuts the Stirling Highway.
6. If the proposed change (and presumably the resumption of part of the land) occurs as depicted on the plan,
the amenity and market value of our unit will suffer significantly.
7. Currently the complex and the unit are protected from the Stirling Highway by a istance of several metres
occupied by a magnificent old tree and hedges, which not only provide privacy and shelter from traffic
noise, but also shade.
8. The proposed changes will ean that our unit will effectively be on the edge of Stirling Highway without
any protection because the tree, hedges and also the lawn on which they are located, will have to be
destroyed.
9. Disturbingly, the proposed chances will seriously affect the value of the property. Currently, its seclusion
from the highway makes it a desirable ground floor unit. The removal of the seclusion and the expansion of
the highway will make the property less desirable and affect not only the capital v lue of the property but
also the rental values.

The property abo e already has restricted and limited vehicular access connecting t e Leura A enue vehicle parking
with the lower level Stirling Highway vehicle parking. The proposed scheme aithough less than the original reservation,
will remove this vehicular access way completely, effectively shutting of e icular access to the car bays on the property.
Regular and new business clientele will be confused and frustrate by the limited exits an entry oints from the property
and will not ha e the ability to migrate within the site if the top or lower le els are fully occupied.
Tenants both current and future will penalize the property through the rental likely to be paid and the property will
suffer from value destruction well above the fair compensation for land that may occur due to this reservation.
As a real life example, on the 16th of September 2011 negotiations began on securing a national retailer for the whole
of t e premise for $310/sqm nett + VO + 3% annual increases with the tenant paying relocation cost and refurbishment
cost with a 3 month rent free period. This represented a 24% increase from the current rental in one of the worst retail
trading environments in 20 years. Negotiations were being finalize in March-April 2012 when the pro osed amendments
were received, the Offers were quickly withdrawn an fell apart once the disclosure was made about the proposed
reser e.

He says the city cannot rely on
building more roads to underpin
its development.
Dr Michael, who gave the key¬
note speech at the annual C.Y.
O Connor lecture last night, also
called on authorities to draw up
longer-term plans for the State
amid concerns current t meframes were too short.
Less than a year since stepping
down as WA’s representative of
the Queen, Dr Michael said State
governments of all persuasions
had done a pretty good job of
managing development.
But citing the trailblazing
work of famed engineer C. Y.
O Connor in the late 1800s and of
Gordon Stephenson in designing
Perth’s roads in the 1950s, Dr Mi¬
chael said authorities should
never lose sight of the big picture.
He pointed to Perth’s transport
network to highlight the claim,
saying policymakers would need
to plan for more public options if
the rapidly growing city was to
remain sustainable.
And he singled out light rail as
a means of public transport that
could be an important part of the
solution.

SUBMISSION - METROPOLITAN REGIO SCHE E A ENDMENT 1210/41 RATIONALISATION OF STIRLING HIGHWAY RESERVATION
In response to the formal advertising of Amendment No. 1210/41 to the Metropolitan
Region Scheme (MRS), the following submission is lodged by Cardno (WA) on behalf
of our client, BP Australia Limited ( BP ), who operate the BP Service Station on Lot 1
(No. 553) Stirling Highway, Cottesloe (herein referred to as 'the subject site ).
It is understood that Amendment 1210/41 will facilitate the rationalisation of the existing
Stirling Highway Road reservation over the subject site. The existing reservation under
the MRS currently extends over the whole of the subject site. The reduced road
reservation will result in a residual land area of 537m2, with the remainder of the site
(207m2) being subject to the Regional Road reservation. The residual land will be zoned
'Urban under the MRS as part of this amendment, and most likely rezoned to 'Town
Centre under the City of Cottesloe Town Planning Scheme No. 2, in accordance with
the adjacent landholdings.
Although the proposed amendment is resulting in a reduction in the current reservation
over the subject site, it will still have detrimental impacts on it’s existing operations. The
proposed reservation extends over the existing forecourt area of the site and as such is
affecting the most critical component of the service station. The disturbance to the
forecourt area will render the whole site useless for a service station.
The proposed road reservation will also diminish the value of the site as it will affect its
potential use as a future Town Centre’ site, which would be consistent with all adjoining
land uses.
If the proposed road reservation is approved over the subject site BP will claim
compensation in accordance with the Planning and Development Act 2005 on the basis
that the rationalisation will still result in the site being unable to be operated as a service
station or developed as a town centre development.

METROPOLITAN REGION SCHEME PROPOSED AMENDMENT 1210/41
1) Bowra and O Dea Funeral Directors have had a presence at 571 Stirling Highway
Cottesloe, at the intersection of Jarrad Street over the last 8 decades and are part of the
local fabric, offering a valuable service to the community.
2) The current proposal for the rationalisation of the Stirling Highway Reservation proposed
in Metropolitan Region Scheme Amendment 1210/41 affects those premises to such a
profound extent that Bowra and O Dea will not be able to operate its business from the
land remaining after the taking of the reservation.
3) Several issues may conspire in the permanent loss of this long standing branch of Bowra
and O Dea. These issues are:
a) Funeral Parlours are contemplated under a Town Centre zoning in the local town
planning scheme, but are an A-A use under the scheme, permitted at Council
discretion. Therefore, no guarantee exists that a similar use will be approved by
Council on another similarly zoned site in the locality.
b) It has been the experience of Bowra and O’Dea that funeral parlours are often a
misunderstood land use and that an approval for this use, or for the establishment of a
new facility, can be hampered by emotive opinion within certain factions of the
community. Therefore, factional pressure can prejudice a discretionary decision,
potentially removing the potential to re-establish the business on an alternate site.
c) Given the tightly held nature of property in the Cottesole commercial and retail
precinct, the possibility of Bowra and O’Dea identifying another suitably zoned site
with Stirling Highway frontage offering appropriate access and egress characteristics
is remote.
d) We believe that this is an unacceptable outcome at several levels. Firstly, the local
community may permanently lose an important service. Secondly, this set of
circumstances specifically disadvantages Bowra and O’Dea compared with other
more generic land users. Thirdly, Bowra and O’Dea will suffer a potentially
irreplaceable loss to its business enterprise, the cost of which would be considerable.

4) With regard to the highway rationalisation scheme at a global level, we do not believe
that it adequately addresses the following critical issues:
a) Relief of existing congestion surrounding private schools in Claremont affecting both
westbound and eastbound traffic during peak times.
b) The ability of Stirling Highway to grow into the future as a regional road link catering
for increased population densities along its length.
c) The ability of Stirling Highway to support additional modes of transport such as light
rail to supplement existing forms including road, cycle and heavy rail.
5) Existing planning policies have a medium term view (Directions 2031). Planning experts
such as Richard Weller suggest that a longer term view is needed for planning and the
provision of infrastructure, possibly to century s end, in order to adequately cater for the
needs of our cities on a global level. Shorter term views are likely to accede to local or
political interests, resulting in policies that may preclude the implementation of
meaningful initiatives which in many cases will be unpopular but necessary. If the
existing highway reserve is rationalised for the piecemeal construction of bus passing
lanes, cycle lanes and turning lanes; then that is likely to be the extent of future
infrastructure possible within that reserve. The existing reserve (circa 1963) is extensive
but seems to more adequately provide for the goal of providing a meaningful long term
transport solution for what is an important regional road link. Any decision to expand the
reserve after the proposed rationalisation will come with a far greater cost, both socially
and financially. It is our opinion that the current proposal for rationalisation of the
Stirling Highway reserve is ill-conceived, bordering on irresponsible; and is not
consistent with the longer term interests and needs of our community.

1 I agree that the proposed changes to Stirling Highway are necessary in order to
address traffic congestion through Claremont and to make it safer for cyclists
and pedestrians.

a The proposed .4 metre reduction on the southern boundary will bring the
boundary wall 15 cms from my parapet garage wall. This will mean the
loss of mature trees and a footpath and I will not be able to gain access
behind the garage.
b The proposed .2 metre reduction on the northern boundary will bring the
boundary wall 35 cms from the roof eave.
3 Future Sale of the P operty
Will I be gi en any guarantee by the Government that my property will be
purchased by them if it fails to sell within a reasonable period of time? I would
prefer to sell now, rather than wait for all this to happen and to have to endure
the disruption of having a large limestone wall moved nearer to my house.

I support the reduction of the road reserve, and the smaller the better.
As views against any resumption of property 1 provide the following:
At this point in the highway the median strip is up to 5rn wide, and suggest
consideration given to using this as effectively as possible.
Any extra width required should be provided from properties on both sides of the
highway to minimise disraption.
Commonsense needs to be applied to the width of any footpath on the north side of
the highway. It may not be able to be straight or of consistent width.
Now this proposal has been aired, there is general conce that property so affected
will even now, decrease in value. What is your comment?
The possible plan for a bus lane to turn left ( north) into Dalkeith road, as matters
stand, is drawing a long bow , because buses heading from Fremantle go straight
along the highway, and buses going along Dalkeith road continue in that direction. So
is ther©ny need for such a lane?
if a left turn lane is really required, it could commence at Baird Av., leaving plenty of
room for more than one bus, considering that at the moment none turn left at Dalkeith
road, (see above).
Right and left turns from the highway are always a problem. There should only be
designated points for these to occur. Suggest Vincent St. for a right tu .
I hope this has given you some ideas to minimise your resumption costs and still
achieve what you want.
One final question. 1 am sure you have thought this through, as any public servant
would. If there is a resumption of common property on a strata plan and payment is
subsequently made, to whom is payment made to on the statement/cheque?
If it is to the strata company, according to the relevant act, the strata company camiot
pay the individual owners. It remains in a fund. Once money is contributed to a strata
company fund, it cannot be returned to owners.
