The United States real estate industry
most likely had its beginnings shortly after the
country was able to extricate itself from British
rule and a new federal government began to permit individual ownership of property. With the
general migration toward the west, the
Homestead Act of 1862 was instrumental in
continuing a move toward granting individual
property ownership in return for a five year
commitment to the development and improvement of the land. Over the years this act alone
was responsible for distributing and thus converting more than 300 million acres to private
ownership. These grants and distributions ultimately led to continued transference of properties from previous to new owners and are considered responsible for the beginnings of the real
estate practice that is before us today.
As cities grew and property sales
increased the ensuing years saw real estate practitioner activities that ranged from straightfor-
ward and honest transactions to downright
criminal dealings, but since there were no
guidelines to follow the general atmosphere was
“anything goes!” To overcome this problem
several attempts were made to organize real
estate brokers and in 1908 the National
Association of Real Estate Exchanges was
established to ensure that there was some degree
of propriety as it pertained to the property transfers taking place at the time. The organization’s
name was changed to the National Association
of Real Estate Boards in 1916 and later to the
National Association of REALTORS® with
which we are familiar today. There is little doubt
that by following their established Code of
Ethics fair and honest transaction could become
the norm.
Those new to real estate practice most
likely do not realize just how different today’s
process is from when the industry had its beginnings. There are so many things that have
changed throughout the years, even changes
from as recent as the early 1970’s until now.
During the early 1970s, I had my initial exposure to the industry when I purchased my first
home in San Antonio. As a veteran I was able to
establish a loan through the VA and the contract
used at that time was a one page, legal size document that detailed all the specifics pertinent to
the transaction. It is amazing to consider everything that purchase would entail today considering the explosion of multipart forms and
required addenda, not to mention the price difference!
In 1978, when I decided to give the real
estate profession a try I was located in Denton,
a relatively small town north of Dallas, Texas.
At that time every real estate office had its own
“inbox” located at the Board of REALTORS®
and when an agent took a new listing the information was entered (by typewriter) onto a form
and brought to the board so it could be added to
the general MLS inventory and to have copies
of the listing placed in each of the other office’s
inboxes. During the week someone from each
office would collect the new listings along with
any notices from the board, issued since the last
visit. That material accounted for all the communication occurring between the board and its
member offices. Weekly caravans of agents
would set out from the board on a specific day
so all those interested could preview the recently added listings and enjoy some camaraderie. It
was generally agreed then, as it is now, that the
combined efforts of all board members resulted
in faster sales. And, at the time, properties were
actually selling despite interest rates running
between 17% and 18%. Eventually the procedures changed and listings were compiled into
MLS books and released periodically to replace
the individual sheets at the Denton Board.
The MLS books were also in use in the
San Antonio area during the late 1970s and continued to be available while the various incarnations of digital formats were being developed
and tested to keep all members up-to-date with
the current inventory. Accuracy and performance were greatly improved throughout the
system with the advent of a brokers-only digital
database which eventually replaced the printed
book. Today, thanks to the internet, agents work
within a system that allows them access to all
listing information and makes much of the same
data available to the public at large. Happily
they have also been able to do away with using
pens and typewriters to fill in forms and no
longer need to hand deliver documents to
ensure they arrive at the appropriate place by a
specific time.
Due partly to the shortage of housing
inventory the current local real estate market is
as hot as it has ever been. And today rents have
risen so dramatically that the mortgage payments are less than the monthly lease rates.
Owners are experiencing instances of multiple
offers for their property that often exceed the
price for which the
home was originally
listed. Scores of new
practitioners
are
entering the business every month in hopes of
sharing in the good times, some driven by the
false impression that if they place themselves in
the path of progress they will naturally benefit
from the flowing income with little or no effort
on their part. It should come as no surprise that
many of these folks will not be found among the
practicing agents for very long.
It is important that one does not get too
complacent about what the current trend
promises. There is another truism about the real
estate business and that is that it is definitely
cyclical in nature. The 1800s saw the beginning
of a progression of housing bubbles and bursts
occurring within the economy. Historically the
very first major boom was noted in 1837 when
the stock market was riding high, but when it
peaked the bust followed shortly thereafter.
During the down times the banks tend to hoard
gold, silver and cash and one finds that loans
become more difficult to obtain. It was the activity generated by the gold rush in 1849 that was
instrumental in reversing that downward trend.
The next boom/bust period occurred around the
mid 1850s and at that time the interest rates rose
to an all time high of 30%. In that case it took
the Civil War to again turn things around.
It has been estimated that a phenomenon
similar to those noted in 1837 and 1857 occurs
roughly every 18 years in this country. There is
a valuable lesson to be learned from this history
if one were to put current events in perspective:
(1) the real estate market today is exceptional,
(2) the stock market is approaching new highs
and the (3) the most recent hiccup in the economy happened back in the 1990s. It is possible
that the near future could hold a reversal of fortunes so enjoy the ride while it is here but
remember to save some for the lean years!

Latest Legal Updates for Real Estate
Lori Levy, General Counsel and
Vice President of Legal Affairs for the
Texas Association of REALTORS®,
recently came to speak at the San
Antonio Board of REALTORS® and
provided an excellent summary of the
recent hot topics facing the industry
and changes that will be coming down
the road.
She covered a wide variety of
issues, some of which you might have
already been made aware. For example,
she confirmed that unmanned aerial
aircraft (also known as drones) used for
commercial purposes at this point in
time still require an exemption by the
FAA. Regarding the CFPB rules
changes, she discussed that the date to
comply with the new disclosure
requirements has been extended to
October 2015. She also discussed the
importance of voters to approve the
upcoming ballot initiative banning the
imposition of any type of taxes on the
sale of real estate.
A new topic that members will
definitely be interested to know is that a
few of the TREC forms will be seeing
changes. Some of the changes are a
result of the legislative year. They
involve new disclosure requirements
for properties located in ground water
conservation districts or a subsidence
district. Another legislative change
includes the requirement to disclose if a
property is subject to water level fluctuations such as those properties located
near lakes.
Non-legislative changes are
intended to be made to other parts of
the contract as well. The option period
and the timeframe in which to perform
will be amended to place an hour in the
day by which to give notice. New language will be added to address hydro
static testing and define that it is not
considered a part of a standard inspection and therefore would require the
property owner’s consent. In light of
the CFPB three day rule, the contracts
will also be amended to provide for
what shall happen when a closing must

be extended due to the disclosure rule
requirement.
Ms. Levy indicated that these and
other changes are being considered by
TREC and they intend to make the
forms available for review by agents on
August 17th. The forms will go into
effect September 1st under an emergency status. During this time the contracts will be required for use and they
will be open for comment by agents.
Therefore, it is possible the forms could
once again be changed after agents have
the opportunity to provide input.
Other great information Ms. Levy
provided was in regards to the TREC
Information about Brokerage Services
form and the Consumer Notice
Requirement form. Both forms are
being changed to be more consumerfriendly. With regards to the Consumer
Notice form, which is currently only

required to be displayed in a broker’s
office, it is being contemplated as to
whether the same notice should be
required to be posted on an agent’s
website.
Regarding the recent TREC
Housekeeping Bill that was passed this
legislative year it was discussed that the
definition of “brokerage” is going to be
expanded. This is being done in an
effort to curb the individuals who act as
agents by skirting the Licensing Act.
The example given by Ms. Levy was
when individuals use power of attorney
forms as a means to assist consumers
with the purchase of a home or to manage rental properties. By expanding the
definition the intent is to provide consumers with greater protection.

environment. While attending socials
shouldn’t be the goal for joining an
organization, I sincerely believe some
other organizations could greatly
benefit from these types of social
gatherings since they take place in a
nonthreatening environment, can be
very relaxing because it’s not a “work
function,” and they are typically a
great stress reliever at the end of a
long day. I think if you consider initiating these gatherings in your organization you will see your team members and all members as a whole
establish new camaraderie and trust
with one another once they get to
know them outside of the work place
environment.
Socials
Our local NARPM Chapter
members have always benefited from
our Chapter meetings, but more
importantly, I think the camaraderie
and development of our leadership
has been elevated as a result of our
social gatherings outside of the formal meetings.
Bimonthly, our Chapter hosts a
“NARPM Social” and welcomes all of
its members to attend. These socials
have typically been hosted at one of
our member offices, but do sometimes happen outside of the work setting. This year, a few of our member
companies hosted these social events,
for example, Property Management
Services of Texas/Delaney Realty,
Inc. MHN Properties and
Homelocators & Management. In
August we will have a pool party
courtesy of GSG Property
Management.
These events not only allow our
members to relax and socialize outside of the usual “work” activities,
but also allow us an opportunity to
bring the family along so we can all
get to know one another a little better.
In addition, we have an active
NARPM NGP Committee (Next
Generation Professionals) that also
hosts bimonthly socials so that we
actually have a social opportunity
every month! While the NGP group is
typically defined as the “under 40”
crowd, every NARPM member helps
shape and influence the “up and comers” so everyone is welcome to join in
these activities! These socials are
always held in settings away from the
work environment like Karaoke clubs,
pool halls, or wine bars. The point is
that we just want to have fun and
build deeper relationships with our
“work friends.” And from personal
experience over the past five years, I
can assure everyone that it does happen.

a social, our only goal is to provide
our members with a relaxing and fun

Slow Cooker Triple Chocolate Brownies
Ingredients:
2 1/2 cups packaged brownie mix
1/2 cup packed brown sugar
2 eggs, beaten
3 tablespoons butter, melted
1 package (2 3/4 ounces) instant chocolate pudding mix
2 tablespoons unsweetened cocoa powder
Whipped cream or ice cream (optional)
Directions:
Coat inside of slow cooker with nonstick spray.
Combine brownie mix, chocolate chips, brown sugar, water,
eggs, butter, pudding mix and cocoa in slow cooker, stir to
blend, cover. Cook on high for 2 hours.
Turn off heat. Let stand 30 minutes. Top with whipped cream,
if desired. Enjoy!!

SABOR Members Donate Uniforms to Benefit the Kids
