But It’s The Law!

I was listening to a news report recently where in Maryland two young children had
been reported to authorities as being in a local
park unattended. They were subsequently
picked up by the authorities and rather than
being taken home, they were kept at a child
protective services facility for several hours. It
turns out the parents knew where the children
were and had intentionally let them go to the
park by themselves as a way to help them gain
their independence. Apparently Maryland law
is very specific that children must be attended
by a person who is at least 13 years of age
when they are indoors or in a vehicle but the
law says nothing about what must be done
when they are not in either of those areas. That
got me thinking about state laws, and while
researching the subject I found there are
scores of laws throughout the country that are
just plain weird!
Many states have, over the years,
passed laws that I
expect were intended to protect animals, the environment, commerce and just
people and situations in general, but they
make one wonder what specific happening
could have caused them to become laws.
Speaking of Maryland, did you know that in
Baltimore you cannot take a lion to the
movies? Folks must really be mistreating fish
since in Pennsylvania one may not catch a fish
by any body part other than the mouth and in
Oregon you may not use canned corn as bait.
When fishing, it cannot be from a camel’s or
a giraffe’s back in Idaho, you may not use a
lasso in Tennessee or a firearm in Wyoming
and it is illegal to get a fish drunk in Ohio. And
whaling is a no-no in Nebraska, Oklahoma
and Utah.
If you have a pet dog you should know
that you may not tie it to the top of your car in
Alaska, feed it whiskey in Chicago, or educate
it in Connecticut, and in order for dogs in
groups of three or more to congregate on private property they must have a permit in
Oklahoma (can’t you just picture the lineup at
the courthouse waiting for the permit)? Also
dogs may not chase bears or bobcats in
California or molest cars in Fort Thomas,
Kentucky. Sleeping in bathtubs is banned for
donkeys in Arizona and Georgia, for horses in
South Carolina and especially for alligators in
Florida.
In Alaska you may not carry a concealed slingshot unless you have the appropriate license and in Nome you may not walk the
street carrying a bow and arrows. When being
attacked by a criminal or burglar in Arizona
you may only protect yourself with the same
weapon the other person possesses. It is illegal, while committing a murder in New Jersey
to wear a bullet-proof vest and yet a robber
may file a lawsuit in Michigan if he or she
gets injured in your house. But Texas has one
of the best weird laws pertaining to crime in
that, a recently passed law requires criminals
to give their victims 24 hours notice, either
orally or in writing, to explain the nature of the
crime to be committed. And that is followed
closely by a law in Washington that states: “It
is mandatory for a motorist with criminal
intentions to stop at the city limits and telephone the chief of police as he is entering the
town.”
Laws like one in New Mexico that
warns that idiots may not vote makes one
wonder who has been monitoring that restriction lately. Did you know that in Alabama it is
illegal to operate a car while blindfolded, that
no vehicle without a driver may exceed 60
MPH in California, you cannot fly a plane
while drunk in Nebraska and will be stopped
if you peddle your bike over 65 MPH in
Connecticut. The one caveat among transportation laws that leaves me scratching my
head in wonder is that in Texas and Wisconsin
when two trains meet each other at a railroad
crossing, each shall come to a full stop, and
neither shall proceed until the other has gone,
while in Kansas this law will apply if the two
trains are on the same track! And there is supposedly still a law on the books in South
Carolina that says that when approaching a
four- way or blind intersection in a non-horse
driven vehicle you must stop 100 ft from the
intersection and discharge a firearm into the
air to warn horse traffic.
Life must have been pretty interesting
in some of these states when these laws were
enacted because for example in Connecticut
in order for a pickle to officially be considered
a pickle, it must bounce; it is illegal to dispose
of used razor blades; in Devon it is unlawful
to walk backwards after sunset, and in
Hartford you aren’t allowed to cross a street
while walking on your hands. In Florida you
are not permitted to sell your children; you
may not fart in a public place after 6 P.M.; it is
illegal to sing in a public place while attired in
a swimsuit and for Massachusetts it is illegal
to go to bed without first having a full bath
and snoring is prohibited unless all bedroom
windows are closed and securely locked. Just
couldn’t leave out that in Alabama boogers
may not be flicked into the wind!
In the real estate industry we must do a
pretty good job of keeping state laws under
control as there are only a few odd ones to be
found and they are mild – could be the result
of our PAC dollars at work. For the lucky
ladies in Alabama, women are able to retain
all property they owned prior to marriage in
the case of divorce. However, this provision
does not apply to men. Several states seem to
worry about the number of women that live
together even if they are related so the laws
are pretty restrictive: in Missouri it takes only
four, in Ohio it is five, in Arizona six, in
Tennessee eight but Pennsylvania permits up
to 16 (would seem to be ways to keep brothels from popping up). It is illegal in San
Francisco to have potted plants anywhere outside and in Waldron, WA no building is
allowed more than two toilets.
Because they seem so odd there are
just a few more I’d like to mention: In Bexley,
OH Ordinance #223 prohibits the installation
and usage of slot machines in outhouses; the
penalty for jumping off a building in New
York is death – (Ya think?); In Spearfish, SD,
If three or more Indians are walking down the
street together, they can be considered a war
party and be fired upon; to hold public office
in Texas one must acknowledge a supreme
being and finally, Virginia prohibits “corrupt
practices of bribery by any person other than
candidates.” Is it not fortunate for some that
even current state laws are sometimes not
enforced?

Over the last month the following
issues have been frequently coming up in
conversations with members. There are a
wide variety of topics as part of the list
and I have included a brief description of
how to minimize risks.
• On a regular basis I have been
receiving complaints from agents stating
that the agent representing sellers is not
presenting the offers. Legally, agents are
required to present all offers presented to
their clients. Regardless if the amount of
the offer seems to be unreasonable, the
offers must be presented. The only exception to this rule is when a client puts in
writing instructions about the type of
offers to accept and those to reject.
Absent instructions from a seller all offers
should be presented.
• When negotiating terms of an
agreement, and in particular dollar
amounts, it’s important to discuss with
your clients why the amounts to be negotiated are important. An example would
be the addendum for sale of other property. When a buyer needs to waive the contingency on the contract to avoid the
house being sold to another buyer it
should be a serious consideration to
which they commit. Sellers should make
a reasonable request to minimize the risk
of having their property off the market for
buyers who are not serious.
• Special provisions is not the place
to include language that an offer is only
valid for a limited amount of time.
Perhaps buyer’s agents believe they are
helping their clients by putting pressure
on the sellers to decide on the offer.
However, it is possible that the language
has actually created an offer to buy a
property that cannot be withdrawn until
the date specified in the agreement.
Avoid putting these types of provisions in
special provisions as they are not statements of fact nor are they business
details.
• Unlicensed assistants can be a
valuable addition to your team but making sure they only perform those tasks
allowed by law is important. When
answering phone calls, assistants may
confirm information about properties
such as the size of a home or the price and

terms, but nothing further. Assistants may
also act as host at a property but they are
prohibited from saying or doing anything
that would require a real estate license.
This would include negotiating terms or
discussing how to make an offer.
• The broker whose clients make
the final acceptance has the responsibility
of completing the execution date in the
contract. The date should be the day on
which the contract was communicated
back as being accepted and should not be
a later date. Additionally, in a recent court
case a contract was found to be invalid
due to the fact that the contract was lacking an execution date. The court held that

term to the agreement, its absence created
an invalid contract. Make certain that you
insert the appropriate date in the contract.
• Non-Realty Items continue to be
an issue in transactions. Agents make
offers for items to transfer as part of the
transaction in the MLS but the actual
transfer of the items never happens
because the appropriate addendum is not
attached to the contract. Additionally,
sellers who wish to exclude items from
the transaction need to make certain that
those exclusions are properly denoted in
the contract. The MLS is not considered a
part of the contract and therefore it would
not be binding on the parties to require the
transfer or exclusion of property.

Ingredients
Butter or nonstick baking spray
1 tablespoon olive oil
1 small leek, trimmed, rinsed well and thinly sliced
1 small bunch fresh spinach, rinsed and torn into bite-size pieces
salt and pepper
4 large eggs
1 cup heavy cream
chives for garnish
toasted baguette slices or other crusty bread for serving
Directions
1. Preheat the oven to 400 degrees F.
2. Grease 4 6-ounce ramekins with butter or spritz with nonstick baking
spray, and place on a rimmed baking sheet.

3. Heat the olive oil in a large skillet over medium heat.
4. Add the leeks and cook, stirring occasionally, for 8-10 minutes until the
leeks are tender and translucent. Add the spinach and cook for 1-2 minutes
more until the spinach is wilted and vastly reduced in volume. Season with
salt and pepper to taste.
5. Divide the leaks and spinach between the ramekins.
6. Crack an egg into each ramekin, then top with 3-4 tablespoons heavy
cream. Don't fill the ramekins the whole way to the top; leave 1/4 inch of
space as the cream will bubble up in the oven.

7. Bake for 15-20 minutes, until yolks and the white immediately each yolk
are just barely set and still have some jiggle to them. The eggs will continue to
cook for a few minutes after they leave the oven.
8. Sprinkle chives and additional salt and pepper over each ramekin, if
desired, and serve immediately with toasted baguette slices. Enjoy!
