The Greenville Bar Association has enjoyed an active summer with
the Law Clerk Luncheon and the Family Social. The Greenville Bar
welcomed Furman's New President, Rod Smolla, at the July 20 Law
Clerk Luncheon where he proceeded to regale the attendees with an
instructive and, dare I say, engaging lecture on an aspect of the U.S.
Constitution. I am sure I am not alone in wondering what my constitutional law grade might have been were he my professor since he managed to speak of that
topic in a fascinating way rather than the monosyllable droning on of the topic as it was
first presented to me. Judge Aphrodite Konduros and Judge Debra Faulkner had the good
idea to submit his presentation for thirty minutes of CLE credit and this request was approved!!! (SCLS) now allowed to seek and
receive attorneys’ fees

The 1996 statutory and regulatory prohibition on Legal
Services Corporation (LSC) funded (“legal aid”) law
firms such as SCLS claiming, collecting, and retaining
attorneys’ fees was lifted earlier this year. Thus, SCLS
is now seeking attorneys’ fees in appropriate
cases. Last month, an SCLS attorney was awarded attorney’s fees in a successful Simpsonville Magistrate
Court security deposit recovery action filed by SCLS on
behalf of a tenant against a landlord. Also last month, a
Greenville County Circuit Court Judge awarded SCLS
attorney’s fees on behalf of a client SCLS successfully
defended in a consumer collection case.
SCLS is a state-wide law firm providing legal assistance
and representation to low-income South Carolinians in a
wide variety of civil cases. SCLS receives funding from
a variety of sources, including the federally-funded LSC,
local United Ways, and the S.C. Bar Foundation. For

The South Carolina Bar Board of Governors is interested in
hearing from members of the Greenville Bar. Board members
and Bar staff will be traveling to Greenville to hear what’s on
the minds of lawyers in various communities, to include
Greenville. The meetings will be small gatherings of Bar
members. You will have an opportunity to advise the Bar representatives what’s working, what can be improved, what’s
being overlooked. The Bar representatives will spend a few

As to the new support form, the Clerk’s office would appreciate your help in getting these forms completed and
filed with the applicable orders. However, they will file your orders even if this form is not signed. These forms are
available to you at the Clerk’s office and in the courtrooms if you wish to fill this out when both parties are present.
Please try to have this form filled out as completely as possible and bring this form with you to the motion hearing so
that it can be signed at that time. If you have a pro se litigant that cannot be located to sign the form, the Clerk will
still file your order with the form unsigned. If the pro-se litigant appears in the courtroom ask the Judge for help in getting your form signed. The support form still needs to be attached to most orders even if support is not ordered through
the Court, etc. Also, the Clerk will accept the form with the last four digits of the requested social security numbers.

Please be advised that up to two “608 credits” are now available to certified family court mediators who volunteer to mediate for the “DSS mediation program” that is beginning again. These are typically scheduled on Fridays at
9:30. The mediators will now have a back up case to mediate in the event the first case settles. If you are interested
in being a volunteer mediator, please call Angie with Judge Verdin’s office for more information.

The court has implemented a block schedule for DSS First Call Merits cases held on Tuesdays. Previously,
each case was set for a time certain for 15 minutes. Now, several cases will be scheduled in each block of time. The
blocks are: 1) 9:30 to 11:00; 2) 11:00 to 12:30; 3) 2:00 to 3:30; and 4) 3:30 to 5:00. The purpose of the block schedule
is to allow those cases that have agreements to go first in putting the agreement on the record, while the other cases
can use the time to continue to negotiate a possible agreement. If there is no agreement, the case will be set for a
contested trial on a subsequent Thursday.
The next Family Court Liaison meeting will be September 17, 2010 at 1:00 p.m. in the Conference Room in the
Judge’s Hallway. Anyone who is unable to attend these meetings but has issues they would like addressed may contact: Christine M. Howard (282-8575).

Attorney Volunteers Needed!!
On November 20, 2009, the Supreme Court of South Carolina amended Rule 608 so that attorneys will no longer be
appointed as Guardians ad Litem (GALs) in Family Court.
This amendment went into effect on July 1, 2010. While
there are GAL programs in effect to cover DSS Child Protective cases, there are currently no such programs for
Adult Protective cases.
In late spring, an ad hoc group formed to develop a plan to
address the GAL system for Emergency Adult Protective
Service cases. As a stop-gap measure, the group has implemented a six-month interim program in which volunteer
attorneys will serve as GALs in APS cases until December
31, 2010.
Historically, there have been approximately 500 Emergency Adult Protective Service cases per year. Most counties have an average of 8-9 cases per year: eight counties
reported zero cases in 2009-2010 with Charleston and
Richland Counties having 41 and 40 cases, respectively.
Only three counties had more than 20, but less than 30
APS cases, Berkeley (21), Kershaw (27), and Newberry
(21). Five counties reported only 1 case during the report
year.
The Emergency Adult Protective Services cases typically
last approximately six months, as opposed to the Child
Protective Service cases, which may last years. In preparation for these cases, the ad hoc group developed a PowerPoint and statutory guide for reference. These materials

David L. Williford
David is an associate at Davis & Snyder, P.A. His practice areas are Medical Malpractice Defense, Health Care Law, and Pharmaceutical Litigation. David is originally from Richmond, Virginia. He received his JD from Regent University School of Law in
2006 and majored in Government at Wofford College. His hobbies include playing various sports, especially baseball, softball,
basketball & golf; spending time with his wife, Carrie, and their two daughters (Claire = age 3; Lyla = age1); church; reading;
traveling; and music.
This is what David had to say about what he likes the most about the practice of law:
I particularly enjoy working with the people in my firm as well as developing relationships which last outside of and
beyond the attorney-client relationship, especially clients with whom we have had the privilege to counsel, represent,
and serve during difficult and stressful times in their lives. In practical terms, I enjoy problem-solving, the litigation
process, taking depositions, and preparing for and trying cases. The practice of law – perhaps paradoxically – is very
much a ―people‖ profession, yet it is adversarial and involves a measure of competition. As a former college baseball
player, I thoroughly enjoy the competitive nature of litigation and trial practice, but I also find fulfillment in working to
[hopefully] make a positive impact on the lives of our clients. Overall, the legal profession is rewarding in many ways
and provides various opportunities to serve people during very important periods in their lives, and it is truly a privilege
to walk with them through such times

Jessica Fisher

There are many aspects of practicing law that I enjoy, and I believe that this variety is one of the main things that
makes practice interesting. It allows me to indulge my inner geek with things such as researching and writing briefs,
while at the same time it gives me the chance to interact with and help people. In the end helping clients reach a resolution, whatever it may be, is gratifying and I consider myself lucky in that I enjoy the process.

My practice over the past several years has been concentrated in family law, so I mostly represent individuals. Many
lawyers will tell you they won’t handle a case in Family Court because it is too stressful, ―nobody wins,‖ or other reasons. While it can certainly be a difficult area in which to practice, I enjoy many things about it, particularly the responsibility that comes with acting as counsel for a husband, a wife, a mother, a father when every issue in the case has a
direct effect on the rest of their life.

Collie W. ―Trip‖ Lehn, Jr.
