Dear Mayor Schieve:
We appreciate your consideration of our input and the efforts by you and the City Council to revise
the ordinance following the November 4th meeting. This letter is written on behalf of the members of the
Nevada Resort Association (NRA) to provide comments on the revised proposed amendments to Section
18.16.702 and 18.16.804 of the Reno Municipal Code, scheduled for introduction on November 18, 2015.
The proposed draft appears consistent with the direction given by Council, with one exception. The
draft uses the term "flashing or animated" signs instead of "digital display". Flashing or animated signs, as
defined in City code (RMC 18.24.203.4570), apply to a much broader class of signage than digital signs.
"flashing/Animated" signs Include "changeable" signs under City code, which include any "sign whose
informational content can be changed or altered by manual or electric, electro-mechanical, or electronic
means." This Is a very broad class of signage, and includes far more than digital signage. These types of signs
were not discussed by the City Council, and expanding the ordinance to include them appears to go beyond
the Council's intent. Our members are also concerned that the scope and effect of expanding the ordinance
to non-digital signage has not been fully evaluated, and may have significant adverse effects.
For these reasons, we respectfully request the term "flashing/animated" sign be replaced In the
proposed ordinance with "digital display." Thank you for your consideration of this request. If you have any

City Council Tosses Digital Regulations
In a surprise move the city council recently agreed to dump all of the proposed
community-driven digital sign regulations in favor of new ones that perpetuates
existing video, scrolling and flashing signs 24/7 and would allow new ones to pop
up throughout the city. The new draft digital sign regulations will be reviewed
Wednesday in a public hearing.
Let the Reno City Council know your concerns. Email [email protected] or
call 775-334-2030. The clerk's office forwards all emails and phone messages to
the Council. Or come to the public hearing at city hall.
With little discussion of the far stronger regulations presented in the Nov. 4 draft,
Mayor Hillary Schieve and Councilman Oscar Delgado astonished the room with
an entirely new draft that obviously had been written prior to the noticed public
hearing. See the new draft, click here. Scroll down to item F.3 at page 230.
Business Desires Trump Community Concerns
The unexpected move was made after dozens of auto dealers, resort, casino and
sign industry representatives asked the council not to approve the planning
commission recommendations that were painstakingly made during a five hour
public hearing in September.
Those recommendations were based on input from the community and planning
staff during public workshops and after a city survey of 266 respondents, showing
44% opposed digitals; 41 % in favor; and about 15% uncertain.

Schieve and Delgado said their draft is meant to allow business to keep existing
digital signs and to allow others to get new ones, while protecting aesthetics. But
the sparse "protections" do little to minimize the negative impacts of digital signs.
The requests that make up the new draft include:
•
No changes in location. Digital signs will continue to be allowed
everywhere within the city limits they are now, including the main
thoroughfares like South Virginia, North Virginia, Fourth street, Mill Street,
and the commercial parts of Plumb Lane and Kietzke Lane and in Midtown.
•
No changes on what's displayed. Video, flashing, scrolling, and
all animation will continue to be allowed, day and night, 24/7.
•
No public hearings for most digital signs, which oftentimes
impact private property for miles. Only those proposed within 300 feet of a
residentially zoned parcel must get a special use permit which requires a
public hearing first.
•
Abnormally high brightness levels at night; if approved the
brightness levels are about five times brighter than what the sign industry
requested and 15 times brighter than Scenic Nevada's recommendation.
•
No immediate relief from overly bright signs. Owners of existing
digital signs that exceed even this liberal standard have two years to
comply, which means no brightness changes required for the Wild Orchid
sign and those for auto dealerships and casinos until December 2017.
•
No substantial protections for Reno's scenic vistas. Like the
planning commission's draft, the new council draft prohibits flashing
animated signs within 300 feet of certain major highways, like Mount Rose
Highway and a portion of Interstate 580, south of McCarran Boulevard.
Large animated signs can easily escape this restriction, flashing changing
images towards drivers day and night and blocking scenic views. For
example, The Summit Sierra Mall digital sign would have been 350 feet
from 1-580, if it had been approved. Over 400 people signed Scenic
Nevada's petition opposing that sign and the city council unanimously
denied the request.
No Time For Public Scrutiny
The council approved moving the new regulations forward in a 6 to 1 vote, with
Councilwoman Jenny Brekhus opposed. She said the new proposed rules affected
her ward the most and may not be in compliance with the city's Master Plan,
which says signs should match the architectural style and design of buildings. In
Midtown, where the architecture is primarily mid-20th century brick buildings,
digital signs wouldn't match.
She and Councilwoman Naomi Duerr suggested the council get more feedback
from the planning commission or from the community in public workshops. But
the council voted to bring the new draft back for a "first reading" Wednesday. The
final vote could take place two weeks later on December 2.
With the exception of casinos, Scenic Nevada requested that digital signs be
prohibited. But, if the city continues to allow them, we had asked for far more
restrictions to limit the honky-tonk and circus-like appearance from taking over
commercial areas outside of downtown.
Many in the community have objected to various digital signs, which are allowed

under current codes and have been multiplying in the past few years. Digital signs
are far more intrusive and a nuisance that could lower nearby property values.
The Reno City Council in January agreed to a moratorium, which temporarily halts
permits, and gave us hope that new regulations would be developed to protect
driver safety, property values and scenic views. The moratorium expires at the
end of this month.
SouthTowne Sign
In a separate public hearing also on November 4, the city council in a 5-2 vote
denied the SouthTowne shopping center request for a 61-foot-tall sign that would
be 628 square feet; almost as big as a roadside billboard. It was proposed along
Interstate 580 in south Reno. Mayor Schieve and Councilwoman Naoma Jardon
voted to allow the sign.
The shopping center was asking for a variance and a special use permit to build a
giant sign near the Damonte Ranch Parkway exit. The center requested almost
double the allowed height and more than double the size, so the sign could be
viewed from an elevated section of Interstate 580.
Both city staff and the city's planning commission recommended denial of the
variance in June and SouthTowne appealed that decision. The city council upheld
denial of the permits largely because the sign was incompatible with the
surrounding area and there were no hardships, which are required to grant the
variance permit.

These billboards may bring some businesses additional patronage, but they detract from the vision and desire

in Silicon Valley , San Francisco, Seattle and other cities that endeavor to draw young adults to their cities in
search of education and job opportunities.
As an aside, I was very supportive of our mayor, Hillary Schieve, until I became aware of her vote on these
billboard issues. It appears to me that she is caving to the big businesses that want to advertise in a big way.
I am very disappointed in her decision to change the current rules and restrictions and will probably not

sentiment and pose a basic question to the authors: why? Why ignore the efforts of the planning
commission members, the input from the public already garnered and the plain fact that digital billboards are
ugly, garish, intrusive pollution that destroy the scenic beauty of our region? Their eye catching flashes can

Thank you Council member Jenny Brekhus for your usual steady support of your constituents and of the
region in general. Thank you too Naomi Duerr, for wanting more input from the public before taking further
action, but it seems to be that the public has already spoken. Please do not pursue a process which is quite
the opposite of the open and transparent government you claim to endorse.

Reimagine Reno indeed. The digital sign code was recently hijacked by the majority of the Reno City Council.
The code that was carefully constructed, vetted and approved through working groups and the Reno Planning
Commission was deliberately gutted and rewritten to remove most protections for the community. The actual
Reno City Council meeting was theater, not a hearing. The code, as it stands now, fully reverses the intent of
the draft code painstakingly constructed by staff and the Reno Planning Commission exposing an ethical
breakdown in process and the hype surrounding this council.
I bought into this council's self-billing as a new hope for our city whose reputation needs "reimagining". I was
relieved and proud that this council offered us new opportunities to cultivate broader perspectives where better
processes will allow all citizens to provide input into a community that can grow beyond the limitations we've
tolerated under decades of back door politics. From the outside, it seemed Reno finally had a shot to become
a great place competitive with cities all over America that are also reinventing themselves and growing their
economy because they celebrate their natural assets and unique sense of place. Many have banned digital
signs or restricted them to meet their master plans. The technology exists to make digital signs functionally
integrate within a community without destroying the character of each place.
But, the digital sign code is a telling marker for Reno's real commitment to becoming a destination community
that is safe, aesthetically pleasing and desirable - essential criteria for becoming a great place.

Like addicts who showboat about "quitting" to misdirect folks from seeing the extent of their habit, the Reno
City Council's "reimagine" gestures , fighting blight photo ops, and this digital sign code sadly only set us up
for another crushing disappointment. Behind the scenes, Reno is still hooked on it's "six pack a day,
good al boy" habit.
Unbelievably, the architects of our community's hot mess of video blight and traffic safety hazards including
Kietzke's dealer row, garish video casino signs, and GSR blinding the entire community for miles, are the
same folks reimagining Reno's future in their own image. The "good al boy" habit emphasizes "me" profits
over "we" benefits and this translates to MORE, BIGGER, BRIGHTER digital signage. Kietzke is a blighted
digital sign war zone now and this is the model sign companies and businesses embrace? More to come.
And just like an addict, against all reason, empirical data, traffic safety standards, best practices in other
communities, advice from both industry and unbiased experts, working group input, peer-reviewed brightness
studies, the recommendations from the Reno Planning Commission, polls, studies for driving safety for
different age groups, legal precedence, community input, transparent public process, and common sense, The
Reno City Council recklessly, codifies this dangerous nonsense to feed their habit.
The upshot, a code that doesn't prevent blight, but encourages an aggressive form of it to proliferate. Think
advertising, think wild west, think Wild Orchid's sign spawing around town in different sizes only three times
brighter than the GSR's 100 foot wall sign. But there's more, public facilities are fair game - parks, fire and
police stations, schools, small businesses, commercial centers abutting neighborhoods. 24/7 video,
scientifically proven at 1500 nits to be dangerously bright to create glare for drivers at night, inappropriate
placement, it's a dream come true for casinos and car dealers - Reno's defacto community planners.

This isn't a sign code, it's complete denial. Kudos to the Reno Planning Commission for genuinely trying to
write a fair, balanced code. Without due diligence, The Reno City Council has capitulated to old school
"business as usual" at expense to public safety , master urban planning by experts (not businesses looking
out for their wallets), and a reimagined Reno. Reno's revitalization isn't and won't happen until the bad habits
and limited thinking that stranded us here are acknowledged.

According to the RGJ headline on November 15th, "Nevada gets an "F" in State Integrity" because of an
"anything goes" mentality; we're 46th of 50 states. The blatant manner in which the Planning Commission's
good work was twisted 180 degrees to remove protections for the community, left me, like the article stated,
" ... dismayed, but not necessarily surprised." It's a sad Nevada legacy that robs us of our better selves and
best potential that I hoped this council had evolved beyond.
I know your jobs are incredibly hard, but please reconsider this code in light of public safety, unbiased
experts, science, and defensible public process and not "the good ol boy" habit. It's not a good look for Reno
and, like tattoos, not easily ignored nor removed .

the Mayor to clean up. Now business want more crap blocking the views. Enough is enough stop the spread
