General Terms and Conditions

In case of doubt, advertising orders are to be processed within one year of
conclusion of the contract. All insertion orders placed are only binding when
confirmed in writing by the publisher. Order cancellations are to be made at the
latest by the advertising deadline of the issue for which the advertisement is
scheduled, see current publication schedule.
The discounts stated in the advertisement price list are only granted for
advertisements placed in a publication by an advertiser within one year. The
term commences on publication of the first advertisement.
The advertiser is retrospectively entitled to the corresponding discount on
adverts actually placed within the period of a year if, at the beginning of this
term, he placed an order which would have entitled him to a discount from the
start in accordance with the price list.
If an order is not fulfilled for reasons for which the publisher is not responsible,
irrespective of any further legal obligations, the customer is to refund to the
publisher the difference between the discount granted and the discount applying
to the advertisements actually placed. This adjustment charge for the discount is
not due if the publisher was unable to complete the order due to circumstances
beyond his control, and an agreement on a suitable subsequent term is not
reached.
Advertisements which, due to their editorial style, are not recognisable as
advertisements are clearly labelled as such by the publisher.
The publisher reserves the right to reject orders for advertisements and loose
inserts (including individual placements within an order) due to their content,
origin or technical form, in accordance with the publisher’s uniform principles.
Loose insert orders are only binding for the publisher once a sample insert has
been submitted and approved. Loose inserts which, due to their format or
design, give the reader the impression that they are part of the newspaper or
journal, or which include third-party advertising, are not accepted. The customer
is informed of the rejection of an order without delay.
In case of fully or partially unreadable, incorrect or incomplete publication of the
advertisement, the customer is entitled to reduced payment or a replacement
advertisement, but only to the extent that the purpose of the advertisement was
impaired. Any further liability of the publisher is excluded. Lacking or incorrectly
printed checking data do not result in any entitlement for the customer, unless
agreed otherwise. The publisher assumes no liability for advertisements,
alterations or cancellations made by telephone or fax. Claims are to be asserted
within 14 days of receipt of the invoice and documents.
Proofs are only supplied if expressly requested. The customer bears
responsibility for the correctness of the proofs returned. If the customer fails to
return the punctually provided proof within the term specified by the publisher,
the print approval is deemed granted. The customer is liable for ensuring that the

content of his advertisement does not violate statutory provisions or any other
regulations.
If no special size is specified, the price calculation is based on the actual print
height.
If the customer does not make payment in advance, the invoice and documents
are sent directly after publication of the advertisement. The invoice is to be paid
within the term shown on the price list calculated from receipt of the invoice,
provided a shorter payment term or advance payment has not been agreed in
individual cases. Any discounts for early payment are granted in accordance with
the price list.
If payment is delayed or deferred, interest is charged at 1 percent above the
current discount rate of the Deutsche Bundesbank along with the collection
costs. In case of default, the publisher may defer further performance of the
current order until payment is received, and demand advance payment of the
remaining advertisements. In case of bankruptcy and court-imposed settlement,
all discounts cease to apply.
On request, the publisher supplies a clipping of the advertisement along with the
invoice. If justified by the nature and scope of the advertising order, up to two
header copies or complete copy numbers are supplied. If a document can no
longer be procured, this is replaced by a legally binding confirmation of inclusion
from the publisher.
Costs for significant alterations to originally agreed designs, and lithos and
drawings ordered for delivery are to be paid by the customer.
For box-number advertisements, the publisher makes available his equipment
for receiving, storing and promptly passing on incoming offers. No liability is
accepted for the safekeeping and punctual forwarding of letters of offer.
Registered letters and express letters in reply to box-number advertisements can
only be sent on by standard post. Claims for damages due to loss, misdirection
or delay in passing on these forwarded letters are excluded. – In the interest,
and for the protection of the customer, the publisher reserves the right to open
and inspect offers in order to prevent abuse of the box-number service. The
publisher is not obliged to redirect or return offers of mediation or letters which
are not related to the purpose of the advertisement or which could endanger the
box security.
If a publication is discontinued or interrupted, the customer is not entitled to
make any claims whatsoever in any form for expenses for text, graphics,
production of copy material, etc. which thus become redundant.
Acts of God, breakdowns, etc. release the publisher from the obligations
entered.
The place of performance is Hennef and the exclusive place of jurisdiction – also
for dunning purposes – is Bonn.

In case of alteration of the advertising rates, the new conditions become
effective immediately, also for open orders, unless agreed otherwise in writing.
The current rate is shown in the imprint of the journal.
No guarantee is provided for the inclusion of advertisements in specific
numbers, specific issues or in specific positions within the publication unless the
customer has made the validity of the contract expressly dependent on this.
Special position agreements are only binding if the special position surcharge
specified in the advertising rate and expressly stated in the confirmation is
recognised.
It is only possible to withdraw from reserved specific pages at the latest 4 weeks
prior to the advertising deadline stated in the publication schedule of the
respective issue.
The customer is responsible for the timely delivery of the advertisement text and
error-free copy material or the loose inserts. The publisher demands immediate
replacement of recognisably unsuitable or damaged copy material.
If any deficiencies in the copy material are not immediately apparent, but
become clear during the printing process, the advertiser has no entitlements in
case of inadequate printing. The same applies in case of defective repeat
advertisements if the advertiser fails to notify us of the error prior to printing of
the next advertisement.
Lithos are only sent back to the customer if this is specially requested. The duty
to keep lithos ends six months after completion of the order, unless expressly
agreed otherwise.
The publisher is entitled to process the data stored on the business partner with
regard to the business relations or in connection with these within the meaning
of the Federal Data Protection Act, whether this data is received from the
business partner himself or from third parties.
In case of advertisements placed online, no liability is accepted for the content or
the availability of any additional links.
