10. DATA PROTECTION
The customer agrees that the data provided in the context of the order and its processing may be collected, processed, stored and used for the purposes of LA RIC’s
book-keeping and for internal market-research and marketing purposes. The files will be used by LA RIC in order to comply with legal requirements, for the processing of
payment transaction and for publicity purposes. The agents of LA RIC are obliged to comply with data protection laws.
11. APPLICABLE LAW, PLACE OF PERFORMANCE AND PLACE OF JuRISDICTION
Austrian substantive law, with the exclusion of the uN Sales Convention, is to be applied exclusively to the legal relationships with the customer. The place of payment for
all obligations arising from this contract is the company’s Head Office. The place of jurisdiction for all disputes arising directly or indirectly from the contract is agreed to be
the Austrian court competent for the subject matter and for the region of A-1010 Vienna. If the customer is a consumer as defined in the Consumer Protection Act (KSchG),
this place of jurisdiction is only deemed to be agreed if the customer’s place of residence, usual residence or place or work is in this court’s district or if the customer lives
outside Austria. LA RIC is also entitled to bring an action against the customer in his general place of jurisdiction.
12. RIGHT OF WITHDRAWAL IN ACCORDANCE WITH § 5 E OF THE CONSUMER PROTECTION ACT (KSCHG)
The customer, who is a consumer as defined in the Consumer Protection Act (KSchG), may withdraw from a distance selling contract or a contractual declaration given in
the course of distance selling up to the expiry of the periods set out below. It is sufficient if the declaration of withdrawal is despatched within the period allowed. The time
limit is 7 working days and Saturday does not count as a working day. In the case of contracts involving the delivery of goods, the time limit begins on the day of the delivery
of the goods to the customer; in the case of contracts for the performance of services, the time period begins on the day of the conclusion of the contract. If LA RIC fails
to comply with its duty to furnish information in accordance with § 5 d, Paragraphs 1 and 2 of the Consumer Protection Act (KSchG), the time limit for withdrawal from the
contract is 3 months from the points in time set out in the previous sentence. If LA RIC complies with its duty to furnish information within this time period, the time period
for exercising the right of withdrawal from the contract set out in the earlier sentence begins at the point in time at which the information is furnished.
