Running the Highwood Road Community site and the Village Hall
Brockenhurst Village Trust is a charitable company bound by the rules of Companies House and the
Charity Commissioners. It is responsible for the management of the Highwood Road site, comprising
the Parish Council Office, Highwood Nursery and the Village Hall and has a duty to manage the site for
the educational, recreational and social benefit of the Brockenhurst community.
The Trustees or Directors are representative of the community they serve. Six directors are elected
at the Annual Parish Meeting ( held on the fourth Tuesday in April) and serve a three-year term, two
directors are elected by the hall user groups and a further two directors are appointed annually by
Brockenhurst Parish Council. The Trust reports to the village at the annual meeting where members of
the public are invited to ask questions.

THE HIGHWOOD SITE
This site was acquired from Hampshire County Council in 2000. Close to the primary
school, doctor’s surgery, village centre, railway station and bus routes and with a
large free car park for users, it is in an ideal location to offer facilities for all ages,
from pre-school groups to the elderly and infirm.
THE VILLAGE HALL
The village hall was built in the early 1980’s, has recently been upgraded and now
offers one of the best-equipped venues in the New Forest. It is well-used by regular
groups and societies and is available for general hire for seminars, meetings,
wedding receptions, dances, stage shows, sales and exhibitions. All the facilities are
accessible for disabled people, with a lift to the first floor and the hire fees are very
competitive.
ACCOMMODATION
FOREST HALL is a large multi-purpose hall for sports, dances, entertainments,
Moviola cinema, public meetings and receptions. It seats 196 people (approx. 120
for dining), has a modern stage with a piano and kitchen/servery attached.
EXHIBITION ROOM seats 100 people and is suitable for exhibitions, talks,
seminars and ‘away days’. It has a kitchenette.
CRAFT ROOM seats 100 people. It has easy access to the main kitchen and is used
for craft displays or as a rehearsal area for productions.
OAK ROOM seats 60 people and has access to a kitchenette.
Fundraisers, sponsors and anyone able to help in arranging events or providing
practical or promotional skills and experience are always welcome.

Riparian Ownership - Frequently Asked Questions
Who is responsible for the ditch at the bottom of my garden?
If your ditch borders your property in any way, then you are responsible for maintaining it. If you have
a fence between your garden and the ditch, the ditch is still your responsibility. The responsibility lies
50:50 between you and the landowner on the other side of the ditch. However, if the ditch borders
the Crown Land the ditch is your responsibility. Please contact the Forestry Commission Keeper.
What if the ditch is between my property and a public area, e.g. a park?
If a ditch borders your property in any way, then you have riparian ownership of the half that
borders your property. If the land on the other side of the ditch is council-owned, then you share the
responsibility 50:50 with the council. This ownership split applies even if there is a fence between
your property and the ditch and it appears as though the ditch is within the park boundaries.
I have never heard of riparian rights or ownership,
when did this come into force?
The land drainage byelaws were made under section 34 of the Land Drainage Act 1976. They
are enforced by the Environment Agency by provision of the Water Resources Act 1991 and
the Environment Act 1995. A copy of the byelaws and a guide to riparian ownership can be
obtained by contacting the Environment Agency or your Local Council Environment Services.
If I have riparian ownership of the ditch at the bottom of my garden,
am I allowed to extend my property and build on it?
If you wish to extend your property over the ditch, you must first obtain permission from the
Environment Agency. If you build on the ditch without permission, you may be interfering with
the natural flow of the watercourse. The Agency has the right to enforce the removal of any
obstruction to flow.
If someone is dumping rubbish in the ditch, what should I do?
Contact the Environment Agency on 08708 506 506 for guidance.
How important is the ditch – I’ve never seen water in it?
Even if the ditch no longer appears to be wet, the responsibility to ensure it is kept clear of
debris and other obstructions still applies. The ditch may form a vital part in clearing street or
land runoff, especially in times of localised flooding.

NEW FOREST MATTERS
The New Forest’s Crown lands comprise essentially two parts. The timber-growing enclosures
are operated by the Forest Commission, while the un-enclosed, or “open forest”, of heath,
lawn and ancient woodland, is historically the domain of the New Forest Commoners, with
ancient “Forest Rights”. These rights are enshrined in Forest Law and are administered and
enforced by the Verderers Court. In the Forest property is enclosed, not the pasture. Animals
have the right of way on highway and the owner has the responsibility to fence animals out
of his property. Encroachment onto, and damage of, pasture is taken very seriously. Dogs
must be kept under control at all times.

low income to remain independent in their own homes. Help with
repairs, funding, adaptations, improvements or help in finding a

those on low incomes. Minor repairs or adaptations in homes at a
reasonable cost.

Transport Services
Minibuses for hire to voluntary and community groups

Call and Go – a flexible minibus service for older people and people
with disabilities to set destinations (Tel. 0845 6024326).
Wheels to Work – a moped loan scheme for young people who
