The technical data in the scope of work/specification attached to this solicitation have been designated as
International Traffic in Arms Regulations (ITAR) controlled (22 C.F.R. 120 through 130) per Category XVI of the
United States Munitions List (22 C.F.R. 121).
I certify that I am a U.S. person [see 22 C.F.R. 120.15, 8 U.S.C. 1101(a)(20), and 8 U.S.C. 1324b(a)(3)]
and that I have read, understood, and shall comply with all United States export control laws and
regulations, including ITAR, 22 C.F.R. 120 through 130, regarding protection of information in conjunction
with the subject procurement. Only U.S. persons may access the information contained in this solicitation
unless (1) special CNS security permission is obtained, AND (2) the ITAR requirements have been met.
Only U.S. persons may be given access to, or be allowed to perform work under, any resulting subcontract
to this solicitation unless (1) special CNS security permission is obtained, AND (2) the ITAR requirements
have been met. To determine that your company is in compliance with this requirement, CNS security
requires that your company maintain documented evidence for each of your current employees and your
subcontractors’ employees for work on this procurement. Copies of these documents attesting that they
are true, accurate, and complete copies are acceptable. You must be able to provide verification evidence
upon request.
Acceptable evidence is as follows:
• Birth Certificate
• Certificates of Naturalization (INS Form N-550 or N-570)
• Certificate of United States Citizenship issued by immigration and naturalization (INS Form N- 560 or N-561)
• Report of birth abroad of a citizen of the United States (Form FS-240)
• United States Passport
I understand that any resulting subcontract (1) shall be contingent on compliance with 22 C.F.R. 120 through 130,
(2) shall require registration with the United States Department of State as a Category XVI corporation, and (3) shall
require that a Technology Control Plan be in effect to ensure that no foreign person accesses information pertaining
to this procurement. I have read, understood, and shall comply with the requirements imposed by the subcontract
clause titled, “Export Control,” in the terms and conditions attached to this solicitation.
