Official Contest Rules (“Contest Rules”)
1. How to Enter: No purchase necessary. There are three ways to enter the Contest: (i) Every time you purchase twenty dollars CDN ($20) or more (before taxes) of Lindt chocolate at a participating Sears location while using your Sears Card or Sears® MasterCard® between March 1, 2011 and April 10, 2011 (the “Contest Period”), you will automatically receive one (1) entry into the Contest. (ii) You can also enter the Contest an unlimited number of times during the Contest Period by sending in a different envelope bearing sufficient postage for each entry, a hand‐
written 50 word composition explaining why Lindt Chocolate is your favourite chocolate. Each hand‐written entry must be unique and original (no photocopies) and must contain your full name, mailing address, telephone number, and signature. All hand‐written entries must be mailed to: Lindt & Sears Stars on Ice Contest. Marketing Department 895a. 290 Yonge Street, Suite 700. Toronto Ontario M5B 2C3. Entries must be postmarked by no later than April 10, 2011 and received by no later than April 15, 2011. (iii) You can also enter the Contest an unlimited number of times by filling out a Stars on Ice ballot found at www.sears.ca. Entries must be postmarked by no later than April 10, 2011 and received by no later than April 15, 2011. 2. Eligibility: Contest is open to legal residents of Canada (except Quebec) who: (i) have reached the age of majority in their province or territory of residence at the time of entry; and (ii) are currently Sears Cardholders in good standing. Employees, representatives and agents of the Contest Sponsors (Lindt & Sprungli Canada, Sears Canada Inc.), their partners, affiliates, subsidiaries, marketing and advertising agencies, suppliers, printers, and distributors, the independent contest judging organization and all persons with whom any of the above are domiciled, are not eligible to participate in this Contest. 3. Prizes Grand Prizes: There is one (1) Grand Prize package available to be won in each of the following regions (each a “Region”): East (includes the provinces of NS, NB, NF and PEI); Central (includes the province of ON); and West (includes the provinces of BC, AB, SK, and MB and the territories of NWT, YK and NU). Each Grand Prize package has an approximate total value of three thousand and three hundred dollars CDN ($3,300, based on Halifax departure). Each Grand Prize package consists of the following: return economy air‐fare for the winner and one (1) guest from the major commercial airport in Canada closest to the winner’s place of residence to Vancouver International Airport; two nights of standard hotel accommodation and $500 CDN spending money Two (2) tickets to STARS ON ICE ‐ location: Vancouver, British Columbia on May 13, 2011. All costs not specifically stated as being part of the Grand Prize package including but not limited to; transportation to and from airports, and ground transportation generally, pre‐and post‐night accommodation, travel documents, upgrades, hotel telephone, fax and e‐mail charges, room service charges, all tips, activities not stated as included, meals, beverages, gratuities, taxes, insurance and items of a personal nature, will be the sole responsibility of the winner and his/her guest. The winner and his/her guest must travel together on the same itinerary and are responsible for ensuring that they have any and all required travel identification and/or documentation and that such identification and/or documentation is valid prior to and for the entire duration of the trip. The winner’s guest, or his/her parent or legal guardian if the guest is under the age of majority, will be required to sign a release form or other documentation in order to be able to participate in the Grand Prize package. The winner will then be instructed how to claim their prize. Secondary Prizes: There are a total of twenty (20) Secondary Prizes available to be won throughout the Contest Period. Each Secondary Prize consists of one (1) Lindt Chocolate basket worth one hundred dollars CDN ($100). Contents of Lindt Chocolate basket will be determined by the Contest Sponsor in its sole discretion. All prizes must be accepted as awarded, are not transferrable and, unless agreed to by the Contest Sponsors, are not redeemable for cash. The Contest Sponsors reserve the right, in their sole discretion, to substitute a prize or any portion thereof for another prize of equal or greater value, or its monetary equivalent. Prize Draws: A random draw will be held on April 19, 2011 in Toronto at approximately 3:00pm (the “Draw Date”) to select the entrants to be eligible for the prizes. The Secondary Prizes will be selected first, followed by the Grand Prizes. Entrants selected to be eligible for a Secondary Prize will still be eligible for a Grand Prize. Secondary Prizes Draw: On the Draw Date, twenty (20) entries will be randomly selected from all eligible entries received during the Contest Period to be eligible for a Secondary Prize. The odds of winning a Secondary Prize depend on the total number of eligible entries received during the Contest Period. Grand Prizes Draw: On the Draw Date, one entry from each Region will be randomly selected from among all eligible entries received in that Region during the Contest Period to be eligible for the Grand Prize available in that Region. The odds of winning a Grand Prize depend on the total number of eligible entries received during the Contest Period in the Region of the entrant. The Contest Sponsor or its designated representative will make three (3) attempts to contact selected entrants by telephone within seven (7) business days of the draw. If a selected entrant cannot be contacted within three (3) attempts or seven (7) business days of the draw (whichever occurs first), or if there is a return of any notification as undeliverable, then that selected entrant will be disqualified and the Contest Sponsor reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible entries. Before being declared a winner, each selected entrant must: (i) first correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing question to be provided through the Contest Sponsor's Declaration and Release Form; and (ii) sign and return the Contest Sponsor’s Declaration and Release Form (the “Release Form”) within ten (10) business days. The Sponsor’s Declaration and Release Form; (a) confirms selected entrant’s compliance with these Contest Rules and acceptance of the prize as awarded without substitution, (b) releases the Contest Sponsors, their affiliated and related companies, advertising and promotional agencies, the independent contest judging organization and each of their respective shareholders, directors, officers, employees, agents, dealers, representatives, successors and assigns (collectively, the “Releasees”) from any liability in connection with this Contest, the selected entrant’s participation therein and/or the awarding and use/misuse of a prize or any portion thereof, and (c) obtains selected entrant’s consent to the publication, reproduction and/or other use of his/her name, address, voice, comments, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Contest Sponsors in any manner whatsoever, including print, broadcast or the Internet. If a selected entrant: (i) declines or is unable to accept the prize for any reason; (ii) fails to correctly answer the mathematical skill‐testing question; (iii) fails to return the properly executed Release Form within ten (10) business days; or (iv) does not otherwise comply with the Contest Rules, then that selected entrant will be disqualified (and forfeit the prize) and the Contest Sponsor reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible entries. 4. General: All entries become the property of the Contest Sponsor, which assumes no responsibility for late, lost, delayed, incomplete, damaged or misdirected entries. The Contest Sponsor will not be under any obligation to provide entrants, at any time, with the number of entries he/she has/had into the Contest. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Contest Sponsor are final and binding on all entrants with respect to all aspects of this Contest without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries or entrants. By entering this Contest, the entrant agrees to release and hold the Contest Sponsors, their affiliates, subsidiaries, and agencies and their respective directors, officers, employees and assigns, harmless from and against any and all claims and liability, including without limitation, any loss, harm, damage, injury, cost or expense, personal injury and/or death, arising out of or in any way connected with the operation of this Contest or use of a prize, and for any claims based on publicity rights, defamation or invasion of privacy. The Releasees will not be liable for: any technical malfunction or other problems relating to the telephone network or lines, computer on‐line systems, servers, access providers, computer equipment or software; the failure of any entry to be received by the Contest Sponsor for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website; or any combination of the above. Contest Sponsor reserves the right, at its sole discretion, to disqualify any individual (and all of his or her entries) who tampers with the entry process. The Contest Sponsor reserves the right to amend, withdraw, suspend or terminate this Contest at any time without prior notice or obligation for any reason including (but not limited to) should a virus, bug or any other cause beyond the reasonable control of the Contest Sponsor corrupt the security or proper administration of the Contest, or the odds of winning or in the event of any accident, printing, administrative, or other error or any kind. Any attempt to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. Entries are subject to verification and will be declared invalid if they are forged, falsified, altered or tampered with in any way. 5. Privacy Statement: Any personal information collected will be used to administer this Contest (including contacting entrants selected to win a prize) and as otherwise set out in these Contest Rules or permitted or required by law. By accepting a prize, winners agree to the use of their name, age, city of residence, comments, photo(s) and/or image(s) on videotape for advertising or publicity purposes without compensation.
