Role Purpose:

Reporting to and working with the Director of Legal, Enforcement and Policy the Head of Enforcement is responsible for the
successful strategic leadership, management and conduct of the Financial Services Commission’s (“FSC”) Enforcement Function.

Responsible for working collaboratively with the other FSC regulatory functions to deliver risk-based regulation.
Accountabilities:











Lead the development and effective delivery of the enforcement strategic/operational plan in a changing market environment.
Provide direction and oversight for the most effective and efficient utilisation of enforcement resource, delivering the FSC’s credible deterrence strategy,
working closely with the other regulatory functions and external legal support as appropriate.
Monitor the effectiveness and quality of the Enforcement team’s engagement, selection and assessment of cases, decision making and timeliness.
Ensure adequate preparation and planning for enforcement workloads, new enforcement strategies, changes in regulatory policies and case selection.
Undertake thorough and detailed preparation and conduct of all cases pursued.
Responsible for ensuring that the FSC’s enforcement decision making is based on sound information, in accordance with agreed criteria and processes,
correctly documented and able to withstand legal challenge, wherever possible.
Provide clear and timely communications to firms/individuals on the requisite information being sought and updates on progress.
An effective and efficient use of any necessary external legal resource, including excellent cost control and clear justification for not using internal
resource.
Work closely with the other regulatory functions (particularly supervision and authorisation) to provide the requisite high quality advice and support in
complex applications/risk mitigation action plans to ensure that new and existing firms and individuals can be appropriately regulated.
Proactively build strong relationships, with a diverse set of stakeholders, including firms, representative bodies, local enforcement bodies, consumers, the
Government of Gibraltar, other UK, EU and international regulators. Seen as a respected, authoritative voice of the FSC.
Provide strong leadership and effective communication in both the enforcement team and across the FSC – seen as a role model in:
 Decision-making – appropriate judgements based on sound evidence and analysis, experience of risks and desired outcomes.
 Driving change and innovation - identifying creative solutions and helping others through change in a positive and constructive way.

Knowledge, Skills & Experience:
Essential










Strong regulatory knowledge and experience and/or strong relevant law practice experience (if only one present, evidence of ability to fully comprehend
the other is required).
A Solicitor or Barrister or other legal professional.
Understanding of the Gibraltar financial services market.
Excellent communicator.
Good level of understanding of the public interest role of a regulator in an international financial services centre.
Excellent leadership skills and experience.
Ability to effectively articulate a vision and strategy of how an enforcement strategy of credible deterrence protects consumers and enhances the
reputation of Gibraltar’s financial services sector.
Demonstrate confidence to lead and conduct difficult negotiations and discourse at the highest levels whilst commanding respect.
Proven ability to build and manage complex stakeholder relationships.
Proven ability to make good decisions which are based upon sound judgements and analysis; are evidence-based and well documented.
Desirable


Understanding and experience of the legal system in Gibraltar, strong familiarity with the legislative framework for financial services and financial services
regulation in Gibraltar.
Experience of the Gibraltar financial services market.
Academic Requirements


Degree level (2:1 or above)
