WHO MUST FILE THIS REPORT?
Active members of the OBA, under the age of 65 on December 31, 2013, who need to:
a) report an exemption for 2013 or
b) report additional credit to complete their 2013 educational requirement.
If OBA/MCLE records indicate that a member has earned the minimum required credit for 2013 by December 31, 2013, that member is not
required to file the 2013 MCLE Annual Report.
SANCTIONS
If a member has not completed 12 hours of CLE credit, including 1 legal ethics hour by December 31, 2013 there shall be added an expense
charge of $100 which cannot be waived by the MCLE Commission.
REGARDLESS OF WHETHER OR NOT EXEMPT FROM THE EDUCATIONAL REQUIREMENTS, if a member has not filed a compliance report
by February 15, 2014, there shall be added an expense charge of $100.
The Rules of the Supreme Court of Oklahoma for Mandatory Continuing Legal Education provide for suspension from the practice of law for
active members who fail to comply with the requirements of the Rules for 2013, REGARDLESS OF WHETHER OR NOT EXEMPT FROM THE
EDUCATIONAL REQUIREMENTS.
If a member is suspended from OBA membership for noncompliance with the Rules, there is a reinstatement fee of $500.00 and an expense
charge of up to $200.00, REGARDLESS OF WHETHER OR NOT EXEMPT FROM THE EDUCATIONAL REQUIREMENTS.
INDIVIDUALS SUBJECT TO THE EDUCATIONAL REQUIREMENTS
Except for those members specifically exempted from the educational requirement, each active member of the OBA is required to complete
12 hours of approved CLE credit. Of the 12 hours required, the attorney must attend one hour of approved legal ethics credit. Such attendance
in 2013 is to be reported on this form.
Credit hours, not to exceed 12 hours, may be carried forward from 2012 and applied to the educational requirement for 2013 if they were
reported on the 2012 compliance report.
INDIVIDUALS EXEMPT FROM THE EDUCATIONAL REQUIREMENTS
Members should claim an exemption only if it is clearly granted under Rule 2 of the Rules for Mandatory Continuing Legal Education.
If you are exempt, check the appropriate box, sign the form and return it to the MCLE Commission. YOU MUST FILE THE FORM EVEN
THOUGH EXEMPT FROM THE EDUCATIONAL REQUIREMENTS.
2013 credits, not to exceed 12 hours, earned by exempt members, but not needed, may be carried forward for use in 2014 if they are reported
on this form.
NOT EXEMPT
The following members who are residents of Oklahoma are NOT exempt: Assistant Attorneys General, District Attorneys, Assistant District
Attorneys, Law Clerks for State and Federal Judges, State and Federal Public Defenders, Assistant Public Defenders, Staff Attorneys for State
and Federal Agencies.
DEFINITION OF THE PRACTICE OF LAW
The "practice of law" is the rendition of services requiring the knowledge and the application of legal principles and techniques to serve the
interests of another with his consent. Edwards v. Hert, 504 P.2d 407 (Okla. 1972).
