ORDER UNDER SECTION 144 OF CRIMINAL PROCEDURE CODE.
Whereas the holding of public meeting, Dharna, Rally, use of Loud
Speaker, slogan shouting etc, in the Fort Area/ Secretariat and Collectorate,
Moti Daman causes inconvenience to the general public and adversely
affects the smooth flow of vehicular traffic as well as interrupts the smooth
working of the Secretariat, Fort Area and Collectorate, Moti Daman. It also
endangers law and order situation for the sensitive offices of Fort Areal
Secretariat and Collectorate, Moti Daman.
Therefore, in exercise of the powers under section 144 of code of
Criminal Procedure 1973, (No.2 of 1974) I, Mitali Namchoom, District
Magistrate, Daman hereby orders that holding of public meeting, Dharna or
gathering of public for celebrating any function or gathering by any private
associations/ organizations, political parties or groups in the Secretariat
and Collectorate premises and in the 100 Mtrs. in the Secretariat, Fort Area
and Collectorate, Moti Daman is strictly prohibited with a view to avoid any
untoward incident or law and order problem in the future and can be
organized only after taking prior permission of District Magistrate.
This order shall come into force with immediate effect from
07-03-2015 and shall be effective for a period of 60 days up to 05-05-2015
(both days inclusive) unless withdrawn earlier.
Any person contravening this order shall be punishable under
Section 188 of the Indian Penal Code.

ORDER
Whereas
, in view of the Bengaluru ATM incident and the incident of removing
the entire ATM with the help of JCB in Ahmedabad city, it is apprehended that some
anti-social elements may attack/rob the Banks/ATMs situated in the Area of Daman
District and there is every likelihood of breach of peace and disturbance of Public
tranquility and also there is grave danger to human life and safety and injury to public
property on that accounts.
And Whereas
, the Public and Private Sector Banks and their ATM's located in
Daman District are not manned with armed Guards round he clock in violation of RBI
directions for maintain and operating Banks and ATMs.
Now, therefore , I, MITALI NAMCHOOM
, District Magistrate, Daman, in
exercise of the powers conferred upon me by Section 144 of the Code of Criminal
Procedure , 1973 ( No. 2 of 1974
) do hereby order that all Banks stationed at Daman
District should post armed guards round the clock
in all Banks as well as ATM's with
immediate effect.
This order shall come into force and shall be effective for a period of two months
with effect from 10/3/2015 to 08/05/2015 ( both the days inclusive) unless withdraw
earlier,
Any Public or Private Sector Bank contravening this Order shall be punishable
under Section 188 of the Indian Penal code.
