purchase water system. If no buyers are found, he'd l ike help with filing a rate increase with the City of League City
(the system is inside of the city limits). I talked to him about the appeal process with the PUC if the city denies his

10/26/15 - Contacted Dennis O'Keffe and discussed the nature of the assignment. Responding to my
question, he indicated that he has expressed his desires to the City of League City but has not heard back
from them. Explained that I would contact them to discuss the issue and obtain their procedures.
Discussed the records needed to complete the Class B application. E-mailed him a list of the needed
records.
Researched the City of League City website and obtained an e-mail address for the City Manager and
the Deputy City Manager. Sent an e-mail to Mark Rohr, City Manager, and John Baumgartner, Deputy
City Manager. Explained that I am contacting them in reference to H20 Water System's interest in a
Rate Increase Application and Wholesale Water Rates.
Added that I have been asked to contact the City on behalf of the H20 Tech water utility. Explained that
the utility owner is interested in: (1) Purchasing wholesale water from the City and asked what are the
procedures to make arrangements for wholesale service and (2) the owner would also like to increase
their water rates and as an "In City" water utility the City has primacy jurisdiction over the approved
water rates. Asked if there is a formal application for the utility to submit a proposal for a rate increase
that is similar to the process at the PUC? Asked that they please let me know if you have any questions

Received a reply e-mail from John Baumgartner. He thanked me for my note and added: "Currently we
do not have any active wholesale customers. We have initiated a study NewGen Strategies and Solutions
to help us determine appropriate rates for wholesale customers based on the types of demand they put
on the system. We would anticipate that study being completed by the end of the year if all goes well.
Effective November 1 our commercial water rates are $7.13 as a base monthly meter charge (ready
serve fee), with a volumetric charge of $3.00 per 1000 gallon (for the first 3,000 gallons) and $5.90 per
1000 gallons (for greater than 4, 000 gallons).
I will need to do additional research regarding our practices related to rate increases associated with
the City having primacy governing rate review and approval. It has not been a subject that has come
before me or our Council in the last 3 or 4 years. We look forward to working with you and your client
to address these issues. "
10/27/15 - E-mailed John Baumgartner and thanked him for his reply. Explained that I am providing the
commercial rates to the owner of H20 Tech Dennis O'Keffe via inclusion in the CC field of the e-mail
so that he can determine if he is interested in applying for the commercial rates. Added that my
understanding is that it is Mr. O'Keffe's desire to get off the ground water system and that he has about
25 connections.
Explained that the City may want to consider using the existing PUC Class B application as it is already
vetted by the State since the City does not have an existing procedure in place. For his convenience, I
attached both the Class B Application along with the Instructions for his review.
10/30/15 - Telephoned Dennis O'Keffe and discussed the e-mail correspondence. He indicated that he
read all the e-mails and that he has also begun assembling the needed records. He said that my reaching
out to the City officials was very beneficial and that things have begun to move.
11/4/15 - Telephoned Dennis O'Keefe and discussed scheduling an appointment. He indicated that he is
still reviewing the City's application and assembling the needed records. He added that he will need at
least a week to review and will call me when he is ready.

On September 1, 2014, Crazy Horse Ranch Water Company, CCN 11931, was unofficially "transferred" to New
Progress WSC. The proper application to document the sale/transfer/merger and cancellation of CCN 11931 was
never filed. Please help New Progress WSC with completing the proper application to acquire this area. I am also

know why Mr. Gray wants a meeting. She added that he just sent her an email asking her to get some
meeting date options. I explained that the PUC Assistance program allows for one on-site visit per
assignment and that there is no guarantee that any additional assignments will be approved. I also
explained that I the requested records are needed to conduct the study, then I can schedule an
appointment to come on-site to explain the findings. I suggested that if he has some questions that he
wishes to discuss prior to sending the records that we try a telephone call first. She indicated that she
will get back with him and let me know what he decides.
12/7/15 -- Telephoned Brant Gary and discussed the status of the requested records needed to begin the
rate study. He responded that he is still in the process of getting the records together. Discussed the
driver and objectives of the rate study. He indicated that the capital needs, projected water losses, and
water conservations are objectives of the study. He added that he has a meeting scheduled with the City
Manager this week and will email me the requested records after the meeting.

11/04/15 - Telephoned Kimberly Mc Neil and discussed the status of the records. She indicated that she
forwarded the list to Brant Gary but has not received any records from him. She added that she will check
with him and call me back.
11/11/15 - Telephoned Brant Gary and left a message regarding the nature of the assignment and the
needed records.
11/20/15 - Received a voicemail message from Kimberly McNeil. She indicated that she is calling for
Brant Gary to get possible dates and times when we can meet.

11/23/15 - Telephoned Kimberly McNeil. Responding to my question, she indicated that she does not
know why Mr. Gray wants a meeting. She added that he just sent her an email asking her to get some
meeting date options. I explained that the PUC Assistance program allows for one on-site visit per
assignment and that there is no guarantee that any additional assignments will be approved. I also
explained that I the requested records are needed to conduct the study, then I can schedule an appointment
to come on-site to explain the findings. I suggested that if he has some questions that he wishes to discuss
prior to sending the records that we try a telephone call first. She indicated that she will get back with him
and let me know what he decides.
12/7/15 -- Telephoned Brant Gary and discussed the status of the requested records needed to begin the
rate study. He responded that he is still in the process of getting the records together. Discussed the driver
and objectives of the rate study. He indicated that the capital needs, projected water losses, and water
conservations are objectives of the study. He added that he has a meeting scheduled with the City Manager
this week and will email me the requested records after the meeting.
01/04/16 - Received some of the requested records from Brant Gary. Reviewed the records.
01/19/16 - Emailed Brant Gary and asked what are the Dept. codes for the water and wastewater
departments?
0 1/20/16 - Received an email from Kimberly McNeil, Administrative Secretary. She indicated `that these
are the department codes you requested. Please let me know if you need further break down.

0 1/21/16 - Reviewed the records and telephoned Brant Gary. I explained that I needed a conference call
to discuss the records and indicated it is not clear what expenses are for the utilities, as well as the
breakdown of meter inventory and gallons billed is unclear. He indicated that he would arrange the
conference call with the appropriate staff. Scheduled an appointment for 3PM.
Received a call from Shawn Cox, Special Projects Manager, and Kimberly McNeil, Administrative
Secretary. Discussed the budget they provided in detail, line-by-line. They provided additional information
on the budget line items that clarified the specific line items. Shawn Cox emailed me another document
that clarified the consumption data. Discussed the file. Responding to my question regarding the meter
inventory, he indicated that the he is not sure the meter inventory provided is correct and he will need a
couple of days to confirm the data.
01/26/16 - Received an email from Shawn Cox. He wrote: Mr. Givens, I am working on pulling the
information you needed together, and should have it to you after lunch today. I did have a few questions
though:

I telephoned Shawn Cox and discussed his questions and provided him answers. Sent a follow up email
to Shawn Cox confirming our telephone discussion.
01/28/16 - Received an email from Shawn Cox. He wrote: Mr. Givens, I have the answers to a few of
your questions.
Question #1:
Are any of our future CIP projects intended to be funded through the rates? (We should probably have
assumptions to include supporting debt and potential PAYGO.)
Answer: Absolutely we want to consider pay as you go. Our five year forecast for CIP can be
found in the budget book online. Note change in transfer to debt on attached slides based on issuing debt
for all the water stuff. A specific goal would be for us to know the rate impacts for every $100k of PAYGO
CIP projects or debt service.

11/20/15 - Contacted Jeri Cox and discussed the nature of the assignment. She indicated that her husband
Danny Cox is the owner of the water system and that she is assisting. I explained the process of submitting
a rate application and emailed her a list of needed records. She indicated that she will take time over the
Thanksgiving holiday to review the list and gather the records. She added that she will call me back after
the holiday.
11/30/15 - Received an email from Jeri Cox. She indicated she hasn't been able to work on our rate
increase since we spoke. She indicated that they had a TCEQ site and audit inspection set for that week
and that she had been working on gathering records for the inspection. Ms. Cox also stated that "at this
point in time with Christmas fast approaching, I know I won't be ready to schedule an appointment for
your assistance until the new year".
01/14/16 - Emailed Jeri Cox that I am checking to see if she is ready to proceed with completion of the
PUC Rate Application for Copano Heights Water. Received a reply from Jeri Cox. She wrote: "Thanks
for the contact. Yes, I want to proceed and have my 2015 data totals. I plan on inputting the numbers in
the spreadsheet program this weekend, plus do monthly billing statements. Will let you know where I am
in the process after Monday. I have a 3-day weekend and plan on working on the rate increase."

01/15/16 - Downloaded the current rate application and instructions from the PUC website and emailed
the documents to Jeri Cox including the BAA Bond rate, Customer Notice, etc.
01/19/16 - Received an email from Jeri Cox. She wrote: Phillip, Can't say it was a "nice" weekend but it
was productive, although extremely frustrating at times. The spreadsheet links didn't work so I would
manually have to keep track of what and where the numbers need to go, plus some of the fields wouldn't
let me enter numbers because it was protected. I am in the last sections where the taxes are entered. I will
be working on the ending this week. Where do I need to be when you jump in with assistance? I want
this to be over!
Replied to her email: Jeri sorry you had to endure the frustrations. I can provide assistance at any point. I
only need you to have the records and time available. Phillip. She replied, since this is a short week, how
about Monday/Tuesday next week? Unless, if you work weekends, I can be ready this Saturday. If neither
is good for you, it will have to be the next week, Feb 2, 3 or 4. Telephoned Jeri Cox and left a message
about scheduling an appointment.
Received an email from Jeri Cox. She wrote, Phillip, Sorry I missed your call. Feb 3 at 9 am will be great.

1/21/16 - TRWA Representative, Garry Smith telephoned Cypress Garden Mobile Home and spoke to
Mrs. Lynn Raub, owner. I explained the nature of the assistance and assignment. Mrs. Raub indicated that
she has installed all of the residence meters and is ready to proceed with a rate increase. I indicated that it
was important that she have the necessary information to complete the application. I indicated that I would
email a list of needed information which would be helpful with completing the application.
1/21/16 - Emailed electronic rate application, instructions, and a list of things needed to assist in
completing the application. Information required included: customer/meter information, revenue &
expenses, water consumption records, plant and equipment records, debt/loan information, personal
money invested, amount of water pumped and sold, and etc.
1/26/15 -Telephoned Mrs. Raub and confirmed that the information was received. I asked Mrs. Raub to
contact me after the information is gathered and I will schedule an appointment to assist in completing the

January 4, 2016 - TRWA Representative, Refugio Rodriguez contacted Mr. & Mrs. Kiolbassa, owners
of River Oaks Water System. I explained the PUC assistance assignment regarding rates. We discussed
the importance of having good financial recordkeeping system in place that would support their rate
increase. The Kiolbassa's welcomed the assistance and a meeting was set for January 22, 2016.
January 22, 2016 - TRWA Specialist, Refugio Rodriguez traveled to Pipe Creek, TX where the
Kiolbassa's reside. I explained that it is their responsibility is to keep detailed financial records including
revenue and expenses such as electrical, contract labor payments, office supplies, chemicals, types of
repairs to distribution and well, laboratory fees, regulatory fees etc. These are examples of information
that are part of the system's financial documentation.
Mr. Kiolbassa provided me a list of expenses on sheets of paper. I reviewed the information and
discussed with Mr. Kiolbassa. I noted that there was some missing information and would need more
time to look at each item in detail. We discussed the rate spreadsheet and all the information needed to
complete the rate study.
Mr. Kiolbassa indicated that the system consists of 13 meters and at this time the total population is 37.
The system does have a contract operator, Charlene Greenhill, who is keeping the records on pumpage,
chemical and sampling. I inquired why there was no expense item listed for contract labor. Mr.

Kiolbassa said he was under the assumption that he was exempt from many of the requirements and did
not need an operator but a recent TCEQ inspection indicated the need for an operator and Mr. Kiolbassa
had again required the services of Mrs. Greenhill. At this time our meeting concluded.
I am currently working on the spreadsheet and obtaining as much details on the expenses from the
Kiolbassa's. I again emphasized the need to keep accurate records and receipts to support the rate
increase.

2/5/16 - TRWA representative, Garry Smith telephoned Vista Del Rio POA and spoke to Mr. Mike Phillip,
President. I explained the nature of the assistance and assignment. Mr. Phillip indicated that he would like
for me to meet with the board only to gather information regarding the pros and cons of becoming a WSC
and any other options that would benefit the system. He indicated that he is the new President and only
wants information in order to make an informed decision as a board before speaking with the members.
He indicated that this month (February) would not be good for him. I indicated that I would call him next
month to set a date to meet. He indicated that we could meet in the daytime for my convenience.
