Sealed tender is invited from the reputed and experienced Contractors / Sole
proprietor / partnership firm / company for taking up the following works for Kapurdi
Lignite Mining.

Office at Office No. 2 & 3, 7th Floor, Man Upasana Plaza, C-44, Sardar Patel
Marg, C-Scheme, Jaipur–302001 on payment of Rs.100/- only (Non-refundable)
through Demand Draft in favor of Barmer Lignite Mining Company Limited payable at
Jaipur, on any working day from 27-Apr-2015 to 26-May-2015 during office hours
from 9.30 AM to 6.00 PM. Bid documents is also available to prospective bidders on
portal http://blmcl.in/tenders.shtml for viewing and downloading. The bidders
downloading the bid from the portal will be required to deposit a bank draft of
Rs.100/- drawn in favour of Barmer Lignite Mining Company Limited payable at
Jaipur.
The bidders, in their own interest are requested to read very carefully the bid
document before submitting their bid up to the time & date as specified below.
Bids would be submitted at our Jaipur Office, 2 & 3, 7th Floor, Man Upasana Plaza,
C-44, Sardar Patel Marg, C-Scheme, Jaipur-302001. The bids will be received up
to 3.30 PM of 27-May-2015 and opened on same day at 5.00 PM in the Jaipur
Office.
The Earnest Money Deposit should be deposited in the form of Bank draft drawn in
favour of Barmer Lignite Mining Company Limited payable at Jaipur along with
submission of Qualification Bid. Any offer, not accompanied with EMD will be
summarily rejected. Bid should be submitted in two parts i.e. Envelop-I & Envelop-II
duly super-scribed with NIT Nos. Envelop-I shall contain the Qualification Bid
(without price bid) along with other documents as mentioned hereinbelow while
Envelop-II shall contain only the Price Bid. Both envelops shall further be enclosed in
a single Envelop which will be super scribed with name and address of tenderer,
tender number and with date of opening.

Earnest Money Deposit:
The Earnest Money of Rs.10,000/- to be deposited shall not carry any interest and
shall be refunded to those bidders who do not qualify, after opening of price bid. For
the successful Bidder, Earnest Money Deposit, unless otherwise adjusted or
appropriated in accordance with the terms thereof, may be released within 30 days
of completion of work.
Contents and Submission of Bids:
Envelop No. I shall contain the following:

Partnership Deed / Incorporation Certificate as applicable

Service tax Registration certificate
5.
Copy of PAN and latest income tax return.

Certificate of un-conditionality of the Bid (As per Annexure–C on the letter
head of the bidder)
7.
Proof of Experience as per the Bidder’s Qualification criteria mentioned
below. The bidder shall enclose the copies of earlier Work Orders,
Completion Certificates, and Bill Copies etc.
8.
In case of downloading of tender from BLMCL portal, a bank draft of
Rs.100.00 drawn in favour of Barmer Lignite Mining Company Limited
payable at Jaipur.
9.
Tenderer / bidder must self-certify each page of the tender document in
token of its understanding / acceptance.
Envelope II shall contain the Price Bid only. Price bid should be submitted in
the proforma enclosed as Annexure-B.
Bidder’s Qualification Criteria:
(i)
Bidder must be in business of providing manpower services for last 2
years.
(ii)
Must have Manpower Supply as its nature of business (certificate to this
effect if available).

(iii)
Turnover from services shall not be less than Rs.5 Lakhs/year during last
2 years.

Other Instructions to the Bidders:
1.
All document enclosed in Part/Envelope-I must be legible, duly stamped with
their company/ firm seal and signed properly by the person authorized by the
contractor for submission of the bid.
2.
Requirements of the proposed work are given in Annexure–A.
3.
Price Bids will be considered only in the prescribed form.
4.
Bids not submitted in the prescribed format will be summarily rejected. Also,
bidders should refrain from providing the information which is not relevant.
5.
All the communication / correspondence including the bid document
Part/Envelope–I (Technical Bid) & Part/Envelope –II (Price Bid) must be
signed and stamped on each page by the designated authorized
representative of the bidder failing which the bid will be summarily rejected.
6.
BLMCL reserves the complete right to accept or reject all the offers without
assigning any reasons whatsoever.
7.
No further discussion / interaction will be held with the bidders whose bids
have been disqualified / rejected by BLMCL.
8.
In case, any dispute arises with regard to interpretation of any of the terms of
this document, the bids submitted or documents submitted with the bid; the
decision of the Managing Director, BLMCL will be final and binding upon the
bidders.
9.
Interested bidders may obtain further information from Jaipur Office of
BLMCL, on any working day from 27-Apr-2015 to 26-May-2015 between
9.30 AM to 6.00 PM.
10. Bid shall be kept valid for 90 days from the last date of submission of the bid.
Bid with validity for shorter period shall be liable for rejection. The bid shall
be a non-conditional bid and a certificate to the effect for unconditional
validity of the Bid in the form prescribed in Annexure-C shall be signed and
submitted along with the Qualification bid.
11. The bidder shall ensure that bid is furnished / submitted strictly in the
prescribed manner.
12. Part/ Envelope-II, only of such bidders who qualify after opening of
Part/Envelope –I bids shall be opened. Part/ Envelope -II of bidders, who do
not qualify after opening of Part/ Envelope-I, shall not be opened under any
circumstances and will not be returned to the bidder(s).

13. The Price Bid shall be inclusive of all applicable taxes, duties and/or any
other government levy that may be attracted for supply of manpower.

CONTRACT TERMS
Effective Date of Contract:
Time is the essence of the contact and the effective date of contract shall be
the date of placing of the Work/Purchase Order by BLMCL.
Scope of Work:
Providing Services of Manpower as per Annexure-A
Terms of Payment:
No advance shall be paid.
The agency shall raise the bill, in triplicate, along with attendance sheet, duly
verified, in respect of the persons deployed and submit the same to BLMCL in
the first week of the succeeding month. As far as possible the payment will be
released by the second week of the succeeding month. The claims in bills
regarding Employees State Insurance, Provident Fund, and service Tax etc.
should be necessarily accompanied with documentary proof pertaining to the
concerned month’s bill. A requisite portion of the bill / whole of the bill amount
shall be held up till such proof is furnished, at the discretion of BLMCL.
Duties and Taxes:
All prevalent and future taxes, duties & other government levies shall be to the
contractors account.
Liquidated Damages for Delay:
The selected agency shall immediately provide a substitute in the event of any
person leaving the job due any reason. The delay by the Agency in providing a
substitute beyond three working days shall attract liquidated damages @
Rs.200 per day (per such case) on the service providing agency, besides
deduction in payment on pro-rata basis.
Extension of Contract Period:
The contract shall be for two year, unless otherwise specified. However the
purchaser reserves the right to extend the contract period by 1 year beyond the
period specified in the letter of Intent, on the same rates and terms &
conditions, if mutually agreed.

Right to Vary Quantities:
BLMCL reserves the right at the time of award of contract or at any time during
the contract period, to increase or decrease the number of manpower up to
50%.
Risk Purchase:
Time shall be the essence of the contract and if at any stage BLMCL is of the
opinion that the performance of manpower is unsatisfactory, BLMCL, without
prejudice to any other right available to it, shall be at liberty to have the work
performed from another agency entirely at the risk, cost and expenses
(including incidental expenses) of the Contractor. This shall be done by BLMCL
at a negotiated rate and any extra expenditure incurred on this account by
BLMCL shall be recovered from the Contractor. The recovery may be made,
inter-alia from the EMD.
Indemnity:
The contractor shall indemnify and hold harmless BLMCL and its employees
and officers from and against any suits, actions, administrative proceedings,
claims, demands, losses, damages, costs and expenses of whatsoever nature,
including attorney’s fees and expenses, which BLMCL may suffer or incur as a
result of any breach of obligations; or any other action(s) by the contractor or its
employees in relation to the work.
Insurance:
Insurance of manpower during the period of contract shall be the responsibility
of the Contractor and the cost of the same shall be borne by the Contractor.
Any liability/loss during the period of contract shall entirely be the Contractor’s
responsibility.
Compliance of Applicable Laws:
The Contractor shall comply with the provisions of all applicable Laws,
governmental guidelines and directions including the provisions of The
Minimum Wages Act, The Workmen Compensation Act during execution of the
contract and shall be responsible for obtaining any license, registration or other
approval that may be required in connection with the Contract.
No sub-contracting:
The Contractor shall not appoint a sub-contractor to perform the obligations
under the Contract, either in whole or in part, without the prior written consent
of BLMCL.

Arbitration:
In the event of any dispute(s)/difference(s)/claim(s) arising between the
Contractor and BLMCL relating to or arising out of the various terms, conditions
and obligations set forth in this Contract, the same shall be referred for
adjudication to a Sole Arbitrator to be appointed by the MD, BLMCL. The
Contractor expressly waives its right to question the appointment of the sole
arbitrator on the ground that the Appointing Authority is the MD of BLMCL. The
venue of arbitration shall be Jaipur.
Jurisdiction:
The competent court of Jaipur alone shall have exclusive jurisdiction to
entertain any application pertaining to the Arbitration proceedings in relation to
this Contract.

SPECIAL CONDITIONS OF CONTRACT
1. The contract is likely to commence from June 2015 and would continue for a
period of two year unless extended further by the mutual consent of contracting
agency and BLMCL.
2. The period of the contract may be further extended for a period of 1 year after
the completion of contract provided the requirement of BLMCL for manpower
exists at that time or may be curtailed / terminated before the contract period
owing to deficiency in service or substandard quality of the manpower deployed
by the selected Company / Firm /Agency after giving one week notice.
3. The contractor will be required to pay minimum wages as prescribed under the
Minimum Wages Act.
4. The tenderer will be bound by the details furnished by him / her to this
Department, while submitting the tender or at subsequent stage. In case, any of
such documents furnished by him / her is found to be false at any stage, it would
be deemed to be a breach of terms of contract making him / her liable for legal
action besides termination of contract.
5. The manpower employed by the agency for weighbridges shall be required to
work normally in three shifts A, B & C having eight hrs. each Shift A (06:00 AM to
02:00 PM), Shift B (02:00 PM to 10:00 PM), Shift C (10:00 PM to 06:00 AM) .The
manpower may also be called upon to perform duties on Sunday and other
gazetted holidays, if required.
6. The attendant, if deputed for any official work outside the office, shall not be
entitled any other emoluments except only the actual bus fare for the purpose.
7. In case, the person employed by the successful Company / Firm / Agency
commits any act of omission /commission that amounts to misconduct
/Indiscipline/ incompetence and security risks, the successful company / Firm /
Agency will be liable to take appropriate disciplinary action against such persons,
including their removal from site of work, if required by BLMCL within 2 days of
being brought to their notice.
8. The tendering company shall provide identity cards to the personnel deployed in
BLMCL carrying the photograph of the personnel and personal information as to
Name, DOB, Age and Identification mark etc.
9. The service provider shall ensure that any details of office, operational process,
technical know-how, security arrangements, and administrative/organizational
matters are not divulged or disclosed to any person by its personnel deployed in
BLMCL.
10. The service provider shall ensure proper conduct of his personnel in office
premises, and enforce prohibition of consumption of alcoholic drinks, paan,
smoking, loitering without work.

11. The agency shall depute a co-ordinator, out of the deployed personnel, who
would be responsible for immediate interaction with BLMCL, so that optimal
services of the persons deployed by the agency could be availed without any
disruption.
12. It will be the responsibility of the service providing agency to meet medical and
any other requirements in respect of the persons deployed by it (Agency) in
BLMCL and BLMCL will have no liabilities in this regard.
13. The service providing agency shall be solely responsible for the redressal of
grievances / resolution of disputes relating to person deployed. BLMCL shall, in
no way, be responsible for settlement of such issues whatsoever.
14. BLMCL shall not be responsible for any damages, losses, claims, financial or
other injury to any person deployed by service providing agency in the course of
their performing the functions/duties, or for payment towards any compensation.
15. The persons deployed by the service providing agency shall not claim nor shall
be entitled to pay, perks and other facilities admissible to casual, ad hoc, regular
/ confirmed employees of BLMCL during the currency or after expiry of the
contract.
16. In case of termination of this contract on its expiry or otherwise, the persons
deployed by the service providing agency shall not be entitled to and will have no
claim for any absorption nor for any relaxation for absorption in the regular /
otherwise capacity in BLMCL.
17. The contractor shall be solely responsible for redress of grievances / resolution
of disputes relating to the manpower deployed.
18. The tendering agency will be responsible for compliance of all statutory
provisions relating to Minimum Wages, Provident Fund, and Employees State
Insurance etc. in respect of the persons deployed by it in BLMCL.
19. Tendering agency shall also be liable for depositing all taxes, levies, Cess etc.
on account of service rendered by it to BLMCL to concerned tax collection
authorities from time to time as per extant rules and regulations on the matter.
20. The tendering agency shall maintain all statutory registers under the applicable
Law. The agency shall produce the same, on demand, to the concerned
authority of BLMCL or any other authority under Law.
21. The Tax Deduction at Source (T.D.S.) shall be deducted as per the provisions of
Income Tax Department, as amended from time to time.
22. In case, the tendering agency fails to comply with any statutory / taxation liability
under appropriate law and as a result thereof BLMCL is put to any loss /
obligation, monitory or otherwise, BLMCL will be entitled to get itself reimbursed
out of the outstanding bills or the Performance Security Deposit of the agency, to
the extent of the loss or obligation in monitory terms.

23. BLMCL reserves right to withdraw / relax any of the terms and conditions
mentioned above so as to overcome the problem encountered by the contracting
parties.
24. The driver at Jaipur must have knowledge about the vicinity of Jaipur. The
ambulance driver should have knowledge about the vicinity of Kapurdi ,
Jalipa and other adjoining areas in Barmer district.
25. The contracting Company / Firm / Agency shall furnish the following documents
in respect of the individual Attendants who will be deployed by it in this
Department before the commencement of work:
a. List of Attendants short listed by agency for deployment at the O/o
BLMCL, containing full details i.e. date of birth, marital status, address
etc;
b. Bio-data of the persons.
c. Character certificate from a Gazetted officer of the Central / State
Government.
d. Certificate of verification of antecedents of persons by local police
authority.

Weighbridge Operator Qualification:
a. At least Degree Pass from recognized institution with a fair command on
English.
b. He/She should have sufficient knowledge of Computer operations typically like
MS office, Excel, Access, Word etc. and should be able to handle the data
operations efficiently.
c. The services shall include carrying out all the functions generally performed in
this office by computer operators including but not limited to the work of
maintenance of office record etc.
The nature of services of Weighbridge Operation will require the following abilities.
a. Scanning of documents, computer data entry, preparing of reports and other
general office documents.
b. Typing the official letters and other documents.
c. Handling existing data and editing current information.
d. Keeping the office record updated.
e. Taking backup of data at regular intervals and storage of data.
f. The operators to be engaged should be between 18-40 years in age.
g. His /his/her antecedents should have been got verified by the agency from the
local police authorities.
Drivers Qualification Criteria:
a. A valid driving Licence
b. Well conversant about the routes and must carry a mobile phone
Other Conditions:
a. One day holiday in a week shall be given to the driver
b. On the days of holiday in case of any emergency, driver should be provided.
c. In case, the designated driver is not available than the alternate driver is to be
provided.

d. The driver should obey the instructions of the officer authorized by BLMCL in this
regard.
e. BLMCL will not be responsible for any challan, loss, damage and accident to the
vehicle or any other vehicle or injury to anybody.
f. The driver on hire shall be available at all time including Saturdays, Sundays and
public holidays.
g. The contractor shall provide a log book in which contractor’s driver shall ensure
that travel particulars such as departure time of vehicle from one point to
another, time of arrival at destination, the kms covered for the journey, etc. are
entered correctly and signed by the officer-in-charge.
h. The log book with the entries duly completed should be submitted to the officerin-charge along with the bill at the end of every month. In case, the signatures
mentioned above are not obtained, such journey will not be counted for the
purpose of payment.
i. If during any particular trip, it is noticed that the driver has not met the time
schedule given to him or that he has caused inconvenience to the passenger,
penalty clauses will be invoked.
j. His /his/her antecedents should have been got verified by the agency from the
local police authorities.
