WILLIE HORTON’S 14th Annual BATTING FOR KIDS2015 BASEBALL CHALLENGE TO BENEFIT DON BOSCO
WAIVER AND RELEASE FORM
In consideration of my child being permitted to participate in the 2014 Willie Horton’s Baseball Challenge Benefiting
Don Bosco Hall, and enter for any purposes any RESTRICTED AREA (HEREIN DEFINED AS THE AREAS TO WHICH
ADMISSION BY GENERAL PUBLIC SPECTATORS IS PROHIBITED), or being permitted to complete, officiate, observe,
work for or for any purpose participate in any way in and around Comerica Park or with Detroit Tigers, Inc., I hereby agree, for
myself and my child and our respective heirs and next of kin, acknowledges, agrees and represents that I/he/she has, or will
immediately upon entering any such restricted areas, and will continuously thereafter, inspect such restricted area or areas and
all portions thereof which he/she enters and with which he/she comes in contact, and he/she does further warrant that his/her
entry upon such restricted area or areas and his participation, if any, in the event constitutes an acknowledgement that he/she
has inspected such restricted area and that he/she finds and accepts the same as being safe and reasonably suited for the
purposes of his use, and he/she further agrees and warrants that if, at any time, he is in or about restricted areas and he/she feels
anything to be unsafe, he/she will immediately advise the officials of such and will leave the restricted areas.
Further, I understand and agree that Willie Horton’s Batting for Kids 2015 Baseball Challenge to benefit Don Bosco
(hereafter known as the “Activity”) in which my child is participating involves strenuous physical activities and should be
engaged in only by persons in good health. I further maintain that my child is in good physical condition and able to
participate in the Activity. I further understand and agree that my child may decline to participate in any particular part of the
Activity that he/she feels, is beyond his/her ability.
I hereby agree, for myself and my child and our respective heirs, assigns and legal representatives, to forever release,
waive, discharge and covenant not to sue Don Bosco Hall, the Youth Development Commission, Detroit Medical Center, The
FBI, Wayne State University, Ilitch Holdings, Inc., The Detroit Tigers Inc., Tiger Ballpark L.L.C., Ballpark Operations
Management Inc., Olympia Entertainment Inc., Olympia Entertainment Tiger Ballpark, Inc., Little Caesar Enterprises, Theater
Operators, Inc., the Downtown Development Authority, the Detroit /Wayne County Stadium Authority, the County of Wayne,
the City of Detroit and the City of Detroit Building Authority, Sport service, their affiliated corporations, the promoter, other
participants, operators, officials, any persons in a restricted area, sponsors, advertisers, owners and lessees of premises used to
conduct the Activity and each of them, their respective officers, directors, board members, shareholders and employees,
(hereafter known as “The Parties”) for all the purposes herein referred to as “releases,” from all liability to the undersigned,
his/her personal representatives, assigns, heirs and next of kin for any and all demands, claims and causes of action of any
nature, in law or equity, for any and all personal injury or illness, including death, which may occur or which may be
aggravated during the course or the Activity in which I have decided to allow my child to engage.
I further waive any and all claims or causes of action which my child may now or hereafter have against The Parties
which may at any time arise as a result of any act or thing occurring in or arising out of my child’s participation in the Activity.
I understand and agree that medical or other services that are rendered to my child by or at the instance of any of the above
parties are not admission of liability to provide, or to continue any such services, and am not a waiver by The Parties of any
rights hereunder.
I hereby assume full responsibility for and risk of bodily injury, death or property damage due to the negligence of
releases or otherwise while in or upon the restricted area and/or while competing, officiating, observing, or working for, or for
any purpose participating in any event.
I further expressly understand and agree that the foregoing indemnity, release and waiver is intended to be as broad
and inclusive as is permitted by the law of the State of Michigan and that if any portion thereof is held invalid, it is agreed that
the balance shall, notwithstanding, continue in full force and effect.
I further give my permission for any photographs or facsimiles taken of my child during the Activity to be used for
any promotional publicity or advertising purposes and waive any and all claims for payment for such permission.
I
