Duryea Festival Food and Beverage Vendor Agreement
For and in consideration of the following covenants, terms and obligation, the Duryea Festival and the Vendor
mutually agree on the following:
Vendor Terms:
REQUIREMENTS: Vendor participation is by invitation/approval only and is restricted to food and beverage
vendors.
LOCATION: Tower Park or along Prospect Rd as assigned by Duryea Chair or designated person of the Duryea
committee
PARTICIPATION FEE: $30 for a 10x10 space. $50 for 25 x 25 space
EVENT DATE and HOURS: Saturday June 20, 2015 from 10am – 10 pm
SET UP INSTRUCTIONS: Set up times is one hour prior to event and to be completed no later than 10 minutes
before start time of the event. Please indicate if additional set up time is required.
TAXES: Vendors are responsible to collect and file Illinois and Peoria County sales tax.
PARKING: Vendors will utilize the PEARL parking lot on Glen Ave. across the street from Tower Park.
LIABILITY INSURANCE: By signing this agreement, the vendor is confirming they have liability insurance.
Questions re: general commercial liability insurance should be directed to the agency that provides your
insurance coverage.

Vendors shall abide by all written terms stated in agreement and directives issued pertaining to the event, its
security, promotion and administration. Vendors must be clean, sanitary and properly dressed. Shirt and
shoes are required. Al inquiries, complaints, adjustments, and final decisions regarding same shall be
addressed to, decided by, determined or adjusted by the Duryea Festival contact person. All publicity,
promotion or advertising by the Vendor referring to the event and/or it production shall be subject to the
advanced approval by the Duryea Festival person or Chamber President. The Vendor shall indemnify and hold
harmless the Peoria Heights Chamber of Commerce, identified hereafter as the PHCoC, Duryea Festival and
the Village of Peoria Heights, it agents or employees and all persons or firms connected therewith, including all
costs and reasonable attorney fees from any and all liability in any matter whole or in part, expressly included
but not limited to: any injury to Vendor, its property, agents or employees, all goods, fixtures, props or
property of any kind or nature of Vendor displayed by, brought in, or in any applicable way to any and all
occurrences, incidents or happenings involving agents or employees of Vendor in relations to any other person
or persons, including other Vendors, their agents or employees, from which any theory of liability may or
might accrue.
Vendors must comply with Peoria County Health Department requirements. Vendors must supply their own
refrigeration, hand washing stations, pop up tents, generators, hook up power cords, etc.

I, ____________________________________hereby acknowledge that I have received and read the Vendor
Rules and Regulations Agreement and fully understand and agree to abide by the term stated. The PHCoC and
the Village of Peoria Heights is not responsible and will assume no responsibility for any loss, theft, damage or
personal injury suffered by the undersigned from any cause whatsoever. I acknowledge that any property is
displayed at my own rick. I also understand that Duryea Festival reserves the right to reject any vendor.
Furthermore, I release all rights to photography taken during Duryea Festival for future use in print,
publication, advertising, etc. I further acknowledge that I will not be paid for any use of images of the work.
The undersigned hereby represents that he/she has read and understands this release and that by application
submission agrees to be legally bound by this release and to indemnify and hold harmless PHCoC and the
Village of Peoria Heights.
