President’s Message
We’re Coming Down to the Wire!

FADRA has seen a lot of change
and activity since we last got
together in Daytona Beach for
the annual convention. Our
convention set a record for
profit to the association, and I
think our members enjoyed a
very high-quality educational
and social program. We will
soon work on putting together the program for our
2013 meeting, which is going to be at a beautiful new
location, the Hyatt Regency Coconut Point in Southwest
Florida. Our Board and staff met there in early September
and we were very impressed by the beauty of the facility
and the accommodations.
The biggest change has been in our Board personnel, as
we had two longtime members go off the Board after
fulfilling their terms (Terry Thompson and Bill Rutherford),
two resign to concentrate more on their business (Gerry
and Gary Vertucci), and one pass away: Lenny Damron.
Lenny’s sudden and surprising passing has left us with
a heavy heart and the loss of an enormous amount
of our organizational history and leadership. Lenny
spoke only occasionally at meetings, but when he did,
it was important. His business acumen, dedication to
the industry, and personal kindness and caring nature
represented the best among us. We will sorely miss
him. We are very glad to welcome his son Chad to the
Board to fulfill his father’s term of office. We have also
already welcomed Shann Lathem and Claude Grenier to
the Board, and will soon add Gary Lindros, Jr. and Tony
Quarno to the Board, upon approval. We are excited to
bring in younger and forward-thinking members of our
industry as we meet the challenges of the future.

industry that way. In addition, people are moving more
and more to portable devices, so in the future we might
have a conference app accessible by iPhone. Steve
Holland has also suggested we create a website on mobi.
com, a mobile site, from GoDaddy. The E-Commerce
Committee, chaired by Claude Grenier of Teddy Bear’s,
has been charged with developing this initiative. If you
are interested in helping, please contact Claude or me.
Finally, I’d like to invite anyone in the Panhandle area,
and anyone else who wants to come, to our yard on
April 20 for the FADRA Yard Expo. It will be an informal
social and educational meeting for one day, with
tabletop exhibits and heavy equipment in the yard if
anyone wants to see them. We plan to have more of
these regional meetings in the future.
Calendar
One thing I would like to accomplish as president
is to made better use of modern technology in our
communications and operations, and to help our
members do a better job of marketing themselves
and finding new sources of business. We have the
opportunity to move our communications to more
electronic formats and better promote both FADRA and
the salvage industry. One company we have contracted
with can create an online newsletter, provide a Facebook
page, and a YouTube page that will look the same

Executive Directors Report

I hope you are all enjoying the holidays and taking time
to appreciate your loved ones. This has been an up and
down year, with many successes and some losses of
people in our industry. Among those that I know of, we
lost John Kiker, Doug Lathem, George Gardner’s son
David, Victor Pancorvo, and Lenny Damron this year.
Each of these individuals had an affiliation with this
association, and we will miss them terribly.
On a brighter note, we do have some good news, as
Tim McMillon and Shan Lathem have recently gotten
engaged. Congratulations to both of them, and since
they are both on the FADRA Board, we can keep a close
eye on them!
We have a few new additions to the Board this year.
Chad Damron, Claude Grenier, Shan Lathem, Gary
Lindros, Jr., and Tony Quarno have all joined to replace
those who have gone off the Board. It is exciting to see
these young members taking the big step to take part
in FADRA and work on behalf of our industry. We look
forward to some exciting changes and initiatives in the
coming years.
We had a fantastic convention this year, both in terms of
the speakers and events and the profits we generated.
(I am all about the money!) We set a record with more
than $37,000 in net profit, which helps fund our
association activities. I think our Convention Committee
put together a dynamite slate of speakers, almost all of
them new people, and we got very good evaluations
from attendees. The new Convention Committee will
soon start planning for the 2013 convention, so if you
want to take part (it takes a handful of conference calls),
please let me know.
In the first quarter of 2013, we have two big events:
Legislative Days and the FADRA Yard Expo. We have
been going to Tallahassee for a few years now, with our
members meeting with legislators about key bills and
business issues, and it has given FADRA a voice in the
Legislature. We want more of our members to join us,
so please make plans now to be in Tallahassee on March
19-20.
We’re very excited about our first Yard Expo. It is loosely
modeled on IT, and we’d like owners and employees to
join us Saturday, April 20, 2013 from 2:00 – 8:00 pm at
Butler Auto Recycling in Pensacola. We will invite nonmembers from the area as well, including Alabama and
Mississippi, for an informal social and educational day.
Our President Jim Butler will welcome anyone who can
visit his yard for the tour and expo.
Thank you for all your support of FADRA, its leadership,
and our staff. This is a vibrant group with great people,
and a sincere pleasure to work with. Happy Holidays and
New Year to everyone!

Fire at Budget Auto Parts
A fire consumed an auto parts building at Budget
U-Pull-It Auto Parts in Winter Garden on September 4,
sending a large black flume of smoke into the sky. The
blaze broke out around 1:30 pm at Budget Auto Parts at
881 9th St. in Winter Garden. Firefighters from Winter
Garden and Ocoee extinguished the blaze after nearly an
hour. All employees were accounted for, and no injuries
were reported.
Local 6 news helicopter Sky 6 was on scene as smoke
billowed out of the roof of the business and as the fire
spread throughout the building. Witnesses told Local
6 that they heard three loud “booms” before the fire
ignited. Firefighters told Local 6 they believe the fire
started when sparks from a cutting mixed with gasoline,
igniting the fire. The building is considered a total loss
and the fire is still under investigation, according to fire
officials.

Officials said they couldn’t recall any major problems or
code enforcement issues at the business recently. Fire
officials said 50 percent of the building was destroyed.
They said tires, paint and other flammable chemicals in
the warehouse helped fuel the fire.
Witness Emanuel Rangeo had just pulled onto the 5-acre
auto salvage yard to get a used part for his car when he
spotted the flames.
“There were multiple explosions during the event,” said
Winter Garden Fire Chief John Williamson. “There was
some sort of a cutting operation going on at the facility
-- not in the building, but in an area that was covered by
a roof. Somehow, the sparks from that got into the fuel,
and then the fire extended pretty rapidly. They tried to
fight it with fire extinguishers, but weren’t able to.”
“Everybody was running like crazy,” Rangeo said. “So, as
soon as I saw everybody, I ran because I saw the flames
was coming from that warehouse. I got a little nervous.”
The state fire marshal is investigating. The Environmental
Protection Agency is looking into whether water from
firefighter hoses caused chemicals to run off the property.

Langston’s Featured on Local News
Jason Langston of Langston’s Auto Parts in Tampa was
interviewed extensively for a four-part piece in June by
Charley Belcher for Charley’s World, a show on Fox News
13 in Tampa. Charley examined the auto dismantling
process using autos at Langston’s, which began as a
body shop and towing service in 1925 by Jason’s greatgrandfather.
After wondering if the term “junkyard” used by the
news anchor was “politically correct,” Charley was
disabused of that notion by Jason, who emphasized the
high level of organization and recycling capacity of an
auto salvage recycler. Charley cited a number of statistics
from ARA illustrating that autos are the most recycled
consumer products in the United States, with 11 million
vehicles—95% of all vehicles manufactured—and 86%
of all vehicle parts being recycled each year, and that the
auto recycling business employs 140,000 people at 9000
facilities in the U.S.
Jason showed how a vehicle is dismantled and some of
the parts that are resold. The report noted that only the
foam and fabric of the seats can’t be recycled. Jason
showed Charley the oil and gasoline receptacles, and the
bins where aluminum, steel, and plastic parts and the
wire trains are placed before sent to a scrap processor at
the Port of Tampa. The report culminated with Charley
pressing the button to activate the OverBuilt High-Speed
Crusher to crush two stacked auto frames.
All in all, Jason did a great job showing the benefits of
auto recycling and represented the industry well.
Larry Danielle Featured in Recycling
Today Magazine
Readers of Recycling Today may have recognized a
familiar face on the cover of the magazine’s September
issue: ARA member Larry Danielle. Larry is owner and
president of U-Pull-It of Broward, located in Davie, Florida
and has been an ARA member since 2003.
Recycling Today’s article profiled the growth of U-Pull-It
over the past 16 years, as Larry and his family expanded
the scope of U-Pull-It’s services within the automotive
recycling industry: increasing the annual volume of
salvaged vehicles, expanding with more than 30 acres of
land, and offering additional self-serve and scrap metal
services. Larry got his start in auto recycling with the family
business, Danielle’s Used Auto Parts, in 1969. The
company was a full-service salvage and used auto
parts business, which he ran until 1994. In 1996, Larry
introduced the self-serve used auto parts concept to his
customers and the surrounding Broward County area and business at U-Pull-It has been growing ever since.
The most recent addition to this Davie, Florida facility is
an 80-inch auto-shredding plant, expanding U-Pull-It’s
operations to include the processing and shredding of
scrap metal.

In Memoriam: John Kiker
FADRA lost another long-time member not long after
the convention when John Roley Kiker, 52 years old, of
Kiker’s U-Pull-It in Pensacola passed away on August 7,
2012.
John was blessed with a daughter, Nicole M. Carpenter
and two grandsons, Trace Carpenter and namesake,
Kiker Carpenter. His grandsons loved their “Papa
John.”
John was born and raised on a cotton farm in James,
MS in the Mississippi Delta. He was raised in a loving
family where cousins felt like brothers and sisters and
friends like aunts and uncles. He was driving tractors
in the fields as soon as his feet could reach the pedals,
and his eyes could see over the steering wheel. He
attended Deer Creek School, in Arcola, MS, and after
football practice, would come home to farm with his
family in the fields.
John was an “Idea Man.” He was always thinking
of his next business adventure. Some, of which, he
partnered with his father, James W. Kiker. They were
more than father and son; they were buddies. John
loved his daddy. But don’t be fooled, John was also a
momma’s boy. John loved his mother, Clider R. Kiker,
and was always quick to shower her with hugs and
kisses.
John was a charming, jolly, and fun-loving man. He had
an infectious laugh that rippled through the room. His
heart was huge and so were his pockets. Everybody
loved Big John.
“I knew John for 35 years,” said Bruce Trawick of
Atmore Auto Salvage in Atmore, AL. “We used to go
deer hunting together and we did business back and
forth. Me met through the salvage business, and if
there ever was a problem, you just had to pick up the
phone and he’d fix it. He was a good guy and I really
miss him.”
John moved to Pensacola, FL to work in the family
salvage business after graduating high school in 1978.
He still loved the Mississippi Delta and frequently
traveled back to spend time with family and good
friends. It was back in the Delta where John found
his first and only true love, Tracy Key Kiker. They were
married in Greenville, MS in November, 1984, and
resided in Pensacola.
It was with Tracy, that John found his first paternal love,
when Jonathon Hunter Kiker was born in 1986.
John took his new family back to the Mississippi
Delta in 1989 to partner with his father in farming.
John loved to farm. John also loved to cook. He was
an excellent man-on-the-grill and won and placed
in several barbeque contests. He was an avid gun
collector and hunter. John also loved his billiards.

John’s entrepreneurial spirit led him back to Pensacola,
FL to start Kiker’s U-Pull It with his father. Another
business adventure included Southern Raceway in
Milton, Florida. John loved the thrill of racing and his
racecar. John drove number 98 for Kiker’s Racing Team
on the dirt tracks of Southern Raceway. But it wouldn’t
be long before his racing team graduated to the
asphalt track at Five Flags Speedway.
John was continuing the family partnership as he was
bringing his son, Hunter Kiker, into Kiker’s U-Pull It,
making it a three generation business, when he left us
far too soon.
John is survived by his parents, James W. Kiker and
Clider R. Kiker of Cantonment, FL. He is survived by
his son, Jonathon Hunter Kiker and his wife, Laura
Davis Kiker with baby Lilah Faith Kiker on the way, of
Pensacola, FL. He is survived by a daughter, Nicole M.
Carpenter and two grandchildren, Trace Carpenter and
Kiker Carpenter of Winona, MS. He is survived by his
sisters, Myra J. Kiker of Aurora, CO, Nora K. Sheetz
and her husband, Donald M. Sheetz of Pensacola,
FL and his sister Teresa O. Kiker of Windsor, MA. He
is preceded by his wife Tracy K. Kiker, 1998 and his
brother, James W. Kiker Jr., 1982.

Auto Salvage, died on December
14 after a short struggle with
cancer. He had his family by
his side. He was born July 10,
1944, in Gainesville, Georgia. A
resident of Cocoa since 1970, he
was well known and respected
throughout the community for
his many contributions as well as
his successes as a businessman,
running a Shell station in Cocoa for
many years.
He is survived by his wife of 46
years, Linda Lathem; his son, Steven
Lathem (Elaine); his daughter, Shan
Lathem; his adopted daughter, Mina
Williams (Shaler); his grandchildren,
John Lathem, Madison Gillispie,
Kaitlyn Gillispie, Abbegail Lathem,
and Lana Williams; his sisters,
Morene Underwood (Marion) and
Willie Mae Grizzle (Herman); as well
as countless nieces, nephews and
cousins.
Neal Harrow of Greenstar Recycling
in Orlando said on Facebook,
“Steve, your dad was a great guy
and had touched many. He was a
great friend and I as many will miss
him.I am so sorry to hear of his
passing. He always knew how to
enjoy life.”
Another friend, Eddie Norman,
remembered, “He was a great
person. I remember I got stuck on
Shell Hill in my Baja biggie and he
pulled me out with the tow truck
and didn’t even charge me.”
Dena Baldwin, another friend, said,
“I have so many fond memories of
your dad racing and the station!!
We would get such a laugh
watching him race and knowing
that he was looking with one eye!!
Lol! And the gas station will always
be known as Doug Shell as long as I
live!! Good memories!”

Industry Legend Passes Away:
Remembering Lenny Damron
FADRA members and auto
recyclers all over the country were
shocked and saddened to learn of
the death of Leonard A. “Lenny”
Damron of heart failure on August 10, 2012, aged
61, at his home in Crystal River. Lenny was truly a giant
in the industry, a paragon of financial and personal
success who never stopped working or learning. The
Service of Remembrance held at the Gulf to Lake Church
in Crystal River drew hundreds of people, with a line
of mourners stretching out the door and around the
building. Hundreds of LKQ employees lined County Road
486 to say a final farewell to their friend and employer as
the hearse carrying his body drove to Memorial Gardens
Cemetery in Beverly Hills on August 14.
“There were quite a few of us that started out in the
salvage business back in the ’70s and ’80s, and we all
had a certain amount of vision and drive. Lenny had a
boatload of both,” said Barney Thompson, a 30-year
friend and Past President of FADRA.
“His vision went beyond Crystal River and Ocala, beyond
Orlando, beyond Florida. He always wanted to do things
bigger and better, and it wasn’t always about the money,
although he did pretty well for himself. He wanted to
accomplish things that no one else had done. He wanted
to leave a legacy in the salvage industry and in this
community, and that he did.
“He was a jokester, a prankster, a master storyteller,”
Barney said at the memorial service. “He could make up
a story that you knew probably wasn’t true, but you’d
believe it. He could go from the boardroom discussing
multimillion-dollar deals one minute and the next he’d be
jumping out from behind a door and scaring you.”
“Lenny Damron was one to raise the bar in everything
he did,” said ARA Past President Herb Lieberman. “But
always, he raised the bar for himself first, to find a way
to work harder, work smarter and set an example for
others to follow and benefit from.”
Lenny was born March 31, 1951 in Dearborn, MI,
son of Leonard and Geri Damron. His family moved

to Citrus County when he was just 2 years old and he
was a lifelong resident. He first ran a body shop on
County Road 486 in Crystal River, but the auto salvage
business became more and more central to his activities,
so he founded Damron Auto Parts in 1981. He later
incorporated Damron’s into LKQ and was Senior Vice
President of LKQ Self Service and Heavy Trucks Division.
At one time, his company was the third-largest employer
in Citrus County, FL, and now employs 165 people. LKQ
Corp. was founded in 1998, when Lenny and his two
sons, Chad and Casey, joined forces with Star Auto Parts
in Wisconsin and Triplett Auto Parts in Akron, Ohio. The
company went public in 2003 and its New York Stock
Exchange ticker symbol is LKQX.
In the early days, Lenny kept a wrecker tow truck in his
front yard, on call 24 hours a day, recalled the Rev. Lloyd
Bertine, who grew up with Lenny Damron in Crystal
River and later became his pastor at Gulf to Lake Church.
Lenny married Bertine’s cousin, Diane, so they were also
family.
“I remember Diane had a Cadillac and she came home
one time and Lenny had taken some parts off of it and
sold them,” Bertine said. “People see people like Lenny
and Diane and see how successful they are, but they paid
a price to build their business.”

His hobbies were collecting muscle cars and hot rods
and fishing. As anyone who has ever attended a FADRA
auction at the convention knows, Lenny was an avid
Gator fan, enjoying all Gator sports, and he loved
spending time with his grandkids, for whom he bought
many items.
Rob Wagman, CEO and President of LKQ Corp, said,
“Lenny was the owner of one of our first acquisition
targets and has stayed on with us as a key employee
ever since. Lenny has
been an important
part of the LKQ
family and a great
friend to all who had
the honor of working
with him. Equally
important to being
a trusted colleague,
Lenny was a mentor,
a strong leader and
a visionary to many
within LKQ and
Lenny’s lovely wife Diane during the 1980s.

industry. His passion will be carried on by his two sons,
Chad and Casey, in their respective roles of Regional Vice
President and Plant Manager. We will miss Lenny deeply
and our condolences go out to his wife, Diane, and the
entire Damron family.”
LKQ colleague Stephen Tatoul said, “Lenny was one of
very few men I held in the highest regard. I was proud
to know him and later count him among friends. So
few people truly amaze me. I learned early on to never
underestimate Lenny’s ability or resolve.” He continued,
“Pioneer, innovator, fearless leader, maverick, but mostly
I will remember my dear friend who touched my life in so
many ways. And I will do my best to honor him every day
as we move forward and continue to grow LKQ, which
was his greatest passion outside of family and friends.”
ARA member Herb Lieberman said this: “I knew Lenny
Damron for over 30 years. If there is anything I could
say about Lenny Damron it is that the Dismantling and
Recycling Industry is better today because Lenny Damron
was ‘one of us.’
“Lenny was a dreamer, but would not allow it to stop
there,” Herb continued. “He did what it took to make his
dreams become a reality. Lenny Damron was one to raise
the bar in everything he did. But always, he raised the

bar for himself first, to find a way to work harder, work
smarter and set an example for others to follow and
benefit from.
“Lenny’s life was cut all too short. Yet, during the time
he had, he gave his all, to his wife and partner Diane, to
his sons Chad and Casey, to his grandchildren, his family,
friends and community. Lenny is gone, but not the gifts
he left behind. He was a person who always gave more
than he took, and acted more than he spoke.

Thorpe expressed
his feelings this way,
“I met Lenny a long
time ago when we
were both taking
flying lessons in
Crystal River back
in the ’80s. He used
to have a runway
on his property on
Lenny in his prime, another 1980s shot.
(County Road) 486,
a grass landing strip, when 486 was just a little road.
He’s been around for a long time and has always been a
very integral part of the economic development of Citrus
County.”
Another commissioner, family friend Joe Meek, said,
“I can’t say enough about Mr. Damron and the whole
Damron family. He was a wonderful man who raised a
wonderful family and someone who set an example for a
lot of people in this community to follow and look up to.
He was an impressive person, and the Damrons are an
impressive family. It’s a sad loss.”
Jim Seamans remembered, “I first met Lenny in the
early ‘80s when he still ran the body shop, and I sold
him a Hollander Interchange Manual. Soon after that,
he started Damron’s and I sold him an AIM inventory
System and encouraged him to become involved in
FADRA. In 1984, both he and Steve Holland joined the
Board, and Lenny served faithfully for 28 years. He was
a sagacious Board member and he served as President in
1987-88. I considered him a good friend and Edel and I
always enjoyed seeing Lenny and Diane at meetings and
conventions. He will be sorely missed.”
An LKQ employee called him, simply, a “silver lining on
a dark day.” He was optimistic, always looking for the

good in any situation or person. As busy as he was, he
took time for people.
Gerry Vertucci of Atlantic Auto Salvage, now LKQ
Self-Service Riviera Beach, served with Lenny for
many years on the FADRA Board and considered him
a friend. He recalled his last conversation with Lenny,
when he was struggling with the decision to join the
LKQ organization.“We were talking under this tree I’m
standing under now as I talk to you,” he said. “I asked
him, ‘Why do you still work in this business? I won’t be
able to talk to you like this once I become an employee.’
He said, simply, ‘I love what I do.’ We talked some more
and I asked him again, ‘Why do you still do it?’ Again, he
said, ‘I love what I do.’ After more conversation, I asked
him a third time. I really wanted to know what drove
him, and felt this was the time to talk with no barriers.
Again, he said, ‘I love what I do.’ That was Lenny
Damron to me.”

Indeed, Lenny remained curious and open to sharing
ideas with other auto recyclers to the end. He attended
every FADRA convention and rarely missed a seminar,
even though one would think that there was little Lenny
didn’t know about the business. He listened attentively
in sessions and listened carefully to group conversations,
more interested in hearing the ideas of others than telling
everyone else how to do it, though he would always
answer questions respectfully. He was no doubt hardnosed in business, but he was committed to the industry
as a whole and willing to share his knowledge. His family
always made the FADRA convention a family vacation, as
Diane, Chad and Casey, grandchildren Caroline, Connor,
Colby and Will, niece Keri Maggiore, and nephew Jason
Owen, would enjoy the trade show and closing banquet
to the fullest.
2011 on a $7 million, 125,400-square-foot building in
the auto salvage yard, housing 17 dismantling bays and
20 loading bays along with an enormous warehouse —
50.5 feet tall at its highest point — to house parts. It
incorporates many of the ideas of his son Chad. Chad
has agreed to serve on the FADRA Board to fulfill the
remainder of Lenny’s term.

At the wish of his family, The Lenny Damron Memorial
Fund has been established by the Boys & Girls Clubs of
Citrus County, of which Diane is a Board member. The
Damrons wished to commemorate Lenny’s dedication
to the welfare of the children of Citrus County and
the ideals he exemplified throughout his life: honesty
and integrity, an exemplary work ethic, the love of a
challenge, and the belief that he should give back to
his community. The fund will directly benefit the at-risk
children who attend the Clubs, funding programs and
providing for their needs. The Boys & Girls Clubs’ website

of the YMCA.
On September 25, the Citrus County Board of
Commissioners presented a proclamation to Casey
declaring it “Lenny Damron Day” in recognition of his
many contributions to the community.
He remained an innovator to the end, leaving behind a
state-of-the-art dismantling and inventory building that
covers three acres. Construction started in September

The Automotive Recyclers Association of America met in
Orlando on October 24-27 at the Gaylord Palms Resort.
Auto recyclers came from all over the world to join with
their peers at the industry’s premier convention and
trade show. The trade show had 100 exhibitors, with
more than 15 new to the ARA exposition. Attendees also
had the opportunity to see more than 40 educational
sessions. Sessions included:

FADRA had a booth in the trade show manned by
Executive Director Kim O’Dell and Assistant Director
Bobby Davis. They passed out association literature,
convention information, and promoted the April Yard
Expo at Butler’s Auto Recycling in Pensacola. Members
such as Jim Seamans, Jim Butler, Steve Holland, Mike
Karklins, Joe Loeffler, Rachel Rigsby Lare, Bob Eubanks,
Gary Lindros, Jr., Bo Wroten, and others stopped by to
chat and to talk to attendees who stopped by. We had a
fun and festive booth with a lot of activity.
Attendees also had a special guest at the trade show.
A five-foot tall, 120lb, basketball-playing robot from
a local Orlando-based FIRST robotics team was on the
trade show floor to interact with attendees and vendors.
ARA and the ARA Educational Foundation are proud to
partner with FIRST® Robotics Competition to provide
small motor parts to their competition teams. FIRST
Robotics was founded in 1989 to inspire young people’s
interest and participation in science and technology. Each
school year teams of 25 students or more are challenged
to build and program robots to perform prescribed tasks
against a field of competitors. The robot visiting the trade
show was designed, programmed and built in six weeks
entirely by high school students under the guidance
of college mentors and professional engineers. ARA
members were able to watch the robot shoot basketballs
and drive around, as well as meet the impressive team of
students who built the robot.

Julie mentioned a department VIN verification site that is
FREE to use. Just keep in mind that the data is only from
Florida and can only say if there is an existing Lien or
Stop on the title. FADRA has the address posted at www.

In July, I attended an ARA State Legislative Summit in
Nashville. We discussed topics that affect the states this
year and coming in the future. China was a new topic
that is becoming a major concern for Recyclers, as that
country is buying up enormous quantities of scrap metal
and junked motor vehicles. We had long discussions
on Unregulated Salvage Buyers, End Of Life vehicles,
barriers to selling parts, access to Interchange data,
OEM vehicle repair data, future uses of NMVTIS, EPA &
OSHA Regulatory issues. ARA has Position Statements
on many of today’s issues that can be adopted for a
flare-up in a state. ARA is working on Model Legislation
and talking points for topics such as End Of Life Vehicles
and Licensing that could be used in states for future
legislation opportunities.
I would like to thank you for all the support you give to
the Legislative Committee in their efforts to represent
the salvage industry. My thanks to all who donated and
supported the Legislative Auction and gave funds on
renewal and registration applications.

Below is an update on the Ohio Legislation pertaining
the Copart Amendment to dispose of Salvage Bid Cards.

Post Hearing Update - SB 273
Thank You for Stepping Up to Defend Your Business and
Community!
The Ohio House Insurance Committee held an opponents
hearing on SB 273 –a bill that Ohio auto recyclers
are actively opposing. This bill would open the state’s
salvage auctions to unlicensed and unregulated buyers.
Local, state, regional, and national organizations joined
forces to voice their concerns and independent recyclers
throughout Ohio took the time to make phone calls
and send letters to their Representatives expressing their
strong opposition.
Testifying in opposition were OATRA (Ohio Auto & Truck
Recyclers Association), UCOAR, ARA, LKQ, concerned
citizens, and environmental groups. Opponents argued
that SB 273 would create an unbalanced playing field
for law-abiding auto recyclers and threaten local jobs,
consumers, the environment, and the safety of Ohioans.
Chairman Jay Hottinger announced the date of the
third hearing for Tuesday, November 27, 2012, which
was attended by ARA Director of State Government
and Grassroots Affairs, Jessica Thomas, and Regional
Director Greg Bender. Another hearing was scheduled for
December 4.
An amendment to SB 273, as passed by the Ohio Senate
earlier this year, removed the only consumer protection
and reporting requirements that were part of the law.
Among the provisions removed was the development
of a statewide electronic database to collect buyer
identification information and salvage motor vehicle sales
records, as well as the requirement that salvage auctions
obtain and maintain records of buyer identification
and licensing information. The definition of authorized
purchaser was also expanded.

Clean Harbors Buys Safety-Kleen
Clean Harbors, Inc. the leading provider of

agreement on October 29 to acquire Safety-Kleen,
Inc., the largest re-refiner and recycler of used oil
in North America and a leading provider of parts
cleaning and environmental services.
Under the terms of the agreement, Clean Harbors
will purchase Safety-Kleen in an all-cash transaction
valued at $1.25 billion. The acquisition is subject to
approval by U.S. and Canadian regulators, as well as
other customary closing conditions. The transaction is
expected to be completed by year-end.

Georgia Auto Recycling Yard
Implicated in Auto Theft
Thieves Apprehended at Pick-n-Pull
of Panama City
On Friday, August 24, 2012 the Kingsland Police
Department (KPD) and Georgia Bureau of Investigation
(GBI) executed simultaneous Search Warrants on J & A
and Sons Recycling in Kingsland and at the residence
of the business owner. KPD Officers and Investigators
along with GBI Special
Agents carried out the
search, the culmination of
an intensive investigation
by the Kingsland Police
Department, Georgia
Bureau of Investigations.
The Panama City Police Department announces
additional arrest following the investigation of Pick-nPull being defrauded of over $40,000. After the arrest
of William E. Smith, 43 years of age, on August 3, 2012,
detectives were able to secure arrest warrants for James
R. Davis, 60 years of age,
of Panama City Beach, and
his son Steven R. Davis, 33
years of age. Both were
arrested on August 9, 2012
for the warrants. They
were booked into the Bay
County Jail for principal
to ongoing scheme to
defraud and principal to
grand theft.
It began in the late fall
of 2010 into violations
of the Georgia Racketeer
Influenced and Corrupt
Organizations Act (RICO)
through predicate acts
of violations of Title 18
USC 2314 Interstate Transportation of Stolen Property
and Title 18 USC 1343 Wire Fraud along with other
violations of Georgia State Code pertaining to the Theft
by Receiving Stolen Property. All charges/violations are
Felony level.
In addition to serving the Search Warrants, an arrest
warrant was served on Ms. Amy Brow, 33, of Kingsland
for the charge of Violation of the Georgia Racketeer
Influenced and Corrupt Organizations Act (RICO) a
felony. Ms. Brow was taken into custody on the scene of
the business and transported to the Camden County Jail
without incident.
During the investigation
it was determined that
Smith, an employee of
Pick-n-Pull, would arrange for checks to be made out
to different business names with false tax identification
numbers to purchase scrap cars. Smith would provide
these checks to the Davises, who would cash the
checks through their bank, endorsing the checks as a
representative of the business the checks were made out
to. In these cases there were no scrap cars purchased or
delivered to Pick-n-Pull. Smith was able to arrange these
fraudulent purchases to the Davis’ due to his position as
a buyer of scrap cars and many

October, OmniSource lost 5 trailer
loads of copper valued at over
$500,000 to a theft ring believed
to be operating out of Florida. This
group has cloned the identity of
MAM Trucking but also operates

under the name of JJP and Freight
Star. At least six law enforcement
agencies on the east coast have
contacted SDI Security concerning
this theft, which appears to be
widespread and has included the
theft of liquor, scrap metal, and
other cargo. This is a very organized
group that presented actual shipping
documents to OmniSource at the
time of pickup, so it may be very
difficult to identify them as being
fraudulent.

Beware of Flood-Damaged Vehicles from Hurricane Sandy
The staff and members of the Automotive Recyclers
Association (ARA) send their thoughts and prayers to
the thousands of people directly impacted by Hurricane
Sandy. In the wake of historic damage produced by the
storm, ARA is once again urging Congress to review
implementation and enforcement of the National Motor
Vehicle Title Information System (NMVTIS) to ensure all
flood-damaged vehicles are appropriately tracked and
not sold to unsuspecting automotive consumers.
Record rainfall and flooding from the Carolinas up into
Canada has resulted in vehicles all over the East Coast
being submerged in water. The depth of flooding and
length of time cars are left under water has the potential
to increase the number of vehicles damaged beyond
repair. Now more than ever, it is essential that NMVTIS be
fully implemented and the underlying statute enforced to
help prevent the sale of these flood-damaged vehicles to
the unknowing consumer.
NMVTIS, a national electronic system that provides
consumers with valuable information about a vehicle’s
condition and history, must be fully enforced so that it
can play its crucial role in helping to ensure that these
flood-damaged vehicles are not sold to unsuspecting
consumers in the used-car market. “According to the
Department of Justice (DOJ), after Hurricane Katrina
in 2005, law enforcement and insurance crime experts
reported truckloads of flooded vehicles being taken out
of Louisiana to other states where they were dried out,
cleaned, and sold to unsuspecting consumers in other
states,” said Michael E. Wilson, CEO of ARA. “NMVTIS
must be fully implemented and utilized to prevent this
activity from happening again,” added Wilson.

ARA believes that such fraudulent and unsafe practices
can only be stopped if all states participate fully in
NMVTIS and all “individuals” and “entities” that are
required to report to the system are held accountable.
“Regrettably, DOJ has limited resources to do this. ARA
has urged Congress time and time again to intercede
and appropriate sufficient resources to DOJ to implement
the program, increase state participation, and efficiently
enforce violations. Only with sufficient resources can DOJ
and the appropriate state law enforcement entities target
all businesses/individuals who are operating under the
radar and force them to fulfill their obligations under the
statute,” Wilson asserts.

ARA Initiates ISO 9001 Educational Research Project
ARA has announced a bold initiative to develop a process
through which its CAR and Gold Seal members could
achieve ISO 9001 certification. Since 1996, the ARA CAR
and Gold Seal certification programs have represented
the professional automotive recycling industry’s highest
level of accreditation. Several top CAR/Gold Seal facilities
will participate in this first-ever pilot program that will
quantify the cost and effort necessary for CAR/Gold Seal
members to secure and maintain ISO 9001 certification.
The International Organization for Standardization’s ISO
9001 certification demonstrates a company’s compliance
with a set of guidelines that outline a philosophy of
quality management for businesses. This philosophy
results in optimal products and/or services - which in turn
results in high levels of customer satisfaction. With the
introduction of ISO 9001:2008 several years ago, small
businesses now have a more economic and plausible
avenue to meet ISO certification requirements. ARA
CEO Michael E. Wilson believes the quality recycled
parts market could capture substantial growth in the
collision, mechanical and do-it-yourself markets with
an enhanced product assurance program. Wilson says,
“The sophistication of today’s vehicles necessitates that
professional automotive recyclers elevate their product
quality and procedures to successfully compete in today’s
market.”
Under the direction of senior consultant Ginny
Whelan, ARA’s educational research pilot will provide
comprehensive assistance and analysis to participating
CAR/Gold Seal members on the most economic and
efficient pathway to ISO 9001 accreditation. With
information obtained from the pilot, ARA will then
develop a broad automotive recycling model for securing
ISO 9001 accreditation, which can serve as a road
map for professional automotive recyclers during the
application process. According to Whelan, “achieving
ISO 9001 certification does not need to be complicated
or expensive”. No-nonsense, step-by-step instructions
and guides, easy-to-customize documentation templates/
forms and convenient online training using a secured
cloud shared data platform will be used and Whelan
notes that “ARA will be able to determine the best
methodology by which CAR /Gold Seal facilities can
attain ISO 9001 certification.”

FADRA Convention Hits the
Beach in Daytona

FADRA visited the Hilton Daytona at “the world’s most
famous beach” for its 2012 annual convention on July
24-27. Attendance was high as 169 members joined in
the fun and we brought in the biggest profit in FADRA
history.
The FADRA Convention Committee of Jim Butler,
Cheryl Nelson, Shann Lathem, Steve Holland, Rachel
Rigsby Lare, and Gerry Vertucci put together a very
strong educational program of all-new speakers, led by
auto recyclers J.C. Cahill of Brown’s Auto Salvage and
Rian Garner of Counts Automotive. Both did multiple
sessions and engaged the attendees deeply with their
comprehensive understanding of the industry.

J.C. had tremendous energy and talked about cuttingedge ways to improve business operations and the use
of social media. As one member said in his evaluation,
“J.C. is one of us and he understands our industry.” Of
his session on social media marketing, one person said,
“J.C.’s information related to us and our industry. This
seminar alone was worth the cost of the convention.
Those in the room were fed information they couldn’t
get anywhere else.” Another member concluded,
“The quality of speakers at this year’s convention was
outstanding. But I think J.C. Cahill was one of the best
I have ever seen. Without any gimmicks, he was able
to hold my attention. He was great, and I hope you can
bring him back in the future.”
Rian’s session on the “Seven-Line P&L Statement” was
also engaging despite the rather dry subject matter. As
one person said, “Anyone who can explain accounting
and hold my attention accomplished something. The
session was awesome.” His sales seminar “provided the
attendees with good, solid information on hiring and
training employees.”

Other new speakers this year were Julie Baker of the
DMV, Yasmin Restrepo on labor law, and Jen Wilson
on employee recruitment and retention. All three
provided very useful information that most attendees
were able to bring back to their businesses, and all
elicited a lot of questions from the audience. In Julie’s
session, several were able to ask her and Steve Holland
about their individual situations concerning derelict
vehicles. Jen and Julie joined Rian and J.C. in an
industry potpourri, question-and-answer session where
members could ask about whatever they wanted. The
lively discussion gave members one last chance to ask
questions of the speaker experts.
A first-time event this year was the women’s luncheon,
from which the men were definitely excluded. About
25 company owners and employees, spouses, and
speakers came together to talk in round tables about
issues that women face in the industry, to empower
women and solve basic problems. They had rich
discussions and it will become a regular event at
FADRA.
Michael Wilson of ARA attended again this year and
gave an interesting summary of national issues at the
FADRA Business Meeting. He noted that with more
cars having crash-avoidance systems, it has reduced
accidents by 85%, which, ironically, reduces the
amount of salvage available to the industry. As a result,
he believes auto recyclers will need to focus more on
high-value electronic parts, and overcome barriers by
the auto and insurance companies to harvesting them
for resale.
Finally, D.J. Harrington led an experimental and fun
session based on an auto recycling trivia game. D.J.
brought his special brand of good cheer and the
questions put together by members were challenging
to the players.
This year’s banquet and auction were emotional affairs
as always. D.J. served as emcee as the scholarship
winners were brought to the stage to thank the
members. Our auction did very well this year, with 55
items donated bringing in $22,325 for the Legislative
and Scholarship Funds.

The 12 Golden Rules for Auto Recylers
By The Florida Department of Environmental Protection
More than 14 million tons of steel are recycled from
end-of-life vehicles at facilities where spare parts from
stripped or wrecked vehicles are reused, remanufactured
or redistributed to the public and body shops as viable
alternatives to more costly new parts.

Automobile recyclers used to be known as “salvage”
or “junk” yards, but today’s auto recyclers can be
sophisticated facilities with computerized inventory.
Auto recycling is a $22 billion industry that can cause
numerous environmental problems if processes are not
managed properly.
2. Regularly checking core storage areas to ensure fluids
are not leaking on the ground and core parts are
protected from stormwater.
The Compliance Assistance Program for Automotive
Recyclers, developed by the Florida Department of
Environmental Protection in coordination with the
Florida Auto Dismantlers and Recyclers Association,
provides Florida’s automobile recycling facilities with
best management practices to maintain clean facilities
and environmentally safe procedures, and a self-audit
workbook and checklist for the recycling facility to
evaluate its progress.
1. Checking new vehicle arrivals for fluid leaks, mercury
switches and removing batteries and mercury
switches.
3. Labeling used oil tanks/containers as “used oil” and
regularly inspecting for good condition.
4. Labeling antifreeze tanks/containers as “used
antifreeze” and regularly inspecting for good
condition.
5. Labeling gasoline tanks/containers as “used gasoline”
and regularly inspecting for good condition.
6. Developing and implementing, if required, a
Stormwater Pollution Prevention Plan.
7. Storing mercury switches and batteries inside on a
pallet or outside in a leak-proof container away from
traffic.
8. Checking refrigerant recovery machines (R12 and
R134a), which should be in working condition and in
good repair.
9. Marking all drums and storage containers with
proper contents -- no mystery drums.
10.Maintaining disposal records for used oil, used
gasoline, mercury switches, batteries and refrigerant
at a central location on site for a minimum of three
years.
11.Addressing spills immediately. Quickly removing
contaminated soils and storing in a separate, labeled
container.
Best management practices, including waste reduction
and pollution prevention, not only helps protect our
natural resources, but also helps businesses create a
healthier work environment, prevent serious injuries or
illnesses, reduce long-term liability risks and reduce the
costs of hazardous waste management and disposal.
The recommended practices for auto recyclers are known
as The 12 Auto Recycler’s Golden Rules. By implementing

12.Storing waste tires in a central location. A waste tire
processing facility, storing more than 1,500 tires,
requires a waste tire permit.
Even though the generation of wastes may be
unavoidable, vehicle recyclers can improve the quality of
Florida’s environment through good waste management
practices. Recycling also contributes to Florida’s economy
by providing nearly 32,000 jobs with an estimated
annual payroll of $765 million and revenue up to $4.4
billion. The best way to reduce liability and to increase a
business’ bottom line is to recycle.
