The Utah Apartment Association and
The Landlord Times have joined forces
to publish the UTAH LANDLORD
TIMES newspaper to an expanded
distribution of over 5,000 Utah landlords.
This partnership will bring together the premier advocate for Utah
Landlords, the Utah Apartment Association and the publishing might of
Professional Publishing Inc., an organization that publishes landlord newspapers in several markets.

Times to provide content and informa-
tion about what is happening in the
landlord world in Utah and are excited to be working with a company
that has their experience and expertise.” The UAA previously published
a bi-monthly Journal Magazine. That
publication will be discontinued and
instead the UAA will provide content
for the Utah Landlord Times which
will be published monthly.
The UAA brings a membership
of several thousand property owners
and managers and nearly 300 vendors who will now receive this magazine. The Utah Landlord Times will
initially go out to over 5,000 landlords with expansion plans to reach
between 6,000 and 8,000 landlords a
month.

Fair Housing Education
Conference

speaker at the Fair Housing Education Conference and Trade Show,
April 27th, at the South Towne Expo.
The NBA All Star and former Utah
Jazz basketball player will speak
during the lunch starting at noon at
the Conference, which is held at the
South Towne Expo Center.

Eaton played for the Utah Jazz from
1982 – 1993 and is still the NBA’s alltime leading shot blocker per game.
He is second in total blocked shots
only to Kareem Abdul Jabar. During the Stockton to Malone era, Mark
Eaton’s stifling defense and rebounding prowess helped make the Jazz
one of the best teams in the NBA.
Eaton’s journey to the NBA was
far from conventional. Despite his
7’4 height, he played water polo, not
basketball, in high school. Following
high school he worked as an auto mechanic for three years. He was discovered by an assistant basketball coach
at Cyprus Junior College who encouraged Mark to enroll and try out for
the team. Mark played for two years

2011 Legislature
Protects Landlords

Two bills passed by the 2011 legislature that were supported by the
Utah Apartment Association will restrict the ability of municipalities to
penalize landlords for activity of their
tenants or require costly retrofits.
HB 403, Changes to Fit Premises
Act, sponsored by Jenifer Seelig (D),
Salt Lake City prohibits cities from
punishing landlords when tenants
call police agencies or are victims of
crime. Recently some cities have been
punishing landlords whose tenants
call the police more than the average
property. They do this by charging
landlords higher business license fees
if they don’t evict tenants who have
called the police multiple times.
“It’s an issue of public policy that it
is bad policy to penalize people who
are victims of crime or are cooperating with law enforcement by calling
the police,’ said Zane Froerer, an attorney who practices landlord law. “A
landlord should only be penalized if
they are not taking general corrective
actions like doing the proper background checks or removing tenants
who are causing problems,” he said.
HB 403 also prohibits landlords
from evicting tenants who are victims of crime or who call the police
for reasonable reasons. “The reaContinued on page 2

son this new provision won’t have
much effect on landlords is they still
can evict for nuisance (such as committing a crime or allowing criminal
activity on the premises). The ability
to evict for nuisance is still in effect,”
Froerer says.
The impetus for the bill was tenant and domestic violence advocates
who complained to Representative
Seelig about cities forcing landlords
to evict crime victims. “My focus here
was to get this (pressure to evict crime
victims) to stop,” she said. She took
language to the Apartment Association early in the session and the UAA
and the League of Cities and Towns
worked with her on language that all
parties were comfortable with.
Another bill that will protect landlords is SB 178, Municipal Land Use
Modifications, Curt Bramble (R),
Provo. This bill gives cities the right
to require older rental buildings to
make health and safety upgrades.
However, the scope is very limited.
The bill says cities can only require
battery or plug in smoke detectors,
GFI outlets on existing wiring, installation of larger basement windows if
there is enough room in the yard for
window wells and if doing so won’t
affect the structural integrity of the
building, and plumbing and electrical upgrades only if a licensed professional says they are unsafe or not
operable.
“The good thing about this bill,”
says Mike Ostermiller, a lobbyist who
worked on the bill for the UAA, “is
that by creating a list of what cities
can require older properties to do, it
also has created a list of what they
can’t require and that list is anything
not specifically in the bill.”
The bill came about from Provo residents who were upset about changes
in state law last year that wouldn’t
let cities deny nonconforming rental
properties business licenses. The sponsor, Senator Bramble, approached the
real estate community with the citizens proposal and negotiated compromise language. Taylor Oldroyd,
CEO of the Utah County Realtors Association supported the bill and was
happy with the compromise.
“I think this bill does two things,”
he said. “First it reaffirms that cities
cannot take away nonconforming
uses. It also reaffirms that life safety
issues are important. It protects tenants by allowing for safety upgrades
but also protects landlords by affirming cities can only act to require upgrades under certain circumstances.”
Oldroyd said that his original concern that cities could require expensive retrofits that would force landlords not to rent older buildings has
been addressed and he is comfortable
that good middle ground has been
reached.

title game. In 1979, he was drafted
107th in the 5th round by the Phoenix
Suns, but chose instead to continue
playing college ball at UCLA. Eaton
did not see much playing time with
the Bruins, and upon graduation few
NBA teams were interested in him,
but the Utah Jazz took a chance and
drafted him with the 72nd pick in the
fourth round.
He had an immediate effect on
defense, blocking 275 shots his first
season, third in the NBA. Over the
years, he improved and became the
leading shot blocker and one of the
2
leading rebounders in the NBA. In
1989, Eaton played in the NBA All
Star Game along with teammates
Karl Malone and John Stockton.
Since leaving the NBA, Eaton has
been a commentator for KJZZ-TV
and an entrepreneur. He has also
led a non-profit that has helped over
3,000 at-risk-youth have sports opportunities.

When I was a kid, I played on a lot
of baseball teams. Some were champions and some had losing records.
It was definitely more fun to play
for a winner. That’s why we should
all be excited to be part of the UAA
team! Whether you are a resident, a
member, or an associate, we all can
benefit from this great organization.
It has truly been amazing to see what
the UAA has accomplished the past
several years, and if we all lend our
support, we can expect even greater
things for 2011.

lenges we encounter. We are fortunate to have an outstanding staff in
the UAA office to lend support and to

hand. We are also fortunate to be financially sound and to be in a strong

This coming year, we plan to continue our emphasis on education,
political action, public relations and
service to our community. We have
just completed another successful
legislative session at the state capitol.
We thank you for your contributions
to our Political Action activities and to
those legislators who have supported
our interests. The impact of these efforts continue to be extremely ben-
eficial to our industry. Your financial
contributions to our PAC funds are
essential to the success of this work

Collecting From Bad Tenants Requires Preparation

E
ven in good times, some tenants will leave owing money.
In tougher times, problems can increase. While every landlord should
attempt to avoid risky tenants through
effective background checks, it is also
important to prepare for effectively
collecting if there is a default.
The best way to prepare for effective collection is to start at, and even
before the signing of a lease. The two
most important steps are to acquire
the right information about the tenant up front and to have appropriate
language in your rental contract that
will enhance your ability to collect if
tenants do default.
Information to Acquire up
Front:
Indentifying information like social security number, driver’s license
number and birthday of all occupants
over 18 are essential. Next, obtain information about job history and bank
account numbers. Garnishing wages
and bank accounts are two of the most
effective ways to collect debt. Always
take a photocopy of any personal
check so you have the bank account
number in case you need it. Also, be
sure to regularly update job informa-
tion. For instance, when you know
there has been a job change or at least
once a year you should get updated
information on their employment.
All contact numbers including cell
phone numbers and emails of all tenants and an emergency contact are
very important. When someone owes
you money, the more ways you have
to track them down the better.
Language to Have in Your
Contract:
In 2010, the Utah Legislature authorized business owners to have a
clause in their contracts that allow up
to a 40% collection fee to be added
to any account that is sent to a attorney or agency for collection. This allows an owner, for instance, that has
a $1,000 owed by a tenant to use the
threat of an additional $400 tacked
on top to get tenants to resolve debts
before going to collection. If collection
is required, the account automatically
becomes $1,400, which provides an
additional incentive to collectors to
do all they can to collect. To do this,
you must have the clause written into
your contract.
All contracts should also have language allowing a prevailing party in
any lawsuit to collection attorneys’
fees and court costs. If you don’t have
a good 2011 or newer Utah specific
rental contract, I recommend the
Utah Apartment Association Residential Rental Agreement. It has all
the language you need - and more to protect your interests and pave the
way for maximizing collections on
bad debt. Use of this contract is free
to UAA members.
How Soon to go to
Collections:
When tenants move out owing
money, you are required to send them
a letter within 30 days of move out to
the last known address outlining the
charges owed minus any deposits
you were holding. This letter should
have language asking them to pay the
amounts due immediately or risk having you vigorously pursue collections.
How long you wait to do that is up to
you. If a tenant is working with you,
it may be a good idea to work with
them on your own. This way they
won’t be charged the additional 40%
if you send the amount to collections
and you won’t have to pay any fees
to a collector. However, if someone is
not responding to you, 30 days may
be a reasonable time to wait.
How Long Can You Pursue
Bad Debt?:
The statute of limitations is 6 years
in Utah. Remember you can’t add the
40% unless it is in your contract (start
immediately using a contract like the
UAA’s that has that language in it).
A typical collection agency or attorney charges anywhere from 25-40%
of the amount collected. Remember,
the ability of a collector to collect is
largely based on your preparations.
The better the info you get, specifically on jobs and bank accounts the
more likely you are to be successful in
collection. On the other hand, if you
chose to rent to deadbeats with bad
credit who aren’t employed you will
have a very difficult time; thus, you
shouldn’t expect too much of your
collector. Also, remember, rental collections take time, sometimes years.
The best advice for landlords is
have a good upfront system that gives
you good information prior to move
in, reduce risk by not renting to people who have had credit problems in
the past or who are not steadily employed, and then turn over all of your
accounts to a collector within about
90 days on the default. If you do this,
you may receive as much as 30-40% of
the debt owed you.

New Rental Contract Released

T
he 2011 Utah Apartment Association Residential Rental Agreement is now available and contains
several exciting new updates. The
form is updated when laws change or
to accommodate court interpretation
changes and new challenges in rental
property management. Changes include language allowing higher collection fees, clarifying procedure
for testing apartments, clarifying
tenant’s responsibilities concerning
pests and an option requiring renters
insurance.
The most significant change is inclusion of language authorized by
the 2010 legislature concerning additional fees that are added if a debt
is sent to a collection agency or attorney. HB 452 (2010), Sandstrom (R),
Orem, allows a business to impose
additional fees in the contract of up
to 40% if any debt created under the
contract is sent to a collection agency
or attorney. This is only allowed if the
business uses a contract with the statutorily allowed language in it. The
2011 UAA Rental Agreement contains language that allows for the additional charge if tenants don’t work
out debts with you before you send it
to collections. This benefits an owner
who uses this lease because they have
leverage to encourage debtors to pay
before sending them to collections. It
also provides more potential revenue
if they force you to hire a third party
collector that will help cover the cost
of that collector.
Another change is on testing properties a tenant suspects to be contaminated. The new language specifies
that a tenant cannot do testing them-
selves but must request testing to the
property owner by a licensed professional and pay for it in advance. It
also states that test results only have
to be disclosed if they are in excess
of state standards. Many tenants are
currently getting notoriously unreliable meth and mold tests and trying
to use results to get out of lease agreements. Landlords want our places to
be safe and are happy to test anytime
at a tenant’s request as long as we use
licensed professionals and receive
payments in advance.
Bedbugs and other pests have become a very big problem in Utah.
The new lease addresses bedbugs
and other pests by clarifying that if
a tenant brings them in on bedding,
furniture or clothing that they are responsible for cleanup costs. It states
that tenants warrant and represent
items they bring in will be free of
pests and requires they take responsibility for any costs caused by the
breach of that warranty.
Requiring renter’s insurance is
now an option that is available in
the UAA lease. Many companies require renter’s insurance as a way to
mitigate risk. For instance, if tenants
start a fire, renters insurance may
cover the damages. Also if there is a
flood or theft, a renter is covered and
the event is less likely to cause them
to move out angry at the landlord.
When requiring renter’s insurance,
a landlord is encouraged to require
they be added to the policy as an additional insured.
The UAA lease format is the most
popular lease in Utah and is very
familiar to the courts. Using a Utah
specific agreement that is updated
regularly to keep you on the cutting
edge is very important.
