Third and final reading an Ordinance determining the public necessity for public use and
authorizing the acquisition of a fee simple interest in approximately 0.17 acres known as Lot
17, Block C, Bluff North Heights Subdivision, located at 888 Jefferson Street, as labeled by
Maverick County Appraisal District with property ID No. 5669 (“property”); located in Eagle
Pass, Maverick County, Texas. The property shall be acquired by negotiation and/or
condemnation, if necessary, for the public use of an expansion of the Eagle Pass Water
Treatment Plant and related infrastructure and authorizing the City Manager or his designee
to take all appropriate actions to acquire the fee simple interest in the property by
negotiation and/or condemnation; finding that the meeting at which this ordinance is passed
is open to the public as required by law; providing a severability clause; and establishing an
effective date.
10.
Third and final reading of an Ordinance of the City Council of the City of Eagle Pass, Texas
amending Chapter 13 (Fire Prevention and Protection), Article III, by adding Section 13 - 45
of the City’s Code of Ordinances to provide for a procedure to consider the issuance of letters
of authorization for new emergency medical service providers; finding that the meeting at
which this ordinance is passed is open to the public as required by law; providing a
severability clause; and establishing an effective date.

Third and final reading of an Ordinance amending Sections 14-10 (2) (A–G) and (5) (A–B),
Chapter 14 (Municipal Solid Waste) of the Code of Ordinances of the City of Eagle Pass, Texas,
to provide for new rates/fees to commercial properties and tire delivery; finding that the
meeting at which this ordinance is passed is open to the public as required by law; providing
a severability clause; and establishing an effective date.

Third and final reading of an Ordinance amending the 2015-2016 budget adopted by
Ordinance No. 2015-24 to transfer the Multimedia Specialist position from the Finance
Department to the Administration Department; finding that the meeting at which this

and establishing an effective date.

Third and final reading of an Ordinance of the City of Eagle Pass, Texas amending Article II,
Chapter 2 (Administration) of the City’s Code of Ordinances by adding new Section 2 -35
regarding non-discrimination, non-harassment and sexual harassment; finding that the
meeting at which this ordinance is passed is open to the public as required by law; providing
a severability clause; and establishing an effective date.

Third and final reading of an Ordinance of the City of Eagle Pass, Texas amending Article II,
Chapter 2 (Administration) of the City’s Code of Ordinances by adding new Section 2-36 to
adopt a dress code for city employees; finding that the meeting at which this ordinance is
passed is open to the public as required by law; providing a severability clause; and
establishing an effective date.

Third and final reading of an Ordinance amending Section 2-23(i), Article II, Chapter 2
(Administration) of the Code of Ordinances of the City of Eagle Pass, Texas, by deleting in its
entirety and adopting new Section 2-23 (i) to provide for updated provisions regarding
payment of vacations or sick leave for termination purposes, or in cases of extreme hardship
or medical hardship; and providing for an effective date.

Third and final reading of an Ordinance amending Section 2-32, Article II, Chapter 2
(Administration) of the Code of Ordinances of the City of Eagle Pass, Texas, by deleting in its
entirety and adopting new Section 2-32 to revise and clarify the educational reimbursement
program; finding that the meeting at which this ordinance is passed is open to the public as
required by law; providing a severability clause; and establishing an effective date.

Consideration and possible approval of a Resolution appointing Members to the Eagle Pass
Library Board.

Consideration and possible approval of a Resolution authorizing the appointment of
Assistant Fire Chief and four Police Lieutenants pursuant to Civil Service, Texas Local

Consideration and possible approval of a Resolution nominating a candidate to the Board of

Consideration and possible action on the petition submitted by Mr. Carlos Mondragon, for
the extension of the “wet zone” to include Abstract A1013, G C & S F R R CO, Survey 5, Acres
.52 (1995 North Veterans Blvd.), where the sale and consumption of alcoholic beverages may
be permitted.
21.
Consideration and possible approval to authorize City Manager to negotiate and execute a
contract extension with Bega Paving, Inc. for micro-surfacing.
22.
Consideration and possible action on directing the City of Eagle Pass Water Works System to
address issues of wastewater/sewer backups throughout the City.

The City Council reserves the right to consider business out of the posted order and the right to adjourn
into executive session to discuss items which are not listed as executive session items but which
qualify to be discussed in closed session under Chapter 551 of the Texas Government Code.

The City Council of the City of Eagle Pass held a special meeting on Tuesday, September 15, 2015
at 5:30 p.m. in the Council Chambers at City Hall, 100 South Monroe Street, Eagle Pass, Texas. All
legal notices were duly posted in accordance with the law.
ESTABLISHMENT OF QUORUM
Present: Mayor Ramsey English Cantu; Mayor Pro-Tem Rudy Villalpando; Council Members
Gloria Hernandez, Yolanda Ramon and Luis Sifuentes.
Absent: None

With a quorum being present, Mayor English Cantu called the meeting to order and the City
Council considered the items as follows.
MOMENT OF REVERENCE
Mayor English Cantu requested the Council and members of the public present to have a moment
of silence as a sign of respect to those who are serving in the military forces and those who have
lost their lives protecting our country.
CITIZENS COMMUNICATIONS AND RECOGNITIONS
Mayor English Cantu asked if there was anyone in the audience wishing to express their
comments on items which did not appear on the agenda, reminding them at the same time, that
although they were unable to take formal action on such items, they would be glad to take it
under advisement.
Mr. Ken Dirksen from Dirksen Engineering approached the Council and expressed his
appreciation for the expediting of item number 19 by the Planning Department.
Mr. Sergio Galindo, owner of Amistad Ready Mix approached the Council and informed them of

his business situation.
Mayor English Cantu then recommended that Administration visit with Mr. Galindo to address
the issue.
PUBLIC HEARINGS
1.
Second public hearing on the City of Eagle Pass Annual Budget for fiscal year 2015-2016.
Mayor, English Cantu opened the public hearing and invited the public to express their
comments.
There were no comments from the public. Therefore, the public hearing was closed.
2.
Public hearing on the request submitted by Santiago and Romelia Herrera, for the
rezoning of Lot 13 in Block 2 of Rancho Escondido, from R-2 (Second On- Family Dwelling District)
to R-3 (A) (Apartment District).
Mayor, English Cantu opened the public hearing and invited the public to express their
comments.
Brian Shea, Director of Community Development informed the Council on the details of the
rezoning. He then stated that the Planning and Zoning Commission along with the Planning
Department recommends approval.
In response to a question posed by the Council, Mr. Shea responded that they are required to
have one and a half parking spaces per unit.
There were no comments from the public. Therefore, the public hearing was closed.
3.
Public hearing on the proposed final Re-Plat of Lot 6 in Block 19 of Lewis Farms
Estate Subdivision Unit 5; closing of public hearing and possible action regarding same.
Mayor, English Cantu opened the public hearing and invited the public to express their
comments.
Mr. Shea informed the Council on the details of the final Re-plat, and stated that the Planning
and Zoning Commission along with the Planning Department recommends approval.
There were no comments from the public. Therefore, the public hearing was closed.

Assistant Planning Director, Vanessa Rosales-Herrera informed the Council on the details,
of the final plat approval, and stated that the Planning and Zoning Commission along with
the Planning Department recommends approval.

Consideration and possible approval of a donation by Major General Homer I. “Pete”
Lewis of an aircraft Cessna 210, XB-NOY to be placed on permanent display at the Dorothy
Jane Lehrer Lewis Park.
Acting City Manager Chavez informed the Council on the details of the donation, and
recommends approval.
After a minor discussion arose among the Council, it was agreed upon to have Administration
draft an agreement for the donation expectations, and also with authority for City Manager to
execute.

Mayor Pro-Tem Villalpando thanked all departments for their work on the budget.
In response to a question posed by the Council regarding progress of streets. Mr. Sandoval
responded that they currently are 35% done with the streets reconstruction, and 8% with the
maintenance of streets.
RESOLUTIONS

Consideration and possible approval of a Resolution declaring the official holidays
for the City of Eagle Pass for fiscal year 2015-2016.
Acting City Manager Chavez recommends approval of the Resolution presented. He further
stated for the next fiscal year we need to look at possibly removing some holidays.

monthly garbage and rubbish collection fee for persons 65 years of age or older, or disabled

Pass as indicated on the tax rolls of the City for the fiscal year commencing October 1, 2015
and ending September 30, 2016.

2014-07 adopting term limits for individuals appointed to City Council boards or
committees to codify the term limit provisions as Sections 2-290 (a)-(c) through 2-291 of
the City Code; adopting new subsections 2-290 (d) and (e) that further clarifies the term
limit provisions adopted in Ordinance 2014-07 and adopting a new Section 2-292 that
eliminates compensation for individuals appointed to serve on City Council boards or
committees; finding that the meeting at which this ordinance is passed is open to the public
as required by law; providing a severability clause; and establishing an effective date .

City Attorney Morales informed the Council that the latest changes were in a separate
ordinance presented to Council at this meeting.
Councilmember Hernandez recommended to clarify the language, as to when the violation
fee begins. City Attorney then stated he would add language to address this concern.

the City of Eagle Pass due to the adoption of Civil Service for police officers and fire fighters by
(1) adding a pre-emption clause; (2) amending the personnel rules and regulations regarding sick

leave accruals for Civil Service police officers and firefighters; (3) amending the personnel rules
and regulations regarding the separation of sick leave accruals for Civil Service police officers and

In response to a question posed by the Council regarding the timeframe for adoption. Mrs. Perez
responded that the adoption date is October 30, 2015.

Third and final reading of an ordinance approving and adopting the budget of the
City of Eagle Pass, Texas, for the 2015-2016 fiscal year; finding that the meeting at which
this ordinance is passed is open to the public as required by law; providing a severability
clause; and establishing an effective date.
Mayor English Cantu stated that balanced budgets were sent out to the Council on Friday
of last week for review.
Mrs. Garza presented the proposed budget for the 2015-16 fiscal year, and informed the Council
in detail, and highlighted on the following, and answered questions from the Council:







Every Department: Positions that were approved in the current budget vs. new ones that
are requested for next year
Amounts for Salaries and Benefits is $17,000.00 difference from Workshop II
Capital Outlay: $961, 232.00
Solid Waste Fund: Expenditures $ $4,598,579.00
Additional positions that were removed from previous Budget Workshop: Assistant Chief
of Police, and ICT Director. (ICT Director position was eliminated, and combined into the
Economic Development Director position)
Grant Administrator Position: new position (current Grant Writer Contract will be
eliminated)
Health Inspector: on hold until Ordinances are in place
After much discussion regarding not having the proper ordinances needed for the Health
Inspector position in place, by consensus of the Council, it was agreed to have a deadline of 3
months to have the ordinances in place.

2 positions added under the Golf Course (changed from part-time to full-time)
Solid Waste overtime: $102,000.00 (amount is based on previous years)
Contributions to Others: $133,100.00
Other Special Revenue Funds: Room Occupancy Tax Committee $242,071.00
Storm Drainage Fund: funds have dried out
ICT Revenues: $79,556.00
General Funds Expenditures by Departments: increases in some departments are due to
reclassifications to the proper departments
IT Network Systems Administrator: new position for the IT department in order to have
a staff of three
Assistant Municipal Court Judge funding comes is classified as salary under Extra Help
($10,000)
Finance Department: Furniture & Equipment; increased in order to purchase software
Finance Department: Travel & Training; increased due to educational reimbursement
program provided by the City
Public Works Department: new position Public Works Business Manager
Pg. 46; correction to 3 Recreations Programs Special to 8 Recreation Programs Specialist
After much discussion regarding the Pay Plan and job descriptions. Mrs. Perez stated that
currently the Pay Plan is pending to have a formal organizational chart for each Department City
wide, and that the Pay Plan is now at 100% of the market value.

To approve Ordinance (2015-24) on third and final reading adopting budget
presented by Administration; and to ratify the property tax increase reflected in
the budget which totals a tax rate of $0.546017/$100 assessed value for tax rate.

Third and final reading of an Ordinance levying a tax rate for the City of Eagle Pass
for the tax year 2015; finding that the meeting at which this ordinance is passed is open to
the public as required by law; providing a severability clause; and establishing an effective
date.
Mayor, English Cantu informed the Council that the 2015 tax rate of $0.340789/$100 for
Maintenance and Operation is the same as in 2013; $0.205228/$100 value for the payment of
principal and interest on debt of the City’s long term debt; $0.546017/$100 is the total tax rate
for 2015. The average home valuated at $112,704, this increases the tax amount by $39.78 which
equates to $3.31 per month.

The Council expressed their concerns and responsibilities as elected officials regarding the tax
increase for 2015.

rate be increased by the adoption of a Tax Rate of $0.546017/$100 which is
effectively an 11.073 percent by which the proposed Tax Rate exceeds the
effective Tax Rate. The 2015 effective tax rate is $0.4191581/$100.

Consideration and possible approval of a subdivision variance to plat a property,
legally defined as Buena Vista Addition, Block A, Lot 6 in of North 35 Feet and Survey 37,
Abstract 835, 0.1343 Acres, prior to obtaining city utility services and related building
permit(s) approvals located at 1069 Del Rio Boulevard.
Mrs. Rosales-Herrera informed the Council on the details, of the subdivision variance, and
stated that the Planning and Zoning Commission along with the Planning Department
recommends approval.
In response to a question posed from the Council Mrs. Rosales-Herrera responded that if
the City Council approves the subdivision variance this is a one-time issuance of building
permits for the property and does not attempt to alter, amend, or remove any covenants
or restrictions or waive any platting requirements for the property.

The City Council of the City of Eagle Pass held a special meeting on Tuesday, September 16, 2015
at 4:30 p.m. at the International Center for Trade-East Room, 3295 Bob Rogers Drive, Eagle Pass,

JOINT WORKSHOP WITH COMMUNITY DEVELOPERS

Discussion on possible action on the City of Eagle Pass comprehensive strategic
planning and community development strategies and discuss process, methods and
efficiency goals with community developers.
Mayor English Cantu and Acting City Manager Chavez welcomed everyone.
At this moment there was a formal introduction of everyone present at said meeting.
Brian Shea, Executive Director of Community Development then addressed the Council, and
gave a presentation that went into detail of the duties/functions of every employee that
pertains to the Planning and Building department.
At this moment Councilmember Sifuentes arrived at said meeting.
Mr. Shea also went into the details of the processes/checklist of the following:

Within the presentation Mr. Shea went into detail of comments that were addressed at a
previous developers meeting held in 2011 as follows:
 Utility Standards and Inspections Process
 Road Standards and Inspection Process
 Detention Standards
 Park and Dedication and Landscaping
 Subdivision Processing Timelines
Mr. Shea then informed everyone that they are in the process of updating the Construction
Specification Manuel to work with utility providers to come up the specs needed. He also
advised that he was working on a subdivision ordinance that addressed many of the
concerns/issues that are in the current ordinance. Mr. Shea also stated that all his work
was in his computer, which is currently corrupted with a virus and he has not been able to
retrieve any information. Mr. Shea further stated that he has to recreate every document
he has stored in his corrupted computer.
Councilmember Sifuentes then stated that this also happened in the School District and
there is nothing that can be done to retrieve information.
Mayor English Cantu then stated that at this time they would take any feedback from
developers in regards to Utility Standards and Inspection, Road Standard and Inspection
Process.
Mr. Clayton Brown then stated the following concerns in general:
 Cost Sensitive- lots too expensive
 Reduce some of the standards
 Become the most pro-growth City on the border
 Need to have less obstacles for new development
 Legal Opinion slows down the process – some issues were not done correctly
in the past and these should be grandfathered in; consider have a small
group/committee to handle opinions
 Have an attitude to make things work
Mayor English Cantu then stated the community needs to be pro-growth, and keep growth
in our City and not have developers/investors go to other Cities.

Councilmember Hernandez thanked Mr. Brown and stated that there is always room for
improvement. She further stated if there are any issues/concerns in regard to ordinances
for these to be brought to City Council. She further stated that she also wants the City to
be pro-growth.
Mayor English Cantu then stated that they can work on ordinances, and they can look good
on paper. But once they, are implemented it may not be the best for pro-growth.
Mr. Brown then complemented Mr. Shea on the good work they have done in organizing
the Planning Department, and now that Mr. Shea is aware of the areas that have issues, we
need to move forward.
Ms. Monica Cruz expressed her issues/concerns and stated the following:
 Timeframe- too long for a re-plat it took 1 ½ years to get approved
 Always something new added to Checklist - in which some projects were already in
the middle, and applicant has no choice but to comply and accrue more expense to
project
 Need to know why or where is the delay in the process
 New Development process very confusing
 Sidewalks- first told they are needed, and then told they are not needed
 Have consistency in checklist
Mayor English Cantu then stated that the Council is enforcing consistency with new
development/subdivisions to have sidewalks.
Mr. Ken Dirksen thanked Mr. Shea, and stated the following:
 The City is one of the most pro-growth Cities around
 Subdivision Code Section 23-10 Scope-; Suggested addressing tracks less than 5
acres
City Attorney Morales then briefed everyone on the process of platting less than 5 acres.
He further stated he is aware of the issues related to this matter, but State Law requirement
that anything under 5 acres needs to be platted. Councilmember Hernandez then stated
that we need to make the changes at the City level as long as it’s platted.
 Subdivision Ordinance should address difference between commercial and
residential lots

After a minor discussion arose regarding placing items on the Planning and Zoning
Commission (P & Z) agenda, and then after on the City Council agenda, Mayor English Cantu
stated that this issued can be address at the Administration level.
Mr. Abner Martinez stated the following concerns:
 Subdivision rules- three different processes
 Time of services – taking too long
 Have only the minimal state requirements
 Clarify/Distinguish between commercial and residential development
Councilmember Sifuentes questioned Mr. Shea on the timeframe for a subdivision process.
Mr. Shea responded that fifty percent of the time the applications are submitted
incomplete delaying the process, and when submitted complete it takes a couple of weeks
depending on response of applicants. Mr. Shea further stated that every applicant is a
different situation, and they are processed as quickly as they can.
Mr. Paco Mondragon stated his concerns/issues, and suggestions and stated the following:
 Timing being a major issue
 Analysis time on projects; basing themselves by the last 10 project in order to have
a more accurate time and improve on expediting projects
 Have more P & Z meeting, not wait until they have two or more applicants to have
meetings; suggested twice a month
 Be more consistent
 Tract time and set goals
 Narrow the reports that come to Planning and Zoning
After a minor discussion arose regarding placement of items on P & Z agenda, then after
placing on City Council Agenda, Councilmember Sifuentes then suggested that to place
items on City Council agenda subject to pending Planning and Zoning approval. Mayor
English Cantu again stated that this issue can be addressed by Administration.
Mr. Bob Jaffer stated his concerns and stated the following:
 Too much work load; Needs more staff
 Timing- too long
 Need more P & Z Meetings; have meeting twice a month
Councilmember Sifuentes concurred with Mr. Jaffer and stated that for a very long time

Councilmember Sifuentes asked what is the plan of action that we can take to avoid delays.
Mr. Shea responded that all the information is in the corrupted computer, it does address
issues/concerns to shorten the processes. Mr. Shea then stated that the Planning
Department has been running in the red since he got here. He further stated that there is
not charge for a subdivision variance, and this involves a lot of research.
Mayor English Cantu then stated the all issues/concerns addressed at this meeting will be
reviewed. He further stated that most of the issues are addressed in documents contained
in the corrupted computer, which will hopefully be able to be recovered.
City Attorney Morales then suggested the following comments to the
Developers/Architects:
 Use Checklist every time to assure all requirements are met every time an
application is submitted
 Developer holds engineers accountable in regards to application process
 When Legal reviews the applications; we follow the same checklist that is provided
to applicant
 Applicants need to do their part in submitting a complete application, this will avoid
any additional delays in process
 When a plat is submitted within 30 days it has to go to P & Z, if it doesn’t go to P &
Z it automatically approved; and within 30 days after that it has to go to City Council
if P & Z didn’t take action because it wasn’t ready/reviewed then City Council will
have no choice but to deny request/application
City Attorney Morales finally stated that the major issues are in the submitting stage of the
application, and when it goes to P & Z, Acting City Manager Chavez also concurred with
legal. Mr. Chavez further stated that we all need to work together and use the Checklist.
Ms. Cruz asked if the City has an engineer that reviews applications. Mr. Shea responded
“yes”. She then stated that there is also a delay once it is approved by City Council in
getting documents processed and signed. Ms. Cruz also suggested that if the contractor
instead of developer get the bonds issuance, as it is done in other cities.
After a minor discussion arose in regards to bond issuance and letter of credit, it was agreed
to be looked into.
Mr. Gene Mireles then stated his concerns as follows:

 Ordinances in the past were processed/produced by picking and choosing from
other cities, and then put together; results have a very bad ordinance and having to
work with this for several years
 Planning Director is getting too many things to do; department overload with work
 1 year to develop a property
 Work on Checklist
 Things change during the process; and things need to be re-planned at the expense
of the developer
 Need a new ordinance
 More staff to focus on applications
 Process is very complex and needs to be addressed in new ordinance
 Timing in regards to P & Z, and City Council meetings
 Cost also an issue- property lots very expensive
Mr. Jaffer thanked the Council and stated that we are moving forward, if we made mistake
in the past we learn from them and move forward, and forgive each other.
At this moment Mayor Pro-Tem Villalpando left the meeting.
Councilmember Sifuentes then stated that we need to help with cost to developers by using
Economic Development Tools and move forward. Mr. Brown then stated that the City of
San Antonio is very aggressive in utilizing these tools to attract more businesses.
Mayor English Cantu thanked everyone present, and stated that there is a number of notes
that he has taken from all of the comments/issues in which City
Council will be looking to better enhance the way that the structure is handled , and process
for development. He further stated that the major issue is how we can improve our
Planning Department.

Fire Chief Manuel Mello also expressed his gratitude to Mr. Villarreal for his years of service with
the Eagle Pass Fire Department.

Consideration and possible approval an Ordinance determining the public necessity
for public use and authorizing the acquisition of a fee simple interest in approximately 0.17
acres known as Lot 17, Block C, Bluff North Heights Subdivision, located at 888 Jefferson
Street, as labeled by Maverick County Appraisal District with property ID No. 5669
(“property”); located in Eagle Pass, Maverick County, Texas. The property shall be acquired
by negotiation and/or condemnation, if necessary, for the public use of an expansion of the
Eagle Pass Water Treatment Plant and related infrastructure and authorizing the City
Manager or his designee to take all appropriate actions to acquire the fee simple interest
in the property by negotiation and/or condemnation; finding that the meeting at which this

the Council on how this ordinance would assist with the factors that are needed to approve the

Consideration and possible action of an Ordinance amending Section 14-10,
Subsections 2 (A–G) and 5 (A–B), Chapter 14 (Municipal Solid Waste) of the Code of
Ordinances of the City of Eagle Pass, Texas, to provide for new rates/fees to commercial
properties and tire delivery; finding that the meeting at which this ordinance is passed is

In response to a question posed by the Council regarding establishing an ordinance to address
tire businesses in collecting tires, and charging a fee reimbursable to the City. Mr. Chavez
responded that “yes” we can have an ordinance to address this, but the County is not required.

Consideration and possible approval of an Ordinance amending Section 9. - B-2 (Central
Business District) of Appendix A (Zoning Ordinance) of the Code of Ordinances of the City of Eagle
Pass, Texas to prohibit establishment of flea market operations in the Central Business District;
finding that the meeting at which this ordinance is passed is open to the public as required by
law; providing a severability clause; and establishing an effective date.

Mr. Shea informed the Council on the details of the ordinance, and stated that the Planning
and Zoning Commission, along with the Planning Department recommends approval. He
clarified that all current flea markets in this area will be grandfathered in.
Councilmember Hernandez expressed her concerns with this being a change in land use
and not having the proper public hearings and notices. Acting City Manager Chavez stated
it would be in the best interest of all to have public hearings to obtain citizen input.
After a minor discussion within the Council, it was agreed that the purpose of this ordinance was
not to have flea markets in the downtown area, and that the current ones in place would be
grandfathered.
Councilmember Hernandez reiterated that this is a change of land use and proper notice has not
been given.
Motion made by Councilmember Sifuentes second by Councilmember Ramon: motion does not
carry.
City Attorney Morales then stated that the wishes of the Council are to have public hearing prior
to presenting this ordinance again.

Consideration and possible approval of an Ordinance amending the 2015-2016
budget adopted by Ordinance No. 2015-24 to transfer the Multimedia Specialist position
from the Finance Department to the Administration Department; finding that the meeting
at which this ordinance is passed is open to the public as required by law; providing a
severability clause; and establishing an effective date.
Acting City Manager Chavez informed the Council on the details of the ordinance, and
recommends approval.
Councilmember Sifuentes questioned why the Human Resources Department is requesting this
item instead of Administration. Human Resources Director, Isabel Perez responded that when
they are personnel requests, she usually always submits these on behalf of the Department Head.

Acting City Manager Chavez informed the Council on the details of the agreement, and

Councilmember Hernandez expressed her concerns regarding the availability of funds to
cover the cost of this agreement, and for the Economic Developer. Mr. Chavez then stated
that there are sufficient funds to cover this agreement, and with respects to the Economic
Developer this is still in the works, and this position is not in place at this point.

Acting City Manager Chavez informed the Council of the details of the selection of a construction
firm for a miniature golf course, and is recommending Harris Miniature Golf.
Mayor Pro-Tem Villalpando questioned the cost to complete the entire golf course. Mr. Chavez
responded that for the long term it would be an estimated $700,000.00 to $800,000.00.

Hector Chavez, Acting City Manager informed the Council on the details of the proposed changes
to the ordinance.
After a minor discussion arose in regards to who makes the recommendations, it was agreed
that the department head, in consultation with human resources, make the recommendation.
Another discussion ensued in regards to reporting an incident. City Attorney Morales
recommended to remove the word “their” and add wording of “the complaint’s” to section “e”.
City Attorney Morales expressed his concern with the removal of the section regarding drug and
alcohol use policy. Mrs. Perez stated that it will be addressed in a separate ordinance.
Mayor English Cantu expressed his concerns regarding on properly informing the employees and
translating policies in Spanish. Mrs. Perez responded that they are working on having mandatory
training to further educate the employees and also working on translating the policies.
Councilmember Ramon suggested to have employees take online training in regards to sexual
harassment.
Mayor English then stated the corrections as follows: to remove the word “their” and add “the
complaint’s” to section “e” , and change the word “the” to “their” in the paragraph of 2
Responsibilities.

Mayor English Cantu asked as to the timeframe to give notice to the department heads. Mrs.
Perez responded that the requestor should submit prior to registering and also during the
Budgeting season.
City Attorney Morales then expressed concerns with the course of study being directly related to
the employee’s job in second paragraph of Section 2-32. A minor discussion ensued and by
consensus of the Council, it was agreed to have the wording of “job” removed and replaced with
“employment”.
Councilmember Ramon suggested to also include vocational trainings to this program, and by
consensus, the Council agreed.
After a minor discussion arose regarding employee deductions pertaining to the Educational
Reimbursement Program. Mrs. Perez stated that there is a form that is filled out once an
employee is approved for this program, and it does have a section specifying the conditions, and
acknowledgement of deductions. By consensus, the Council agreed to include the form for the
second reading for approval, along with the ordinance.

PUBLIC HEARINGS

Mayor English Cantu opened the public hearing and invited the public to express their
comments.
Hector Chavez, Acting City Manager informed the Council on the details of the Texas
Community Development Block Grant Contract.
Mayor English Cantu then stated that for the record, the City is working on the issue off of
Yoblanda and Camarinos Streets.
There were no comments from the public. Therefore, the public hearing was closed.
At this moment, by consensus of the Council, the items were considered as follows:

Presentation by South West Area Regional Transit (SWART).
Ms. Sarah Hidalgo-Cook, General Manager of SWART approached the Council and informed them
in detail, of the history and services that SWART provides to the City and County.
City Attorney Morales then questioned if there is an existing franchise agreement between the
City and SWART. Ms. Hidalgo-Cook responded that they do not, since they are a political
subdivision of TXDOT they are not required to have a franchise agreement to run on city streets,
county roads, or Texas highways.
She further stated that SWART is requesting the endorsement of the City, and is also required to
hold public hearings. City Attorney Morales then questioned where the public hearing will be
held. Ms. Hidalgo-Cook responded that they can be held at City Hall, Middle Rio Grande or the
office of SWART. Ms. Hidalgo-Cook further stated that she would like to work with the City hand
in hand to provide other services as well, and has a target date of December to present to Council.
Mayor English Cantu then expressed his concerns regarding the possibility of the City deciding to
have their own means of public transportation in the future. Ms. Hidalgo-Cook stated that when
the City reaches a population of 50,000, the SWART will not be able to provide services to
residents that live in the City, due to the fact the City would be considered a small urban transit.
Mayor English Cantu then suggested to have our Media Technician possibly assist in having a PSA
that informs our citizens of the services that SWART provides.

CITY MANAGER’S REPORT
3.
Update on the flood of October 8, 2015.
Acting City Manager Chavez informed the Council, and gave a detailed presentation on the
flood. He also briefed the Council on the history of drainage plan/study dating back to 2000,
and answered questions from the Council.
Acting City Manager Chavez also informed the Council that he would like to submit an
application to do a re-study of not only the flood areas, but also the new areas north of
town developed. He further recommended to have a Bond Election rather than Certificates
of Obligation, and this would require the citizens to vote for or against. He also stated that
we would need to educate the citizens, and convince them of why we need this.
Mayor English Cantu then suggested that instead of looking at a tax increase, maybe look
at an increase to the storm drainage fee for a limited period.
Mayor English Cantu then recommended to have a workshop to identify what the next steps
will be to move forward with actually funding it or looking at potential options for the
Council to consider. He further stated that if there are ways for us to further remedy the
situation in the meantime or to at least alleviate and make sure our canals are clean, due
to potential rain that is to come.

Government Code – Discussion of Personnel –Appointment/Reappointment of Municipal
Court Judge, and Assistant Municipal Court Judges; and possible action in open session

Mayor English Cantu stated that after reviewing appointments, and considerations for the
Municipal Court Judge and Assistant Municipal Court Judges these are put forth as
resolutions for Council to consider.
Mayor English Cantu stated that Mr. Francisco Martinez, III will be reappointed as Municipal
Court Judge, with the following modifications to Resolution and Terms of Agreement:
Terms of Appointment:
 Salary increase from $70,000.00 to $85,000.00
 Administrative/personnel matters will be addressed through the Court
Administrator under the direction and approval of the Municipal Court Judge.

 Section 3: Day-to-day activities and/or scheduling conflicts shall be coordinated by

Department Highlights:
We continue with the After-School Boys’ Flag Football and Girls’ Volleyball Leagues. With basketball season
around the corner, we are preparing to hold the mandatory coaches’ meetings as well as getting everything in
place for the Cheerleading Competition.
The Oldies but Goodies Dances continue. We are working on an art project that we are hoping generates
interest among the teens in our community.

ORDINANCE NO. 2015AN ORDINANCE TO RATIFY ORDINANCE 2015-28 CREATING
“ASSIGNMENT PAY” FOR CERTAIN ASSIGNMENTS FOR CIVIL
SERVICE EMPLOYEES WITHIN THE POLICE DEPARTMENT AND
“CERTIFICATE PAY” FOR CERTAIN EMPLOYEES IN THE FIRE
DEPARTMENT HOLDING CERTAIN CERTIFICATIONS; FINDING THAT
THE MEETING AT WHICH THIS ORDINANCE IS PASSED IS OPEN TO
THE PUBLIC AS REQUIRED BY LAW; PROVIDING A SEVERABILITY
CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE
WHEREAS, the City of Eagle Pass adopted Chapter 143 of the Texas Local Government Code
for its police and fire departments;
WHEREAS, there are specialized assignments within the Police Departments that certain police
officers perform that are not performed by every police officer;
WHEREAS, § 143.042 of the Texas Local Government Code states that the governing body of a
municipality may authorize assignment pay for police officers who perform specialized functions
in the Police Department;
WHEREAS, § 143.042 (c) of the Texas Local Government Code requires that the governing body
must set forth in an ordinance the amount of assignment pay and the conditions under which it is
to be payable to members of the Police Department;
WHEREAS, § 143.044 of the Texas Local Government Code states that the governing body of a
municipality may authorize certification pay for certifications held by firefighters;
WHEREAS, §143.044 of the Texas Local Government Code states that the governing body must
set forth an amount to be paid to each Firefighter who meets the requirements for the certification;
and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EAGLE PASS, TEXAS, as follows:
SECTION 1.
Police Officers who are assigned to the following functions by the Chief of Police
shall receive assignment pay in the amount indicated:
Motorcycle Police Officer
$177.00 per month
Canine Police Officer
$177.00 per month
Senior Police Officer
$177.00 per month
Each of the above assignments are specialized assignment within the Eagle Pass
Police Department. The Police Chief or his designee assigns capable Police
personnel to each of these positions of responsibility in accordance with his or
her demonstrated knowledge and familiarity with the job duties associated with
the position.
SECTION 2.
Fire fighters who obtain and maintain the following certifications shall receive
certification pay in the amount indicated:
EMT-Intermediate Certification Range of $242 per month through $325 per
month, based upon years of service as an EMT-Intermediate certified Fire Fighter,
as indicated on attachment hereto.
EMT-Paramedic Certification
Range of $270 per month through $362 per
month, based upon years of service as an EMT-Paramedic certified Fire Fighter, as
indicated on attachment hereto.
SECTION 3.
That the terms of this ordinance and/or any payment of “assignment pay” do
not apply to a member who is performing any of these duties on a “step-up”
“acting” or any other temporary basis.
SECTION 5.
This Ordinance shall be in full force after its final passage in accordance with
the City Charter of the City of Eagle Pass.

WHEREAS, the City Council of the City of Eagle Pass utilized diligent thought and attention to
the preparation of the 2015-2016 fiscal year budget; and
WHEREAS, circumstances have arisen during the fiscal year which, have, or will require to
amend the budget for the Finance Department to reclassify 1 Accounting Clerk to Purchasing
Clerk to facilitate the carrying out of day to day duties related to procurement, and for which
there is no change in budgeted payroll dollars for the Finance department’s budget; and
WHEREAS, the City Council finds the proposed budget amendment reasonable and necessary;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EAGLE PASS, TEXAS,
that:

WHEREAS, following the Planning and Zoning Commission public hearing and meeting, the

effected; and
WHEREAS, the City Council of the City of Eagle Pass is of the opinion that it is in the best interest
of the City and its residents to effect such change in order to promote orderly development of the
City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EAGLE
PASS, TEXAS, that:
SECTION 1.

AN ORDINANCE DETERMINING THE PUBLIC NECESSITY FOR PUBLIC
USE AND AUTHORIZING THE ACQUISITION OF A FEE SIMPLE INTEREST
IN APPROXIMATELY 0.17 ACRES KNOWN AS LOT 17, BLOCK C, BLUFF
NORTH HEIGHTS SUBDIVISION, LOCATED AT 888 JEFFERSON STREET,
AS LABELED BY MAVERICK COUNTY APPRAISAL DISTRICT WITH
PROPERTY ID NO. 5669 (“PROPERTY”); LOCATED IN EAGLE PASS,
MAVERICK COUNTY, TEXAS. THE PROPERTY SHALL BE ACQUIRED BY
NEGOTIATION AND/OR CONDEMNATION, IF NECESSARY, FOR THE
PUBLIC USE OF AN EXPANSION OF THE EAGLE PASS WATER
TREATMENT PLANT AND RELATED INFRASTRUCTURE AND
AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO TAKE ALL
APPROPRIATE ACTIONS TO ACQUIRE THE FEE SIMPLE INTEREST IN THE
PROPERTY BY NEGOTIATION AND/OR CONDEMNATION
WHEREAS, the City of Eagle Pass, Texas has determined that the acquisition of a fee simple
interest to certain real property is necessary and desirable for an expansion of the Eagle Pass Water
Treatment Plant Expansion (“Project”) and related infrastructure; specifically, the Property will be
used to expand the Eagle Pass Water Treatment Plant in order to meet the growing water demands
placed on the Eagle Pass Water Works System; and
WHEREAS, employees, agents, and attorneys acting for the City of Eagle Pass, Texas are in the
process of investigating, surveying, defining, and negotiating the acquisition of a fee simple interest
in the Property, as is needed for the expansion of the Eagle Pass Water Treatment Plant; and
WHEREAS, in connection with the acquisition of the Property, it may be necessary for the City to
enter upon the property to investigate and survey the Property so that it may defined and described
with specificity for the inclusion in any instrument recorded with the Official Real Property Records
of Maverick County, Texas or as part of any filings in an eminent domain proceedings to acquire the
necessary property rights.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF EAGLE
PASS, TEXAS, as follows:
SECTION 1. The above caption and recitals are incorporated herein for all purposes.
SECTION 2. Public necessity for the public use of the Property is required for City of Eagle Pass
to utilize said Property as part of its Eagle Pass Water Works Treatment Plant
Expansion (“Project”) either through the purchase or by the process of eminent
domain for the public purpose and public uses expansion of the Eagle Pass Water
Treatment Plant. The City Council further finds that the public purpose and public
use to be served in and addressed by this Ordinance is paramount to any other private
or public use that may be encountered at the Property.
SECTION 3. The fee simple interest of real property required by the City is identified by Maverick
County Appraisal District with Property Id No. 5669 and being 0.17 acres of land
known as Lot 17, block C, Bluff North Heights Subdivision, known as 888 Jefferson
Street, Eagle Pass, Texas and further depicted and described on the attached Exhibit
A (“Property”).
SECTION 4. The City Manager of the City of Eagle Pass, Texas or his designees acting by and/or
through their attorneys are authorized to institute and prosecute to conclusion, all
necessary proceedings to condemn the Property described herein and to acquire such
interest in the land that the City is unable to acquire through negotiation by reason of
its inability to agree with the owner(s) of the land as to the value of such interest in
the land or other terms, and to take any other legal action necessary or incidental to
such acquisition or eminent domain proceeding to investigate, survey, specify, define,
and secure the necessary property rights.
SECTION 5. All acts and proceedings done or initiated by employees, agents, attorneys for the
City for the acquisition of the Property are hereby authorized, ratified, approved,
confirmed, validated, and declared to be valid in all respects as of the respective dates
of such acts and proceedings.
SECTION 6. If any provision, section, subsection, sentence, clause, or phrase of this Ordinance or
the application of same to any person or set of circumstances is held to be
unconstitutional, void, or invalid, the validity of the remaining portions of this
Ordinance shall not be affected. It is the intent of the City Council in adopting this
Ordinance that no portion hereof or provisions or regulation contained herein shall
become inoperative or fail by reason of any unconstitutionality or invalidity of any
other portion hereof and all provisions of this Ordinance are declared to be severable
for the purpose. The Ordinance shall be effective immediately upon passage by the
City Council and publication thereof in accordance with the City charter for the City
of Eagle Pass.

ORDINANCE NO. 2015AN ORDINANCE OF THE CITY OF EAGLE PASS, TEXAS AMENDING

BY ADDING NEW SECTION 13 – 45, OF THE CITY’S CODE OF
ORDINANCES TO PROVIDE FOR A PROCEDURE TO CONSIDER THE
ISSUANCE OF LETTERS OF AUTHORIZATION FOR NEW
EMERGENCY MEDICAL SERVICE PROVIDERS; FINDING THAT THE
MEETING AT WHICH THIS ORDINANCE IS PASSED IS OPEN TO
THE PUBLIC AS REQUIRED BY LAW; PROVIDING A SEVERABILITY
CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE
WHEREAS, The City of Eagle Pass, is Texas municipal corporation operating as a home rule
municipality (“City”) in accordance with the provisions of Chapter 26 of the Texas Local
Government Code and the Eagle Pass City Charter; and
WHEREAS, the City created and established a Fire Department, which provides emergency
medical services in the City with the goal of providing prompt and efficient transportation of sick
and injured patients, after necessary stabilization; and
WHEREAS, pursuant to Tex. Health & Safety Code § 773.003(8), emergency medical services
means services used to respond to an individual's perceived need for immediate medical care and
to prevent death or aggravation of physiological or psychological illness or injury; and
WHEREAS, emergency medical service providers change over time and new emergency
medical services providers are required to obtain a Letter of Authorization (LOA) from the
governing body of the municipality in which they wish to operate; and
WHEREAS, this Ordinance does not regulate or apply to: (1) air transfers that do not advertise
as an ambulance service and that are not licensed by the Department of State Health Services
(Department); (2) the use of ground or air transfer vehicles to transport sick or injured persons in
a casualty situation that exceeds the basic vehicular capacity or capability of emergency medical
services providers in the area; (3) an industrial ambulance (generally owned and operated by an
industrial facility and not for hire); or (4) a physician, registered nurse, or other health care
practitioner licensed by this state unless the health care practitioner regularly staffs an emergency
medical services vehicle; and
WHEREAS, Tex. Health & Safety Code § 773.051 provides that a municipality may establish
standards for an emergency medical services provider that are stricter than the minimum
standards in state law or rules of the Department; and
WHEREAS, Tex. Health & Safety Code § 773.057(c) provides that the Department may
delegate vehicle inspections to the governing body of a municipality upon the request of the
municipality; and

WHEREAS, the City Council desires to amend Chapter 13, Article III, by adopting a new
Section 13 - 45 of the City’s Code of Ordinances to create a process to evaluate and determine if
a Letter of Authorization should be issued to an applicant that wishes to provide emergency
medical services within the City; and
WHEREAS, this amendment will not apply to: the renewal of an existing and previously
authorized emergency medical services provider that has continuously (no cessation of operation
for more than 90 days) operated in the City; or a municipality, county, emergency services
district, hospital, or emergency medical services volunteer provider organization in this state that
applies for an emergency medical services provider license; and
WHEREAS, the City Council finds and determines that it is in the best interest of and will
promote the public health, safety, morals and general welfare of the community to adopt a
process to evaluate and determine if a Letter of Authorization should be issued to an applicant to
provide emergency medical services within the City and in accordance with state and local law;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EAGLE PASS, TEXAS:
SECTION 1. That Chapter 13, Article III, Section 13 - 45 of the City’s Code of Ordinances is
hereby adopted to read as follows:
(a) Application for a Letter of Approval. The applicant shall submit a written request to
the City Secretary's Office that contains the following:
(1) a copy of the applicant’s emergency medical service provider license and
variance, if any, issued by the Department of State Health Services (Department).
The applicant shall also submit to the City Secretary's Office any pending
applications, renewals, suspensions, revocations or other adverse Department
actions; and
(2) a statement or description as to the type of services the applicant will provide
in the City including but not limited to being a provider of:
(i) basic life-support emergency medical services that provides a vehicle
designed for transporting the sick or injured, has personnel and sufficient
equipment and supplies for providing basic life support, and is capable of
providing emergency and nonemergency transportation;
(ii) advanced life-support emergency medical services that provides basic
life support emergency medical services plus has personnel and sufficient
equipment and supplies for providing intravenous therapy and
endotracheal or esophageal intubation;
(iii) mobile intensive-care emergency medical services that provides
advanced life-support emergency medical services plus has personnel and
sufficient equipment and supplies to provide cardiac monitoring,

defibrillation, cardioversion, drug therapy, and two-way radio
communication; and
(iv) specialized emergency medical services that uses a vehicle, including
a helicopter, boat, fixed-wing aircraft, or ground vehicle is designed for
transporting the sick or injured by air, water, or ground transportation plus
the provider has personnel and sufficient equipment and supplies to
provide for the specialized needs of the patient transported.
(3) a copy of the license or certificate issued by the Department for any
emergency care attendants, emergency medical technician, advanced emergency
medical technician, emergency medical technician-paramedic, paramedic,
licensed physician or other health care professional that will provide emergency
medical services for the applicant in the City. The applicant shall also submit to
the City Secretary's Office any pending applications, renewals, suspensions,
revocations or other adverse Department actions related to the person(s) that will
provide emergency medical services.
(4) a copy of the lease or deed or other proof of ownership of:
(i) the applicant’s primary place of business in the City, which is the
location where the vehicles that are intended to provide emergency
medical services in the City are stored and primarily located and where the
records of the applicant are located; and
(ii) all equipment necessary for the safe operation as an emergency
medical services provider, including emergency medical services vehicles,
heart rate monitors, defibrillators, stretchers, and any other equipment the
Department determined is required of the applicant;
(5) a copy of all insurance policies and coverages applicable to the applicant,
which shall have available limits of at least $1,000,000 per occurrence and
$2,000,000 general aggregate for the following types of coverages: in force
automobile liability insurance; commercial general liability insurance; contractual
liability insurance; broad form property damage liability insurance; personal and
accidental injury insurance; premises and ongoing operation coverage; errors and
omission insurance; and professional liability insurance.
Section 13 – 45 does not apply to: the renewal of an existing and previously authorized
emergency medical services provider that has continuously (no cessation of operation for
more than 90 days) operated in the City; or a municipal, county, emergency services
district, hospital, or emergency medical services volunteer provider organization in this
state that applies for an emergency medical services provider license.
(b) Evaluation for the issuance of a Letter of Approval. Upon receipt of a complete
application for the issuance of a Letter of Approval (LOA) by the City Council of the
City of Eagle Pass, the City Secretary's Office shall distribute the application to the City
Fire Department for further evaluation. The City’s Fire Department shall have 14 days to
investigate, review and comment on the application. The City’s Fire Department shall

immediately forward the comments to the City Council for their consideration. In
coordination with the City’s Fire Department, the City Secretary's Office shall publish a
notice in one or more local papers or periodicals notifying the public of the application
and setting the matter for a public hearing; furthermore, the City Secretary's Office shall
send written notice of the public hearing to all known licensed emergency medical
services providers in the City. Notice shall be published and mailed, via certified mail,
return receipt to the last known address of a licensed emergency medical services
provider located in the City, at least 72 hours prior to the public hearing. The public
hearing process may be completed within 45 days after the receipt of a complete
application.
(1) In preparing for the evaluation, the City’s Fire Department shall gather and
present evidence at the public hearing to the City Council:
(i) if the addition of another licensed emergency medical services provider
will interfere with or adversely affect the provision of emergency medical
services by the licensed emergency medical services providers operating
in the City;
(ii) if the addition of another licensed emergency medical services
provider will remedy an existing provider shortage that cannot be resolved
through the use of the licensed emergency medical services providers
operating in the City;
(iii) if the addition of another licensed emergency medical services
provider will cause an oversupply of licensed emergency medical services
providers in the City;
(iv) of the number of licensed or certificated emergency medical services
personnel, providers, and vehicles in the City; and
(v) of any other relevant information, including the applicant’s corporate
status with the Secretary of State and Comptroller of Texas, complaints
filed with the Department, disciplinary actions taken against the applicant
by the Department, and a copy of the Department’s summary of the annual
number and types of runs of the emergency medical services providers
operating in the City.
(2) In considering whether to grant a LOA, the City Council may issue a LOA
only after a public hearing and only if the City Council determines that:
(i) the addition of another licensed emergency medical services provider
will not interfere with or adversely affect the provision of emergency
medical services by the licensed emergency medical services providers
operating in the City;
(ii) the addition of another licensed emergency medical services provider
will remedy an existing provider shortage that cannot be resolved through
the use of the licensed emergency medical services providers operating in
the City; and
(iii) the addition of another licensed emergency medical services provider
will not cause an oversupply of licensed emergency medical services
providers in the City.

(c) Decision. After holding a public hearing, the City Council shall determine if it shall
grant an applicant a LOA based on the forgoing factors. The decision of the City Council
is final and binding and not subject to review. If an LOA is granted and the applicant is
not yet licensed by the Department, then the LOA is issued subject to the applicant
receiving an emergency medical services provider license from the Department, within 3
months of the date of City Council approval after which the LOA shall become null and
void.
SECTION 2. That the City Manager is instructed to make a request on behalf of the City
Council for the City of Eagle Pass to be delegated the authority to collect a fee
and inspect vehicles that are intended to provide emergency medical services in
the City to ensure that the vehicles comply with the criteria and procedures
adopted by the executive commissioner and the City;
SECTION 3. That it is hereby officially found and determined that the meeting at which this
Ordinance is passed is open to the public as required by law and that public notice
of the time, place and purpose of said meeting was given as required.
SECTION 4. If any section, part, or provision of this Ordinance is declared unconstitutional or
invalid by a court of competent jurisdiction, then, in that event, it is expressly
provided, and it is the intention of the City Council in passing this Ordinance that
its parts shall be severable, and all other parts of this Ordinance shall not be
affected thereby and they shall remain in full force and effect.
SECTION 5. This Ordinance becomes effective immediately after being passed and approved
on third and final reading.

WHEREAS,
Section 14-10, Chapter 14 Municipal Solid Waste, of the Code of Ordinances of
the City of Eagle Pass which regulates schedule of rates/fees for commercial
properties has not been modified in three years and there is a need to modify in
order to be competitive with surrounding South Texas areas.
WHEREAS,
the City manager of the City of Eagle Pass is of the opinion that it is in the best
interest of the City to effect such increase in order to promote orderly
development of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITTY OF
EAGLE PASS, TEXAS, that:

ORDINANCES BY ADDING NEW SECTION 2-35 REGARDING NONDISCRIMINATION,NON-HARASSMENT AND SEXUAL HARASSMENT;
FINDING THAT THE MEETING AT WHICH THIS ORDINANCE IS

PROVIDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN
EFFECTIVE DATE
WHEREAS, Article II of the City of Eagle Pass, Texas (“City”) Code of Ordinances contains the
personnel rules and regulations governing all of the City’s employees; and
WHEREAS, Section 2-31 of the City’s Code of Ordinances addresses the City’s drug and alcohol
abuse policy and policy on sexual harassment; and
WHEREAS, the City is in the process of updating its personnel rules and regulations and desires
to amend certain sections in Article II to simplify, clarify and improve upon the City’s existing
employment policies and procedures; and
WHEREAS, the City seeks to incorporate its existing sexual harassment policy in a separate
personnel rule and regulation at Section 2-35 of the City’s Code of Ordinances, which shall address
all types of prohibited discrimination, harassment, sexual harassment and retaliation in the
workplace and implements revised reporting and investigatory procedures; and
WHEREAS, the City desires to incorporation the of Section 2-35 take immediate effect upon final
reading and adoption of this Ordinance by the City Council and apply to all existing and future
City employees following the Ordinance’s effective date;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EAGLE PASS, TEXAS:
SECTION 1. Article II of the City Code of Ordinances shall be amended to add a new Section 235 incorporating and expanding upon the City’s sexual harassment policy, which
shall now read as follows:
Sec. 2-35. –Non-Discrimination / Non-Harassment Policy.
a. Statement of purpose. It is the City's policy to prohibit any form of discrimination
or harassment in the workplace based on race, religion, sex, national origin, age,
disability, genetic information, or other individual characteristics protected by
applicable federal, state or local nondiscrimination laws.
b. Non-retaliation policy. This policy also prohibits any retaliatory action against
anyone who has complained in good faith about discrimination or harassment in
the workplace, has participated in an investigation, proceeding or lawsuit regarding
an allegation of discrimination or harassment in the workplace, or who otherwise
opposes employment practices the individual reasonably believes discriminate
against individuals in violation of law.
c. Definitions.
1. “Discrimination” is defined as the unfair or unequal treatment of an
individual (or group) in the terms and conditions of employment based on
certain characteristics protected under law.
2. “Harassment” is defined as unwelcome and offensive conduct that is based
on an individual’s race, religion, sex, national origin, age, disability or
genetic information.
3. “Hostile work environment” is a type of harassment defined as severe or
pervasive harassment that creates a work environment a reasonable person
would find intimidating, hostile or offensive and unreasonably interferes
with the individual’s work performance.
4. “Retaliation” is defined as adverse action against an individual for opposing
or reporting a discriminatory practice, or participating in an employment
discrimination proceeding or investigation.
i. Examples of retaliation include employment actions like
termination, refusal to hire and denial of a promotion.
ii. Retaliation may include other actions that would dissuade a
reasonable individual from reporting discrimination or harassment,
such as threats or intimidating comments, unjustified negative
evaluations or references, demotions or reassignments to less
desirable positions, increased surveillance and social isolation and
exclusion.
5. “Sexual harassment” is a form of harassment defined as:
i. unwelcome sexual advances;
ii. requests for sexual favors; or
iii. all other verbal or physical conduct of a sexual or otherwise
offensive nature where
 Submission to such conduct is made either explicitly or
implicitly a term or condition of employment;
 Submission to or rejection of such conduct by an individual
is used as the basis for employment decisions affecting such
individual; and/or
 Such conduct has the purpose or effect of unreasonably
interfering with an individual’s work performance or
creating an intimidating, hostile or offensive working
environment.
6. “Personal space” is defined as an approximate area surrounding an
individual in which other people should not physically violate in order for
the individual to feel comfortable and secure.
d. Examples of Prohibited Conduct. Although not exhaustive, the following are
examples of conduct expressly prohibited by this policy:

Grabbing, groping, kissing, fondling.
Intentionally violating someone’s “personal space.”
Lewd, off-color, sexually oriented comments or jokes.
Jokes, cartoons, photographs or offensive comments based on race, sex,
religion, national origin, disability, etc.
6. Foul or obscene language.
7. Sexually, racially or otherwise discriminatory or lewd e-mails, text
messages or voicemail messages.
8. Threats of violence or retribution.
9. Intimidation.
10. Repeated requests for dates.
11. Sexual assault or rape.
e. Reporting Complaints. Any employee who believes that he/she has been the
subject of discrimination, harassment or retaliation, or has witnessed an incident of
discrimination, harassment or retaliation, is encouraged to report it immediately, or
as soon as practicable, to the complaint’s immediate supervisor, department head
or the human resources department. All persons that learn of an incident of
discrimination, harassment or retaliation have a duty to report it to a supervisor,
department head or the human resources department. If an incident is reported to
the human resources department, the human resources department will notify the
employee’s department head.
f. Procedures for investigating discrimination / harassment / retaliation
complaints. The human resources department shall be responsible for coordinating
and directing the investigation and review of complaints of discrimination,
harassment or retaliation. The following procedures shall apply to the receipt,
review, and handling of such complaints and are to be applied under the guidance
and in consultation with the human resources department.
1. If an oral or written complaint is made to anyone other than the human
resources department, the complaint shall be immediately referred to the
human resources department for investigation. In most cases, the human
resources department will be responsible for conducting the investigation
but the city may utilize an outside investigator or legal counsel to conduct
investigations at its discretion.
2. The complainant will be asked to submit a written statement describing the
incident(s) and details giving rise to the complaint. The complainant will
also be interviewed regarding the allegations. If a complainant does not
want to submit the complaint in writing, the human resources department
will still investigate the complaint.
3. Following receipt of the complaint and interview of the complainant, the
investigator will contact the respondent (the accused individual) regarding
the complaint within two (2) business days. If the respondent cannot be
reached in-person or by telephone, a notice advising the respondent of the
complaint will be mailed via certified mail to the most recent address noted
in the respondent’s personnel file.
4. Upon notification of the complaint, the respondent shall have five (5)
business days to submit a response to the allegations. Additionally, the
respondent will be interviewed regarding the allegations. The respondent
will also have the opportunity to respond to any other new
information/allegations that may arise during the course of the
investigation.
5. During the pendency of an investigation, the human resources department,
with the city manager’s approval, may place the respondent on leave with
pay for a period not to exceed two (2) weeks (unless extended with approval
of the city manager). A decision to place an employee on leave during the
pendency of an investigation is not a disciplinary action, nor is it subject to
the city’s grievance procedures.
6. In order to conduct a full investigation, the investigator retains the discretion
to interview other witnesses and request signed statements from them. The
investigator may also request evidence or documents from any of the
interviewed parties that could possibly assist in the investigation.
7. Although all measures to maintain the privacy and confidentiality of the
investigation will be taken, no person involved in the investigation process
can be guaranteed absolute or strict confidentiality.
8. As soon as practicable following conclusion of the investigation, but not
later than ten (10) business days, the investigator shall provide the human
resources department and department head, or other designated individual,
a conclusion regarding the validity of the complainant's allegations along
with recommendations for action, if any.
9. The recommendation regarding any possible disciplinary action against any
employee on account of an investigation into a complaint of discrimination,
harassment or retaliation will be made by the department head in
consultation with human resources department and/or the city attorney. The
decision shall be rendered as soon as practicable, but not later than ten (10)
business days from receipt of the investigator’s conclusions. The human
resources department will notify the complainant and the respondent in
writing of the results of the investigation, including any disciplinary
action(s) to be taken, with copies to the city manager.
i. If the complainant’s allegation is not substantiated, the investigation
may be closed with no action taken against the respondent. If
discrimination, harassment or retaliation did not occur, but other
inappropriate behavior did occur, disciplinary or other action may
be taken pursuant to the city’s policies.
ii. If the complainant’s allegation is substantiated, any of the following
disciplinary actions may be taken, depending on the severity of the
offense:

Counseling (documented in writing);

Transfer (the option to transfer the complainant may only be
considered upon the complainant’s request);

Suspension (without pay); or

Dismissal.
iii. If the investigation into a complainant’s allegations proves
inconclusive, the department head, in consultation with human
resources department may recommend on any course of action that
serves the best interest of the city, minimizes interference of
divisional/departmental operations, and allows for the complainant
and respondent to continue their work routines with minimal
personal consequence.
iv. If the complainant’s allegations are proven to have been made in bad
faith, the complainant shall be disciplined appropriately.
10. A complainant may withdraw a complaint at any time. However, the city
may still pursue an investigation and determine whether disciplinary action
is warranted against any employee on account of the complaint.
11. In any instance where a member of the human resources department is the
subject of a complaint of discrimination, harassment or retaliation, the same
procedures shall apply except that the city manager will be responsible for
receiving, reviewing and handling the complaint. The city manager shall
have the authority to appoint a designee or outside investigator to conduct
the investigation.
12. In any instance where the city manager, municipal court judge, alternate
municipal court judge, city auditor or the city attorney is the subject of a
complaint of discrimination, harassment or retaliation, the same procedures
shall apply except that human resources department will be responsible for
receiving, reviewing and handling the complaint, including the authority to
appoint an outside investigator to conduct the investigation, and report
findings and recommendations to City Council.
g. Appeals. Disciplinary actions taken against a complainant or respondent as a result
of an investigation into a complaint of discrimination, harassment or retaliation may
be appealed in accordance with the city’s grievance procedures.
h. Ongoing Duty to Monitor and Report. It is the ongoing responsibility of all
department heads, supervisors and managers to monitor the employees in their
areas of responsibility for inappropriate comments, displays or behavior and to take
appropriate action by reminding their employees of the city’s policies and reporting
concerns and incidents to the human resources department.
i. Record keeping. All records concerning an investigation into a complaint of
discrimination, harassment or retaliation shall be kept in a separate secure file in
the human resources department. Access to an investigation file shall only be
granted to parties who have a direct and relevant need for the information and only
upon approval by the human resources department and/or legal counsel. Records
concerning any subsequent disciplinary action against an employee as a result of
an investigation shall be kept in the employee’s regular personnel file.
j. “No Dating” policy. In furtherance of the City’s non-discrimination and nonharassment policy, supervisors, managers and department heads are prohibited
from dating or engaging in any type of intimate or romantic relationship with
subordinate employees. Such relationships can be disruptive to the workplace,
create a conflict of interest or the appearance of a conflict, and lead to charges of
favoritism, discrimination or sexual harassment. The City reserves the right to take
whatever action is appropriate, in its discretion, to protect the City’s interest in
promoting a fair, equitable and harassment-free workplace in the event of a
violation of this policy.
A “subordinate employee” is any employee under the authority and/or supervision
of another individual within the City.
1. Duty to Report. Any employee who becomes involved in an intimate or
romantic relationship with any employee of management capacity within
the department must promptly notify the department head of the relationship
within three (3) business days. The department head will review the
situation and take appropriate action where necessary in consultation with
human resources, as approved by city manager. Failure to disclose a
relationship in violation of this provision could result in disciplinary action,
including termination, pursuant to City policies.
2. Reassignment if Available. Upon disclosure of a relationship between a
supervisor and subordinate employee, the department head in consultation
with human resources, and the approval of city manager, may decide to
reassign one or both employees to another position or department in the city
to eliminate the conflict of interest. Where reassignment is not an option,
the employee in the supervisory or managerial position may be subject to
termination pursuant to City policies.
3. Responsibility of Professionalism. All employees involved in intimate or
romantic relationships with other city employees, whether or not in
contravention of this policy, have the duty to ensure they act professionally
at all times and not engage in any conduct that interferes with their ability
to perform their jobs or that could be deemed offensive to others.
k. Workplace Bullying Policy. The City is committed to providing all employees a
healthy, safe and respectful work environment. To that end, the City is committed
to the elimination of bullying in the workplace. Bullying behavior by any City
employee, including supervisors, directors and executives, will not be tolerated.
This policy applies during normal working hours, at work-related or sponsored
functions, and while traveling on work-related business. Employees found in
violation of this policy may be disciplined, up to and including termination pursuant
to City policies. Retaliation against individuals who make a good faith report of
bulling is strictly prohibited.
1. Definitions: The City defines “bullying” as unwelcome or unreasonable
behavior that demeans, intimidates or humiliates people either as
individuals or as a group. Bullying behavior is often persistent and part of
a pattern, but it can also occur as a single incident. It may be carried out by
an individual or as a group. Some examples of bullying behavior are:
i. Verbal Communication

Abusive and offensive language
Threats
Insults
Teasing
Spreading rumor and innuendo
Unreasonable criticism
Trivializing of work and achievements
ii. Manipulating the Work Environment




Isolating people from normal work interaction
Excessive demands
Setting impossible deadlines
Placing on least desired schedules
iii. Psychological Manipulation







Unfairly blaming for mistakes
Setting people up for failure
Deliberate exclusion
Unjustified excessive supervision
Practical jokes
Belittling or disregarding opinions or suggestions
Criticizing in public
iv. Mobbing


Mobbing is the bullying or social isolation of a person
through collective unjustified accusations, humiliation,
general harassment or emotional abuse.
Although it is group behavior, specific incidents such as an
insult or a practical joke may be carried out by an individual
as part of mobbing behavior.
2. Responsibilities: All employees have a duty and responsibility to promptly
report any incidents of bullying in the workplace to their immediate
supervisor, department head or human resources department. If the report is
submitted to the human resources department, the department head(s) must
be notified. Context is important in understanding bullying, particularly
verbal communication. While care should be exercised, it is better to make
a good faith report of bullying than to let actual bullying go unreported.
i. Department directors and supervisors shall:




Ensure that all employees are aware of the City’s antibullying policy;
Ensure that any incident of bullying is dealt with regardless
of whether a complaint of bullying has been received orally
or in writing;

have occurred.
ii. Employees shall:

Familiarize themselves with and behave according to this
policy;

Report incidents of bullying to your supervisor, department
director or Human Resources Director as appropriate; and
Where appropriate, speak to the alleged bully(ies) to object
to the behavior.

3. Reporting: Any employee who feels he or she has been a victim of bullying
or witnessed an incident of bullying is encouraged to report the matter to
his or her immediate supervisor, department director or the Human
Resources department.
Supervisors and Directors shall report all
complaints of bullying, whether oral or written, to the Human Resources
department. Where appropriate, the Human Resources department will
undertake an investigation in accordance with the process for investigating
complaints of discrimination and harassment and disciplinary measures,
pursuant to City policies, will be taken as necessary.
SECTION 2. That it is hereby officially found and determined that the meeting at which this
Ordinance is passed is open to the public as required by law and that public notice
of the time, place and purpose of said meeting was given as required.
SECTION 3. If any section, part, or provision of this Ordinance is declared unconstitutional or
invalid by a court of competent jurisdiction, then, in that event, it is expressly
provided, and it is the intention of the City Council in passing this Ordinance that
its parts shall be severable, and all other parts of this Ordinance shall not be
affected thereby and they shall remain in full force and effect.
SECTION 4. This Ordinance becomes effective immediately after being passed and approved on
third and final reading.

MEETING AT WHICH THIS ORDINANCE IS PASSED IS OPEN TO
THE PUBLIC AS REQUIRED BY LAW; PROVIDING A
SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE
DATE
WHEREAS, Article II of the City of Eagle Pass, Texas (“City”) Code of Ordinances contains
the personnel rules and regulations governing the City’s employees; and
WHEREAS, the City is in the process of updating its personnel rules and regulations and
desires to amend certain sections in Article II to simplify, clarify and improve upon the City’s
existing employment policies and procedures; and
WHEREAS, the City believes the implementation of a dress code will promote
professionalism in the workplace by applying uniform standards of dress, appearance and
grooming to all City employees; and
WHEREAS, the City desires Article II, Chapter 2 of the Code of Ordinances be amended to
add Section 2-36 and that such amendment take immediate effect upon final reading and
adoption of this Ordinance by the City Council and apply to all existing and future City
employees following the Ordinance’s effective date;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EAGLE PASS, TEXAS:
SECTION 1. Article II, Chapter 2 of the City’s Code of Ordinances shall be amended to add
new Section 2-36 to read as follows:
a. Statement of Policy. The City of Eagle Pass considers it very important that all City
employees dress appropriately for their job functions and maintain a clean, neat, and
tasteful appearance. For this reason, the City has adopted a dress code for all
employees. While we trust our employees will exercise good judgment in their dress
and appearance, a dress code policy provides guidance to all employees and enhances
professionalism in the workplace. Appropriate dress and hygiene are important in
promoting a positive city image to our customers, both internally and externally.
b. Responsibility and Enforcement. Department directors and supervisors, in consultation
with the human resources department, shall be responsible for enforcing the City’s
dress code and addressing concerns with employees who do not comply with the
policy. Employees are responsible for following the policy and understand they may
be sent home and/or be disciplined for noncompliance, up to and including
termination, pursuant to city policy. If paid leave is not otherwise available, hourlypaid staff will not be compensated for any work time missed because of failure to
comply with the dress code policy.
c. Grooming & Hygiene. All City employees are expected to maintain proper hygiene,
which includes regular bathing, brushing teeth, and proper grooming. Employees
should avoid excessive use of perfume or colognes. Hair should be clean and neatly
trimmed, including facial hair for men. Additional restrictions on length of hair may
be imposed on individuals working in safety-sensitive positions. Hair dyed in
unnatural colors (e.g. blue, pink, green) is not allowed.
d. Tattoos/Piercings. In general, tattoos and body piercings should not be visible and
employees may be required to cover up tattoos and/or remove piercings in the tongue,
brow, belly-button or facial area. Visible tattoos that contain profanity or inappropriate
or sexually provocative images are prohibited. Men with ear piercings should remove
them while on duty. Similarly, hoops or other ear piercings that could cause a safety
concern based on the employee’s duties and responsibilities are not allowed.
e. Uniforms. City employees who must wear uniforms while performing their
employment duties shall maintain their uniforms in clean and good condition.
Uniforms should not be excessively torn, worn, frayed or visibly patched. The uniform
should fit properly and allow for movement without exposing the employee’s
undergarments or skin. Employees are not allowed to affix any other image or article
to their uniforms unless otherwise designated or required by the City.
f. Clothing Standards. Employees must arrive to work in clothes that are clean, neat and
in good condition. Appropriate undergarments are required at all times and should not
be visible through an employee’s clothing. Employees may not wear any images or
displays on their clothing or uniforms that is inappropriate or damages the professional
image of the City (e.g. images containing profanity, slogans, cartoons, beer/tobacco
products or sexually provocative images).
1. Business Attire. On occasion, employees may be asked to attend events,
meetings or other functions on behalf of the City that require more formal
attire. In such case, the following guidelines may apply:
i. For men, business attire shall include a short/long-sleeved dress shirt,
tie, tailored sport coat or suit coat, dress trousers or suit pants and dress
shoes.
ii. For women, business attire shall include tailored pantsuits, business
suits, suit dresses, or coordinated dressy separates worn with or without
a blazer, and dress shoes.
2.
Prohibited Attire for Office Personnel. The following clothing shall not be
allowed for any reason:
i. Sweatpants, leggings or exercise wear;
ii. Lycra or spandex tops or bottoms;
iii. Shorts, hip-hugger pants, skirts or jeans;
iv. Ripped or frayed jeans;
v. T-shirts, sweatshirts or shirts with writing (other than City logo);
vi. Crop tops or Midriff tops;
vii. Tank tops, backless shirts, strapless blouses, halter tops, or shirts with
spaghetti straps that are worn without a jacket;
viii. Clothing that is “see-through” or low-cut blouses, shirts and tops;
ix. Skirts or dresses more than three (3) inches above the knee;
x. Sundresses or beachwear;
xi. Thongs, flip-flops, tennis shoes, athletic shoes, and
xii. Caps.
3. Casual Days. On occasion, the City may permit employees to dress in a more
casual fashion than is normally required. An example is “casual Fridays” when
employees are allowed to wear jeans. On these occasions, employees are still
expected to present a neat appearance and are not permitted to wear ripped,
frayed or disheveled clothing, athletic wear, tight, revealing or otherwise
inappropriate clothing.
g. Footwear. Footwear should be safe, in good condition, and appropriate for the
employee’s duties and responsibilities. Employees in certain departments may be
required to wear specific shoes in connection with the department’s uniform
requirements. Employees assigned to work outdoors may be allowed to wear athletic
or tennis shoes when deemed necessary or appropriate by the department director.
h. Off-duty Conduct. When off-duty, employees should not wear their City uniforms, or
other clothing that identifies the individual as a City employee, to bars, night clubs,
adult entertainment establishments, casinos or other locales where the employee
consumes alcohol in a setting open to the public.
i. Accommodations. Employees who desire an accommodation under the City’s dress
code policy on the basis of religion or disability should contact human resources
department to discuss the matter and submit a request for accommodation for the
approval of city manager, or designee.
SECTION 3. That it is hereby officially found and determined that the meeting at which this

SECTION 1. Sec. 2-23(i) Article II, Chapter 2 of the Code of Ordinances of the City of Eagle
Pass, Texas, is hereby deleted in its entirety and new Sec. 2-23 (i) is hereby adopted
to read as follows:
i)
Payment in lieu of vacations or sick leave.
(1) No pay in lieu of vacations or sick leave will be authorized unless such be
for termination pay or in cases of extreme hardship or medical hardship.
(2) Payment in cases of extreme hardship or medical hardship shall be made if
funding is available, provided it does not reduce hours of sick leave balance
to less than 40 hours or 60 hours for firefighters, and only after
substantiating documentation has been submitted by the employee, and
approved by the director and city manager. Payment will be applied in the
following order and manner:
a. Reserve sick leave hours accumulated above 240 hours for regular
employees or above 360 hours for firefighters, at 50% rate of pay.
b. Sick leave hours of 240 or less for regular employees or 360 or less
for firefighters, at 100% rate of pay for extreme hardship or medical
hardship.
c. Vacation hours available for use, at 100% rate of pay.
(3) Request and approval of payment in lieu of sick leave hours will result in a
12-month disqualification, from date of approval, of the sick leave benefit
payment provided in Sec. 2-28 (e)(5)(d).
SECTION 2. This Ordinance shall be in full force and effect from and after its final passage in
accordance with the City Charter of the City of Eagle Pass.

WHEREAS, the City of Eagle Pass, Texas (“City”) established an educational
reimbursement program to promote education to increase and enhance the skill and
development of its employees; and
WHEREAS, the educational reimbursement program is intended to help City employees
maintain a satisfactory level of knowledge and expertise in their present position as well as
to help them develop their skills and increase their potential for future advancement with
the City; and
WHEREAS, the City of Eagle Pass, Texas experienced an increase in use of the
educational reimbursement program and now seeks to modify and streamline the procedure
for educational reimbursements.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EAGLE PASS, TEXAS, as follows:
SECTION 1. Sec. 2-32 Article II, Chapter 2 of the Code of Ordinances of the City of
Eagle Pass, Texas, is hereby deleted in its entirety and new Sec. 2-32 is
hereby adopted to read as follows:
2-32. - Educational reimbursement policy.
Subject to funding availability, the City may offer an educational
reimbursement program to regular full-time employees who attend a course
of study at a pre-approved institution, or through an approved
correspondence school. Educational reimbursement is intended to help
employees maintain a satisfactory level of knowledge and expertise in their
present position as well as to help them develop their skills and increase
their potential for future advancement with the City.
Employees
participating in this educational reimbursement program shall not be
permitted to attend courses during work hours unless authorized by the
department head and approved by City Manager, or designee.
Additionally, employees attending courses under this educational
reimbursement program shall not be compensated for their course work as
hours of work.
The course of study must be directly related to the city’s employment, as
determined by the employee’s department head, and must be approved by
the City Manager, or designee, on the City’s pre-approval form, prior to
registration.
This educational reimbursement program will not reimburse an employee
for costs covered by State or Federal educational assistance programs, nor
does it cover any incidental expenses such as supplies and/or other personal
expenses. Employees will provide any additional documentation to the City
upon request in order to be eligible to participate in this educational
reimbursement program.
Employees requesting educational reimbursement assistance must
acknowledge continued employment with the City for a minimum period of
two (2) years upon attaining a degree in the pre-approved course of study.
Employees must acknowledge and agree that educational reimbursement
assistance is a financial investment by the City and it is both reasonable and
appropriate for the employee to reimburse the City subject to the following
terms and conditions:
(a)
one hundred percent (100%), (i) if the employee fails to
successfully
attain
said
degree
and/or
vocational
training/certification
(ii) if the employee makes a conscious
decision to no longer pursue the degree and/or vocational
training/certification (iii) if employment separation occurs prior to
one (1) year from the employees graduation date.
(b)
fifty percent (50%), if employment separation occurs, prior
to two (2) years, but more than (1) year, from the employees
graduation date.
Procedure for the Department Head
Each department head is required to inform their department staff prior to
the new fiscal year of the Educational Reimbursement Policy to budget
accordingly and subject to funding approval.
Procedure
To be eligible to receive an educational reimbursement, employees must
comply with the following procedures:
1.
Prior to registration, the employee must submit the following
documents to the employee’s department head for review and
consideration:
a. The name of the college or institution the employee is
attending;
b. The
employee’s
degree
and/or
vocational
training/certification plan or course of study;
c. The name and description of each course the employee
intends to enroll in for the semester, including a brief
summary of how the course relates to the employee’s
job;
d. The start and end date of the course;
e. The costs for tuition, books or any other fees the
employee expects to incur for the course; and
f. Any amount of State or Federal educational assistance
the employee will receive or has requested.
2. The employee’s department head will review and confirm the
following information before approving a request for educational
reimbursement and returning the pre-approval form to the
employee:
a. The department head must ensure funding is available to
support the reimbursement; otherwise, the department
head must ensure a budget amendment is requested;
b. The department head must ensure the proposed course(s)
is/are directly related to the employee’s job; and
c. The department head shall provide a recommendation
regarding approval of the request.
3. If the department head approves the course(s), the employee
must then submit the pre-approval form to the Human Resources
department. Human Resources will review the employee’s
documentation for accuracy and will forward to City Manager or
his designee for approval.
4. The Human Resources department is responsible for informing
the employee (or department head) of the final determination on
pre-approval of the courses and shall return the pre-approval
form to the employee.
5. Upon receipt of a final passing grade of “C” or better, the
employee must submit the educational reimbursement request to
the Human Resources department within thirty (30) days. The
City may reimburse an employee up to a maximum of $3,000.00
per fiscal year for the cost of tuition, lab fees, books, and other
required materials for pre-approved courses.
SECTION 2. This Ordinance shall be in full force and effect immediately from and after
its final passage in accordance with the City Charter of the City of Eagle
Pass, Texas.

The City of Eagle Pass offers the benefit of educational reimbursement to regular full-time employees. To request this benefit, please fill out the first page of
this form. Once completed please submit the request for to your director for their approval. The Director will then forward to Human Resources to forward
to City Manager for approval. If you have any questions please call Human Resources Department at (830) 773-1111.

of the semester, which is due within 30 days after receiving final course grade. I acknowledge and agree that educational reimbursement
assistance is a financial investment by the City and it is both reasonable and appropriate that I reimburse the City subject to the terms and
conditions in accordance with the policy. I acknowledge and authorize the City of Eagle Pass to deduct money from my pay in accordance with
the terms and conditions of the policy. I further understand that the City has stated its intention to abide by all applicable federal and Texas wage
and hour laws and that if I believe that any such law has not been followed, I have the right to file a wage claim with appropriate Texas and
federal agencies.

A RESOLUTION APPOINTING MEMBERS TO THE
EAGLE PASS LIBRARY BOARD
WHEREAS, Ordinance No. 05-09 amended Section 18-1, Article I, Chapter 18 of the Code of
Ordinances of the City of Eagle Pass to provide that five of the members of the Eagle Pass
Library Board be appointed through a Resolution duly adopted by the Council with each
Council Member entitled to an appointment; and
WHEREAS, the term of office of all members expired on July 3, 2015; and
WHEREAS, the persons herein named are residents of Maverick County.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EAGLE PASS, TEXAS, as follows:
SECTION 1.
Each position on the Eagle Pass Library Board shall be numbered according
to the place number served by the Council Member making each
appointment, with the Mayor’s place being Place 5.

A RESOLUTION AUTHORIZING THE APPOINTMENT
OF ASSISTANT FIRE CHIEF AND FOUR POLICE
LIEUTENANTS PURSUANT TO CIVIL SERVICE,
TEXAS LOCAL GOVERNMENT CODE, CHAPTER
143.014
WHEREAS, the City of Eagle Pass adopted Chapter 143 of the Texas Local Government
Code, or “Civil Service,” for its Police and Fire Departments; and
WHEREAS, the City of Eagle Pass, pursuant to its home-rule authority is required by
Chapter 143.014 of the Texas Local Government Code to authorize the appointment by the
Fire Chief of one Assistant Fire Chief, and the Police Chief, up to four (4) Police
Lieutenants; and
WHEREAS, the City of Eagle Pass believes that it is in the best interests of the City and will
secure efficient and effective operations of the Police and Fire Departments to permit the Fire
Chief and the Police Chief to appoint the individuals most immediately below them in rank in
their respective Departments; and
WHEREAS, the City of Eagle Pass must City Council must authorize the Fire and Police
Chiefs to appoint one Assistant Fire Chief and four Police Lieutenants;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EAGLE PASS, TEXAS:
SECTION 1. The City of Eagle Pass Fire Chief is hereby authorized to appoint one Assistant
Fire Chief pursuant to the requirements contained in Chapter 143.014 of the
Texas Local Government Code;
The following person is hereby appointed as the Assistant Fire Chief of the City of Eagle Pass
Fire Department:

RESOLUTION NO. 2015- R
A RESOLUTION NOMINATING A CANDIDATE TO THE
BOARD OF DIRECTORS OF THE MAVERICK COUNTY
APPRAISAL DISTRICT
WHEREAS,
Section 6.03 of the Property Tax Code provides that each Taxing Unit in a county that is
entitled to vote may nominate by resolution adopted by its governing body one candidate
for each position to be filled on the Board of Directors of the County's Appraisal District;
and
WHEREAS,
Sec. 6.035(a) of the Property Tax Code states that a Member of the Board of Directors is
ineligible to serve if he/she is: 1) related within the second degree by consanguinity or
affinity to an individual who is engaged in the business of appraising property for
compensation for use in proceedings under Chapter 6 of the Property Tax Code or of
representing property owners for compensation in proceedings under this title in the
appraisal district; or 2) owns property on which delinquent taxes have been owed to a
taxing unit for more than 60 days after the date the individual knew or should have
known of the delinquency unless a payment agreement has been made or a suit to collect
the delinquent taxes is deferred or abated; and
WHEREAS,
The City Council of the City of Eagle Pass is entitled to vote and it wishes to nominate a
qualified candidate for positions to be filled on the Board of Directors of the Maverick
County Appraisal District.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EAGLE PASS,
TEXAS, that:
SECTION 1.
All of the above paragraphs are incorporated and made a part of this Resolution.
SECTION 2.
The City Council nominates the following qualified person for the position to be filled
on the Board of Directors of the Maverick County Appraisal District:

The Mayor of the City of Eagle Pass is hereby authorized and directed to submit this
nominee of the City of Eagle Pass to the Chief Appraiser of the Maverick County
