PROJECT DESCRIPTION
The Project includes the change of use from Retail to Restaurant with interior tenant improvements. The
789 square foot Restaurant, d.b.a. Birba, is a principally permitted use in the Hayes-Gough NCT Zoning
District, and would operate from Noon to 10:00 p.m. Tuesday-Saturday, and from Noon to 9:00 p.m. on
Sunday. The business owner has applied for a Type 41 ABC License, which would permit beer and wine
on the premises of a Bona Fide Eating Place.
The Project originally included a 745 square foot Outdoor Activity Area at the rear when the 312
Notification was distributed, but was later removed from the scope of work as Conditional Use
Authorization is required. The current project includes interior tenant work and a change of use from
retail to restaurant only.
SITE DESCRIPTION AND PRESENT USE
The Subject Property is located on north side of Grove Street between Gough and Octavia Streets.
Originally constructed in 1940 as a two-story, single-family dwelling, the building was converted to
commercial space in 1994 per Site Permit No. 9400627S. There are 789 square feet of retail space on the
ground floor as well as a 259 square foot garage fronting Grove Street, office space on the second floor,
and a landscaped patio at the rear.
Until recently, the garage space was used by Oxenrose Salon, located adjacent to the subject property at
448 Grove, for storage and laundry purposes. Oxenrose management and administration formerly

occupied the office space on the second floor of 458 Grove and had maintained use of the garage after
they moved administration operations elsewhere. The property owner was alerted that the use of the
garage by a commercial operation was not permitted within the Hayes-NCT Zoning District and has
terminated the lease of the garage space to Oxenrose.
SURROUNDING PROPERTIES AND NEIGHBORHOOD
The Hayes-Gough Neighborhood Commercial Transit District extends along both sides of Octavia
Boulevard to Market Street, and is bounded by Franklin Street to the east and Laguna Street to the west.
This district contains a limited range of commercial activity which primarily caters to the neighborhood,
but also to visitors and workers from the performance arts venues and Civic Center nearby.
The surrounding properties along Grove Street are 2-3 story mixed-use buildings with residential units
over ground floor retail. In addition to Oxenrose Salon directly adjacent to the property, the block
includes a spa and laundromat, and there is a 4-story Days Inn Motel located across the street from the
Subject Property.

SUPPORT OF RESTAURANT USE
The project sponsor has collected signatures and letters of support from 51 local businesses and Hayes
Valley residents within three blocks of the project site. Of the 51 signatures, there are 23 letters of support
that have come from commercial and residential neighbors located on Assessor’s Block 0793. The
Oxenrose salon, which is adjacent to the subject property at 448 Grove, has provided 19 signatures from
owners, management, and staff. Several supporters believe that the restaurant will add character and
diversity to the neighborhood. Others support a quality, independently owned business in the
neighborhood. Eleanore Mooney has cited that the proposed restaurant would be a welcoming space for
Hayes Valley residents becoming increasingly alienated from their neighborhood. Letters of support can
be found in Appendix B at the end of this report.
OPPOSITION AGAINST RESTAURANT USE
The DR Requestor has collected signatures and letters of opposition from 3 neighborhood groups, the San
Francisco Police Department ABC liason, 22 residents and businesses in Hayes Valley, as well as 42
signatures of San Francisco residents from other neighborhoods. Most of the public opposition received
by the department has been in regards to the Outdoor Activity Area.
The Coalition for San Francisco Neighborhoods (CSFN) strongly opposes the change of use, as they
believe the project as proposed does not operate as a Bona Fide Eating Place and will not comply with the
Good Neighbor Policies to control odor and noise that are listed in Planning Code Section 703.5. The
Hayes Valley Neighborhood Association (HVNA) has “recommended denial of the wine and beer garden
use” due to the potential noise nuisance that would be created if the proposed restaurant would be
allowed to use the outdoor space. The D5 Action Group has reiterated neighbor concerns that when the
project sponsor or property owner decides to pursue Conditional Approval for the outdoor space
“intrusion into the homes will be substantial." The ABC Liaison Unit of the San Francisco Police
Department has “objected to the unconditional issuance of the original application” and has provided
conditions that will “improve quality of life” for nearby residents. The ABC Liaison Unit would be
supportive of the restaurant use and Outdoor Activity Area if Conditions of Approval included limited
hours of operation on the patio and that the restaurant continues to operate as a Bona Fide Eating Place.
Neighbors John Colton and Rafi Sarkis, who live adjacent to the Subject Property at 470 Grove,
Apartment 4, share the concerns of the DR Requestor that any outdoor activity in the rear yard will cause
noise that will render their adjacent units “unlivable.” Their concerns regarding noise also extend to the
potential disturbance created by Birba employees taking out trash, specifically bottles, in the evenings, as
the trash will be placed in the lightwell adjacent to 470 Grove. William Matsumoto, who also lives at 470
Grove in Apartment 1, has stated that the majority of commercial tenants have failed in the retail space as
they have found it “unsuitable for occupancy as it was designed as a residential property.” In addition to
concerns about noise, he has concerns with the proposed operations of the business owner, as she has
featured the Outdoor Activity Area during promotion of her restaurant prior to seeking conditional
approval.

Other neighbors that live on the block have been solicited for comments, and have reiterated their
concerns regarding the possibility of noise echoing throughout the mid-block, and that potential future
restaurant tenants that could be less desirable. Letters of Opposition can be found in Appendix C of this
report.
DR REQUESTOR
Mike Welch, 470 Grove Street #3, San Francisco, CA. Mr. Welch’s property is adjacent to the Subject
Property.
DR REQUESTOR’S CONCERNS AND PROPOSED ALTERNATIVES
Issue 1: The DR requestor is dissatisfied with plan revision during the 312 notification process. He
disagrees with the determination that the 312 notification period was permitted to continue following the
omission of the patio from the plans.
Issue 2: The DR requestor believes there has been dishonesty on the part of the applicant regarding
proposed hours of operation. The wine bar owner has indicated on her ABC application that she plans to
operate from Noon to 10:00 p.m. Tuesday-Saturday, and from Noon to 9:00 p.m. on Sunday. The DR
Requestor believes that these proposed hours of operation are inconsistent with what she has told
neighbors. There has been solicitation for evening and weekend events in the yard.
Issue 3: The DR requestor is concerned that the owner of the Subject Property has filed building permits
to make improvements on the rear yard under the address 460 Grove, but is being considered for use at
458 Grove. He believes that these permits were not adequately reviewed by the Planning Department,
and do not take the residential nature of the adjacent properties into consideration. He is concerned that
the hardscaping and landscaping used in the construction of the back patio will amplify sound, and any
noise from the patio area will be intrusive to adjacent residences.
Issue 4: The DR requestor believes that there are currently illegal uses in the building, as the owner is
renting the garage space to a commercial business that was formerly located at the property, and that use
of the garage as vehicular storage has been abandoned. He believes that the owner is renting out parking
on the city street at the curb cut to the same commercial tenant.
Issue 5: The DR requestor is concerned by the fact that any future Conditional Use Approval of the
Outdoor Activity Area will run with the land. He believes that if the proposed wine bar is unsuccessful,
the building owner would be able to open another restaurant in its place, and that operations of such
restaurant may vary from what the current wine bar owner has proposed.

PROJECT SPONSOR’S RESPONSE
General: This permit application is for the restaurant/wine bar only. A restaurant and bar are both
permitted uses in this area. The owner and the restaurant operator will be thrilled to have a

restaurant/wine bar in this space, even without the garden space. The restaurant owner is willing to work
with the neighbors.
Issue 2: There has been no discussion of changing the hours from what was stated in the ABC application,
and therefore has been no dishonesty.
Issue 3: The building at 458/460 Grove was converted from residential to commercial use long before this
group of tenants moved into 470 Grove.
Issue 4: The owner has not ‘rented’ the space in front of the garage, and he has terminated the lease with
the tenant who was leasing the garage. The space has been restored back to a garage. The owner is willing
to convert the garages space into commercial space and remove the curb cut so there is an active use at
the ground floor and a public parking space can be re-established.
PROJECT ANALYSIS
Issue 1: As previously mentioned, the scope of work on Building Permit No. 2014.0325.1658 includes the
change of use from Retail to Restaurant and interior tenant improvements. The DR filer and his agent
have maintained that the intention to pursue use of the patio cannot be disregarded, and have repeatedly
demanded the project planner to consider the patio as part of the current project. Per Planning Code
Sections 720.24 and 145.2(a), Conditional Use Authorization for an Outdoor Activity Area is required in
the Hayes-NCT for commercial use of a patio in the rear yard. The applicant intends to seek Conditional
Use Approval to use the patio in the future, but would keep the patio off-limits to restaurant patrons until
that time. Initially, the patio was included as a part of the restaurant during the 312 Notification period.
When the project planner recognized that the Outdoor Activity Area would require Conditional Use
Approval for outdoor activity, the patio was removed from the current proposal. This resulted in a
reduction of the project scope and therefore did not require a new 312 Notice.
Issue 2: The proposed hours of operation are from Noon-10:00 p.m. Tuesday-Saturday, and until 9:00
p.m. on Sunday. These operating hours are compliant with those permitted in the Hayes NCT per
Planning Code Section 720.27, which permits business owners to operate from 6:00 a.m. to 2:00 a.m.
Issue 3: Building permits have been filed under the address 460 Grove as it was the primary address of
the property for several years, and is located on the same lot as 458 Grove. Construction and grading of
the rear yard was approved by planning staff over the counter per Building Permit 2007.0515.1341. The
approval language is as follows: “[Approved] per application and plans for hardscape of rear yard and
construction of new 8 foot fence at rear. No other work. Outdoor activity area at rear under separate
permit.” The approval can be found in the attachments section of this report. The project planner
reviewed the digital property records on the Property Information Map, which provided a clear and
adequate permit history to verify that the change of use to a restaurant was code complying.
Issue 4: Unauthorized use of the garage as a laundry and storage area for the Oxenrose salon at 448 Grove
has been abated since this Discretionary Review case was filed. The project sponsor and property owner
have provided a photo and a copy of the termination of the lease to demonstrate that unauthorized
activity has ceased, which can be found in Appendix A of this report.

Issue 5: The DR Requestor is correct in his assertion that conditions of approval run with the land. The
applicant has not yet filed for Conditional Use Authorization to use the rear patio as an Outdoor Activity
Area, and the proposed restaurant is limited to the indoor space under the current building permit. The
applicant and property owner have been honest and clear about their intention to seek Conditional Use
Approval to use the rear yard for seating, and have discussed potential measures that would address the
concerns of the neighbors and could be included as conditions of approval should the Planning
Department choose to support the Conditional Authorization in the future.
Additional Concerns: There are few concerns from neighbors and neighborhood groups that do not
involve the patio and are instead focused on the proposed change of use. The business owner has
provided an ABC Section 23038 Acknowledgement to demonstrate that she is compliant with the
regulations for Bona Fide Eating Places. She has also agreed to manage her trash in a manner that is
respectful of the surrounding neighbors by bringing the bins indoors to empty bottles.
ENVIRONMENTAL REVIEW
The Department has determined that the proposed project is exempt from environmental review,
pursuant to CEQA Guideline Sections 15301(1)(4) and 15303(a).
BASIS FOR RECOMMENDATION
Do not take Discretionary Review and Approve as proposed.






The project sponsor has agreed to reduced hours of operation, with a closing time of 10:00 p.m.
Monday through Saturday and 9:00 p.m. on Sundays in order to be more compatible with the
neighborhood.
The proposed restaurant will operate as a bona fide eating place only serving beer and wine, and
will secure an ABC License Type 41.
The proposed restaurant will enable an independent, locally-owned business to provide desirable
goods and services to the surrounding neighborhood.
The proposed restaurant is focused on providing California cuisine and a rotating selection of
complimentary wines from around the world, strengthening the local economy, culture and food
system while diversifying the offerings available in the neighborhood.
The project meets all applicable requirements of the Planning Code.
The business is not a Formula Retail use and would serve the immediate neighborhood.
RECOMMENDATION:
Do not take DR and approve the project as proposed.

458-460 Issues for DR application
A 312 notice has been issued
A 312 notice was issued that described the project as a change to restaurant/wine bar
operations at 458 Grove. The site was clearly delineated as the interior space at 458 Grove
with seating for up to 19 persons + seating on the rear "redwood deck," The rear yard is also
described as part of the premises of 458 Grove. Prior to the 312 notice the wine bar operator
had also filed with the California ABC for permission to sell alcohol.
After the 312 notice resulted in questions to Department staff, the Department decided that
this change required a CU. That the wine bar would open with interior operations only. Then a
CU permit would be filed for restaurant use in the rear yard.
Hours of operation dishonesty
Application to ABC stays planned hours of operation lu-Sat Noon - 10pm, Sunday Noon - 9pm
This is quite different from the hours stated by the wine bar owner to the neighbors. There has
also been solicitation for evening and weekend events in the yard.
Residential nature of adjacent property
The operation is in former residential building on residential block with residences immediately
adjacent on the east facing lightwell. They will have to listen to the noise of proposed
operations and events. This will be an intrusion of noise into their homes.
Previous permits which OWNER took out "improved" back yard - now planned for restaurant
use - were landscaping hardscape which amplifies noise. All permits were taken out under 460
Grove - the upstairs unit, and NOT reviewed by Planning Department.
The Planning
Department has consistently resisted pulling the permit plans, reviewing them and placing in
Planning files where public can review them.
Illegal current uses in building
Owner has rented renting out - ILLEGALLY - the 458/460 garage to a commercial business
Oxenrose Hair Salon as their utility/laundry room. They were formerly located at 460 Grove,
but have moved into the commercial space EAST of 458 Grove. Vehicular use of the garage
appears to have been abandoned. Because Planning adamantly refuses to pull all the permits
on this site, there is no permit trail of the USES described for the garage on the permits.

Owner also appears to have rented out the CITY street in front in the garage to Oxenrose. Since
there is an (used) garage with a driveway, cars belonging to Oxenroseare consistently parked on
Grove in front of "the driveway." If anyone parks in that space, Oxenrose places a notice is on
the windshield advising the car owner that they are illegally blocking a (NOT USED) driveway
aka "loading zone." See attached photos. The owner appears to have rented out the City
street because he has not applied to remove the garage and convert it into legal commercial
space, while removing the driveway replacing public parking in the street.
Building OWNER owns the permit and right to have restaurant with alcohol IN REAR YARD
California courts have ruled - FOR SAN FRANCISCO - that approval (CU) belongs too OWNER, not
operator of wine bar. It make no legal difference what proposed current tenant says re
operations.
When current wine bar goes out of business or moves, the BUILDING OWNER will be free to
open another restaurant with alcohol in premises. If they include rear yard, that will be extent
of what is permitted for subsequent restaurants.
The neighbors are not wedded to this DR. BUT any restaurant operations INSIDE must be part
of a discussion that imposes BINDING conditions that RUN WITH THE LAND.
The resistance to pulling, reviewing and having solid permit plans for the build out of the rear
yard - which is CLEARLY intended to be part of the premises and which AVOIDED any review by
Planning or neighbors - should be unacceptable to the Planning Department.
There appears to be a pattern of deceit by the owner. He

This building 458/460 Grove street was converted to a commercial building long before this group
of tenants at 470 moved in.
The owner has terminated the lease with the tenant who was leasing the garage. It has been
restored back to a garage. The owner is willing to convert this to commercial space and remove the
curb cut if the city views this as an asset. City picks up a parking space…. City gets active ground
floor.
Owner has not “rented” the street space in front of the garage.

Hello! I write with regard to the change of use permit that has been submitted for
458 Grove Street by the landlord John Kennedy. I am a resident and homeowner at
445 Fulton Street, in the "Fulton-Grove" condos that are just next door. I support
development in Hayes Valley but wanted to convey my concern about noise in
particular, as well as managing additional traffic (foot and vehicle), and general
concerns associated with a venue that serves alcohol, if the permit is granted.
I'm not familiar with the permit process and whether contingency and mitigation
plans are part of the requirements but I hope the permit applicant is taking seriously
the impact that his establishment would have on the neighbors.

It was a pleasure to talk to you this afternoon. I've sent some photos to show the proximity of my
place, 441 Fulton Street and the proposed beer and wine garden at 460 Grove Street.
One of the photos is from my kitchen window and another shows the distance of my backyard fence in
relationship to the patio of 460 Grove.
At the moment the Change of Use application pertains to just the interior but who ever starts a lease
will be applying to the city for the use of the patio. That's just common sense on the part of the new
lease holder and I'm sure their application for use of the patio for food, wine and beer consumption will
be granted. If the lease were to change hands then there's always the chance that the new lease holder
could be very undesirable.
As we talked on the home, there is so much echo in that back yard. When the yard has been used, I
can hear everyone's conversation. When folks, sometimes they get louder.
