Changes to the Residential Sales Contract
At their meeting on October 30, 2003, the GLAR Board of Directors approved
changes to the residential sales contract. These revisions are intended to further
protect you as an agent. Changes in the contract include basic additions of
verbiage as well as more substantial changes. Some changes include a section
addressing home warranties and the addition of language regarding a contract
acceptance without receipt of the Seller’s Disclosure.

changes to the form. A copy of this document is also available online for
members to review. To view the new contract go to our website
www.LouisvilleRealtors.com, login to Internet Member Services, and choose
Forms Online. Revisions are indicated in blue.
The new Residential Sales Contract will be available in the Realtor® store no later
than the second week of December. Please remember that due to the changes in
the contract you may not mix and match pages from the old and new versions.
Several sales contract education classes will be scheduled in January. Please
contact the education department for more information.
GLAR Office Closings
The Association office will be closed on Friday, December 19th from noon – 2pm
and all day December 24th, 25th and Thursday, January 1st. We apologize for any
inconvenience this may cause. You can still download flyers and schedules,
register for classes and events, shop the Realtor® store, and even pay your bills
online through IMS (your member number is your login name and the last four
digits of your Social Security Number is your password).
Holiday Cocktail Reception
Our annual Holiday Cocktail Reception will be on Wednesday, December 10th
from 5-8pm. For the first time, we will gather at The Hurstbourne Country Club,
off South Lyndon Lane from Shelbyville Road. This is a great opportunity to
visit with friends and business associates, as well as extend goodwill to each other
during the holiday season.

NAR’s Strength on Display. Membership now stands at 971,000, with
multi-million dollar increases in revenues due to the increased membership.
RPAC reaches record high $ 4,108,967, with a 26% increase in individual
contributions. To date, 36% of the NAR membership has contributed to
RPAC. Locally, GLARPAC has exceeded its goal, with over $ 31,000
raised since July 2003.
Record numbers of Realtors® attend the San Francisco Expo with over
24,000 attending. GLAR members in attendance, in addition to me,
include, President-elect Kathy McGann, NAR Director Bill Snyder, John
Weikel, Guy Montgomery, Mike Brown, Chris Coury, Pat Parks, MSI
President Jim Russell, and our EVP Lisa Stephenson.
Outgoing NAR President Cathy Whatley emphasized the importance of
the real estate industry in driving the nation’s economic engine. GLAR
President-elect Kathy McGann attended Cathy Whatley’s session and was
proud that all Realtors® can take a measure of credit for the outstanding
housing market and record 5.99 million existing home sales. Locally,
GLAR reported 12,000 sales over the past year in our service area and
over 2 billion dollars in transactions.
NAR releases membership survey, that shows for the first time, a majority of real estate brokers are women-52%, with the typical member being
a 51 year old married female who works 40 hours a week.
REALTOR.com President rallies Realtors® to defend the online site
from media moguls including LendingTree and Interactive Corp. The
media giants are eyeing the space between Realtors® and consumers. Full
details of this story are available at inman.com. NAR statistics show that
84% of members place their listings on REALTOR.com
NAR projects 2004 to be the SECOND BEST year for the housing
market. NAR chief economist told Realtors® to expect the housing
market to coast to somewhat lower, yet historically strong levels during
2004.
In summary, NAR appears financially strong, with membership and income
increasing and healthy projections for 2004. The story appears to mirror what’s
going on at GLAR, as our membership is up and our association is financially
strong. The housing market is projected to continue to rise to levels not seen
since 1986, and mortgage rates are expected to rise minimally to an attractive
6.5% for 2004.
A few final notes from your President, as I return from the NAR Convention in
San Francisco. Talking with Board Presidents and Realtor® leaders from around
the country, I remain proud of our Association and believe strongly that we have a
progressive and leading edge organization. Our financial strength, newly created
GLARPAC, on site Realtor® store and our strong education program clearly set
the pace for our members to achieve financial success in the real estate business.
We must, however, continue to challenge our Association to provide the best
services and most productive classes in order to maintain our leadership position
and advance the interests of Realtors®.

Let’s look at the MLS system as one of our opportunities for improvement. The
system is our greatest tool for service to our customers but it is only as good as
the information we have entered. Since all of us have agreed to abide by the MLS
Rules and Regulations when we joined, it is our responsibility to know what they
are, as well as, the law concerning real estate. If we, as REALTOR professionals,
take time to check our listings, verify the property information, and follow the
rules, we will find that the MLS will function efficiently and therefore boost our
efficiency.
There is an easy way to check our listings once they have been entered in the MLS
system. Whether you enter your own listings or your office assistant, once your
listing has been entered print it and check the information. Be sure any corrections that need to be made are done as quickly as possible. As a precaution, I
would check my Inventory in the system at least once a week depending on your
listing (and selling) activity. The MLS makes this task easy by going to Inventory
and printing your inventory list.
And finally, remember the Code of Ethics and apply it to how we do business
with our customers and our peers. We can summarize our professionalism in that
old simple statement, “Do unto others as you would have them do unto you.”

The 2-day ABR Designation course will be at GLAR on January 19 & 20, 2004,
and the ABR elective course will be on January 21, 2004, both of which are
necessary to receive the ABR Designation. For those of you who are looking for

tremendous opportunity for REALTORS who have the skills to reach this

Realtor® Roundtable to meet and discuss issues with your Board of Directors. A
brief outline of items discussed at the meeting follows.

1. The Board was looking into allowing a greater amount of time between
updates for Supra. However, there are several “behind the scenes” issues that need
to be addressed first. Other Boards have allowed longer update times and have
since reverted back to daily updates. When the Board chose this system, THERE
WAS NO OTHER OPTION available. Other systems are coming on market soon
and when our contract expires, we may have better options at that time.
Since the Roundtable in October, a discussion was held by the the Board of
Directors in reference to the Supra daily update vs. weekly. After an extensive
discussion on the pros and cons on a weekly update, the Directors voted to
continue the daily update.
2. Another broad topic discussed at the round table pertained to contracts. The
Realtors® who spoke wanted shorter forms, designed by Realtors® and worded
by attorneys. Some debate ensued about the process of crafting our contracts. The
forms committee welcomes ANY REALTOR who has the time to attend all
meetings to sit on the committee. EVERYONE’S input is welcome at any time
either by phone or email to the committee chair or Lisa Stephenson.
3. With “Limited Right To Sell” listings, it was brought forth that KREC has
guidelines that assist agents in how to approach these listings for showings and
contracts. The GLAR Board does not have the power to make statutes, this is in
KREC’s hands, but Realtors® thought that the GLAR and MLS Boards need to
be active in crafting an effective formula for our industry that will be beneficial to
the public and Realtors® alike.
4. It was noted that new development information is included in Business First
book of lists and their website and that city infrastructure work such as road
improvements are listed on the LOJIC website. We carry a link to that site from
our MLS homepage.

5. Mention was made to include “Standard of Practice” issues in our Informed
Realtor® newsletter that would help us all conform to the law by example. It was
also requested that no names be included in these cases.
6. GLARPAC questions were raised. You should give to GLARPAC because with
over 3,600 members, we are big enough to turn heads and votes at the local level.
These votes can and will affect the way you do business. Call John May,
GLARPAC Chairperson for more information.
ALL meetings are open the membership. The Boards encourage your involvement
and will be doing so by keeping you abreast of changes in print and website form.
The Realtor® to Realtor Roundtable is open to all members. It’s
designed to address industry issues in an informal setting and give
you an opportunity to network with your fellow agents.
