I
t is hard to believe that Tributes 2011 is just days away! Over the
course of the last several months, nomination statements underwent
evaluation, finalists were selected and interviews by independent
judges occurred. I witnessed one afternoon of the finalist interview
waiting room and experienced the gamut of emotions. To a person,
everyone I talked with expressed sincere appreciation and humility
about their nomination. The excitement and nerves were palpable and
clearly reflected the impact and importance of this recognition.
Although as an industry, we spend a fair amount of time together,
and many of us have worked for multiple companies within the field,
we rarely have an opportunity to celebrate success as a complete group.
Tributes 2011 provides the opportunity for both Owner Members and
Supplier Members to honor their team members and competitors.
The representatives from the major sponsor companies (Presenting,
Platinum and Gold) gathered last month to snap the shot seen on the
cover (and to the right). These are the companies who make Tributes
possible, along with our Silver and Bronze sponsors, and you’ll see
them light up the stage as they present the awards to each of the
Tributes winners.
As an Owner Member, I am nervous and hopeful for our nominees
and am looking very forward to witnessing my other Owner and
Supplier friends accept their awards. I am also honored by the
opportunity to present an award which provides me the chance to
recognize our company and our finalists in a very public forum.

Jon Troshinski of Karndean International has been named
Karndean’s “Dual Channel” Rookie of the Year! (Dual
Channel means that Jon works with both Commercial and Residential floor
covering suppliers in his 3 state territory of Colorado, Utah and Wyoming)
Todd Gates of Karndean International shared that Jon has not only grown his
territory and achieved top line sales, he has brought a very positive attitude
to the team as well as an innovative and creative approach to both business
development and problem solving! Jon was the recipient of the “Most Outstanding Newcomer
to the Industry” Tribute award in 2008.
Rapid Restoration welcomes Jeremy Bennett to their team as Sr. Project Estimator. Jeremy
brings an extensive background in property management, ground up construction and reimaging construction projects. Jeremy’s focus will be to provide services including large capital
improvements, renovations and tenant finishes. On a personal note – Jeremy and his wife have
a two year old son and are patiently awaiting the birth of twins in October.

More Sales and Happier

here are many studies on listening and “retention” and all have
dismal findings. Commonly people only hear about 25% of
what you have to say. That means they may be listening – but
that they only “get” or “retain” about 2.5 minutes of a 10-minute
conversation. Wow!
Becoming a better listener helps on so many levels – you’ll be a
better sales person since you’ll have a better understanding of your
client’s needs. You’ll be more productive, since you’ll get projects
done correctly the first time since you “heard” proper directions.
You’ll be a better manager, and residents will be able to converse
with you more effectively – and this will save you time! In addition,
everyone loves an employee who pays attention and doesn’t need a
huge amount of direction.
For some people, listening is really hard. It is certainly a skill that
needs practice, and is hard to do in this multi-tasking world of ours.
Practice your listening skills -- start right now! - and you’ll close more
sales, have better relationships, and be more valuable to your boss
since you’ll be the one finishing requested tasks while the others are
scratching their heads trying to remember what the boss wanted...

Revolving Door Industry
How we are screwing up the resident turnover battle

I
truly believe the multifamily industry is progressing rapidly, so I’m
very optimistic about prospects in multifamily, but we still average
around 60% resident turnover every year. I think that this figure
is so commonplace that people tend to forget how ridiculous it truly
is that 60% of our customers take the time to move their entire life in
order to leave our service. I am particularly concerned that with the
potential rising rents coming in our industry, we will lose focus on our
inherent problems and just relish the changing market conditions. So
I’ve started a list of elements that I believe add to the fundamental
problems we face with resident retention.
Our contracts are designed to end
With most other subscription-type services,
contracts renew forever automatically or at least
last for several years, such as car leases. In a
subscription-type revenue model, you hope
that the customer does not enter the “buying
cycle”, because once that happens, they are
actively shopping for alternatives. With many
services, an average customer will stick
with a service until something forces them
into that buying cycle, such as the product
doesn’t work, the product is outdated,
the price increases significantly, or the
customer’s personal budget changes. In most
cases, competing marketing will not impact
their decision to change, similar to how you
don’t even notice car commercials until you
are looking to buy one.
However, in the multifamily industry, we are
so fearful of losing out on potential rent increases
that we place time limits on our customers, forcing
them to re-examine their purchase every year. Each
year, we ask the question, “Do you really want to stay with
us another year,” which translates to, “go ahead and take a
look at what concessions all our competitors have going on right now.”
If our own communities had not put that thought in their ear, they
would have never known about the free two months rent down the
street. We are doing this to ourselves.
Marketing vs Customer Service
We spend an inordinate amount of time on marketing versus
customer service – Feel free to vote on the poll, but I recently asked
how much time per week did apartment marketing take up compared
to resident retention. Not surprisingly, 55% of people said marketing
takes up more time. But this is really a chicken and the egg situation,
isn’t it? Let’s say we had happy and engaged residents who were truly
fans of our community – we certainly wouldn’t have 60% resident
turnover, which means we wouldn’t need nearly so much time on

apartment marketing. But since we are not there yet, we spend more
time on marketing, which means less time on resident retention, which
leads to high resident turnover. It’s a cycle that apartment communities
just can’t seem to get out of.
Profitability
Fee-managed companies receive a set percentage as compensation
– Generally, fee-managed companies, those that manage a property
for a separate owner, receive approximately 3%, give or take. Now,
there are some absolutely amazing fee-managed companies out there,
but any company will operate to the highest potential profit. You’ve
heard about the concept of “low hanging fruit”, right? Well, to get a
community running on a very basic level would be considered
the low hanging fruit. Once that is done, it requires a little
more effort to gain that next level of profitability. Every
incremental improvement in profit and revenue will
become harder to achieve, which is where the
problem lies. If a property management company
only receives 3% of the benefit, there comes a
time where it simply isn’t worth the effort to
progress upward to harder-to-obtain profits/
operations. Conversely, if you increase the
profit sharing opportunities for the property
management company, it creates incentives to
cut corners, such as preventive maintenance,
that boost short term profits at the expense
of long-term viability. But because of this
concern about negative incentives, from
what I have heard and seen, nobody appears
to be trying to solve this issue of lowering
compensation relative to increasing difficulty of
achieving profits.
Our Customers’ American Dream
For so long, not only had we given up the fight
against homeownership, but we actually congratulated
our residents when they left us! Now there are finally some
definite shifts in this mindset, but we have to be mindful of one of our
customers’ reasons for wanting to own a home - a sense of ownership.
What is the difference between these two statements: “This is my
home” and “This is where I live”? One implies a sense of emotional
ownership, while the other is a transitional place where they happen
to store their stuff. Are we encouraging our residents to make their
apartment their own? Are we giving them any ability to add their
own touches to it besides an accent wall (which I do believe is a step
in the right direction)? We need to figure out how to make people
take ownership of their home, even though they don’t own it in the
financial sense.

The New American Dream

Renter Nation is Has Emerged

wo years ago we witnessed the highest vacancy rates
nationally in over thirty years. Just a mere 24 months later, we
are seeing extremely low vacancy rates as the new “Renter
Nation” takes the stage in the housing marketplace. By 2015,
we expect seven million new renter households to form across
America. In Colorado alone, according to the 2009-10 Census
we have seen an increase of 200,000 new Colorado residents.
This points to probable higher rents in Colorado, albeit will be
cautiously rising as we are still contending with a slow increase of
job growth in our state.
Why are the renters coming in droves? The multi-faceted answer
lies in many areas including the high rates of unemployment, the
possibility of increased corporate layoffs that can affect job security;
additional mandates on local businesses have created a cautious
environment among business owners; the need for flexibility in the
case of layoffs (renting offers flexibility and the increased ability
to move to a different market in the case of a job offer); increased
regulations within the mortgage industry have tightened the ease of
obtaining a mortgage, which has contributed to the slowing of housing
sales. With the instability in the market, many people do not wish to
burden themselves with the 30 year mortgage.
Each of these components have led the consumer to look to other
alternatives which include renting.
Through the increase of foreclosed upon single family residential
homes, we are now seeing the rise of the investor that has purchased
foreclosed upon properties and has now become the “accidental
landlord.” Quite often the investor of these homes leases the property
without the understanding of housing provider issues or compliance.
Little, if any attention may be given to the Federal Fair Housing laws,
or running credit checks. It is not uncommon to have three, four or
more applications to rent a single family residential home. For this
reason, the Apartment Association of Metro Denver is taking additional
steps to assist the new landlord.
The Apartment Association is currently aligning with area city
councils to offer support to address the needs of the new landlord.
The Apartment Association hosts numerous housing provider classes
from understanding the Federal Fair Housing Law, credit checks,
EPA requirements and more. The Association also provides access
to credit checks via a link on the AAMD website available to anyone
who wishes to use it. You do not need to be a member to access this
tool. The Association offers top quality resources including handymen,
carpet layers, painters, roofers and nearly every need to keep your

Due to the recent changes in the marketplace, the Apartment
Association, within the next few months, plans to reach out to the nonmember housing providers that may need guidance in these areas by
offering seminars specifically created to address compliance for new
landlords.
As local governments and municipalities look to increase renter
protections, many are hopeful that through this outreach to new
housing providers, we can maintain ideal relationships between
landlords and tenants and not add to the regulatory burden that
already exists.
From a statewide perspective, additional local regulations are
often unnecessary as the industry complies with ample regulations
and statutes that orchestrate the landlord-tenant arena. The Warranty
of Habitability was enacted at the state level to illustrate the rights of a
tenant. All parties involved in the creation of this statute have stated it
is well balanced policy.
The Apartment Association of Metro Denver has taken steps to
educate the tenant as to their rights. A copy of the Tenant Rights

Take the financial bite out of vicious dog cases

M
ore and more, we hear about landlords getting sued
when their Resident’s dog becomes aggressive, bites or
even kills someone. In California, a tenant’s German
shepherd attacked and seriously injured a deliveryman. The victim
sued both the tenant and the tenant’s landlord. The court ruled
that the landlord was liable because the landlord was aware of the
presence of the dog and failed to use reasonable care in renewing
the lease. The court believed that if the landlord had used
reasonable care and inspected the rental premises at renewal time,
the landlord would have seen the tenant’s posted sign, warning
people about his “guard dog” and would have made inquiries and
discovered the dangerous propensities of the dog. The landlord’s
failure to inspect or use reasonable care made the landlord liable
for the victim’s injuries. Portillo v Aiassa, 27 Cal.App.4th 1128
(1994).
In Florida, a tenant’s two pit bulls attacked a young girl on
her rollerblades, resulting in serious injuries. The landlord and
the tenant/dog owner were sued. The community allowed pets,
but prohibited certain breeds, including pit bulls. However, the
tenant had occasionally allowed his pit bulls to run loose in the
community. The court noted that, although the landlord was
aware of this, the landlord had failed to ask the tenant to remove
the animals or leave the community for violation of the community
rules. Therefore, the landlord could be held liable for the injuries to
the victim. Ramirez v M.L. Management Co., Inc., 920 So2d 36 (Dt.
Ct.App.FL 2005)
In South Carolina, a tenant’s two Rottweilers tried to attack a
neighbor and later did attack the neighbor’s coworker. The lease
allowed only one dog, but management had permitted the tenant
to keep both dogs. The landlord also was aware of these incidents
of aggression and violence, but failed to take any action. The dogs
later attacked a visitor, who in turn sued the landlord for his injuries.
The court noted that the lease allowed the Landlord to remove any
pet within 48 hours of written notification of pet disturbance or
undesirable conduct. The landlord’s failure to take appropriate action
that was within their control made them liable for the victim’s injuries.
Holcomb v Colonial Assoc., LLC, 597 S.E.2d 710 (Sup.Ct NC 2004)
In Colorado, a social guest of a tenant was bitten by the tenant’s
Rottweiler dog while playing in tenant’s backyard. The victim sued the
tenant/dog owner as well as the Landlord. Importantly, in this case,
the Landlord was absolved of liability. Why? Because in this case,
the court found that the Tenant was the “person in possession” of the
premises where the injury occurred to a licensee (social guest) of their
tenant. The landlord had transferred control to the tenant, and even the
landlord’s reservation of the right in the Lease to inspect and the right of
maintenance and repairs did not create liability for the landlord under
Colorado’s premises liability statute CRS 13-21-115. Furthermore,
the victim failed to demonstrate that the landlord knew about the
dog’s allegedly vicious nature before the lease was signed. Wilson v
Marchiondo, 124 P.3d 837 (Colo.App. 2005)
The lesson to be learned from these lawsuits is that a landlord
cannot simply ignore complaints of aggressive or dangerous dogs.
Many of us in Colorado love dogs and are loath to require Residents
to get rid of their dogs or commence eviction, even when a Resident’s
dog repeatedly barks, growls or snaps at other residents or other

dogs. However, when a landlord receives complaints, it is important
to take appropriate action to protect the safety and well being of
other residents/visitors, as well as to protect yourself as a Landlord
from substantial financial or even criminal liability for injury or death
of a victim of an attack. If a dog barks excessively, a Demand for
Compliance, requiring the tenant to take appropriate action to stop
the barking, should be served. If the dog attacks or bites someone, a
Landlord should take more drastic action and demand removal of the
dog permanently, or in some cases, ask the Resident to vacate.
Once you as a Landlord become aware of the aggressive or vicious
nature of your Resident’s dog, you should review your pet addendum
or applicable Lease provision. Does it permit you as the Landlord to
require permanent removal of an aggressive dog? If so, prepare and
serve a “Demand for Compliance or Possession” giving the Resident 3
days to remove the dog from the rental premises. Inspect the premises
after day 3 to insure compliance. If the dog is still there, you should
proceed with eviction action. If the dog is gone, the problem is solved
(for now).
If the Resident brings the dog back to the premises at a later date,
there is no second opportunity to cure the breach of lease. You should
serve a “Notice to Quit for Repeated Violation” on the Resident, giving
the Resident 3 days to vacate the premises completely. The Resident
loses his/her right to possession, yet still remains liable for lease break
charges, future rent, etc.
Avoid the financial bite that can result from allowing dangerous
or vicious dogs on your rental property. If your community policies
(or insurance carrier) prohibit certain breeds, enforce these policies.
Although insurance carriers often will defend a landlord in cases
such as these, there may be a substantial deductible to be paid. If
management allows prohibited breeds, your carrier may deny coverage
altogether. If you receive a complaint of a dangerous dog, and you are
not sure of the proper steps to take, contact your attorney for guidance.

Revoke Definition of “Unblockable Drain”

focused on reducing taxes. NAA/NMHC will continue to make the
case to lawmakers—including the 12-member “Super Committee” on
deficit reduction—that using carried interest as a pay-for would be
counterproductive in the context of a 9.1% unemployment rate.
The VGBA requires pool operators to install new anti-entrapment
drain covers on all public pools. When a pool has a single main
drain, other than an “unblockable drain,” the law requires additional
layers of protection such as an automatic pump shut-off or a gravity
drainage system. Prior to this change, the CPSC in some cases
permitted the use of large drain covers installed on small single main
drains to satisfy the requirements, which eliminated the need for
secondary anti-entrapment devices. This vote reverses this position;
Staff Technical Guidance will be amended to state, “placing a
removable unblockable drain cover over a blockable drain shall not
constitute an unblockable drain.”
The Obama job-creation package includes items of interest to
multifamily firms. For individuals, it would extend through 2012 and
increase to 3.1 percentage points the cut in the 6.2% employee-paid
payroll tax. For employers, the President’s proposal would cut in half
the 6.2% payroll tax for the first $5 million any firm paid in wages. It
would also completely eliminate employer-paid payroll taxes for up
to $50 million in increased wages or total payroll. Finally, the White
House package would extend through 2012 “bonus depreciation,”
which allows businesses to write off the cost of new capital
equipment in the year purchased instead of depreciating it over years.
Without an extension, just 50% of the cost could be immediately
deducted in 2012.
he Consumer Product Safety Commission (CPSC) on September
28 revoked its interpretation of an “unblockable drain” for
purposes of complying with the requirements of the Virginia
Graeme Baker Pool and Spa Safety Act (VGBA). Some apartment
pool operators may be impacted by this new interpretation.
The revised CPSC guidance will define unblockable to mean
a “suction outlet, including the sump, that has a perforated (open)
area that cannot be shadowed by the area of the 18” X 23” Body
Blocking Element of ASME/ANSI A112.19.8-2007, and that the rated
flow through any portion of the remaining open area cannot create a
suction force in excess of the removal force values in table 1 of that
Standard.”
The Commission does not anticipate enforcing this change before
May 28, 2012 and will seek comments from pool operators regarding
their ability to come into compliance by this date. For more

Block on Illegal Immigrant Harboring Law
Renewed in Alabama
A federal judge has granted a preliminary injunction that blocks
enforcement of parts of an Alabama immigration law (Ala. Laws Act
2011-535) already on hold, including the law’s provisions that punish
rental property owners for “harboring” illegal immigrants.
On September 28, U.S. District Judge Sharon Lovelace Blackburn
ruled that neither Congress nor the U.S. Supreme Court has defined
“harboring”, but federal law nonetheless preempts Section 13 of
Alabama’s statute, making it unenforceable (U.S. v. Bentley, 5:11-cv2746, U.S. District Court, Northern District of Alabama (Birmingham).
Importantly, the judge noted that federal law explicitly and
implicitly permits apartment owners to provide rental housing to
individuals without legal documentation. That rejected Alabama’s
argument that only providing rental housing without a further
proactive act to someone known or reasonably believed to be an

illegal alien constitutes “harboring.” The U.S. Department of Justice
and a coalition of civil rights groups opposed to the Alabama law
have already filed motions to stay the judge’s ruling that allows some
provisions of the law to go forward pending consideration of the statute
by the 11th Circuit Court of Appeals. Judge Blackburn’s decision could
spur further legal review of other recently enacted state and local
immigration laws across the United States.

E-Verify Bill Advances in U.S. House of
Representatives
On September 21, the House Judiciary Committee approved the
“Legal Workforce Act of 2011” (H.R. 2885), which would require
all employers to use the federal government’s E-Verify program to
confirm the employment eligibility of new hires. Under current law,
federal contractors must use E-Verify, and some states require most
other employers to use the system. The bill also reduces the number
of identification documents that an employer can accept when using
E-Verify and increases employer penalties. Final passage of the bill is
uncertain even if it is approved by the full House because it is opposed
by Senate Democrats.
Lawmakers Seek Foreign Capital into U.S.
Commercial Real Estate
Prior to adjourning for a late-September recess, lawmakers
introduced NAA/NMHC-supported legislation (H.R. 2989 and S. 1616)
to spur foreign capital into commercial real estate markets, including
multifamily housing, by loosening the Foreign Investment in Real
Property Tax Act (FIRPTA). The bills would:
•
Reverse IRS Notice 2007-55, which has disrupted foreign
investment in U.S. real estate markets. Rules in effect prior
to 2007 would be reinstated to allow REIT redemptions and
liquidating distributions to be treated as stock sales, exempt
from FIRPTA.
•
Double—to 10%—the amount of stock a foreign entity could
control in a publicly traded REIT without triggering FIRPTA.
Notably, during the 111th Congress in 2010, the House
overwhelmingly (402-11) passed legislation similar to the bills, but the
full Senate did not take action. The legislation was introduced in the
Senate by Senators Robert Menendez (D-NJ), Mike Enzi (R-WY) and
Chuck Schumer (D-NY) and in the House by Representatives Kevin
Brady (R-TX), Joe Crowley (D-NY), Shelley Berkley (D-NV), and Patrick
Tiberi (R-OH).
IRS Provides LIHTC Relief to Vermont
Storm Victims
The Internal Revenue Service (IRS) has issued Notice 2011-74 to
suspend certain Low-Income Housing Tax Credit (LIHTC) requirements
in areas of Vermont impacted by Tropical Storm Irene beginning on
August 27, 2011. The IRS will allow the Vermont Housing Finance
Agency to suspend otherwise-applicable income limitations and
non-transient requirements to allow owners of low-income housing
to temporarily provide vacant units to displaced storm victims. Rent
restrictions will continue to apply to such units. Although the Vermont
Housing Finance Agency will determine how long requirements are
suspended, relief may not extend beyond September 30, 2012.
