Frequently Asked Questions What are contract numbers and Member numbers? Your contract number is the unique number we use to denote information such as the year and location of the sale for each vacation ownership purchase. It is commonly used when inquiring about loan or contract information.Your Member number is a unique number and is how we identify your membership when making reservations and accessing other Member benefits.You may have several contract numbers, but only one Member number. What legal document governs the operations of FairShare Plus? Fairfield Resorts, Inc. created FairShare Plus with the establishment of the FairShare Vacation Plan Use Management Trust in 1991.This trust, as summarized in this directory on the FairShare Plus Program Disclosure page, provides some important information. As a Member of the FairShare Plus program, you are a Member of the FairShare Vacation Owners Association, as well as a Member of the Property Owners Association where your “home” resort is located. How far in advance should I request my vacation? Vacation requests should be made as soon as possible, as all reservations are based upon space availability. As a rule, holiday, summer and special event time periods require more advance planning than other times. After the ARP Reservation period discussed above has passed, most reservations are confirmed during the Standard Reservation period, between 10 months to 3 months in advance of check-in date. Express Reservation requests may begin 3 months in advance of the check-in date and are the least restrictive and sometimes most economical. However, they require flexibility as availability of this inventory can be very limited so close to the check-in date. What is the significance of my “Home” Resort? Your “home” resort is a specific resort location of the ownership interest indicated on your purchase contract. It is important because it is where you may access the Advance Reservation Priority (ARP) feature, which allows you exclusive privileges to reserve a weekly reservation up to 3 months before it becomes available to Members with a different “home” resort.The ARP is available beginning 13 months in advance of the check-in date, so it cannot be guaranteed in your first year. What is the significance of my “Use Year”? Your Use Year is the 12-month period in which your points are allocated for a variety of uses annually. Your Use Year was determined based upon the date your first ownership entered the FairShare Plus program. Remember, points do not automatically roll over from one Use Year to another, so it is important to always be aware of your current year’s points balance! Also note that points are taken from the Use Year in which the vacation/usage takes place, not the date the reservation is confirmed. So it is not necessary to wait until your annual Use Year begins to plan your vacation. Owners James & Dotty Warrick from Port Clinton, Ohio 258 Do Associate resorts and hotels have similar availability as FairShare Plus resort locations? No, the Associate locations included in this directory have been added to provide FairShare Plus Members additional vacation experiences using their points. Because these resorts and hotels are not owned or managed by Fairfield, the availability to FairShare Plus Members is limited.These locations can change throughout the year, as Fairfield continually searches for new and exciting vacation options. Point values assigned to the Associate inventory in this Directory were valid at the time of printing, but can change at any time. Please refer to our Web site for the most current listing of locations and point values included in the program. Are all units assigned FairShare Plus available for me to reserve? You always maintain exclusive use rights for a reservation during the Advance Reservation Priority time period at your “home” resort. However, within the Standard Reservation time period, the Plan Manager may remove the amount of inventory corresponding to a Member’s points usage of non-resort benefits such as cruises, Adventure Club and PlusPartners for rental or other purposes. Sometimes when I call to make a reservation there is no availability, but if I call the resort, there is space. How does this happen? At resorts that are not completely sold out, FairShare Plus may not have access to the unsold inventory or the property has been developed with other partners for non-timeshare usage. Also, when FairShare Plus Members choose to make a reservation with an external exchange company like RCI and II, inventory is assigned to the exchange companies for their guests. In the “Fast Facts” section on the resort pages in this directory, you will find references to the resorts that have limited or very limited availability. This should help you when you are planning your vacation. Please remember that you cannot make a FairShare Plus reservation by calling the resort directly. Instead, contact a Vacation Planning Counselor at 800-251-8736, Ext. 11. When should I use the Points Credit Pool? The Points Credit Pool is a good feature to use if you know in advance that you are not going to be able to use your points for the next year. By putting your points in the Points Credit Pool, you receive pool credits that can be used up to 3 years from the date they were placed in the pool. Remember, you must place your points in the Points Credit Pool prior to the Use Year Start Date. Pool credits can be used for a Standard or Express reservation. If you take yearly vacations and typically use your points throughout the year, this feature is not recommended. When are PIC Plus points available for me to use? If you enrolled in the PIC Plus program, your non-Fairfield week was given a FairShare Plus point value. However, enrollment does not automatically put these points into your FairShare Plus account. In order to receive FairShare Plus points for your PIC Plus week, you must contact a Vacation Planning Counselor at least 10 months prior to the check-in date of the PIC Plus week that you would like to receive FairShare Plus points. Once the points are placed in your account, you may begin using them.These points are effective for 1 (one) year from the date they are placed in your account. Because this must be done at least 10 months prior to the check-in date, this feature may not be available the first year of ownership. What happens if I have to cancel my reservation? If you cancel your reservation more than 30 days in advance, your points will be returned to your account as Cancelled Reservation Points.These points are good until the end of their Use Year.They can be used for any program feature except an ARP Reservation and a conversion to Rewards Credits. If you are cancelling less than 30 days from your arrival date, your points will be returned to your account as Limited Account Points.These points may only be used for a reservation that is made within 30 days of check-in.When Why do some FairShare Plus program features require a transaction fee? In order to keep your assessment fees as low as possible, it is necessary to charge transaction fees for optional program features upon use. In this way, Members only pay for the optional features they choose to take advantage of. Each Member is given 1 (one) transaction per year for every 77,000 points of ownership. Once you use all of the transactions allotted to you, you will be charged for each additional optional program feature you choose to use. Additionally, usage fees may be assessed by the vendor partner in conjunction with the FairShare Plus exchange and travel program offered. When do I have to pay for Housekeeping Credits? Each year you receive 1 (one) Housekeeping Credit for every 1,000 points you have.You use these credits based on the size of unit you reserve and the number of nights you are staying. Depending on how you vacation, you may have enough to last you for the year. However, if you typically take several smaller vacations throughout the year, more cleanings are required, and if you use all of your Credits, you will need to purchase additional credits. Please be aware that some changes may require additional legal documentation. In order to maintain the confidentiality of your records, only Members listed on your legal documents are allowed to request reservations and related benefits. reservations have been made less than 30 days prior to check-in, you have a 10-day grace period from when you made your reservation in which to cancel those reservations. Limited Account Points are good until the end of their Use Year. How can I reserve the vacation I want? Be flexible! Think about the type of vacation you are looking for. Are you looking for a beach location? A ski trip? A week full of action-packed adventure? Once you have identified the type of vacation you are looking for, browse the Member’s Directory to identify resorts fitting your ideal vacation description. Now, determine the dates you are available to vacation! Try to have as many alternate dates as possible. Added flexibility increases your opportunity for getting your dream vacation. Also, keep in mind how far in advance you should book (refer back to the question regarding how far in advance to request a vacation). Don’t forget to talk to your Vacation Planning Counselor about your plans! They can make suggestions and provide information to help you get the vacation you want. When is the best time to call? Although Member calls are answered as quickly as possible, the greatest call volume occurs on Mondays, the days following holidays and in the late afternoon, EST. What if I am not confident that I have a clear understanding of the program? No Problem! Owners Fran & Mary Ellen Marko from Glendale, Ohio How do “Worldwide External Exchanges” differ from reservations at Fairfield resorts? If you desire a vacation destination not listed in this FairShare Plus Member’s Directory, your membership includes access to thousands of resorts worldwide that are affiliated with the exchange company listed on your ownership documents. FairShare Plus simply “exchanges” comparable FairShare Plus resort inventory with the applicable exchange company and you request (for a fee) the desired destination(s) from its Resort Directory. If your requested location is not immediately available, a “Waitlist” search feature can be utilized.Your Vacation Planning Counselor can provide additional details. Can I request a specific unit when making my reservation? No.The inventory management system is programmed to place the maximum number of Members at each resort every night.Therefore, actual unit assignments are not made until 261 the check-in date. Exceptions are made for guests with special medical needs and VIP Members. Additionally, an unforeseen maintenance problem may prevent occupancy in a particular unit. However, Fairfield guarantees that you will be placed in the exact unit type (i.e., Studio, 2 Bedroom Deluxe) you reserved. I purchased at several different resorts. Why does it take so much longer to get a deed at one than at others? The process of issuing deeds and title insurance begins only after the completion of the building and can take several months, depending on the location of the resort. Some locations are still in the process of being built. Additionally, the local municipality where your property is located may have different recording processes. Rest assured that having a deed is not required to access any membership privileges. 262 FairShare Plus Assessment & Financial Services The more you experience the resorts, hospitality and service of the FairShare Plus program, the more you will come to appreciate the consistent standard of excellence it offers. It will also demonstrate how your assessment dollars are put to the best possible use.The FairShare Plus Assessment consists of two parts: 1. The Program Assessment Fee 2. The underlying Property Owners’ Association Maintenance Fee at your “home” resort (“POA Fee”) The Program Assessment Fee is determined annually by the FairShare Plus Board of Directors on a pro-rata basis based on the number of points assigned to each Member.This fee is used to pay the operating and administrative expenses, such as personnel and Member services, telephone and computer systems, Members’ directories and updates, the Plan Manager fee, annual audits and other related expenses. The amount of the POA Fee is determined by the board of directors of the underlying Property Owners’ Association. Fixed/float weeks POA Fees and assessments are determined on a per-interval basis. UDI and Destinations Club POA Fees are determined by the number of points allocated to a Member’s interest.The POA Fee for fixed and floating week owners is collected and held in escrow on your behalf until it is due and paid to the POA. Expenses typically covered by the POA Fee include on-site maintenance and resort services for owners such as maintenance of common areas, interiors and appliances as well as major refurbishment expenses, housekeeping, utilities, taxes and on-site management. Assessment Billing Assessments may be paid annually or in monthly installments. For annual payments, the assessment must be paid 12 months in advance. Members are requested to use the pre-authorized checking (PAC) payment system. Members who choose to be billed for their assessment pay a $5 service charge per billing to cover the cost of statements. If a Member makes an additional FairShare Plus purchase, all assessments must have the same payment date and method. UDI Program Assessment and POA Fees are paid concurrently with membership participation. Any fee adjustments are made at the beginning of each calendar year. Fixed week owners’ program assessment fees are paid concurrently with membership participation. If there is a difference between the amount paid and the amount charged by the POA, the Member will be billed or credited at the beginning of each calendar year. If a Member becomes delinquent in paying an installment of the FairShare Plus Assessment, the Member will receive a notice of the delinquency on their next statement and will have an opportunity to respond before being blocked from making a reservation or vacationing and/or being assessed a monetary penalty. Assessments more than 30 days past due may be subject to interest charges or late fees as allowed by state law. A Member may also be charged for any collection fees, including reasonable attorney fees, and a lien may be placed on the Member’s ownership interest. If a Member is delinquent in paying installments of the FairShare Plus Assessment for more than 90 days, the Plan Manager may cause the forfeiture of the delinquent Member’s use rights for the entire current Use Year, even if the Member later becomes current. Use rights will be reinstated for the following year. There are some services offered by FairShare Plus that are not paid from the assessment.The rates are included in the description of these services in this directory. Rates shown are subject to change. The Financial Services Department can assist you with any assessment or billing questions.They can also provide a full written description and details of FairShare Plus assessment expenses. Simply log in at the home page and click on “Review My Financial Status.” 264 Title & Ownership Changes Our World Class Service Commitment Fairfield’s Title Department is responsible for preparing Fairfield purchasers’ warranty deeds, ordering title insurance, mortgage releases and satisfactions to clear titles.The specific title/deed delivery process is dependent upon completion of the building as well as local government requirements where the ownership interest is located. e We pledge to assist our owners and members to ensure that they receive maximum value for their vacation purchase. Additionally, the Title Department assists owners who have identified purchasers for their timeshare ownership interest or need to make other changes to their ownership status. e We promise to be courteous, understanding and professional at all times. If you are certain that you will not be vacationing during the upcoming year, and you do not want your FairShare Plus points to expire, you can convert them into Rewards Program Credits during the first three months of your Use Year.To determine how many Rewards Program Credits you will receive, multiply the amount of FairShare Plus points you are converting by the current rate of .007. (Example: 300,000 FairShare Plus points will convert into 2,100 Rewards Program Credits.) Then use your Rewards Program Credits for travel and merchandise, or you may use them to pay your FairShare Plus assessment at the current rate of $.30 per credit. (Only regular FairShare Plus points can be converted into Rewards Program Credits.) Rewards Program, 800-251-8736, Ext. 32. *Individual state restrictions apply. 265 266 Glossary Advance Reservation Priority (ARP) – a special reservation feature allowing fixed week owners to reserve, in 3-, 4- or 7-night intervals, use of their specific ownership interests that have been assigned to FairShare Plus. Undivided Interest Owners can reserve, in 3-, 4- or 7-night intervals, reservations equal to or less than the annual point allocation at the resort where their interest is located. Float week owners can reserve, in 3-, 4- or 7-night intervals, reservations equal to the annual point allocation associated with their ownership interest. Reservations may be reserved between 13 months to 10 months in advance. Adventure Club – an option for FairShare Plus Members to use their points for one-time group trips to exciting vacation destinations, with set itineraries, traveling with a Fairfield host. Information regarding upcoming trips can be found in the latest edition of the Fairfield Faces & Places magazine or your monthly Adventures Online newsletter, and by calling the Adventure Club Hotline at 800-251-8736, Ext. 11. Affiliate Locations – participating resorts at which accommodations are made available when individual timeshare owners assign the use rights of their nonFairfield ownership interest to FairShare Plus. Assessment Fee – the fee Members pay to the operating fund used to cover the expenses related to the use rights assigned to the FairShare Vacation Plan Trust, including the maintenance fees of each property owner’s association. Associate Locations – additional non-Fairfield developed ior managed resorts where occupancy may be available to FairShare Plus Members for a limited period of time, seasons and accommodations. Borrowing – the ability of a Member to use all or a portion of their points from a future Use Year in the current Use Year. Members may borrow points when making a reservation during the Express Reservation period. Cancelled Reservation Points – points that are returned to an account after a reservation is cancelled more than 30 days prior to the check-in date.They may not be used for Rewards Credit conversions, ARP Reservations or placed in the Points Credit Pool. Conversion – the assignment of a fixed or float interval week to the FairShare Vacation Plan Trust. 267 Housekeeping Credits – the system used to determine the amount of housekeeping service each Member is entitled to annually. Property Owners Association (POA) – the “home” resort condominium, townhouse or timeshare association in which a Member belongs. Destinations Club/Destinations Club Membership – a type of FairShare Plus membership where Members participate by using the FairShare Plus points allocated to Destinations Club ownership interests, the title or use rights of which have been assigned to the FairShare Plus program. Limited Account Points – points which have their reservations use rights restricted to 30 days prior to arrival date because of a late cancellation by the Member. Reservation Timeline – the timeframe in which a particular type of reservation can be made in FairShare Plus. Express Reservations – reservations made 90 or fewer days before the travel date. Lockoff Unit – a timeshare unit that can be divided into separate A and B sides and can be used as a larger single or as two smaller and separate units. FairShare Vacation Owners Association – the non-profit corporation made up of all Members of the FairShare Vacation Plan. FairShare Vacation Plan Trust – the Trust to which the use rights for ownership interests of Members have been assigned. Also referred to as the FairShare Vacation Plan, Vacation Plan,Vacation Program and/or FairShare Plus. Fixed Interval Week – ownership interest in a specific unit at your “home” resort that includes the right to use accommodations during a specific 7-day period each year. The use rights of the ownership interest are assigned to the FairShare Vacation Plan Trust in exchange for FairShare Plus points. Float Interval Week – ownership interest in a specific unit at your “home” resort that includes the right to use accommodations for a 7-day period within an established season each year.The use rights of the ownership interest are assigned to the FairShare Vacation Plan Trust in exchange for FairShare Plus points. Get Out & Play! – an on-site recreation program at Fairfield-managed resorts, featuring both site-specific activities and outings to local attractions. Activities at each resort will vary based on on-site amenities and on the season. Guest Confirmation – a confirmation that is issued when a FairShare Plus Member allows a guest to occupy their reserved unit accommodations. A guest confirmation must be issued prior to the arrival date in order for the guest to be allowed to check in at the resort. “Home” Resort – the underlying condominium, townhouse or timeshare property where the Member’s ownership interest is located regardless of where the original timeshare purchase contract was signed. Maintenance Fee/Property Owners Association Fee – the annual fee and/or assessment paid to the timeshare property owners association for the operation cost of fixed and float interval weeks which have assigned their use rights to the FairShare Vacation Plan Trust. Member/Owner – a FairShare Plus Vacation participant who has assigned the use rights of their ownership interest or membership in a timeshare association to the vacation plan in exchange for an allocation of points in the vacation plan. Ownership Interest – an interest in (1) a fixed or floating timeshare interval, (2) an undivided timeshare interest, (3) an estate for years, (4) a leasehold/membership or “right to use” interest or (5) other interests which may be accepted into the Vacation Plan. Plan Manager – the administrative manager of the FairShare Plus Vacation Plan Trust (Fairfield Resorts). Points – the symbolic unit of measure allocated to a Member in connection with the Member’s ownership interest, which has been assigned to the FairShare Vacation Plan Trust. Points have no intrinsic value separate and apart from the ownership interest. Points are used to establish value for seasons, unit size and resort locations. Rotating Priority List – the system for allowing Members to request reservations up to 22 months in advance of check-in for specific weeks in holiday or high-demand time periods at selected resorts. Season – the time division into which the use days at each resort location or association are divided. Prime, High,Value and Quiet are the names of FairShare Plus seasons. Standard Reservations – reservations made up to 10 months in advance of the desired check-in date. Undivided Interest Ownership (UDI) – ownership interest in a unit or group of units at your “home” resort that includes the right to use accommodations each year. The use rights of the ownership interest are assigned to the FairShare Vacation Plan Trust in exchange for FairShare Plus points. Unit Type – the size, configuration, sleeping capacity, style and other features of unit accommodations. Use Rights – the rights a Member has to use, occupy and possess a unit accommodation, which are assigned to the FairShare Vacation Plan Trust in exchange for FairShare Plus points. Use Year – the 12-month period during which a Member must use their annual point allocation as long as the ownership interests assigned to the FairShare Plus Vacation Plan continue in force and effect. Points Credit Pool – the feature that allows Members to defer the use of all or a portion of their points by putting them in the pool and earning credits for them to be used in another Use Year. Use Year End Date – the last day of the Use Year assigned by the Plan Manager. It is on this day each year that the unused points allocated to a Member expire.There are four Use Year End Dates: 3/31, 6/30, 9/30 and 12/31. Point Saver – reduced point cost for units with an obstructed view. Use Year Start Date – the first day of the 12-month Use Year. It is on this day each year the annual points allocated to a Member become available for use over the next 12 months. Program Assessment – expenses related to the FairShare Plus vacation plan operations, consisting primarily of reservation services, plan administration and other indirect expenses and services. 268 FairShare Plus Program Disclosures The FairShare Plus Program (“Program”) was created by Fairfield Resorts, Inc., f/k/a Fairfield Communities, Inc. (“Fairfield”), with the establishment of the FairShare Vacation Plan Use Management Trust (“Trust”) by the execution of the FairShare Vacation Plan Use Management Trust Agreement dated as of June 26, 1991, as amended by the Amended and Restated FairShare Vacation Plan Use Management Trust Agreement dated as of January 1, 1996, as may be further amended from time to time (“Trust Agreement”).The trustee of the Trust is the FairShare Vacation Owners Association, 8427 SouthPark Circle, Suite 500, Orlando, Florida 32819.The Program is managed and offered by Fairfield, 8427 SouthPark Circle, Suite 500, Orlando, Florida 32819. Fairfield is a subsidiary of Cendant Corporation. There are two ways to enter the Program: (i) A purchaser may buy a timeshare interest, which has the use rights already subject to the Trust in which instance the contract with the exchange company is not separate from the sales contract. OR (ii) An owner of a timeshare interest may assign the use rights of his property to the terms of the Trust in which case the contract with the exchange company is separate from the sales contract. In cases where (ii) above is applicable, the following will apply: (a) Subject to any outstanding or confirmed reservations, Members may terminate their membership at any time by giving written notice of termination to the Trustee; and (b) Upon any termination, the timeshare interest and all rights incident to it, including use and voting rights, shall automatically be returned to the terminated Member.Timeshare interests may be in both Fairfield developed properties and non-Fairfield developed properties. Members may use their points to reserve accommodations at locations for which time is available through the Trust.The Advance Reservation Priority allows a Member to priority reserve their specific timeshare interest from ten (10) to thirteen (13) months in advance of the requested vacation time period. Certain Members have Reciprocal Advance Reservation Priority privileges which allows Members to make a reservation at the reciprocal resort eleven (11) months in advance. A standard reservation request is accepted up to (10) months in advance. An Express Reservation may be made within ninety (90) days of the requested vacation to rent or borrow points. The number of symbolic points assigned to a Member’s timeshare interest is based on several factors including, without limitation, size of unit, unit week (if applicable) and location of unit.There are no limitations on the number of reservations that can be made; however, additional charges may apply. Refer to the “Making Your FairShare Plus Resort Reservations” section of this Directory. However, the number of points necessary for a specific reservation is determined by the unit size requested, time of year, destination and duration of stay.Thus, a Member may not Owners Rebecca & Richard Bell from Burlington, North Carolina have enough points to make reservations in large units at peak times in popular resorts. Exchanges and PIC Plus Assignment. Also, charges for additional Reservation Transactions and Housekeeping Credits may apply, based on Member usage. Reservations are confirmed on a space available basis and there are no guarantees of fulfillment of specific requests. If a reservation request cannot be confirmed, the Member can elect to be placed on a cancellation wait list or can request an alternate reservation. Participation in the VIP, PIC Plus, Rewards Program and PlusPartners program is optional and subject to eligibility requirements, including an enrollment fee, as determined by Fairfield. Each Member relinquishes the annual use of his or her timeshare interest once it is assigned into the Program. A Member will always be able to obtain accommodations within an Accommodation in the Program so long as the Member applies for a reservation in accordance with the procedures outlined in this Directory. Each Member remains eligible to participate in the Program as long as (i) such Member remains current in the payment of all fees and expenses associated with his or her membership, and (ii) the use rights to such Member’s timeshare interest are assigned to the Trust and available for use by the Members. FairShare Plus Membership (“membership”) includes access membership in either Resort Condominiums International (“RCI”) or Interval International (“II”), international exchange networks, and as such Members are not individually charged an annual membership fee.The international exchange network which a Member will be enrolled in is determined by two factors: 1) an existing membership in either RCI or II, and 2) the exchange network that is affiliated with the project in which the Member is buying a timeshare interest. Each Member’s timeshare interest is available for use by all Members within the Program through the reservation system. A Member’s use of the Program is not dependent upon whether or not his specific unit is used.
