DISCUSSION/RECOMMENDATION: Request by Daniel Gokey to modify the
conditional use permit on parcels SU -40- 4 & 40- 5 to increase the allowable size
of the commercial structure from 3, 600sq ft to 5, 250 sq ft. Located on the east
side of Velp Ave approximately 500 ft. south of Brown Rd.
Staff Report:
The subject property was rezoned in July of 2014 from RR to NB. A conditional
use was also approved to allow a single family home to be constructed on the site
with the following conditions;
1.
Commercial structure is limited to a maximum of 3, 600 sq. ft., with a painting
operation limited to 400 sq. ft.
2. Residential use is limited to one single family home.
3. A 50 ft. vegetative buffer shall remain on the south and west property lines.
4. Signage along Velp Ave shall be limited to a maximum of a single two sided
sign not greater than 10 sq. ft. per side.
5.
A maximum of two non-resident employees.
6.
Parking shall be limited to 4 stalls.
7.
Approval of a rezone to Neighborhood Business
8.
Meet the requirements of all other applicable ordinances, regulations, and
reviewing agencies
As Mr. Gokey was preparing the initial building plans and equipment placement,
he discovered that condition 1 is a bit to limiting in the overall size and efficiency
for the business. Mr. Gokey is asking for the total structure size to be increased to
5, 250 sq ft. The air make-up set-ups on the new booths are substantially larger
than expected. I believe his original idea was for a 60 x 60 main building with the
400sq ft spray booth as an additional attachment to that (4, 000sq ft total). He is
now looking at a 70 x 75 building with the booth internal to that.
Considering the vegetation that is on the site and the distance it will be from the
road, this is a minor adjustment to the overall size of the building. The 7 other
conditions remain as approved.
Motion by Zastrow to recommend approval of modifying the conditional use on
SU -40- 4 & 40- 5 allowing a single family home, increasing the maximum size of
the commercial structure from 3, 600sq ft to 5, 250sq ft total, second by Yaggie,
motion carried 7- 0.

DISCUSSION/ RECOMMENDATION: Request for additional wall signage at
2450 Linville Rd, SU -763- 8. Located 320ft south of Velp Ave on the north side
of Linville Rd.
Staff Report:
Terry Naturally is leasing the new building on the south end of the Power of
Dance ( POD) property. This is a stand- alone building with store fiontage facing
internal toward the Kwik Trip property, actual entrance, and frontage on Lineville
Rd. They would like to sign both faces with approximately 100sq ft each. Any
signage above 100sq ft requires P& Z approval. Typically, in these types of
locations the commission has granted approval of the signs.
Motion by Yaggie to approve an additional 100sq ft of wall signage for Terry
Naturally, 2450 Linville Rd, second by Ward, motion carried 7- 0.

DISCUSSION/ RECOMMENDATION: Request by Julie Voight 438
Fawnwood Ct., Wrightstown, WI 54180 for approval of a 4 -lot Certified Survey
Map, as prepared by Dave Chrouser, Mau & Associates, on parcel SU -98- 2.
Located on the west side of Pine Ln & on the south side of Lost Creels Ln. Zoned
RR
Staff Report:
A 4 -lot CSM was approved in 2015 for the land adjacent to &
under the
same/ similar ownership to this property. Some of the remnant land has been
transferred to this parcel and will now be further divided as part of this parcel.
The remnant and this parcel were part of a preliminary plat approved in
December of 2015. Some issues with likely wetlands and a crossing for access
to the uplands of that remnant have further delayed any determinations on the
ability to complete the final plat. After completion of this 4 -lot CSM, any
further land division will require the submittal of another plat.
The acreage & frontage both meet or exceed the code requirements.
No additional roads will need to be constructed
The existing structures appear to meet all of our code requirements
The property is in a location that will remain in a private sewer &
for the foreseeable future, 20+ years.

DISCUSSION/RECOMMENDATION: Request by North Shore Bank, 1838
Cardinal Ln for a PDD amendment as prepared by Joel Ehrfurth, Mach IV
Engineering, to allow better egress from the drive thm lanes. Located on the
northeast corner of Lineville Rd & Cardinal Ln.
Staff Report:
A PDD overlay to allow the construction of the North Shore Bank was
approved by the Village Board in 2015. The Bank opened at the end of
February, 2016.
After a little over a month of operations it has become apparent that there is
not enough room on the northern side of the drive- thru to comfortably exit the
drive-thru. Vehicles have been repeatedly driving into and over the curb when
exiting the drive-thm lanes. North Shore would like to bump out the northern
pavement with a retaining wall and new curb to alleviate this issue.
Motion by Ward to recommend to the Village Board approval of a PDD alteration
allowing for expansion of the egress lane on the northern side of the bank, second
by Yaggie, motion carried 7- 0.

There is an existing 22 ft. x 22 ft. garage in the proposed location that is already at
the 4 ft. set -back. With the bay to the east, a front yard garage is the only
reasonable location for an additional garage. With the existing garage already in
the proposed location the applicant is only extending the footprint 18ft closer to

the road. The north side of the property does contain the mound/ septic system
limiting the ability to construct any structure to the north of the existing driveway.
Roger Schmitz, 3816 Cottage Row:
Looking to get a variance to build a bigger garage.
Stated that the large garage door will face driveway.
The setback is over 100 feet or close to it from the waterline.
From the right of way of the road is quite a distance and is properly close
to 60 feet.
Thinking about putting a little rock on the front to match the house.
Our neighbors did sign a piece of paper saying that they have no
objections to this variance.
Sue Last —were there ever water issues there?
Roger Schmitz —not
as long as my mom has lived there and she owned it for 52
years.
Sue Last did state for the record that the commission did a site visit on Saturday,
April 9, 2016.
Dan &
Mary O' Leary (3808 Cottage Row) that live south and next door, do not
have any objections and signed a paper saying so.
The property owner to the north did call Steve Dunks and said that as long as it is
not on his property line he had no reason to come to the meeting.
Steve Dunks did forward this variance request to the DNR, both the shore land
and floodplain departments, and neither one had any comments or objections to
the proposed variance.
The Schmitz' are not varying from any shore land ordinances or floodplain
regulations and are comfortable with it.
No one in the audience spoke for or against the variance.
Sue Last closed the hearing and the board went into deliberation.

if the neighbors were fine with this because shrubs will
come down to get the building in. The shrubs are kind of a dividing line.
The shrubs a well maintained and are doing well.
The neighbors are fine with this.
To the north is not impacted and the south are the ones that we have
signatures from.

Mike & Kim Nackers, 1904 Siesta Lane spoke:
The house was a foreclosure when it was purchased back in 2007.
We have done a lot of changes to it and basically want to continue the changes.
The front porch there now is less than desirable and with the three season room on the
side and the mismatched concrete slab, we want to make it a lot more aesthetically
pleasing.
Have a nicer front porch with the railings on and we' ll have the same rood as the house
has now. The three season room will have the same exterior and plan on residing the
house eventually. We' ll have the same exterior and shingles as the house.
The dog fence, with the Pointer mix we have and the three foot fence wouldn' t be
sufficient for her because she would be able to jump that, so that is why we are going
with the four foot for that.
The overhang for the garage, we are going to pour a slab for our camper, it is a 27 foot
camper and we basically want to continue the same roof line, same steel roof at a
different pitch and then have a wall come down on the north side with the same exterior
as the garage; close it in to keep it out of the elements to try to protect the investment we
have into the camper.
Sue Last —asked Steve Dunks if it is all considered a front yard.
Steve Dunks respond saying because it is a corner lot it is considered having two front
yards, one on Siesta and one on Overlook

The existing garage is 1, 700sq ft. in size. There is not an attached garage with the
home. Code would allow a primary detached garage of 1, 020 sq. ft. with an
additional 720sq ft. for an accessory garage. The proposed addition is 600 sq. ft.
2.
The proposed porch addition is located on the Siesta frontage. The home is
currently at the required 35ft set -back. Any steps &/ or landing required for egress
purposes would be allowed to infringe on the required set -back. The proposed 8ft
x 22 ft. porch is more than what would be necessary for egress, thus the variance
request. Steps from the proposed porch are not shown on the plan. If considering
approving, staff would suggest that the steps be required to be within the 8ft width
of the porch, not out beyond it.
The proposed pergola is within the 200 sq. ft. that exempts it from being
counted as an additional structure. No variance is required.
3. (
4 on list) The proposed 3 season room would not infringe on the set -back off
Overlook Ct any greater than the existing slab. The existing appears to be about
32ft from the ROW. Frost protection would be required for the structure

5 on list) Code would only allow a fence a maximum of 3ft high in a front yard.
The 25 ft. vision corner would need to be maintained at the intersection of the
roads. If the fence is running parallel to Overlook Ct from the edge of the house
then they would be in compliance of that requirement. The northern property line
appears to be about 25 ft. off the edge of Siesta Ln. The proposed 12 ft. off the
road would not be allowed. The fence must remain on their property.

Motion to approve/deny a variance request by Mike &

A 12ft x 50ft garage addition, exceeding the allowable maximum sq. footage a

4.
A 4ft high vinyl clad chain link fence with -in the front yard.
With the following conditions;

Any steps required to access grade from either the porch or 3 season room
would not be allowed to further infringe on the front yard set -backs

Dan Schrader: suggested discussing the 4 steps and vote on each one

Dan Schrader asked about the size of the door
Mike Nackers reported what vehicles he has in the garage and that there is a
workshop and storage in the back.
Sue Last —asked what size the motor home was and it is 27 feet.
The building is 50 feet long.
It will be open on both ends. East end has a service door.
2. Front porch:
Small porch there now and don' t know what size it is.
This porch will be removed, put in a concrete slab that extends 8 feet out from
the house and will go from the door to the west side 22 feet.
There will be a porch over this entire slab.
Porch overhang and this will not be enclosed.
This is on the Siesta side.
Anything attached to home has to have frost protection.
3. Three season room:
This is in the front yard setback.
There is going to be a 12 foot cement slab all the way from the house twelve
feet out the entire width of the house.
The three season room is only going to be a portion of that, how much of that
is going to be the three season room?
There will be about 25 feet enclosed.
The rest of it will be a slab with an overhang.
4. Fence:
The reason for the fence is to keep the dogs in the front yard.
Looks like the fence is even with the front of the house on Overlook and goes
the entire length from there to the end of the property on the other end.
It is a total of roughly 115 feet.
Fence can' t be put on the road right-of-way.
They can build up to the road right-of-way.
Does the fence have to be a certain distance inside the lot line?
No, as long as they can install and maintain without trespassing in the right of
way we don' t worry about that.
The main reason we are doing the fence is that way we can let them out
through that north door.
The variance is because the fence is higher.
They can have a 3 foot fence within the required front yard. They can have an
8 foot fence anywhere outside that front yard.
It is one foot higher than what code allows in the front yard.
The biggest request for the fence is the height.
Statements from the audience in favor of variance —no one came forward.
Against the variance:
Jim Corbielle, 1892 Siesta Lane: stated to the commission that he doesn' t like
the idea of the fence being in the front yard.

end of the porch to the front of porch and then from there straight west
to however far they want to go and it would have to go to the back
yard from however big they want to make it from there; second

The preliminary plat of Anston Rd Estates was approved by the Village Board on
April 4th with the following conditions;

Final Plat will require an approved storm water plan
o
Approval of a rezone from AG -FP to RR
o
Meet the requirements of all other applicable ordinances, regulations and
reviewing agencies
The rezone was also approved at the April
4th
meeting
A stormwater plan was submitted and approved by engineering staff.
The plat would create 8 lots, all meeting the 2 acre requirement with 164+ ft of
frontage on Anston Rd
All lots will be served by private sewer &
wells. It is well outside of the sewer
service area.
No additional roads would be constructed.
The final plat is substantially compliant with the preliminary, which by code
requires approval
Fiscal Impact
Parkland dedication fees will be due at signing of the Final plat in the amount of $2,400.
Staff would expect homes at or above $ 200, 000 x 8 lots= $ 1, 600,000 in improvements at
build -out.
Suggested Motion

To recommend to the Village Board, approval of the Final plat, Anston Road
Estates A County Plat, with the following conditions;
