Swarovski Crystal Society Membership General Terms and Conditions, Modified in June 2013
1.General
These General Terms and Conditions (“GTC”) govern
the Swarovski Crystal Society Program (“SCS Program”)
with respect to new membership enrollments January
1, 2014 or later, or renewal membership terms beginning January 1, 2014 or later. The Swarovski Crystal
Society membership is a joint loyalty program by Daniel Swarovski Corporation AG, Alte Landstrasse 411,
8708 Männedorf, Switzerland and the respective local
Swarovski Company responsible for the members’
country of residence (jointly referred to as “Swarovski”).
Swarovski Company responsible for the members’ country of residence may be located in another country than
members’ country of residence. Use of any membership
in Swarovski Crystal Society membership (“membership”) at any time subjects the member to the provisions
of these GTC, as amended from time to time.
2.Benefits
The SCS Program entitles new members enrolling in
membership January 1, 2014 or later or current members whose renewal membership term begins January
1, 2014 or later, to the following benefits:
a.Membership Card: The member will receive a personal
Membership Card.
b.Special Offers and Incentives: Swarovski will announce
from time to time special offers exclusively to members.
c.Membership Gift: Each year, the member will receive a
special gift in the form of a decorative crystal creation.
This gift is exclusive and is not available for sale.
3.3. Members are expected to submit and maintain accurate
and current user information in connection with their
memberships. Such information includes name, address, email address, and telephone number. Members
can change their account information by (i) updating
member profile data through an SCS online account,
(ii) requesting an update from a Swarovski Store (iii)
contacting Customer Relations at members’ country of
residence (by phone, email or otherwise) which can be
found either in the membership brochure or online on
swarovski.com/contact. We cannot assume any liability
for correspondence, mail or e-mail that is lost, delayed,
or misdirected.
4.Membership Fee
4.1.A membership is available for one (1) year or for three
(3) consecutive years. The fees for the membership are
set annually and are communicated in members’ country of residence either in the Swarovski Store or online
(swarovski.com/scs) or on the Order Form of the respective country. Swarovski may change the membership fee
or periods at any time, changes will apply only to new
and renewal memberships.
4.2. Membership fees are not refundable.
5.Term; Renewal
5.1.A renewal within a current membership term extends
the existing expiration date of the membership by the
renewal term; such renewal term begins the day after
the current term ends.
e.Swarovski Magazine: During the course of a year, the
member will receive complementary copies of the
Swarovski Magazine free of charge. Each issue will
provide the member with all of the latest news about
Swarovski products, the Swarovski Company and the
latest trends in crystal.
5.2.Each membership will automatically expire after the
membership term unless the member extends its
respective membership. Swarovski will contact the

member before the end of the membership term
accordingly and grants the member an adequate grace
period (not less than 2 months) after the end date of the
membership term to renew the membership. A renewal
term begins the day after the end date of the previous
membership term. The members’ personal number of
membership will not be used for any other member for
at least 10 years after the end date of the membership.
f.Swarovski Kristallwelten: The member will enjoy free
admission to the Swarovski Kristallwelten in Wattens,
Austria and will be welcomed in the SCS VIP Lounge
with a complimentary drink.
6.Termination
6.1.The membership expires automatically after the membership period unless extended by the member.
d.Exclusive Crystal Products: Only members can purchase
the SCS Annual Edition, Member Exclusive Products
and other SCS related products.
g.Online Members’ Area: In the SCS Members’ Area you
will be granted access to inside information and be
able to register for a special newsletter for members.
h.Events and Trips: The member may receive invitations to
pre-selected local, national and international events,
organized by the dedicated SCS Team (Participating
in an event may be subject to a charge which will be
communicated accordingly).
3.Conditions
3.1.For the Member Benefits to apply, the membership
account must be active at the time of purchase/event.
3.2.Memberships are for individual use only and are nontransferable.
6.2.Swarovski may terminate the membership, including
any associated accounts, without notice, for any reason in its sole discretion, including without limitation if
continued use of such membership would violate any
provisions of these GTC, applicable law, or otherwise be
harmful to our interests. In the event of any such termination, the member will not be entitled to a refund of its
membership fee.
6.3. Swarovski may terminate any or all of the benefits available under the SCS Program at any time with or without
notice. In the event of termination of the SCS Program,
at Swarovski’s election, Swarovski will either maintain
the membership benefits until expiration of the membership current term or refund each member a pro rata
portion of the membership fee for the remaining portion
of the current membership term.
7.
Privacy Policy
A registration of members’ personal details with
Swarovski or the conclusion of a purchase contract with
Swarovski or contact in any other electronic form with
Swarovski means that the member agrees to Swarovski
saving and storing the members’ personal details in
accordance with the present declaration on data protection without any prior written approval on members’ part.
Swarovski can record, process, save, store, reveal and
use members’ personal details. Swarovski will only use
members’ personal details for the following purposes:
processing members’ purchases; sending information
about marketing activities, products and services; and
supporting market research for the improvement of the
Swarovski product range, services and internet appearance as well as mandates granted to third parties for
carrying out assignments and services in this connection (e.g. repairs). Swarovski will process, reveal and use
members’ personal details in a secure, appropriate and
legal form according to the laws of the members’ country of residence and the Swarovski Company responsible
for the members’ country of residence. Processing is
undertaken by electronic or automatic means. Members’
personal details will be recorded and used by Swarovski,
which has been authorized to process these personal
details and is also responsible for the processing of such
details. Member hereby grants approval that members’
personal details can be revealed to, processed by and
used by other companies of the Swarovski Group in various countries and in particular by the companies in Switzerland (Daniel Swarovski Corporation AG and Swarovski
Crystal Online AG), in Austria (D. Swarovski KG) and
Liechtenstein (Swarovski AG and Swarovski International
Distribution AG) for the purposes as mentioned above.
Members’ personal details will not be made available
to third parties outside of the Swarovski Group without
previously advising the member and requiring its special
approval. The member can at all times request information concerning its personal details and can cancel its
approval of the saving, storing and using of its personal
details for the future. For this purpose, member shall
contact Customer Relations of members’ country of residence which can be found in the membership brochure
or online (.swarovski.com/contact).
8. Disclaimers; Limitation of Liability
8.1.USE OF THE SCS PROGRAM AND ANY OF ITS ASSOCIATED BENEFITS IS AT MEMBERS’ SOLE RISK. THE
MEMBERSHIP BENEFITS ARE PROVIDED ON AN “AS
IS” AND “AS AVAILABLE” BASIS.
8.2. SWAROVSKI MAKES NO WARRANTY THAT (i) THE SCS
PROGRAM WILL MEET THE MEMBERS’ REQUIREMENTS, (ii) THE SCS PROGRAM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
8.3.SWAROVSKI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR
EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES
(EVEN IF SWAROVSKI HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES), RESULTING
FROM: (i) THE USE OR THE INABILITY TO USE THE
SCS PROGRAM OR ANY BENEFITS THEREOF; (ii) THE
COST OF PROCUREMENT OF SUBSTITUTE GOODS
AND SERVICES RESULTING FROM ANY GOODS, DATA,
INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS
ENTERED VIA THE USE OF THE SCS PROGRAM; (iii)
UNAUTHORIZED ACCESS TO OR ALTERATION OF
MEMBERS’ THE SCS PROGRAM DATA; OR (iv) ANY
OTHER MATTER RELATING TO THE SCS PROGRAM.
8.4.SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION
OR EXCLUSION OF LIABILITY FOR INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES. ACCORDINGLY,
SOME OF THE ABOVE LIMITATIONS AND EXCLUSIONS
MAY NOT APPLY.
9.
Governing Law and Jurisdiction
These GTC, and the respective rights and obligations of
the parties hereunder, shall be governed by, and construed in accordance with, the laws of Switzerland, without regard to conflict of law principles. Place of Jurisdiction shall be Zurich, Switzerland.
10.Acknowledgement
These GTC, including all documents referenced herein,
represents the entire understanding between Swarovski
and any user of the SCS Program with respect to the SCS
Program and supersedes any other agreements, statements or representations. Headings used in these GTC
are for reference only and shall not affect the meaning of
any terms. Any user of any portion of the SCS Program
is deemed to have accepted the terms and conditions
of these GTC.
11.Changes to these GTC
Swarovski may change the terms of these GTC at any
time without notice or liability by posting revised Terms
and Conditions on the Members’ Area website located
at .swarovski.com/scs. Any change shall take effect immediately, unless otherwise provided. The member may
view the current version of these GTC at any time online
at .swarovski.com/scs. The member may also obtain a
copy at any Swarovski Store or by contacting Customer
Relations.
