Goodman Campus Construction Proceeds Despite Record Rains
Goodman Manufacturing said recently that their new Cypress Creek
Campus on Kermier Rd. will complete
one fourth of the building’s concrete
placement this week. “When it’s been
sunny, we’ve poured concrete, and when
it’s been rainy, we’ve set steel and erected walls,” said Goodman’s Communications Manager Graham Painter. More
than 70 tilt-wall panels have been set.
The Goodman Cypress Creek
Campus will house a world-class, stateof-the-art air conditioning engineering,
manufacturing, testing, administrative
and logistics center. It is utilizing tiltwall construction in which the concrete
walls are poured on site and “tilted-up”
into position, allowing improved efficiency and avoiding having to transport
the large panels over public roads.

On Wednesday, June 23, the Waller County Commissioners Court met at 9 a.m. at the Waller County Courthouse.
Commissioners John Amsler, Justin Beckendorff, Jeron Barnett, and Russell Klecka were present and Waller County
Judge Trey Duhon presided.
After approval of consent agenda items, a presentation
by the WCCC of the Distinguished Service Award was presented to the Waller County Historical Commission on behalf
of the Texas Historical Commission for their active and effective historical preservation in Waller County in 2014.
In further business, an agenda item proposed by Pct.
4 Commissioner Justin Beckendorff, the posting of current
landfill ordinance maps on the county website, was discussed
at length. All commissioners agreed that for the purposes of
transparency, the maps should be posted. However, the item
was tabled until maps can be authenticated and the court can
be assured that any maps posted on the county website are
correct.
Heated debate occurred in regards to another agenda
item put forward by Beckendorff. Beckendorff had asked the
court to instruct legal counsel to move forward immediately
with a new solid waste proposal, and Pct. 3 Commissioner

the first in a series of three public meetings on the possibility of
implementing county-wide voting
in Waller County. County Judge
Trey Duhon, Commissioner Pct. 2
Russell Klecka, and Commissioner Pct. 1 John Amsler also attended the meeting, forming a quorum
of the Commissioners Court.
Teed stated that the purpose
of the public meeting was to provide additional information and to
solicit comments from the public
on the proposed change.

ordinance will be revised when it’s best for the county.”
Commissioner Amsler proclaimed, “The best legal advice for JD Head is to keep the 2011 ordinance at this time.
The stakes are high. Our aquifer and our drinking water are
at stake. It is not time to quibble.”
In another contentious agenda item, Commissioner
Beckendorff proposed setting spending limits on outside legal counsel, and was supported in this position by Commissioner Barnet.
In response, Judge Duhon stated that the county had
passed resolutions concerning the high speed rail, the transmission lines, and Pintail LLC, supporting the positions of
the citizens on these issues. Legal counsel, according to
Duhon, was chosen by the court and the firm Fritz, Byrne,
Head and Fitzpatrick, PLLC gave an estimate of their fees
before they were hired.
“Cost of legal counsel is by nature uncertain, “ Judge
Duhon stated. He added that the court has worked to limit attorney’s fees by initiating teleconferences and by leaving the
hiring of experts to other entities involved in the Contested

The currently active 2011 ordinance states than any area
within a two mile radius of any privately-owned solid waste
disposal site holding a valid permit as of August 26, 2011, is
eligible for solid waste development, but no other sites will be
permitted or will be authorized by the county after that date.
Commissioners Beckendorff and Barnett stated their
concern that this might open the county for a landfill in the
Monaville area, or other areas that have quick access to transportation via I-10.
However, after heated debate between commissioners
and a further consultation with attorney JD Head of Fritz,
Bryne, Head & Fitzpatrick during Executive Session via a
telephone conference call, the court emerged from Executive
Session and voted 3-2 (Commissioner Beckendorff and Barnett supported the motion) against any action to move forward with a new solid waste ordinance at this time.
Duhon stated, “Due to the upcoming Contested Case
Hearing with the SOAH, to which Waller County is a full
participant on the side of the citizens, attorneys for the county
have recommended keeping the 2011 ordinance in place at
this time.”
Duhon then added, “I defer to our attorney’s judgment.

polling location, but could vote at
any polling location in the county.
Voters would then be able to vote
according to their schedule and
lifestyle.
Although the county now has
19 polling places, that number
may be reduced if Voting Centers are approved by the county.
All selected polling centers must
have internet access, adequate
parking, and be handicapped accessible. The state requires that a
county maintain 65% of locations
during the first election, and 50%
thereafter. If the county’s application is approved, a committee of
citizens, with the approval of the
Commissioners Court, will determine the polling locations within
the county.
Teed believes Vote Centers
will reduce voter fraud, since all
poll workers in the county would
have immediate access to voter
registration records via the internet, allowing them to know instantly whether an individual has
already cast their ballot.
County-wide voting began
in 2003, with a pilot program in
Larimer County, Colorado. In
2006, the 78th Texas Legislature
authorized a pilot program in
Lubbock County. By 2011, Colorado, Indiana, Iowa, Texas, North
Dakota, South Dakota, Tennessee
and Utah have all approved the
use of Vote Centers. Twenty-six
Texas counties now participate in
the program.
August 20 is the deadline for
the county to submit a formal application to the Texas Secretary
of State for participation in the
program. The application must
include video or transcripts of all

DPS Increasing DWI Patrols for July 4th Holiday
The Texas Department of Public Safety
(DPS) will increase DWI patrols for a 12-day
period that includes the July 4th holiday. From
June 26 – July 7, DPS troopers will focus DWI
patrols in high-risk locations at times when alcohol-related crashes are most frequent.
“As Texans make their plans for the
Fourth of July, DPS is urging everyone to enjoy the holiday responsibly,” said DPS Director Steven McCraw. “Driving while impaired
can have deadly consequences, so Texans who
grant, which allowed increased patrols in highrisk locations during times when alcohol-related crashes are most frequent. During the same
period, DPS enforcement also resulted in more
than 15,000 speeding citations and more than
2,500 seat belt/child safety seat citations.
According to TxDOT, in 2014 more than
1,000 people in Texas were killed in motor vehicle crashes involving a driver who was under the influence of alcohol, accounting for 29
percent of the year’s total traffic fatalities.

Waller Wonders - It’s just Texas weather …

weather. Our
friends up
North make
fun of Texas weather. Even people
in California, home of random mudslides and earthquakes, make fun of
Texas weather.
However, Mother Nature was
particularly moody on Saturday, and
no one was making fun. I was heading to Waller from Houston around
8:00 in the evening. Up ahead, I
could see lots of gray smoke blowing across the highway, just west of
the Grand Parkway overpasses. As
wet as it’s been, I couldn’t imagine
what could possibly be burning.
Then I drove into the “smoke,”
and it wasn’t smoke at all. It was
rain – heavy, blinding rain – the kind
that even windshield wipers on full
couldn’t handle.
Suddenly – and thankfully - everyone slowed to a crawl and tried
to stay in their own lane – wherever
that might be. Scary, believe me!
But here’s the interesting part.
Going into this mini-storm, my
temperature gauge read 90 degrees.
Within four-tenths of a mile – just
seconds – the temperature dropped
10 degrees. Plummeted is a better
word.
After another two-tenths of a
mile, the temperature dropped to 77
degrees.
Then just as suddenly as I encountered the rain, I drove out and
continued my very dry journey on
into Waller. By the time I reached
my house, a scant ten miles from
“point of impact,” the temperature
was back up to 88 degrees.
Now THAT, my friends, constitutes very strange Texas weather!
A friend and I were discussing
this and she shared her own tale of
Texas weather from Thursday night.
She lives off FM 2978 just east of
Tomball. They got five inches of
rain Thursday night between 8:0010:00, including a lightning strike
that exploded a huge tree between
her house and her neighbor’s. She
proclaimed that to be just a bit more
excitement than she wanted. She
said all she does now in her spare
time is pick up limbs that rain and
wind have knocked out of the trees.
From the reports coming out of
the Waller County Sheriff’s department, the northern part of the county nearly went under water again.
Almost a dozen roads and/or intersections along FM 1488, Joseph,
Riley, FM 362 North, and others in
that general area were either impassable or had enough water on them to
make driving on them dangerous.
No one is brave or courageous
when they drive through high water
on roads. It’s a short slogan, but important: TURN AROUND! DON’T
DROWN!
I do feel bad for the folks building that massive Goodman air conditioner plant just east of town. That
property could more accurately be
described as a 500-acre lake right
now, what with all of the unprecedented rain we’ve had. In fact, I
was talking to one of the men from
the company last week, and he confirmed that’s exactly what it looks
like from the air.
Nevertheless, they aren’t letting
a “little” rain stop them. They just
move some dirt around to “contour”
the land and force the water into the
ditches along Hwy 290, and they
work on the part of the land that is
drier than the rest.
I’m still in awe of that building they are constructing on the side
of the property nearest FM 2920. It
didn’t look so big while the steel was
going up, but then they started putting up the walls, and oh, my! My
friend from Goodman tells me that
just that one building is one million
square feet. That’s 1,000,000 – six
zeroes! To break that down into numbers that you and I might understand
– although maybe not fully comprehend: that’s room for 400 houses of
2,500 square feet each – the size of a
good-size subdivision. Wow.
One more weather item: as of
Monday, the Houston area hasn’t had
a 100-degree day since September 3,
2013 – that’s 658 days (and yes, I’ve
probably jinxed it!). The weather
people aren’t predicting one this
week, either, which bodes well for
the Waller Freedom Fest Friday and
Saturday. There’s no rain predicted,
either, and that’s a good thing. Can’t
have fireworks in the rain!
Come out to the Waller High
School stadium north of town on
Friday around 6:00 p.m. Fireworks
will follow a musical program at
around 9:00.
On Saturday, festivities will
start at 3:00, with rides and games
(helicopter rides, anyone?), a petting
zoo, food, drink, more food, crafts
… and did I mention food? Fireworks again at around 9:00.

240 Years Ago, Americans Fired the Shot Heard Round the World

By 1775, tensions had been
brewing between the British crown
and their American colonies for several years. Starting in 1763, King
George III began the disputes by
issuing a proclamation prohibiting
settlements beyond the Appalachian
Mountains where many American
colonists had already settled. Some
clashes occurred between the British
and American setters, as the British
stopped colonists as they headed
west and forcibly removed others
from their homesteads.
Adding insult to injury, in
1765, Parliament passed the Quartering Act, asserting that colonists
must find or pay for lodging of British soldiers stationed in America.
Parliament furthered the angst of
the Americans by passing a string
of tax acts, including the infamous
Stamp Act and the Townshend Acts-which required a tax on all imported goods.
Colonists complained vehemently to both the King and to Parliament that their rights as British
citizens were violated by these acts,
since Americans had no representation in Parliament and therefore no
voice in laws passed concerning the
American colonies. Envoys were
sent to the king to request representation, but all their pleas fell on deaf
ears.
Hence, in response to the British crown ignoring their requests for
representation, in 1774 the first Continental Congress was formed. Relationships between the British and
the American colonists continued to

deteriorate, leading to a watershed
event in world history.
At 5 a.m. on April 19, 1775,
700 British troops set out to capture
Patriot leaders and seize Patriot arsenals at Lexington and Concord,
Massachusetts Colony. The British
troops, under Major John Pitcairn,
upon entering Lexington, found 77
American minutemen under Captain John Parker waiting for them
on the town’s green. Smith ordered
the minutemen to disperse, when a
shot was fired, and a brief battle occurred. Afterwards, eight Americans
lay dead and 10 others wounded.
The British then continued into
Concord to seize arsenals, not realizing that, thanks to a rather elaborate
colonial intelligence network led by
the Sons of Liberty, the Patriots had
been made aware--particularly by
the late night ride of Paul Revere and
others-- that their supplies were at
risk, and had successfully relocated
the majority of their arms and ammunition before the British arrived.
The British then proceeded to
burn what little they found. Viewing
the conflagration from their lookout,
the American militia left their hilltop retreat, and hustled to Concord’s
North Bridge. Believing that the
Redcoats were simply trying to intimidate them, they had no intention
of opening fire. That illusion was
shattered when a volley was loosed
from the British side. Afterwards,
the Redcoats fell back, but then one
of the colonists returned volley, initiating a fire fight. This first shot fired
by an unknown militiaman became
the famous “shot heard round the
world.”
The American Revolution had
begun.
The battles of Lexington and
Concord were the first battles of the
American Revolution, a conflict that
would escalate from a colonial uprising to a world war, that seven years
later would give birth to the independent United States of America.
A little over 60 years after the
battle, Ralph Waldo Emerson, a
highly renowned American poet,
immortalized the “shot heard round
the world” in his poem, “The Concord Hymn”. The poem was written
at the request of the Battle Monument Committee of Concord, and
was read at Concord’s Independence
Day celebration in 1837.

absolved from all allegiance to the
British Crown…”
What an astounding statement
by our fledgling nation! No country in the world at that time lacked
a monarch or absolute ruler. The
idea of governing oneself was a
novel concept, untried at the time.
Our Founding Fathers, signers of the
Declaration of Independence laid it
all on the line for their new country,
pledging, “..with a firm reliance on
the protection of Divine Providence
we mutually pledge to each other
our Lives, our Fortunes, and our sacred Honor.”
And that fight for our freedom
all began at Lexington and Concord,
an event immortalized in Emerson’s
famous poem, which honors all
those who gave their lives so that our
nation may live free.

what might be a mundane event of
a battle, the firing of the first shot
against the British in the American
Revolution, turning it into a symbolic event of “right over might”. That
first shot has long been acknowledged as an important steppingstone on the march to freedom, not
only for Americans, but for all nations of the world.
At Concord, a group of ordinary citizen farmers, stood up to
what was then the most powerful
nation on earth, and dared to challenge their right to rule the colonies
by fiat.
These brave Americans dared
to thwart the status quo, and challenged the so-called “divine right”
of kings to rule arbitrarily over their
citizens.
A little over a year later, on
July 4, 1776, the Declaration of
Independence was officially adopted by the Continental Congress,
which announced to the world that
the 13 American colonies, already
at war with Great Britain, regarded
themselves as free and independent.

officers responded to 53 calls for
service resulting in nine incident
reports and one arrest. Additionally, officers completed three motor
vehicle crash reports.
On June 15, Officer Tyler
responded to the 1600 block of
Dewey Street in reference to the
report of damage to property. Officer Tyler completed an information
report and no criminal charges are
pending.
On June 16, Officer Tyler
served multiple outstanding City
of Waller municipal warrants on an
inmate at the Waller County Jail.
On June 17, Detective Sgt.
Stokely received an anonymous
report concerning the welfare of
children in the 19600 block of FM
362. Det. Sgt. Stokely and Sgt.
Lopez checked on the welfare of
the children and determined that
the children were safe and in good
condition. No criminal offense was
observed.
On June 17, Officer Fernand
met with a complainant at the
Waller Police Department and took
a report of Forgery of a Financial
Instrument. This case was forwarded to the Criminal Investigations Division.
On June 18, Officer Floyd
took a report for Theft of Property
in the 40900 block of US Hwy 290.
This report concerned merchandise
that was shoplifted from a retail
business. This case was forwarded
to the Criminal Investigations Division.
On June 19, Sgt. Smith observed a vehicle being operated
in a reckless manner in the 40900
block of US Hwy 290. The Sgt.
conducted a traffic stop on the
vehicle and the operator was subsequently issued a traffic citation
as well as being cited for Minor in
Possession of an Alcoholic Beverage and Possession of Drug Paraphernalia. The passenger in the
vehicle was arrested for Furnishing
Alcohol to a Minor and was transported to Waller County Jail. Sgt.
Smith was assisted by Officer Tyler
and Officer Floyd of the Waller Police Department as well as Deputy
Morgan from the Waller County
Sheriff’s Office.
On June 20, Officer Castillo
responded to the 40800 block of
Business Hwy 290 to investigate
the report of Criminal Mischief.
The complainant reported damage
to property belonging to Union
Pacific Railroad. This case was
forwarded to the Criminal Investigations Division.
On June 21, Officer Floyd
took a report for Theft of Property
in the 40900 block of US Hwy 290.
This report concerned merchandise
that was shoplifted from a retail
business. This case was forwarded
to the Criminal Investigations Division.
On June 21, Officer Tyler responded to the 1800 block of Cherry Street in reference to the report
of Interference with Child Custody.
Officer Tyler requested a supervisor also be dispatched to the scene
and Sgt. Smith responded. The
complainant reported that the noncustodial parent was overdue to return the child from visitation. The
non-custodial parent made contact
with the complainant and the child
was returned to the custodial parent. No criminal charges are pending in the case at this time.

Commissioner Amsler was “amazed” at the objection to attorney fees expressed by Commissioners
Beckendorff and Barnett.”
“Allison, Bass”, Amsler stated, “hired by the prior commissioners court to fight the citizens, cost this
county and arm and a leg, yet no objection was ever
voiced by anyone but me.” (Authors note: Barnett was
on the court at that time, but Beckendorff was not.)
Duhon added, “Every opportunity is provided in
Executive Session to discuss bills in detail. How much
is it worth to save our drinking water? Ten thousand?
Twenty thousand? Will we say we will spend twenty
thousand and not a penny more? I think most of us
would agree that defending our county’s drinking water
is well worth the price.”
Finally, after a heated debate, there was a motion
made to table the item to set spending limits on outside
legal counsel. The motion passed 3-2, with Beckendorff and Barnett voting no.
According to the County Auditor, Alan Younts, approximately $35,000 is available in the budget for attorney’s fees and some contingency funds, already allocated in the budget, would also be available if needed.
Also, the court approved submission of the application to the Federal Justice Assistance Grant Program
for Fiscal Year 2015, for $1.8 million. The grant, if approved, will award the county funds for two constables
per precinct, as well as their vehicles and salary packages for three years. The new officers will be slated to
work with Royal and Waller ISD to reduce truancy.

about the reduction of polling
locations.
Commissioner Amsler addressed the attendees on his concerns stating, “Will the people
be satisfied? We have a long
history of contention surrounding voting in Waller County. I’m
afraid it could be problematic.”
Commissioner Klecka added his concern on the increased
cost for those running for office
due to the need to place signage
at all polling locations if Waller
County moves to Vote Centers.
Judge Duhon, however,
spoke positively of the change,
saying, “I think it would be easier for citizens to vote anywhere
in the county. I’m all in favor of
advancing technology.”
Teed emphasized that if
Waller County is approved for
county-wide polls for the November General Election, it is
only a trial, and further participation will depend on the satisfaction of Waller County voters.

The students of H.T. Jones Elementary School refused to let a little bit of rain get them down during a stormy week, so they took
their end of school year field day celebration indoors to the gym
on May 29. Jones Elementary Physical Education teacher Ron
Hill planned several games for the students. The young pupils
burned off some energy and had a great time with their friends
running relay races and playing tug-of-war as they celebrated the

The students of Waller Junior High School took a minute to celebrate their accomplishments and the beautiful weather before
the end of school at field day on the turf at the Auxiliary Stadium.
The students opted to have a field day over an end of the year
dance and had some fun in the sun. The school supplied several
inflatable activities for the students to enjoy, such as an inflatable
basketball court, baseball pitching station, obstacle courses, and

The City of Waller will receive bids for Water Plant Improvements until 11:00 a.m. on July
15, 2015, at City Hall, 1118 Farr Street, Waller Texas 77484 at which time the bids will be
publicly opened and read aloud.
Bids are invited for items and quantities of work as follows:
Natural gas emergency generator with concrete foundation and electrical improvements
Bid/Contract Documents, including Drawings and Technical Specifications are on file at
Cobb, Fendley & Associates, Inc., 13430 Northwest Freeway, Suite 1100, Houston, Texas
77040 or may be downloaded for free from www.civcastusa.com.
Copies of the Bid/Contract Documents may be obtained by depositing $50.00 with the
engineer for each set of documents obtained. The deposit will be refunded if the documents
and drawings are returned in good condition within 10 days following the bid opening.
A non-mandatory pre-bid conference will be held at City Hall on July 8, 2015 at 11:00 a.m.
All prospective bidders are encouraged to attend.
A bid bond in the amount of 5 percent of the bid issued by an acceptable surety shall be
submitted with each bid. A certified check or bank draft payable to the City of Waller or

Adherence to the grant recipient’s Section 3 Policy is required for contracts and subcontracts
