Accept the work performed by Shank/Balfour/Beatty, J.V., for Water
Enterprise, Water System Improvement Program (WSIP)-funded
Contract No. WD-2498, New Crystal Springs Bypass Tunnel, for
construction of a tunnel with two shafts; approve Modification No. 1,
increasing the contract by $1,735,887 for a total contract amount of
$57,409,887 with no time extensions; and authorize the final payment
to the Contractor. Modification No 1 is comprised of thirty-four (34)
change orders, which address credits for installation of new valves,
additional soil investigations, environmental mitigation measures, and
design changes due to differing site conditions. The total of all
change orders represents a 3.12% increase over the original contract
amount.
Background:
The New Crystal Springs Bypass Tunnel (NCSBT) is one of the
regional seismic upgrade projects included in the SFPUC's Water
System Improvement Program (WSIP). The N C S B T reinforces a
critical segment of the Hetch Hetchy Regional Water System to
provide reliable water delivery from Hetch Hetchy and East Bay
reservoirs to northern San Mateo County and the City of San
Francisco. This project was necessary to address both the lack of a
redundant conduit in a portion of the system that is within the
influence zone of the San Andreas Fault as well as vulnerabilities
associated with potential landslides in that area. A landslide that
occurred during the winter of 1996-1997, along the northeast side of
Polhemus Road in San Mateo County, threatened the structural
integrity of a portion of the existing Crystal Springs Bypass Pipeline
(CSBP). The potential for re-occurrence of landslides (resultant from

seismic activity or excessive wet weather) along Polhemus Road
raised concerns regarding system reliability for the existing CSBP.
Due to these concerns, studies were initiated and alternatives
evaluated to replace/repair the existing pipeline; the construction of a
tunnel was determined to be the preferred alternative.
Description of Scope of Work:
Construction contract work is located in the vicinity of the
decommissioned Polhemus Fluoridation Station, along Polhemus
Road in San Mateo County. The work under this contract consisted
primarily of the construction of a tunnel with two shafts, one at each
end of the tunnel.
Scope of Work under this Contract included the following:
• Excavation and construction of approximately 4,200-ft
tunnel, including two shafts, North and South;
•

Installation of initial tunnel lining (pre-cast reinforced
concrete segments) and final tunnel lining (96-in diameter
steel pipeline) in the tunnel and shafts;
•
Grouting and backfilling of voids between the two linings
in the tunnel and shafts;
•
Excavation and construction of valve vaults, installation of
valves, communication for control and monitoring systems,
and emergency power system;
•
Connection of the new tunnel and pipelines to the existing
Crystal Springs Bypass Pipeline and Tunnel, Sunset
Supply Pipeline, and Crystal Springs Pipeline No. 2;
•
Modification of existing drainage system and realignment
of existing roadway; and
•
Installation of new security fences and other miscellaneous
site improvements.
Changes to the Contract under Modifications:
Modification No. 1: was issued for an additional $1,735,887 to
address credits for installation of new valves, additional soil
investigations, environmental mitigation measures, and design
changes due to differing site conditions, increasing the total contract
value to $57,409,887.
Result of Inaction:
A delay in closing out this contract will delay the final payment due to
the Contractor.

W H E R E A S , On October 14, 2008, by Resolution No. 08-0182, this Commission
awarded Contract No. WD-2498, New Crystal Springs Bypass Tunnel to the lowest, qualified
responsible and responsive bidder, Shank/Balfour/Beatty, J.V.; and
W H E R E A S , The original contract amount was for $55,674,000 and the original contract
duration was 986 consecutive calendar days; and
WHEREAS, The construction contract Notice To Proceed (NTP) date was set for
December 1, 2008, with an original schedule of 986 consecutive calendar days and the contract
work was completed in 986 consecutive calendar days on August 12, 2011; and
W H E R E A S , Modification No. 1 was issued for an additional $1,735,887 to address
credits for installation of new valves, additional soil investigations, environmental mitigation
measures, and design changes due to differing site conditions, increasing the total contract
amount to $57,409,887 with no time extension; and
W H E R E A S , The Human Rights Commission (HRC) determined that the Contractor met
the established 4.0% Local Business Enterprise (LBE) subcontractor participation goal by
utilizing a total of 4.8% L B E participation; and
W H E R E A S , Funds are available from Project No. CUW35601, New Crystal Springs
Bypass Tunnel; now, therefore, be it

In a meeting with SFPUC, HRC confirmed that the costs for Cowhey Pacific's scope of work were less
than originally estimated. Accordingly, the final contract amount for Cowhey Pacific is less than the
original contract amount.
In addition, documentation from the SFPUC confirms that Eighteen Trucking's scope of work
substantially decreased due to a change order issued by the SFPUC after the contract commenced.
Finally, in good faith, prime contractor Shank/Balfour Beatty, J.V. added L B E subcontractor A G S , Inc.
("AGS") to the contract after it commenced. A G S performed geologic services for $135,653.00, which
constitutes .24% of the total value of the entire contract.
Based upon the aforementioned review, H R C concurs with the closeout of this contract.
