He was born in Granvil-le County, North Carolina, and removed.
when quite young to Sumner County, Tennessee; thence he removed.
to Montgomery County in 1821 where tre remained til-l his death.

(p. 37) ...In 1805 Mann Phillips, your orator, of Stewart Co.,
was sued i-n the county court of Montgomery by one, Louder Hallon a pretended claim to one third part of the value of ttrree years
service of a negro man named Jefry, estimated at about seventy-five
or six d.ol-Iars . . . On the morning of about the f ifth day of March
1805 he (Phillips) met with Thomas J. Overton at Clarksville the
place of holding the Court of Pleas for Montgomery County...that
J. Overton then a stranger to your orator represented himself as an attorney of that court and resident there who wou1d..
be regular in his attendance at court. Your orator..mentioned
to hirn the suit just. cornmenced agai-nst your orator by Lowden HaLl
and.. desired to-know r,rtrat sum he'would. be willing to take to
put in a plea and defend hin...Thomas J. Overton answered that the
Law altowed hirn but two dollars and a half which he thought was
too litt1e, but sald if your orator would agree to give hj-rn ten
dollars he would cl-ear hirn and have him acquited....Your orator
agreed to pay Thomas J. the..sum of ten dollars...Thomas agreed
to perform his part of the agreement.
. . it was not mentioned by either party that it should be reduced
to writing, but afterwards in the evening of the same day and at
the ssile place, your orator is inforrned and believes he was in
such a state of inebriety as to be disqualifyed for ordinary
business and such indeed was his unfortunate situation that he
knew not what he did nor is tre now able to recollect any of the
transactions of the afterpart of that day, but he is informed
and believes tlrat whil-st he was in that unfortunate situation that
he the saj-d Thomas J. Overton taking advantage of the absence of
your orators mind and his almost if not total want of intelect
came to him..with a note written and sealed, dated the fifteenth
d.ayofMarckr1Bo5andcontaj-ningapromisetopayrrimoiffid
dollars and expressed to be for value received and presented ttre
same to your orator to be signed...stating Lre was your orators
Lawer in the case wtrere Lowder Ha1l had sued him and that he must
note for the fee Lre had agreed to give...and your orator

did then and there as tre is informed. put his name to said note
without readi-ng it nor knowing what he was about and not being
able to understand if it had been read to him.

Shortly after the day of the date of said note..Thomas J. Overton
left Clarksville and was absent at the two succeeding courts there
...that Lre was under tLre necessity of employing ottrer counsel to
defend said suit or a judgement by default would have been had
against hirn. He did employ N. A. McNary, a practic.;ng attorney

Your orator..states that except the contract herein before recited
he never had any with the said Thomas J. Overton and he never owed
hi-m any sums of money on any other account....Your orator represents
that Thomas J. Overton afterwards commenced an action against him
on said note so fraudulently obtained....in the Court of Pleas etc
held in Montgomery County and afterwards removed the same by a
Writ of Error to the fate Superi or Court of Law holden for the
District of Robertson and..Thomas J. Overton concealed from the
said Court all the above mentioned facts and such were the pleadings
and the nature of the action that your orator could not discl-ose
the above..facts and clrcumstances to the court nor coul-d he by
any means avail himself of thern and upon the said note the said
Thomas J. Overton obtained a Judgement of said Court against your
orator...in the sum of one hundred dollars with interest and costs..
Asks for relief...and that Thomas J. Overton, his agents , attornies
and Sheriff of Stewart County be enjoined from pr"oceeding to cause
sai-d Judgement to be executed

one hundred dollars to defend hin in said suit. . . .made no agreement
with complrt that he would take ten dollars as a fee... He states
he did move away from Clarksville to Russelsvill-e in Logan County

nespondant conceives it to be quite immaterial how many attornies
the compl t t might have thought proper to employ in the defence of

negro or his hire might have been estimated at certainly does not
alter or vitiate his bond..solemly executed. to this respondent
under his hand and seal in the presence of two subscribing witnesses

by enlisting for the term of one year with Captain Hargrove in the
Continental Line, that he served in the regiment under the
following officers, that he was taken by Capt. fiargnove beyond
Srnithfield, N. Carolina. He was ttren put under the command of CoI.
Will-iam Linton? ----amted to Capt Bary? Grims? Company. Not long
after Col. Linton was broke for executing some tories ..properly
he was put under the cornmand of CoI. Kenyon? near Wllmington and
was in the battl-e at Rock Fish Creek near Wilmington and was
above the knee. The Americans
wounded. in his right thigh a little
were routed. They ttren fell back to Nuse River near Smithfield.
We run around? on Nuse River untill after we treard of the capture
of Cornwal]as at Little York. After this news came that the
British had left Wilmington we were then discharged, but frorn the
fight at Rockfisb. Creek our Col. had never again found us and the
Major that was ttren whose name I trave forgot told us we might be
diseharged. for furttrer orders. f never had a regular discharge
owing to !h" circumstances before menti-oned.
At tLre time I inlisted f l-ived near Roanoak River, County of
Halifax North Carolina. Ttrere is no person now living by wtrom
I can prove my service, the last of my fellow soldiers that llved
any where in this eountry that I know of, to wit: Genrl R. Carney

He states his d.ischarge was on the l8th d.ay of October 1781 .
He states he was born in Martin County, North Carolina. He can
not remember which year...he is 73 or 74 years of age....there
is no record. of his age..he has the information of his age from
an elder sister. (.to name given).
He was subscribed on the Ro1l of West Tennessee at the rate of
21 .66 conts per annum to conmence on the Jgtfr aay of March 1831.

The original petition 1s found in the Legislative Petitions, State
Library and Archives, Nashville, Tennessee.
To the Honourable the General Assembly of the State of Tennessee
sitting in Knoxville,
The Petition of James M. Reynolds and Jokrn R. McFarland respectful1y represents, That in the winter 1807 your Petitioners purchased a Negroe man named Moses, about thirty five years of age,
from a certain Joseph Penrice of the County of Montgomery for the
sum of Three hundred and thinty three dol-lars thirty three and one
third cents, which Negroe afterwards, to with, before the delivery
of him to us, shot and ki11ed a citizen of Cl-arksville whose name
was Samuel Minott, for which offence he was arrested, tried and
cont'icted, and pursuant to the sentance of the Court was executed
at Clarksville.
After the execution of said Negroe, said Penrice demanded pa;rment
of us, which we refused to make on the grounds of his never having
been delivered prior to his comrnitting the murder aforesaid. In
consequence of which refusal said Penrice commenced suit against
us and ultimately recovered of us Three hundred and thirty three
dollars thirty three and one third cents, togeth.er with the i-nterest thereon, making in al-I the sum of Three hundred and sixty
one dollars sixty four cents, together with the cost of suit which
added to the foregoing sum makes an agregated sum of four hundred
and one dollars eighty two and one hal-f cents, which we paid to
the Sheriff of Montgomery County as his receipt which accompanies
this petition will ful1y shew unto your Honourable Body.
Your Petitioners having fu1ly and fairly represented this case
which they bel-ieve a hard one and knowing no reason consistent
with principles of imrmrtable Justice which would prevent the State
from making to us full compensation for the loss we have sustained
by the mere operation of the laws of the State and conceiving ourselves fairly entitled to receive from the State the sum which we
have been compelled by Law to pay and relying on the Justice of
your Honourable Body chearfully subrnit the decision on our interest
in the above reci-ted case to you.
We do not concieve that the State ought to deprive a Citizen of his
property by the operation of Law (a1tho it is right that Culprits
should be made to suffer punishment) without making the owner
more than one Ci-tizen has a right to
reperation ttrerefor, any

Confederate Soldier
The following infortnation was compiled from questionaires sent out
to Vererans of the Civil War in 1922 by the Tennessee Historical
Committee, Department of Libraries, Archives and History, John
Trotwood Moore, Director. The chlef purpose of the questions was
to bring our facts that would be of help in writing a true history
of the 01d South. fn addition to the information abstracted the
veteran al-so gave his opinion concerning the relationship of slave
owners and non-slave owners in his coflrnunity. The originals are
found in the Manuscript secti-on of the State Library and Archives,
Nashville, TN.
G. E. EDLIN in 1922 lived in Guttrrie, Ky. He was 76. He was born
in Montgomery County, Tennessee, and served as a Confederate Soldier
in Co. C, 2nd Ky Cavalry under General- Forest.
His father, James Ed1in, was a boot and shoe maker born in Ireland.
His mother was Saratr Francisco, daughter of John Francisco and hi-s
wife, Nancy. The farnily lived at New Providence, Tenn. Before
the war hi-s father owned 1!O acres of land valued at $1!00 and
eight slaves. They lived i-n a fi-ve room frame house. As a young
man, he did a1l- kinds of work--p1owed, howed, carpenter, trad.,
fishing.
He attended pay schools for B years, traveling from 1/2 to 4 miles
to school. These public schools ran for 10 months a year and had
men teachers. The boys and girls attended school togettrer.
He enlisted in service at Riggins Hill on Sept 22, 1862 and went
into battle at Riggins Hill the same day. Afterwards they company
went to Hopkinsville and then to Murfreesboro. They were in the
Battle of Lookout Mountain; Atlanta, Georgial and Fort Worth, Texas.
He was discharged at Washington, Georgia. The ltyanks took our
pases . .walked home and beg for a little to eatrt. After tre came
trome, ho went to sctrool for 1 session. He then served three years
learni-ng the carriage trade
He notes that Jeff Davis gave up and took the oath in the same town
he did (Washington, Georgia, May 9, 1865).

The Shady Grove Church and school came into existence sometime
before 1BTZ. Tnavelling preachers of various persuasions preached
there in ttre same building as was used for a graded school. 0n
a busy Sunday, Sept. 17, 1893, Rev. Jeruy Cullom recorded the
following in his diary: trAt eight otclock, married Charley McDaniel to Miss Donia Johnson. At eleven, preached at Grantts
Chapel, dt three at Mt. Carrnel, and at night at Shady Grove. We
protract the meeting. There were eleven mourners, and one contonight.tt this well-known Mettrodist was still- having

a good crowd at Shady Groverr as late as Sunday, Jul-y J, 19Ol .
The new century was to bring changes to the community, however.
The brotlrers, Lycurgus Bartlett Strannon and Jokr.n W. D. Shannon,
anrived at Shady Grove and organized the Freewill Baptist congregation, with ten members on July 20, 1902. A Building Committee
was appointed soon after the organization, consi-stion of W. T.
Major, S. N. I{ogan, and Robert and Will Heflin. The brothers
Shannon boarded at tkre home of the comrmrnity storekeeper, Monroe
Wi-lliams, while the building was being erected. The log building
was completed and dedicated on April 9, 1911 by the Rev. Jessie
Hudgins. A photograph of this bullding survi-ves, and shows it
had two front doors, and three side windows. It was replaced in
the early 1950s with the pr.esent structure, oh approxirnately the
same
site.

By 19lZ tkre congregation was sending delegates to the Baptist
Association meetings. J. A. Major, A. R. Hogan and A. Jackson
were delegates in that year. The next year Henry Holt and A. R.
Hogan were to go, with J. A. Major as alternate.
The congregation has yielded more than one minister to Christian
servi-ce. The first was A. R. Hogan, who preached the second
sermons in June 1916 and was later ordained an El-der. He subsequently became a Methodist, and labored in that denomi.nation for
over forty years.
The present church building was constructed in the 195Os. It has
basement classrooms and a large sanctuary. Since 1970 a large
wing has been added on tkre west side, and the entire structure has
a brict< veneer. A modern Parsonage was constructed in the 1960s
one mi-le south of the church.
