The Mayor noting a quorum was present called the meeting to order at 7:00 pm.
The Mayor introduced himself and welcomed the attendees for the meeting tonight.
The Mayor asked for a moment of silent prayer or meditation, and in particularly to remember the
Brandt and Morgan families for their losses this last week. He then asked Veteran and Council
Member Mary Albaugh to lead the Pledge of Allegiance.
Recognized Guests: Mayor McCauley then recognized special guests for presentation of
Proclamations to:
 Mr. Brandon Tenney for outstanding accomplishments on the B-UHS wrestling team.
Recognition of June 2, 2016 at Brandon Tenney Day. Mr. Tenney’s family and coach were
also present for the presentation.
 Mr. Jack Garcia for outstanding accomplishments on the B-UHS wrestling team. Recognition
for June 3, 2016 as Jack Garcia Day. Mr. Garcia’s family and coach were present for the
presentation.
 Glenn Tanaka & Rosalind “Roz” Okubo for May 23,16 as Glenn Tanaka &Roz Okubo Day.
 The Mayor then recognized Mrs. Linda Wolfe of the Upshur County Relay for Life event. Mrs.
Wolf explained and expressed her sincere thanks on behalf of the Upshur County Relay for
Life organization for the City’s support on their upcoming event to be held at Jawbone Park.
She also expressed her thanks for the cities participation in decorating the Main Street and

Jawbone area for the event in July. She hopes that the citizens enjoy the purple decorations
that will be placed on poles and around the area. She also explained that the theme for this
year’s event is “Paint Our World Purple” for cancer and cancer survivors. Mrs. Wolf
recognized members of her planning committee; Carol Bowman, Crystal Shaw, and Amanda
Hayes. Mrs. Wolf also thanked Mr. Edwards and the CPWB for their approval of this year’s
event at Jawbone Park. Council members expressed their appreciation of the Organization
and the work that is put into the annual event. Stressed the importance of cancer and its
effects on families and the community.

Water Treatment Plant Improvement Project








Construction activities began on April 4, 2016.
Removal of the treatment & processing equipment in Train A of the Settlement Basin is 100% complete.
Crack repair activities on Filter Bed No. 1 in the Control Building have been completed.
Sandblasting of all exterior concrete walls and support steel has been completed.
Sandblasting of all piping in the Pipe Gallery has been completed.
The Contractor with crack repairs and concrete repairs on the wall of Train A of the Settlement Basin and
the Sludge Pump Room.
The Contractor is making preparations to begin the installation of the various valves in the Pipe Gallery.
Project should be completed on, or before, October 10, 2016.
 The Project was originally scheduled to be completed by September 10, 2016 but with the three
approved Additive Alternates, the contract date was extended (30) days.
North Buckhannon City Park Improvement Project



FEMA is still reviewing the request from the City to use permeable concrete at the NBCP due to
restrictions on FEMA-purchased mitigation / buyout property.
The exterior (outside) phases of the Project that involve ADA-compliant permeable concrete cannot start
until the City receives the approval letter from FEMA.
Street Department has completed the necessary interior ADA-compliant renovations to the two (2) public
restrooms.
Raw Water Intake Emergency Generator Project






The WVDHSEM grant application for the purchase & installation of a backup generator for the Raw Water
Intake is ready for submission to the WV Division of Homeland Security and Emergency Management.
Installation of the generator would mean that the entire water department (both WTP and distribution
system) would have backup emergency generator power at all locations.
Anticipated cost of the project is $225,000.00.
Reason for the higher cost is that it will be an elevated generator (due to the floodway and floodplain in the
area) on City property near the Raw Water Intake.
If approved, FEMA would provide $180,000.00 and the City would provide $45,000.00 (an 80/20 split).
There is the possibility that the WVDHSEM would provide the $45,000.00 (as a local match) but the City
needs to budget the money in case the WVDHSEM cannot provide the money.
USACE Local Flood Control Project


The Bid Package for the Virginia Spirea botanical survey has been completed and the Project is currently
advertising for bids.
 The field survey can only be conducted from June 1 st through September 30th of each year (to
allow the plant to bloom and make for easier identification).
 The survey will take approximately one (1) week, including travel, field work, analysis, agency
coordination and reports.
 Two-person survey crew, including a botanist and an assistant.
 The office portion of the botanical survey will take approximately two (2) weeks to complete.
 Approximate cost of $15,000.00.
 Bids are due on Friday, June 17, 2016 by 4:00PM EST.
Letters were sent to the property owners along the Buckhannon River that are in the Flood Control Project
limits to:
 Inform them of the City’s intent to have the Virginia Spirea botanical survey conducted.
 Asking them to attend a meeting at City Hall on May 12, 2016 at 6:00PM to discuss what the
activities will be associated with the Virginia Spirea botanical survey.
 Answer any questions or concerns the property owners may have.

McDonalds / Route 20 Lane Widening




Anticipated advertising date of the project is late June 2016.
Anticipated awarding date of the project is late July 2016.
Anticipating beginning of construction activities is late August 2016.
Anticipating completion of construction in late December 2016.
SCADA System



Overall, the Water Distribution System SCADA installation is approximately 95% complete.
Punchlist items are now being addressed.
Additional work items are being considered / reviewed at this time.
Route 20 Railroad Crossing Update

In recent conversations with A&O Railroad, at this time there are no plans to replace / upgrade the railroad
crossing at this time.
 As I mentioned last July, I would update City Council on the status of this project once I received
information from either A&O Railroad or the WVDOH.
Old Weston Road Waterline Replacement Project

A waterline break underneath the railroad tracks at the Corridor H Overpass on the Old Weston Road
occurred on Friday, May 13, 2016 at approximately 5:00PM EST.
 The 8”Ø waterline is one (1) of (2) lines that supply potable water to the Clow WST and the
customers in the Liggett Addition.
 The Water Department Distribution System Crew worked on the broken waterline for
approximately 4.5 hours.
 However, the site conditions (saturated soil, depth of excavation, time of day, etc.) prevented the
Crew from making the necessary repairs.
 The broken waterline has been temporarily shut down until the necessary repairs can be made.
 A site meeting was held this morning at the site between the WVDOH, A&O Railroad and the
City to discuss the issues and permitting.
 Preliminary designs and photos have been sent to both the WVDOH and CSX Railroad for initial
review and comments.
Gateway West Transportation Alternatives Project

Received notification from the Governor’s Office on May 18, 2016 that the City was awarded $75,000.00
for the Engineering and Design Phase of the GWW Project.
 The City shall have one (1) year to complete the engineering and design of the Project.
 The City can either design the project in-house (which is what I did for Gateway East) or a preapproved consulting engineering firm could design the project.
 However, the consulting engineering firm would be paid out of the $75,000.00 received by the
City, which would leave less money to apply towards the construction phase of the project.
 Once the engineering and design is completed and reviewed & approved by the WVDOH, the City
will receive notification regarding the construction phase of the project.
 Funding for the project is an 80/20 split between the WVDOH and the City where the WVDOH
would provide $293,679.20 towards the project and the City would provide $73,419.80..
 The project funding is $367,099.00, which is based upon the 2015 GWW application.
 However, based upon the 2016 application, the cost of the GWW project is $395,351.42,
which is an increase of $28,252.42.
 Therefore, the total City commitment would be $101,672.22.
 However, there is the possibility that some of the City’s costs could be offset using the Force
Account procedure, which would allow the City’s Street Department to construct the
sidewalks and install the street lights and the time & material from the Street Department
would “count towards” the $101,672.22 (it should be noted that during the GWE project, the
Street Department contributed $81,756.57 of Force Account work.
 Additional information will be made available to me once I have a scoping meeting with the
WVDOH sometime in the near future.


Mayor McCauley recognized Mr. Russell Jarrett to discuss Upper Drive speed bump concerns. Due to
the lack of consensus for removal or keeping the bumps, Mayor McCauley suggested that the bumps
remain for 2-3 months to see if they may be helpful. Noting that summer break and the children will
be out playing more now.

Amby presented the financial report and discussed the 2016/17 CPWB Budget. The Board approved both
as submitted.

The Board approved an event request for the Really Really Free Market event on 7-10-16.

The Board approved the Quilters at Heart quilt show request on 9-11-16.
The Board approve the Pet Door rescue 5K Run/Walk to be held on the parade route indicated on
application 8-13-16 9am-11am.
The Board approved a request for decorations and cooperation from city for July and the “Relay for
Life event at Jawbone Park.

The Board accepted the COI and request a letter from WVSA indemnifying the city from any issues
resulting from “Geese”.

The Board approved a Handicapped parking space to be located at 30 Meade St., and that a list be
generated of all residential handicapped parking spots to be reviewed yearly.

The Board approved to refund the Literacy Volunteers for the usage of NBRP pavilion on 4-6-16.
10. Mayor McCauley then recognized CJ Rylands (CREATE) to request permission for a “pontoon/barge”
be placed on the Buckhannon river for a musical/band event on 6-12-16. Discussion was had
regarding liabilities, insurance, and logistics for such an event. It was explained that the city did not
have the ability to allow such an event on private property, in this case the Buckhannon River at
WVWC. It is believed that permission would need to come from the college. It was suggested that any
event of this type also be discussed with the fire rescue and PD. Mr. Rylands was asked to investigate
further and return to CPWB with more information.

The Board accepted for review Waste Collection Employee evaluations and compensation
recommendations.
The Board approved specifications for a waste collection truck.
I reported on the 2016 Make it Shine Month activities. (75.29 ton Total $972213)
The Board discussed the possible implementation of a toter can service. I will present additional
information and conduct a demonstration at the July 7 th meeting for the Boards consideration.

The paving is completed on Madison and Smithfield Streets.
The SYC basketball court has been resurfaced and resized to a regulation sized high school court. We will
be installing new goals.
We have started with some of our sidewalk construction with a portion on Meade.
We are patching holes as weather permits. We are about 80% complete
We will be working on the College Avenue sidewalk next.
The veteran’s groups and the Boy scouts installed the flags at the cemetery for Memorial Day. We had one
flagpole damaged by a vehicle.
We will continue to pave utility cuts and be paving sections of Shawnee Dr. and Cardinal Streets this
month.
I will be approaching property owners along North Spring Street to solicit materials for the upcoming
sidewalk project.
Scott McClure City Attorney:
1. Mr. McClure discussed Ordinance Draft for the Home Rule P/T Police Officers and
Min/Max age requirements. It has 3 main Elements;
a. P/T police officers due not replace any current or future F/T officers. Max hrs is
1,040 per annum.
b. Increase the age for a sworn officer to 56 and has special assignment status.

c. Increase max age for sworn officer to 40-45. This will need further research since it
infringes upon Civil Service state Codes. The Home Rule Board will not approve any
plans that relate to Civil Service or Pensions.
d. He will continue to work and return with more at next Council meeting
Mr. McClure presented and explained draft Ordinance 391 2nd “Plank” providing for
Property Nuisance Abatement, Special Property Tax Lien, and “On Site Citations”. He
also reminded Council of previous discussions regarding this Ordinance. Particularly
former Municipal Judge Levine concerns. This is Ordinance Draft is very similar to other
municipality statutes.
Mr. McClure discussed the current discussions for the Fireworks contract for the SYC
4th of July event. Mrs. Cuppari is the Lead for this event. Discussion was had regarding
the options for future regulations on certain fireworks and their usage in the City.
Mayor McCauley has concerns for the safety of residents and properties since the new
State Legislation of more powerful fireworks available to citizens. Mr. Pugh agreed with
the Mayor. The Mayor pointed out other municipality ordinances regarding the use of
fireworks.
He briefly mentioned discussion regarding Ordinance Codification and the Walter Drane
Co.
Discussed the advertising for the Public Hearing for Ordinance 2016-03 regarding
Sewage Waste Rate Increase 6-16-16.
Mrs. Cuppari mentioned the 5 Million COI for the Fireworks Company for the 4th event was
received.

Whereas, GLENN TANAKA & ROSALIND “ROZ” OKUBO are natives of Honolulu, Hawaii, our nation’s
island paradise, who are close friends of Buckhannon residents, Roy & Sandra Dean; and,
Whereas, MR. TANAKA & MS. OKUBO visited the Deans in Buckhannon enjoying the 2016 West Virginia
Strawberry Festival just this past week; and,
Whereas, MR. TANAKA is a proud American veteran having served his country during his combat tour in

the Vietnam War in Pleiku with Roy Dean in 1968-69 as part of the U.S. Army’s 359 Transportation Company, which

Company just last year celebrated their 50 anniversary of first deployment; and,
Whereas, MS. OKUBO has served as the personal massage therapist for former Hawaii governor and
Congressional representative, i.e., the Honorable Neil Abercrombie, & is an acclaimed & celebrated professional in

immediately appreciating our community’s rustic charm & natural beauty, & have now adopted Buckhannon as their

of Buckhannon & to designate our beloved Sunnybuck as being now & henceforth as their own Home Among the

Strategic Issues for Discussion and Vote:

Southwestern Company Solicitor Application: Mr. Pugh discussed his concerns with the
request to permitting of the Southwestern Company to solicit door to door. His concern was
the lack of a correct address for the company. Mayor commented that because the State
issued a Business Certificate, we should be satisfied with that. After further discussion and
upon,
Motion [Thomas/Albaugh] to tentatively approve the permit upon condition that a
correct address is supplied to City Hall. Motion passed unanimously.

Approval- Second Reading Ordinance 2016-03 Sewer Rate Increase. Mr. McClure was
recognized to explain the Ordinance. After discussion and upon,
Motion [Pugh/Albaugh] to approve Ordinance 2016-03 Sewer Rate Increase upon Second
Reading. Motion passed unanimously.
ORDINANCE NO. 2016-003 OF THE CITY OF BUCKHANNON, AN ORDINANCE:
(1) AMENDING, MODIFYING AND RE-ENACTING ARTICLE 917 OF THE CODIFIED ORDINANCES OF THE CITY
OF BUCKHANNON, UPSHUR COUNTY, WEST VIRGINIA; AND (2) SPECIFICALLY ESTABLISHING NEW SEWER
RATES AND CHARGES FOR SANITARY SEWAGE COLLECTION AND DISPOSAL SERVICES PROVIDED BY
THE SANITARY BOARD OF THE CITY OF BUCKHANNON
WHEREAS, the current rates and charges of the Sanitary Board of the City of Buckhannon for providing
sanitary sewage collection and disposal services as were previously adopted by City Ordinances No. 233, 291, 295,
307, 333 and 352 and currently reflected in Article 917 of the Codified Ordinances are presently insufficient to
maintain the high quality of sanitary sewage services offered by the Board and City to the residents of Buckhannon
and surrounding Upshur County; and,
WHEREAS, the Board and City have not sought a sanitary sewage rate increase since August of 2010; and,
WHEREAS, the Board and City’s cost of providing sanitary sewage collection and disposal services has
increased substantially since August of 2010; and,
WHEREAS, the City’s opportunities to improve and maintain its sanitary sewage operations are substantially
impeded given current revenues realized from the collection of current rates and charges; and,
WHEREAS, legislative enactments now require utility companies to maintain a working capital fund equal to

1/8 of the operating revenues in surplus; and,

WHEREAS, the City of Buckhannon does not maintain a 1/8 capital fund in accordance with recently
enacted state law and in order to comply with this requirement, the City of Buckhannon must enact the 20% increase
th
in order to maintain a working capital fund equal to 1/8 of operating revenues; and,
WHEREAS, in February of 2016, the City of Buckhannon Sanitary Board conducted a sewer rate analysis
study, which report evidencing this study was compiled by the accounting firm of Smith, Cochran & Hicks of
Charleston, West Virginia, said report dated June 30, 2015, which report has been tendered to the PSC, Sanitary
Board and City Council; and,
WHEREAS, this sewer rate analysis was presented and discussed by the Sanitary Board during a regularly
scheduled public meeting of the Board on the 17
th
day of March, 2016, the analysis demonstrated the need for a
20% increase in existing sewer rates; and,
WHEREAS, the Sanitary Board formally resolved during its meeting on the 17
th
day of March, 2016 to
recommend to the City Council that the City increase Buckhannon’s rates and charges for sanitary sewage collection
and disposal services pursuant to the aforesaid report, said proposed rate and charge schedule being hereinafter
described and set forth pursuant to this Ordinance; and,

WHEREAS, the City Council met at a regularly scheduled meeting on the 21 day of April, 2016 and were
presented with the recommendation and rate study; and,
WHEREAS, the Council of the City of Buckhannon is authorized pursuant to the statutory provisions of
Chapter 8, Article 13, Section 13, and Chapter 24, Article 2, Section 4b of the West Virginia Code, as amended, to
impose by ordinance upon the users of sanitary sewage services, such reasonable rates, fees and charges as shall
be collected in the manner specified by ordinance; and,
WHEREAS, the Council of the City of Buckhannon deems the rates and charges proposed by the Sanitary
Board of the City of Buckhannon, and as set out in the aforesaid June 30, 2015 report of the accounting firm of Smith,
Cochran & Hicks, and further which rates and charges are described and set forth pursuant to Section 917.01, “Rate
and Charge Schedule” hereof, to be just and reasonable; and,
WHEREAS, the statutory provisions of Chapter 8, Article 11, Section 3, Paragraph (1), and Chapter 8,
Article 13, Section 13 of the West Virginia Code, as amended, specifically provide that the collection of fees of any
kind by a municipality shall be by ordinance; and,
WHEREAS, the Council of the City of Buckhannon desires in all respects to comply with the statutes of the
State of West Virginia and further with the administrative rules and regulations of the PSC insofar as the
establishment of new sanitary sewage rates and charges is concerned.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE COUNCIL OF THE CITY OF
BUCKHANNON, AS FOLLOWS:

917.01. FINDINGS OF COUNCIL: The Council of the City of Buckhannon
hereby makes the following findings:

(1) The current rates and charges of the Sanitary Board of the City of Buckhannon for providing sanitary
sewage collection and disposal services as were previously adopted by City Ordinances No. 233, 291, 295, 307, 333

(7) The Board formally moved and resolved during the March 17 , 2016 meeting to recommend to the City
Council that the City accept all rate recommendations of Smith Cochran & Hicks, and that the City increase its rates
and charges for sanitary sewage collection and disposal services pursuant to the proposed rate and charge schedule
now described and set forth pursuant to Article II hereof;
(8) The Council of the City of Buckhannon is authorized pursuant to the statutory provisions of Chapter 8,
Article 13, Section 13, and Chapter 24, Article 2, Section 4b of the West Virginia Code, as amended, to impose by
ordinance upon the users of sanitary sewage services, such reasonable rates, fees and charges as shall be collected
in the manner specified in the ordinance;
(9) The Council of the City of Buckhannon deems all rates and charges proposed by the PSC and

917.02. NEW RATE AND CHARGE SCHEDULE: The following rates and charges shall be paid for sanitary
sewage collection and disposal services offered by the Sanitary Board of the City of Buckhannon, upon this
Ordinance’s effectuation:

917.03. AUTHORITY OF MAYOR TO PREPARE AND FILE ANY AND ALL REASONABLE OR
NECESSARY APPLICATIONS, TARIFF MODIFICATIONS AND/OR OTHER DOCUMENTS WITH THE WEST
VIRGINIA PUBLIC SERVICE COMMISSION:
The Mayor of the City of Buckhannon is hereby expressly authorized to prepare and file, and/or cause to be
prepared and filed, any and all necessary applications, tariff modifications and/or other documents with the West
Virginia Public Service Commission, and generally to assure the City of Buckhannon’s compliance with the West
Virginia Public Service Commission’s rules and regulations respecting sanitary sewer operations by a municipality.
The provisions of Ordinances No. 233, 291, 295, 307, 333 and 352, currently reflected in Article 917 of the Codified
Ordinances, and/or any other ordinance provisions of the City of Buckhannon addressing sanitary sewage services
as provided by the City of Buckhannon or the Sanitary Board of the City of Buckhannon, are hereby expressly
amended pursuant to the provisions hereof.
917.04. PREVIOUS SANITARY SEWER SERVICE ORDINANCES:
Any and all other
provisions of Ordinances No. 233, 291, 295, 307, 333, 352 and/or any other ordinance provisions of the City of

Buckhannon addressing sanitary sewer services as provided by the City of Buckhannon or the Sanitary Board of the
City of Buckhannon, and not expressly amended pursuant to this Ordinance No. 2016-003, shall be deemed to
remain in full force and legal effect, except for those rates, charges, and ordinance provisions which are expressly
amended hereby.
917.05. PUBLIC SERVICE COMMISSION AND SANITARY BOARD RULES AND REGULATIONS:
This Ordinance is adopted by the City of Buckhannon with the express intention of complying with the rules
and regulations of the West Virginia Public Service Commission. Notwithstanding the immediately aforestated
intention, this Ordinance shall not prohibit the Sanitary Board of the City of Buckhannon from establishing, applying
and/or amending from time to time, the Board’s own rules and regulations which are not inconsistent with PSC rules
and regulations, which Board-established rules and regulations are promulgated to facilitate the administration and
operation of the City’s sanitary sewage system.
917.06. SEVERABILITY: In the event that any provision(s) of this Ordinance is determined to be
unconstitutional or invalid by a court exercising competent jurisdiction, such determination shall not affect the validity
of this Ordinance as a whole or the provisions thereof which are not specifically held to be unconstitutional or invalid
other than that provision(s) which is specifically determined to be unconstitutional or invalid.
917.07. EFFECTIVE DATE: Pursuant to Chapter 24, Article 2, Section 4b, Paragraph (b) of the West
Virginia Code, as amended, this Ordinance shall be deemed effective immediately following fourty five (45) days from

Approval of a Task Force-Youth Soccer to be established by Mayor McCauley and
interested parties to address the Youth Soccer request for more playing fields. Mayor
McCauley discussed such a task force and suggested participants. After further discussion
and upon,

Motion [Cuppari/Pugh] to allow the Mayor to solicit and establish a Task Force to
address and explore the available options of playing fields for the Youth Soccer program.
Motion passed unanimously.
Comments and announcements:





Mrs. Albaugh likes the placement of the Council seating upon the floor. Flag disposal at the
American Legion or City Hall. Welcomes Mayor and Mr. Skinner to Council.
Mrs. Cuppari appreciates the refunds to permits as approved previously. Recognized the
additional work placed upon the administration to do such. Needs volunteers for the SYC 4th
of July event.
Mr. Pugh reports on the first of the Festival Friday’s events starts next day.
Mr. Skinner thanked the crews that worked on the Madison/Smithfield paving projects.
Expressed his appreciation for the community and those that attended the Downtown
Parking Meeting and Discussion at the Public Safety Complex. “Great community discussion”
was his exact words.
Mr. Edwards reported that the Codification of Ordinance and Mapping addressing are key
priorities for him. He will be working with Mr. McClure and Highmark to accomplish those
goals. He hopes to have those projects completed by end of the summer and present to
council. Discussed the Fire Civil Service Commission testing to date. Discussion was had
regarding when they top 3 candidates from the “list of eligible’s” might be presented to
council for interviews.
Mayor Comments:

Mayor commended all of the WVSF Board and volunteers for their work during the Festival.
Thanked the City Crews for their hard work during the Festival. “Hats Off to you”
Reminded all that June is Patriotism Month leading up to July 4th.
Explained the UCARE pool party Schedule
Briefed the Council on a correspondence from Suddenlink which will be on next agenda.
 Recognized Mr. Arnold and the committee involved in the “Flags for the Fallen Program at
Heavner Cemetery. Also recognized the Combined Honor Guard and anticipated future
recognition of the involved.
 Asked all in attendance to consider contributing to the “GO FUND ME” accounts set up for
previously discussed Brandt and Morgan families. Distributed the web addresses for those
