Hau’oli Makahiki Hou! OK, 2015…here we go! Since we’re charging into a New Year, I thought maybe we should
get charged up about what our responsibilities are to the ocean and to each other. 2014 was not a year we should
be proud of! There were problems reported on all the islands, arguments that turned ugly between environmentalists
and tropical fish collectors, folks from one island going to the State Legislature asking for laws to prevent folks
from another island from fishing off “their” island. People from one island actually boarded a boat with folks from
another island that were visiting “their” waters for recreational fishing. That same island had issues with boats that
were escorting inter-island racers doing a little fishing on the way over. What’s happening? I didn’t think fishing
and boating were contact sports! We’re supposed to share and share alike, respect each other and the environment.
Maybe we need a few reminders…Mahalo to the Western Pacific Regional Fishery Management Council, the State
of Hawaii Department of Land & Natural Resources, NOAA, and the U.S. Coast Guard for providing suggestions that
will help us all. We’ll begin with the NOAA fishing code of ethics and we’ll follow with the Council’s, and end up
with some great boating practices!
The History of the Code
NOAA Fisheries Service adopted a code of ethical angling as part of a public education
emphasis under the NOAA Recreational Fisheries Strategic Plan. The code was developed in
cooperation with a range of constituent groups and was published in the Federal Register in
1999. The importance of an angler code has been recognized and adopted by many other
countries and organizations throughout the world.
An ethical angler is a good steward who knows that part of the angling experience is to be in
tune with nature. This means treating all wildlife with care and respect.
Let’s Work Together to Preserve Our Sport
Recreational fishermen are leaders in conservation. Practicing ethical angling influences other anglers and increases
public awareness of the important role we all play. Ethical angler behavior -- from concern for habitat, to best
practices for fish handling and release - helps spread the word that responsible anglers are a part of the solution
for sustainable resource management.
Ethical Angling Reminders
Pay attention to restrictions on fish sizes, fishing seasons, species bag limits, and conservation measures. Proper
catch and release methods may vary depending on fish species, water depth, and other factors. So, make sure to
plan your release strategy in advance by having available appropriate tools (dehookers, fish descenders, etc.) For
some fish species circle and barbless hooks may help reduce injury and increase survival.
Landing your catch quickly will minimize exhaustion and, whenever possible, the fish should be kept in the water
during hook removal. The less a fish is handled and the quicker it is released, the better likelihood it will survive.
Pay close attention to the impacts fishing activity may have on habitat. When fishing from a boat take care to
avoid dragging anchors or other fishing gear on the bottom. An ethical angler should use marine sanitation
devices to prevent untreated sewage from being pumped overboard.
Scan the surrounding sky, land, and water for marine mammals, seabirds and sea turtles before casting your line
to reduce risk of encounter.
Minimize the hooking of seabirds and sea turtles, and treat any animals with care to avoid injury to both angler
and animal. Retrieve as much line as possible to minimize entanglement and starvation of the bird or sea turtle. If
possible remove the hook safely by cutting off the barb first and then extracting. If the hook is swallowed, cut the
line as closely as possible to the animal and leave the hook in place. For severely tangled or deeply hooked birds
and turtles call your local game warden.
Never harm marine mammals, even if they attempt to steal the bait or
catch. The law allows people to deter marine mammals not listed under
the Endangered Species Act so long as the deterrence method is safe
and the animal is not killed or seriously injured. The NOAA Fisheries
Service has identified some potential techniques which may be used to
deter problem seals and sea lions, including horns and whistles.

animal’s behavior.
The 9 Point Fisherman Code of Conduct from the Western Pacific Regional Fishery Management Council
1. Respect nature and your place in it.
2. Seek advice from with generational knowledge of the local resources.
3. Show regard to spawning seasons and juvenile fish.
4. Do Not Waste. Take only what is needed.
5. Keep safe people, property, and resources.
6. Obey fishing laws and rules.
7. Use proper gear and techniques.
8. Pick up your trash.
9. Share your catch.
Ten “Clean and Green” Tips For Boating In 2015
1. Prevent oily discharges from the bilge. Keep your engine well tuned to prevent fuel and oil leaks. Secure an oil
absorbent pad or pillow in your bilge and under your engine where drips may occur. Check the pads often, do
not let them clog the bilge pump, and dispose of them as hazardous waste at a marina or local hazardous waste
collection center.
2. Spill-proof your oil changes. For oil changes, use an oil change pump to transfer oil to a spill-proof container.
Wrap a plastic bag or absorbent pad around the oil filter to prevent oil from spilling into the bilge.
3. When fueling, stop the drops! Prevent fuel spills by filling fuel tanks slowly and using absorbent pads or rags to
catch drips and spills. Don’t "top off" or overflow your fuel tank. Leave the tank 10% empty to allow fuel to
expand as it warms.
4. Do not add soap. Never use soap to disperse fuel and oil spills. It increases harm to the environment, and it is
illegal.
5. Minimize boat cleaning and maintenance in the water. If possible, save maintenance projects for the boatyard.
When performing work on the water minimize your impact by containing waste. Use tarps and vacuum sanders
to collect all drips and debris for proper disposal.
6. Reduce toxic discharges from bottom paints. Minimize the discharge of heavy metals found in soft-sloughing
antifouling paints by using a less toxic, or nontoxic antifouling paint. Use only non-abrasive underwater hull
cleaning techniques to prevent excessive paint discharge. Remember, dry storage reduces the need for
antifouling paints and saves money.
7. Dispose of hazardous waste properly. Dispose of paints, batteries, antifreeze, cleaning products, oil, oil filters and
other hazardous wastes at a hazardous waste collection facility or event.
8. Plan Ahead! Manage sewage wastes properly. Never discharge sewage within 3 miles of shore. Use harbor
pump-out stations and shore-side facilities. If you don’t have an installed toilet, use a port-a-potty and empty it
at a harbor dump station or bathroom.
9. Stow it, don’t throw it! Keep your trash on board. Never throw cigarette butts, fishing line, or any other garbage
into the ocean. Take advantage of shore-side facilities to recycle plastic, glass, metal, and paper.
10. Reduce Grey water discharges. Use a phosphate-free biodegradable soap to minimize the impacts of grey water
on the marine environment. Also, minimize discharge by doing dishes and showers on shore whenever possible.

People have said that watching a sailboat race is like watching grass grow. Those of us
out on the open ocean with the wind and seas in our face know this is the furthest thing
from the truth. At any time Mother Nature can turn the weather bad which boating people
know and respect. With all the racing and fishing tournaments throughout the year, the final
bit of acknowledgement are the award dinners for sailors.
Besides winning prizes for the races won, each club has perpetual trophies awarded to
individuals who were first in a series of events or awarded to persons for endeavors they
accomplished during the year. Each club has these awards and rather than acknowledging the

Hawaii Yacht Club continues to hold the Friday Night Races, these are the only organized
races going on right now. The boats are starting with the sun setting shortly after they leave the harbor. All the
boats round Diamond Head mark in the dark and identifying boats as they finish is extremely difficult for PRO
Frank Lange but he manages to pull it off. Frank is truly an asset to this sailing event.
The following represent the top three finishers in each quarter for the Spinnaker and Non-spinnaker class. These
races have an average of twenty-two boats entered each week. HYC decided not to award a first overall this year,
the following are the results per quarter (boats without a skipper’s name need to advise Frank Lange for recognition):

As a correction to my calculations for the Holo Holo race in last month’s article. Kahuna started the race at
17:04:08 and finished at 09:51:12 for an elapsed time of 16 hours 47 minutes and 04 seconds.

The Nawiliwili Yacht Club Christmas party was
held on Sunday, December14th along with the
display of lighted boats, the yearly awards
presentations, and the changing of the guard
with new officers. Jim Saylor ("FAST COMPANY")
handed over the Commodore flag to Doug
Tiffany ("BONJOLEA II", ex Fins). A wonderful
ham dinner was consumed while Christmas
carols were sung and pictures of the racing
season were flashed on the screen.
"FAST COMPANY" walked away with the most
trophies and "BONJOLEA II" won for the
best Christmas lights.

am sometimes asked, "What are the most consistent repair issues found during a CONDITION and VALUE
A
survey?" I label them "Deficiencies" in my reports because they can be corrected. Maybe I can answer that later...
I
Maybe it would be better to start from the beginning.
I
Like some folks, I read a lot of books and magazines, and drooled over the offers you see in publications like
Hawaii Boats & Yachts. Maybe a stack 10 ft. tall, before I bought my first boat. I could afford the books, not the boat. B
Problems was, I had not read some pertinent and critically important books like, the 33 and 46 CFR's (Code of
O
Federal Regulations) or ABYC (American Boat and Yacht Council) Standards for Small Craft, or NFPA (National Fire
A
Protection Association) Standard for Pleasure and Commercial Craft 302, among many, many, others.
T
These are where you get the CONDITION information during the survey. Literally, some of the CFR's were written
S
in blood. No joke. The CFR's are mandatory Federal Law and all boats and ships are required to comply. They were
written and enacted because people died or were injured and there were ways to prevent that from happening. In &
the CFR's you can see technical information developed by ABYC and NFPA. ABYC started in the 50's to develop
standards for the design, construction, maintenance and repair of boats, and NFPA started in the late 1890's so

people could research and learn to effectively fight fires. It's all about preventing fire, drowning, or electrocution,

in whatever way it could happen.

So, a surveyor has to know all this engineering stuff when he or she
H
inspects your boat. They have to know what to look out for, with everything T
that's installed onboard the boat. Add a little common sense, some sea and S
repair experience and you have a good surveyor doing the inspection, but
that's only half of a survey.
As for the second half of a C & V survey...VALUATION. Gee, didn't we all
learn this in 2008? What we learned in 2008 was that lots of assets were
over valued and lots of risk was under valued, and some people lost everything they had, jobs, houses, cars, boats, everything. Mega companies like
the accounting and valuation firm, Arthur Anderson collapsed and the "ripple" effected us all.
I took classes, and comply to USPAP (Uniform Standards of Professional Appraisal Practice), for VALUATION, yet
another organization born out of critical times. USPAP sets the appraisal procedure and requires you to disclose
how you determined the boats worth, in dollars. If you use comparables like Soldboats.com, BUC Research, and
online asking prices, or you used another method, it needs to be documented in the report. I use all of that in
every report. Banks, Credit Unions, and insurance companies count on the surveyor to be honest, whether it's
good for his or her business or not. For me, it has been good.
I got asked once, "Don't all surveyors use vague language in their reports?" How can that happen in the CONDITION
part of the report when in the FUEL SECTION, you list the tank as located below the main cabin sole, wood framed,
as a single aluminum tank, 100 gallon capacity, with a missing bolt at the inspection plate that shows a leak, and
you put a photo or 2?
Or how "vague" is it, in the VALUTION part of the report, that 6 of these boats sole in the last 2 years for $45,000
to $50,000, from Soldboats.com, BUC Research shows the price range of $42,000 to 49,000, and online asking
prices for this same boat, are $43,000 to $51,000? The good surveyor can narrow it down pretty close, then subtracts
needed repairs, adds any new additional equipment, and adjusts for this location, Hawaii.
So...back to the start of all this, "What are the most consistent issues (Deficiencies) found during the survey?"
Eh...Hull and deck? Rigging and sails? Engines and fuel
system? Out of the water inspection and thru-hull
fittings? Electrical and navigations equipment? Safety
equipment? Fresh water, gray water and sanitation?
Ground tackle? Sea trials???
Maybe we can get to those at another time?
