2011 Annual Report
An n u a l R e p o r t 201 1 Phi l adel phi aVI P Philadelphia VIP promotes equal justice for the poor by providing civil legal services not otherwise available, collaborating with other legal services organizations, and promoting a culture of volunteerism by educating and exposing attorneys and law students to issues of poverty. Philadelphia VIP is founded on the principle that access to the legal system should be ensured for all in Philadelphia. For three decades, we have matched those who have nowhere else to turn with volunteer attorneys - saying YES every day to help people solve their legal problems. Dear Friends of VIP, Philadelphia VIP celebrated a significant anniversary in 2011, recognizing thirty years of service to our community. In this report, you will see the results from some of the many initiatives we launched in 2011—each of which resulted in more support for VIP and concurrently, more clients served by VIP. While 2011 was an amazing year for VIP, the outlook for the next few years is not as rosy. While needs are increasing, funding for our mission has been decreasing. Funding is down across the board, from foundations to corporations to government grants. VIP has been very fortunate so far to survive these economic times. For example, our individual supporters have stepped in to bridge some of the resulting financial shortfall and helped VIP continue its core services without disruption. Despite these challenges, VIP is committed to its important mission of leveraging the resources of volunteer attorneys to serve low-income Philadelphians, micro entrepreneurs and nonprofit organizations serving the community. With your help, we can achieve even better results for our clients in 2012. Whether you are interested in volunteering on a case or at a clinic, serving on a committee, or providing supportive services to VIP and our clients, we welcome you to our volunteer rolls. And of course, we hope that you all will continue to financially support our work to ensure we can meet our mission for the next thirty years. Thank you for all that you do for VIP. Sincerely, Mark C. Levy 2011-2012 Board President Sara L. These are their stories... Supporting Family Stability Grace’s* daughter passed away leaving behind a teenage daughter, Joy. On the eve of Thanksgiving, Joy dropped her then 11-month-old son off at day care and vanished. Without hesitation, Grace began caring for Michael, who showed signs of autism. Without the money necessary to complete an adoption and termination of parental rights, Grace came to VIP for help and was matched with Andrea Paul, of the law firm of Harper & Paul. Andrea walked Grace through the process step-by-step and made Grace feel like “royalty.” Together, Andrea and Grace were able to secure Michael a stable and loving home with his great-grandmother. “Grace was so happy and thrilled with the adoption. The conclusion of the case brought so much joy to her,” said Andrea. Almost five years later Grace can still hardly believe how lucky she was to find a pro bono lawyer. “When you wish for something for so long, when you get it, you can’t believe it.” Michael is now a third grader, at the top of his class. Andrea explains that “the best part of working with Philadelphia VIP is being able to provide legal services to someone who cannot afford them. It is like assisting someone to realize his dreams and making them come true.” Preventing Homelessness Lawrence* lives in South Philadelphia with his two children. Lawrence suffers from cancer and is disabled. His Social Security disability benefits are his only source of income. When Lawrence experienced difficulty making mortgage payments, Susan*, his fiancé, used her credit to help him refinance with a new lender. Soon after, she ended the relationship and allowed the mortgage to go into default. Lawrence learned of the scope of the fraud, including forging his name on two deeds giving her an interest in the property, when a foreclosure action was initiated against his house. Lawrence was matched with attorney David Dearden, a partner at Kalogredis, Sansweet, Dearden and Burke. David filed a Quiet Title Action against Susan and intervened in the foreclosure action. Eventually Susan provided a special warranty deed to Lawrence transferring her entire interest to him. Together, they filed a federal action against the mortgage company. Both the foreclosure action and the federal action were settled through an agreement that provided for a mortgage modification that reduced the principal balance and extended the term of the loan so that the required mortgage payments were affordable for Lawrence. “VIP went a long way to get my house back. I don’t know how to thank Dave or VIP enough,” said Lawrence. *Names have been changed and last names have been omitted to protect client privacy. Maintaining Income William* was married for over 22 years and suffers from bipolar disorder. William had recently been released from a psychiatric center after a breakdown. Upon release he was informed by the clinic staff that he could not return home and was given money for a train ticket to Philadelphia. William arrived in Philadelphia with no money and no place to go. Shortly afterward he was informed that his wife was filing for divorce. His wife's attorney then requested William to sign paperwork allowing his wife exclusive use of the marital home and freezing all shared assets. William lived in a series of homeless shelters in Philadelphia for most of the next year. Andrew Cole took on William’s case, working with William to reach an equitable division of his marital estate. William was forced “to rebuild his life from a very vulnerable position. No money, no job, and no family to help him,” said Andrew. "Andrew more than extended himself for me throughout the divorce proceedings, leaving no stone unturned,” said William. Ultimately, Andrew successfully finalized William's divorce in which the marital assets were divided in William’s favor. Andrew explained that he feels a personal “obligation to help others where he can.” He also noted that William “was always very appreciative of everything I did for him, and his perseverance is a testament to his character.” William says that with the help of Andrew, he now has a place to call home and is “leading a calm, contemplative life” as he rebuilds it. Promoting Community Economic Development Fun and Function LLC, a company run by Haskel and Aviva Weiss, designs toys and therapy products to build skills and empower children of every ability, including one of their children who has sensory processing disorder. They needed an attorney to help them on numerous legal issues, including employment agreements, patent searches, website disclaimers, and a frivolous copyright law suit from a larger competitor who threatened to put them out of business. Ryan Wertman, an associate at Blank Rome LLP, agreed to take on the case. Although some of the legal issues were out of Ryan’s practice area, he proactively sought help from other members of his firm to mentor him. "Ryan was an invaluable resource for us because we did not have the capacity for legal fees. He allowed us to grow and explore, be creative," said Aviva. After two years of working with Fun and Function, he did more than strengthen their business. He enhanced the lives of the Weiss family and the special needs children they are dedicated to helping. When they first became VIP clients, Fun and Function only had 3 people on staff and only about 100,000 units in sales annually. After receiving assistance from VIP, they now have 12 employees and celebrated almost a million products sold in 2009. Ryan is amazed and humbled by the growth of Fun and Function since his involvement with its legal matters. Of his experience as a VIP volunteer, he says "It is especially rewarding when you can assist a business with such a good mission that's helping people. It's been incredible to watch for an attorney." If you are interested in volunteering, please visit our website at http://phillyvip.org/content/volunteer-today! Case Statistics VIP’s volunteers provided more than 15,000 hours of volunteer service in 2011, in substantive areas from Adoption to Zoning. VIP’s pro bono attorneys and professional staff assisted in civil cases for more than 3,310 individuals and families who could not afford attorneys and whose cases would not have been handled by other public interest organizations. If billed out at a rate of $200 per hour, a low estimate in today’s for-profit legal market, these pro bono services would be valued at nearly $3,600,000. Case Type Adoption 262 Adv. VIP has a vast network of pro bono attorneys who care, and that allows someone seeking legal help to only have to contact one place in their time of need, rather than conducting a scavenger hunt. I like being a part of that network.” – Lindsay Willett 2011 Financials Fiscal Year 2011 Revenue IOLTA Philadelphia Bar Association Philadelphia Bar Foundation United Way Individual Campaign Annual Firm Appeal Corporate Campaign Board Contributions Foundations & Other Funders Government Grants Interest Income Name Change Escrow Signature Recruitment Events Tangled Title Fund Miscellaneous Fundraiser Total Revenue Fiscal Year 2011 Expenditures $92,250 125,000 68,000 31,330 5,730 58,850 23,890 10,100 770,147 81,309 1,352 3,769 5,710 19,817 6,367 399,220 $1,702,841 Salaries Fringe Benefits William Penn Technology Project Tangled Title Fund Litigation Expenses Name Change Publications Professional Seminars & Travel Insurance Development Awards & Recognition Marketing & Communications Equipment & Software Office Supplies & Postage Professional Services Printing Services, Stationary & Copies Membership, Publ. & Subscriptions Signature Recruitment Events & Trainings Fundraiser Office Move & Rent Miscellaneous Total Expenditures $752,743 137,760 442,172 18,178 1,873 5,499 4,592 11,386 19,500 360 15,805 4,531 2,186 19,508 4,723 4,911 3,219 64,766 81,750 15,128 $1,614,190 Say YES to VIP As a matter of principle and civic responsibility, Philadelphia VIP believes that access to the legal system should be ensured for all residents and businesses in Philadelphia. VIP’s goal is to raise one million dollars over the next three years in order to take a significant step toward realizing this vision. While there are a number of legal service organizations in the area, the demand for legal services far exceeds the total capacity of these groups. By using volunteer resources, Philadelphia VIP serves as the hub of pro bono legal services in Philadelphia and the organization in the best position to expand its reach and impact. Take advantage of this opportunity to invest in Philadelphia VIP. VIP can in turn say YES to clients to help them break the cycle of poverty or exploitation, overcome obstacles, and navigate complex issues. VIP can then do more to help low-income Philadelphians meet basic human needs, build assets and begin to pursue a promise of prosperity.
