President's Message...
You know summertime
is here because the Parade of
Homes has come and gone and
Bill and Shannon are working on
the SIBA Golf Outing. It is hard
to believe this year is half over.
Thank goodness, but I still don’t’
want to wish my life away.
This truly has been an
interesting year. A new President
was sworn in, an ice storm left
many without power for dayssome for weeks, a roller coaster
stock market, the bankruptcy RICK OAKLEY, CGR caps
of two major auto companies,
Creative Interiors/Re-Bath
record low mortgage rates, a
growing unemployment rate, and who knows what is going to
happen to our medical system. These are just a few of the most
memorable experiences in the first half of 2009.
We also had a great Parade. I salute the committee and all of
the builders, suppliers, sponsors, and advertisers that made this
parade successful. That was a job well done. Congratulations
to all of the award winners.
So, where do we go from here? Where will our next job
come from? How will the prospect know to call us? Have we
used the slower time to organize and systemize our business?
Are we leaner and meaner than we have been in years? Are we
contacting previous customers and asking if they know anyone
who might be interested in……….? Do we know our cost to
produce and our overhead? What about profit? How much
do we need? Are we happy with how we are perceived to our
prospects? Any changes to make in that area? Do we have the
right people in the right positions? Do we need to fire anyone?
Do we go back to when it was a much smaller and easier to
manage business? Do we take advantage of the slower time

Code Sends Wake Up Call To Builders
Builders Can’t Hit the “Snooze Bar”!

I highly encourage builders to open their
eyes to what’s happening within the walls of
their own industry. The rules you’ve played
by are changing without your input and, I
would say, because of lack of your input.
I think that builders would never accept
most of the new proposed regulations, unless
under the distress as this economy has
brought. These new rules are not in line with
a better housing industry, but builders have
been too busy surviving 2009 to notice.
More specifically, there is a new model
building code being reviewed for adoption in
Indiana, the 2009 International Residential
Code from ICC, the International Code
Council, practically without input from you whose livelihoods depend on selling a home.
Maybe more importantly, there is scant input
from the perspective of affordability.
Indiana is currently regulated by the
2005 Indiana Residential Code (IRC), which
was updated in 2007, based on the 2006 ICC
model code. Builders participated in that
update, and the process before that (2003),
and the process before that (2000).
As part of a small group reviewing the
2009 IRC, I can tell you, along with the
team members of “Vulture Two”, it’s a
much worse book for its users. Besides the
alarming lack of affordability, the references
to various chapters (forward and backward)
and unknown standards are far worse than
what we have in place. It’s getting close to
the point where the code book won’t tell
you how to build a house. I shudder to think
about those who have to learn from it, or
worse – teach it.
The standard for building in today’s
current code is effective, and in my opinion
it would be far more valuable to reject the
2009 IRC. Send the message to the State
and to ICC that Hoosier builders want them
to repair their tainted process before Indiana
considers another ICC product.
The building code should always be
determined mostly by those who use it.
The ones who, at the end of the day, have
to actually sell the house to make a living.
Not to say that other roles aren’t important,
but in most cases, services and products
provided to a new home are typically paid
if the home sells or not. It’s the home
builder whose risk is rewarded only when
the product is affordable enough to a buyer,
and today’s market is not the time add more
costly regulations.
By the way… what’s the rush for
adopting a new code? At the time Indiana’s
current review committee voted to adopt
the 2009 IRC, the book wasn’t even in
print yet! Notwithstanding, stacks of code
amendments are being approved by the
review committee before builders have
an opportunity to review and digest the
code, the amendments, and their impact on
the code - or even purchase a code book.
What’s the rush? Heck, no one ever gave
a reason to adopt the new code – better
than insurance rates, or worse - “it’s tied
to stimulus money”. It makes it seem like
there is something important we don’t know.
The last time we fell for this line, was during
the push to intensify the energy code to
qualify for federal grant money. It turned
out that two other northern states shared
in the exact same grant, and they weren’t
going to change anything. In fact, it was
reported their insulation requirements were
less stringent than Indiana’s!
As a general rule, Indiana should never
review an early printing of any model code
without ample time for all users to digest its
impact fully. Also, new model codes should
be available at least 1-2 full years for the sole
purpose of educating builders on its impact,
so they can know the code. The final vote
for the 2009 IRC was cast September, 2008.
And knowing the code means having more
than a few people in the entire state who
know what’s in the code.
The bottom line is the average Hoosier
builder hasn’t had the chance to review the
differences between the current IRC and
the 2009 model code, or compare costs, to
make a good decision about which code
to pursue. I’ve learned the hard way that
a slower market translates into less time
available for builders. They happen to be
doing more work in their company, and have
less time available for code review. This is
part of surviving 2009, and everyone who
needs the housing market to improve should
appreciate, if not cater to this point.
I can see Roy Foster rolling over now
asking, as he once said, “Does someone get
a trophy for being first to adopt a new code?
Heck, I’ll buy ‘em a trophy for being last.
It’ll be better for the folks trying to buy their
first home.”
I hope I’m wrong, but I believe our
average builder’s fair and reasonable chances
in this code process are “slim and none”. And
Slim just voted for an amendment placing
overly restrictive seismic requirements for
southwestern Indiana.
At the June meeting, Indiana’s Review
Committee adopted fire sprinklers into
the code, not as a requirement, but as an
option. An option! This does more than
make sprinklers legal (they’ve always been
legal); it makes the code a menu. It’s like
wheelchair ramps – they’re legal, but not
required, so they’re not in the building code.
But if you’re going to install one, you have
to take into account its slope – something
not taken into account when they stepped
onto this slippery slope with sprinklers.
Easy, Roy!
The reason I brought Roy Foster’s name
into this is because he might be the perfect
example of a home builder who sat on the
sidelines of the code process too long. When
he saw what was coming his way, he got
involved. I still have the fax message he
received that told him to get off his butt and
do something about it. He got the message.
Boy, did he!
The reason the first few steps toward
unaffordability have been taken within this
new proposed code is that builders, by and
large, are not participating in the process.
I don’t think today’s home builder would
read the book, and agree to it. However
unreasonable the timeline, I can only say to
SIBA members – “WAKE UP! You’re about
to be run over!”
Perhaps I can’t wake anyone up, …
to start driving to Indianapolis for code
meetings. Maybe I can’t convince anyone
to scour the pages of the building code and
examine its increase in cost vs. safety. But,
believe me, someone is. And being popular
at national code meetings is having more
impact than the betterment of your building
industry. But maybe I can get someone to

be held at Rolling Hills Country Club on
Monday, July 13, 2009. Openings for
foursomes are still available in BOTH
the morning and afternoon sessions. In
previous years, the morning session has
fielded as many as 17 foursomes for the
7:30am start.
The golf committee has, once again,

Then What?
Congratulations to everyone involved in
the 2009 Parade of Homes! Although the
market inevitably drove the number of entries
downward, the overall event was a huge
success for those in it, and perhaps more.
I don’t think we’ve ever heard the
builders describe the traffic using the word,
“excellent” as this year. If you visited any
of the homes, and witnessed the traffic for
yourself – there were buyers in the crowd.
Hopefully, the high number of interested
visitors will evolve into actual sales.
Every year the SIBA office is contacted
by people who plan to visit Parade homes.
And true to form, there was a strong demand
for maps, books and website information.
Along with MLS statistics, the case can be
made that buyers may be much closer to
returning to the market.
Of course the highest-end homes attracted
the lion’s share of the public’s interest.
However, there was plenty of audience at
the lower-end homes too. Perhaps this is
more attractive to the respective builders as
the traffic included more potential buyers.
More than one builder commented visitors
were going to buy something – might not be
theirs, but they’re going to buy something.
The demand for new housing has been
pent-up long enough. And for sure, builders
and consumers both have been frustrated by
this market long enough. This year’s Parade
of Homes seemed to come at exactly the
right time. The attitude of Parade visitors
showed us that, and the fever for something
new is starting to rise again.
Hopefully, the Parade traffic that came
to houses during Parade week can be turned
into actual sales this summer. As much as
we all hate to look to national trends for
impact on the local market, the national
experts are expecting 2009 to have sporadic
increase in new home sales, but by 2010, the
market should be steady. If you can make
it until then.
Parade Builders should be sure to
return their entry and award signs at their
first convenience. And be sure to submit
your evaluation for the committee to begin
working on the 2010 Parade of Homes.

Year Earlier
In the 2009 Legislature, the Model
Home Act was made retroactive to benefit
builders this year (for houses assessed
2008-pay-2009). This law makes builders
eligible to deduct 50% of the improvements,
not the land, for property tax on up to three
model homes.
THIS LAW WAS PASSED BECAUSE
OF THE BUILDERS ASSOCIATION!
Bill Fluty, Vanderburgh Auditor, who
was instrumental in getting this law passed
for this year. In a helpful memo to SIBA
Builders, Fluty explained HB 1071 made the
Deduction for Model Residences retroactive
in 2008-Pay-2009. His office is waiting for
the software changes for applications made
this year. The spring installment should be
paid as billed and a corrected bill fall bill
will be sent.
The new law passed last year by the
General Assembly will save thousands
for home builders. It allows builders an
exemption of 50% of the assessed value
of the structure only, for up to three
model homes.
Important points about the Exemption:
·Exemption is 50% of the assessed
value for the structure only - does not
include land.
·Builders can claim the exemption for
up to three homes at a time.
·Applies to “model residence”,
consisting of a Single-Family residence,
townhouse, or condo unit.
·The owner’s regular office is considered
not a model residence, but this does not
include simply using a garage or other
space to store or display materials used
to promote the property, or as a space
for meetings with prospective buyers.
·Builders must file State Form 53812 at
the County Auditor’s office.
·The deduction is available on a
particular model residence for up to 4
assessment dates.

product is required by code, you can let your
sales staff go. They’ve become order takers.
This should be at the forefront of all minds
involved with developing any regulation.
Some at the meetings have reported there
is a sprinkler manufacturer voting on the
committee. Have we learned nothing from
the tainted meetings at the national level?
During code development discussions,
it’s easy to paint the picture as builder
vs. issue. In reality, it’s homeowners vs
issue. An old story for developers too. The
new homeowners have no voice, because
they aren’t at the table for meetings and
discussion. They don’t want many of these
“safety features” that don’t really feature
more safety. And if they are required to pay
for it…… well, the math simply won’t allow
the loan to be made.
There may be more injuries-falls down
stairs than fires. Would it make sense to
require each new home to have an elevator?
Or limit them to single-story? I’m sure
someone would try to use a cost-analysis to
convince rule makers that we’d have fewer
trips to the emergency room, and perhaps
even fewer emergency rooms needed. But
what good is the best idea if no one can
afford to buy it?
So this really comes down to this – dogooders (term includes manufacturers and
know-it-alls), want to change someone else’s
lifestyle, so they intrude on the code process
as a means to access control. If allowed,
the cost of new homes soars to include their
input. Meanwhile, the misguided actions
don’t address real problems. Older homes
continue to leak heated air. Existing homes
with no HVAC maintenance continue to
get the carbon-monoxide calls. Costs to
improve older homes continue to exceed
the cost of demolishing and rebuilding them
more efficiently.
As the current housing market begins
its slow crawl forward, builders need to
realize that starting back up to build homes
is not enough. You have to work for your
industry, almost as much as you work for
your company, in order for your company
to move forward. You always did. But
someone probably did it for you – until now.
If you think someone else is doing it on your
behalf now, think again.
Using foreclosed and distressed sales
as comparables with appraisals on singlefamily homes without adequately reflecting
the differences in the condition of the
respective properties is needlessly driving
down home values, according to the National
Association of Home Builders (NAHB).
“Any home buyer can recognize the
difference between a well-kept home and
a distressed property that is damaged or
not properly maintained. So it only makes
sense that an appraiser should be required
to consider the overall condition of a
property and the specific factors related to
a foreclosure or distressed property sale
when selecting and adjusting the value of
comparables,” said NAHB Chairman Joe
Robson, a home builder from Tulsa, Okla.
Appraisers are often only required to
conduct exterior inspections of properties
that are being used as comparables because
they are normally unable to enter these
homes and examine their interiors. Too
often, properties that have been subject to
foreclosure or distressed sales have issues
related to deferred maintenance or internal
damage that an external inspection simply
cannot reveal.
“While most appraisers do a fine job,
there needs to be proper regulatory guidelines
for those who use distressed or foreclosed
properties as comparables when determining
home values,” said Robson. “It is essential
that appraisers have the proper experience
and guidance to accurately assess values in
distressed markets.”
In neighborhoods where comps include a
large number of short sales or foreclosures,
appraisers should have the option of
expanding the geographic area or extending
the time frame for eligible sales to get a more
representative basket of the value of homes
sold in the area, Robson added.
Currently, improper or insufficient
adjustments to the comparable values of
foreclosed and/or distressed homes often
results in the undervaluation of new sales
transactions.
“This practice must be corrected because
it contributes to the continuing downward
spiral in home prices, forestalling the
economic recovery,” said Robson.

who completed the course work required
to earn the Certified Green Professional
(CGP) designation. CGP graduates have
knowledge of the best strategies for
incorporating green building principles
into homes.
The CGP program is administered by
the Indiana Builders Association (IBA)
Housing University in conjunction with
the National Association of Home Builders
(NAHB) University of Housing.
In three days of course work, the
CGP curriculum incorporates a variety of
information tailored to green building and
business practices. The CGP curriculum
incorporates training by leading building
industry practitioners and academics on
a range of topics, including strategies for
incorporating green-building principles
into homes using cost-effective methods of
construction, and how green homes provide
buyers with lower maintenance and good
indoor air quality. Techniques are also
discussed for competitively differentiating
your home products with increased indoor
environmental quality as well as energy and
resource efficiency.
CGP program graduates are required to
maintain their designation by completing
12 hours of continuing education every 3
years a portion of which pertain to green
building activities.

SIBA SUPPORTS SECRET BALLOT
IN LEGISLATION
A delegation from southwestern
Indiana, including SIBA representatives
recently traveled to Washington, DC to
meet with Senators Richard Lugar, Evan
Bayh, and Congressman Ellsworth about
the Employee Free Choice Act (EFCA),
also known as “Card Check”. Specifically,
the delegation was sure to point out
reasons to keep the secret ballot in the
process of unionization.
Earlier this year, SIBA specifically
adopted a policy that neither employers,
nor labor unions, should ever attempt to
deny workers the right to a secret ballot
on an issue so integral to their daily lives
as workplace unionization. Maintaining
the secret ballot is the best possible way
to protect the employees’ rights to state
their opinion on unionization.
