Since Joint Government Meeting that time, the City of Iowa City has contributed $6,000 to the project and Tuesday, Jan 26 at 6:30p.m. City Council Thursday, Feb 4 at 4:00p.m. City Council Strategic Planning & Goal Setting Session (continued) Coralville $4,000. The County Auditor is asking North Liberty to consider a contribution, but did not specify an amount. If the Council is inclined to support the program, I would recommend a contribution of around $3,000. County Auditor Travis Weipert will be at the meeting to address questions from the Council. To date, we have awarded $5,620 in social service funds and have a balance of $5,380 remaining in this budget. Penn Street ICAAP Project Agreement The Penn Street ICAAP Project bid letting was held at the IDOT Offices in Ames in December (because it is partially funded by federal dollars). The low bid was received from Metro Pavers in the amount of $1,905,259.45. The IDOT and Shive Hattery have reviewed the bids and both are recommending approval of the bid and contract (included) with Metro Pavers. To the right is a summary of the other Penn Street ICAAP Project Bid Results Metro Pavers, Inc. Streb Construction Co., Inc. Croell and Subsidiary Horsfield Construction, Inc. $1,905,259.45 $2,024,670.15 $2,038,184.38 $2,210,994.73 Engineer's Estimate +/- Engineer's Estimate $1,939,141.00 ($33,881.55) bids received as well as the engineer’s estimate: Misdemeanor Penalty Ordinance, 3rd and Final Reading City Attorney Peterson previously mentioned this ordinance and the concern regarding a misdemeanor punishment for a City Code infraction being possible jail time. The proposed ordinance eliminates jail time as a possible punishment, but stills allows for a fine if a person is convicted of a simple misdemeanor. Staff recommends approval of this ordinance. Urban Renewal Plan Amendment In December, the Planning Commission met to discuss the plan amendment (required by state code) and we hosted a meeting to allow the county and school district to comment on the amendment. The Planning Commission is supportive of the amendments and related projects – they recommended approval of the plan update – and representatives from the county and the Clear Creek Amana School District did not attend our consultation meeting or provide any written comments. Tuesday’s agenda includes a public hearing regarding the amendment as well as a resolution updating the urban renewal plan. The proposed resolution will add the properties in question into the urban renewal plan, later allowing the properties to be added to a TIF district so that a new base tax value can be established and eventually incremental taxes generated. In other words, the urban renewal plan update is the first of several steps that must be approved before the Council can consider any type of incentive agreement; it does not lock the City into providing any type of assistance, only allows the action to happen in the future if desired. I believe incentivizing these businesses is consistent with our Economic Development Strategy (included). Thus, I am recommending approval of the urban renewal plan amendment resolution. If approved, I will continue to work with the businesses on the terms of an incentive agreement. published January 8, 2016 •page 2 Site Plan Timeframe Ordinance Amendment, 1st Reading Currently, the Zoning Ordinance does not provide for an expiration date for approved site plans. This has presented challenges in the past when an older site plan that no longer meets current codes and regulations is resurrected. In order to avoid this confusion and potential issues in the future, staff is recommending an amendment to the code providing for an expiration date of 18 months after a site plan is approved, if permits are not obtained. Additionally, the amendment states that the development must be substantially completed within 36 months from when the site plan is approved. The ordinance does allow for extensions to be granted, for example for larger developments that cannot be completed within the time frames or if other extraordinary circumstances apply. Staff recommends approval of this ordinance amendment. Assessment Resolution Staff is seeking approval to file a lien on a property for failure to pay lawn mowing fees in the amount of $600. If approved, staff will file the lien and the fees collected through the property tax payment system. North Liberty Road – Dubuque Street Project Several easements and a small property acquisition are needed for the North Liberty Road/Dubuque Street construction project. The easements on the agenda include a temporary construction easement and a storm sewer and drainage easement on the Scanlon property, adjacent to North Liberty Road. Also needed is a small parcel of property, which is defined in the property deed, for right-of-way use acquisition. Councilors present: Chipman, Donahue, Hoffman, Pollock, Wayson. Others present: Ryan Heiar, Scott Peterson, Dean Wheatley, Mary Byers, Jim Sayer, Ron Bandy, Andrew Brown and other interested parties. Approval of the Agenda Chipman moved, Pollock seconded, to approve the agenda. The vote was: ayes Donahue, Chipman, Pollock, Hoffman, Wayson; nays—none. Motion carried. Consent Agenda Hoffman moved, Wayson seconded, to approve the Consent Agenda including City Council Minutes; Regular Session, December 8, 2015; Claims; November Revenues. Public Comment Ron Bandy, 25 North Dubuque Street: Thanked the Mayor and City Council on their great job at the last two council meetings on how they handled the gun ban issue. He also gave the Council some ideas on a possible dog park in North Liberty. Andrew Brown, 647 Molly Drive: Would like to have a liaison between the Police Department, Schools, and the citizens to keep the citizens updated on current things happening within the City. City Engineer Report Kevin Trom Reported on Dubuque Street North Liberty Road Project the City will be receiving bids in February with work starting in March. Staff is working on the 28E Agreement for the project. Bids were received on the Penn Street ICAD Project last week from the DOT and will be on the agenda the first meeting in January for approval with a late April start date. Water Tower One Demolition Project was informally bid and is on the agenda tonight. There was a bid opening today for the Water Nano Filtration System and will be on the agenda at the first meeting in January. The Penn Meadows Park Concession Stand Building arrived and set last week. Grading and paving will be later this winter. City of North Liberty – 2015 Page: 1 Updated: December 17, 2015 3:00 p.m. City Attorney Report Scott Peterson reported that he is working on an addendum agreement with Windstream/McLeod to allow them to expand their area of work. As Windstream continues to work within North Liberty, staff will be discussing a more comprehensive agreement. Peterson is waiting on one more agreement for the North Liberty Road Project and hopes to have it for the first meeting in January. City Planner Report Dean Wheatley reported on his monthly meetings and has finished up the GIS Storm Sewer Map, and continues to work with Guy Goldsmith, Park Superintendent on the Parks Plan. There are two Good Neighbor Meetings scheduled next month near high density residences which staff had to send out 168 notices to people that live within 200 feet of the developments. Wheatley showed a map of the cooperate city limits of North Liberty from 1972 and today. City Administrator Report Ryan Heiar reported that the Legislative Day this year is March 1st and wanted the council to let him know if they wanted to go and staff will get them registered. The Chamber’s annual trip to Washington DC is February 28 thru March 1st and Heiar will get the information to the Council on what they want discussed with the Council. Goal setting session will be January 14th at 4:00 p.m. and will be a four hour session. The City is still working on locations for a solar energy program. This will be a substantial savings to the City thru the Power Purchase Agreements. Mayor report Mayor Neilson worked at the Holiday Food Distribution at the North Liberty Food Pantry which served about 40 people. Penn Elementary School had the ribbon cutting for the new addition which is now completed. Neilson watched some of the placement of the new Penn Meadows concession stand and was very impressed. The Mayor was interviewed on KCJJ last week. Community ID Program There were a lot of questions from the Council on this item, a request from Johnson County to subsidize the program, and it was the consensus to table until next meeting. Chipman moved, seconded by Pollock, to table this item. After discussion, the vote was: ayes—Donahue, Chipman, Hoffman, Wayson, Pollock; nays—none. Motion carried. Water Tower Number 1 Hoffman moved, Wayson seconded, to approve Resolution Number 15-140, A Resolution approving the contract with Iseler Demotions, Inc. for demolition of Water Tower Number One in North Liberty, Iowa. After discussion, the vote was: Donahue, Chipman, Hoffman, Wayson, Pollock; nays—none. Motion carried. Donahue moved, Hoffman seconded, to approve Resolution Number 15-141, A Resolution approving the Sale of Property owned by the City of North Liberty and authorizing the Mayor to sign and the City Clerk to attest to a Quit Claim Deed for the conveyance of the property. McLeod USA Agreement Amendment Pollock moved, seconded by Hoffman, to approve Resolution Number 15-144, A Resolution approving the First Addendum to the Tower and Ground Lease with Option between the City of North Liberty and McLeod USA Telecommunications Services, LLC that establishes the terms and conditions under which fiber optic cables will be installed in the City of North Liberty, Iowa. Old Business Pollock asked if there were any other little parcels owned by the city that should be considered for sale or transfer to adjacent residents. Wheatley replied that there were no others that he is aware of. There was a ceremony on behalf of Coleen Chipman’s last meeting after serving eight years on the North Liberty City Council. Mayor Nielson read a proclamation for her. Oath of Office: Sayre, Donahue, Hoffman were sworn into office for their terms ending in January 2019. Describe the program/project. We purchase 150-200 kites for kids to fly for free, along with pinwheels and bubbles for younger children from about noon to 2 p.m. on a Saturday in April (Child Abuse Prevention Monty). In 2015, purchasing 150-200 kites just for the North Liberty event cost more than $1000, as many kites were priced at about $6 (ranging upward to $15 or $20). Additional funds raised were used to purchase pinwheels, bubbles, sidewalk chalk, healthy snacks (also free) and yard signs to promote the event at its location. Attendance at the NL event last year was between 150 and 200 parents and children We were unable to secure a city park last year for the North Liberty event, so it was held at North Central, and it was a good location with few trees. We were pleased members of the police department (and Chief Venenga) arrived to help kids assemble and fly their kites. 2. What specific need in the community is the Agency addressing with this program/project? (Describe the extent of the problem, and the major factors in the community contributing to the problem.) Raising awareness of Child Abuse Prevention programs in this area and remembering victims to prevent child abuse. Across the United States, 1,650 children died of abuse or neglect in 2012. In Iowa, 12,267 children were abused in 2013. In Johnson County, there were 672 reports of child abuse. Child abuse prevention goes beyond investigations, however. It begins with empowering parents to understand that they have support systems they can turn to when parenting becomes stressful, and relies on communities to provide family-friendly activities (such as a kite festival) to bring kids and parents together for positive interactions. 3. How many North Liberty residents will you be serving with this program/project? 150-200 attended the North Liberty event last year, in 2015 4. We had a few people travel in from out of town for the event, but we estimate 95 percent of attendees were from North Liberty 6. How will this program/project benefit the community of North Liberty? Programs like this bring families in our community together to build connections, make new friends, and provide an opportunity to show residents that the city cares about providing activities to keep children and families engaged. 7. Describe your efforts to outreach to residents of North Liberty in providing accessibility to your programs and services. The program was first held in Iowa City only for the first two years, and in its third year, in recognition of North Liberty having such a high percentage of kids ages 0-5, our partnership (consisting of volunteers and area social service agencies) decided to expand into North Liberty. The NL event was a tremendous success. 8. If this funding is not available, describe the impact of that decision on the Agency and the program/project these funds would have supported. We may not be able to host the event if we are unable to raise enough money to purchase kites and free snacks, which represent the largest portion of our budget. North Liberty’s location and business climate are the principal means of attracting and retaining high‐quality jobs; however, in some cases the City may determine that development assistance is necessary and appropriate to attract businesses that are anticipated to have a significant, lasting benefit to the City. When such cases arise, the City will use the strategy below as a guide for incentivizing business development. Purpose of Strategy The purpose of the Economic Development Strategy is to provide guidelines for assisting business in the expansion and new construction of high‐quality industrial or commercial facilities, where such assistance will boost employment opportunities and/or tax base within the City. Strategy The strategy is to utilize a portion of additional property taxes paid (incremental taxes) by new or expanding businesses through one or more of the following incentives. The eligible business and the City will enter into an agreement that specifies the type(s) of economic development support that will be provided by the City: • Providing for the rebate of property taxes in Urban Renewal Areas Utilizing Tax Increment Financing. • Acquiring and/or disposing of land used in an economic development project. • Constructing public infrastructure and improving existing public infrastructure in support of an economic development project. • Performing site improvements such as grading, utility connections, railroad siding, etc. which make disposition of land parcels more marketable and competitive. • Providing up front economic development assistance through loans or grants for projects of extraordinary employment and/or property value expectations. The City Council may also consider providing other additional incentives as provided by law, including, but not limited to: • Tax abatement • The reduction or waiver of connection or other standard City fees. • Access to and staff resources for seeking economic development incentive through state and federal programs. City of North Liberty, Economic Development Strategy Approved April 10, 2012 1 Criteria The City Council shall review proposed use of incentives based on the following criteria: • The amount of investment in new facilities and/or renovation of existing facilities, as well as the type of facility being constructed (i.e. masonry, green elements, etc.). • The number of jobs created and/or retained. • The average wage as it relates to the respective industry and/or the region. • The extent to which investment in public infrastructure is necessary to accommodate the project and is determined to be a good investment for the City. • The extent to which the project prevents or eliminates blighting conditions contributing to urban distress. • The rationale for the incentive is that the project would have been unlikely to occur without its provision. • The rationale that the project and use of incentives serves a public purpose. The City Council reserves the right to consider each application on its merits and may approve or deny Tax Increment Financing and other incentives in any and all cases. Small Business Support The City of North Liberty has established a revolving loan program in order to expand and maintain its economic base by assisting new and expanding small businesses. The North Liberty Small Business Development Program is intended to provide supplemental financing in support of new or expanding businesses located within the City of North Liberty. The Program will make loans for the following purposes: • • • • To increase employment opportunities by increasing the number and types of businesses in the City of North Liberty. To offer financial assistance that will promote the retention and expansion of existing businesses. To increase the local property tax base. To diversify the community’s economic composition by encouraging unique or essential business startups and expansions. The real property (the “Deleted Property”) legally described on Exhibit A hereto, is by virtue of this Amendment, deleted from the Urban Renewal Area. The Deleted Property will also be deleted from the ordinance providing for the division of property tax revenues in the Urban Renewal Area. 2) Addition of Property. The real property (the "Property") legally described on Exhibit B hereto is, by virtue of this Amendment, being added as the January, 2016 Addition to the Urban Renewal Area. With the adoption of this Amendment, the City will designate the Property as an economic development area. The Property will become subject to the provisions of the Plan for the Urban Renewal Area. IT IS HEREBY AGREED AS FOLLOWS: For the sum of one dollar plus other valuable consideration, the receipt of which is hereby acknowledged, the Property Owner hereby grants and conveys to the City a permanent Storm Sewer and Drainage Easement (Division I) and a temporary construction easement (Division II) for the public purpose of reconstructing and maintaining North Liberty Road and related infrastructure from the intersection of North Liberty Road with Dubuque Street, including storm sewer, utilities, and storm water management facilities (the “Project”), under, over, through and across the areas described in the exhibits, which are attached. Additionally, as part of the consideration for this agreement, A. The Property Owner will not be assessed for any costs for the design and construction of the Project, plans for which are on file at City Hall, nor shall the Property Owner be responsible for the initial costs of constructing or maintaining the Project; however, connection fees, frontage fees, or other typical and customary fees will be collected by the City at the time any part of the property is developed. B. The City shall be responsible for the recording of this Agreement and payment of the costs for the same. C. The City shall indemnify and hold harmless the Property Owner, its successors and assigns, from and against any loss, damage, expense, cost, third party claims, causes of action, or other liabilities arising out of, or purporting to arise out of, the City’s exercise of the rights granted under this Agreement. This indemnification and hold harmless shall include, but is not limited to, reasonable legal fees and cost of defense incurred by Property Owner. DIVISION I – PERMANENT EASEMENT Further, the Property Owner and the City agree that: 1. Property Owner hereby grants and conveys to the City a permanent easement for the purposes of excavating, installing, maintaining, and using of such storm water lines, pipes, mains, conduits, culverts, and overland drainageways, along with all necessary appurtenances in connection with said use, as the City shall from time to time elect for conveying storm water; and also a right of way, with the right of ingress and egress thereto, over and across the areas designated as “Storm Sewer and Drainage Easement” as depicted on the attached Exhibit A-1 and described on Exhibits A-2 through A-4, and referred to herein as the “easement area.” 2. The City has the right to construct and maintain the Project with such structures as the City shall from time to time elect. The City shall promptly backfill any trench made by it, and repair any damage caused by the City within the easement area. 3. Property Owner reserves the right to use said easement area for purposes that will not interfere with the City's full enjoyment of the rights hereby granted, including, but not limited to, agricultural purposes; provided that the Property Owner shall not erect or construct any building, fence, retaining wall, or other structure; plant any trees; drill or operate any well; or construct any reservoir or other obstruction on said easement areas. Further, the Property Owner shall not diminish or substantially add to the ground cover or otherwise landscape on or over said easement areas. Fences and trees placed in the easement area, with or without City approval, may be removed by the City without compensation or replacement. Notwithstanding the provisions above, fences may be placed in the easement area, so long as the property is used for agricultural purposes and until said agricultural use is discontinued for a period of twelve (12) months or more. 4. The City shall not fence any part of the permanent easement area, unless otherwise agreed in writing by the parties. 5. The Property Owner shall not change the grade, elevation or contour of any part of the permanent easement area without obtaining the prior written consent of the City Engineer, which consent shall not be unreasonably withheld. 6. The City shall have the right of access to the permanent easement area and have all rights of ingress and egress reasonably necessary for the use and enjoyment of the permanent easement area as herein described, including but not limited to the right to remove any unauthorized obstructions or structures placed or erected on the permanent easement area. 7. City covenants and agrees to remove and stockpile existing topsoil from area to be excavated, to be used in the event of any repair. Following installation of the improvements described herein, all areas within the easement area which are disturbed will be graded to form a uniform slope, and topsoil shall be replaced and respread over disturbed areas, thereby restoring said area substantially to their prior condition, with the exception of the replacement of trees, shrubs and brush. DIVISION II – TEMPORARY EASEMENT The Property Owner and the City further agree that: 1. The temporary easement area being granted and conveyed by this Agreement is depicted on Exhibit B-1 and legally described in Exhibits B-2 through B-4, which is attached and fully incorporated herein, and referred to herein as “temporary construction easement area.” 2. Property Owner does hereby grant and convey to City a temporary construction easement for the purpose of facilitating the City’s construction of the Project described above. 3. The Property Owner shall not erect any landscaping, fences, or structures over, under or within the temporary construction easement area during the construction of the Project, without obtaining the prior written approval of the City Engineer. 4. The Property Owner shall not change the grade, elevation or contour of any part of the temporary construction easement area without obtaining the prior written consent of the City Engineer during the same timeframe, which consent shall not be unreasonably withheld. 5. The City shall have the right of access to the temporary construction easement area and have all rights of ingress and egress reasonably necessary for the use and enjoyment of the easement area as herein described, including but not limited to the right to remove any unauthorized obstructions or structures placed or erected on the easement area. 6. Following the construction and installation of the Project and final acceptance by the City, the City shall restore the temporary construction easement area to substantially the same condition as existed prior to the commencement of construction operations. 7. City covenants and agrees that driveways, fences and other site features that are removed or disturbed shall be replaced by City consistent with the final construction plans, which the City Engineer shall make available to the Property Owner upon request. City covenants and agrees that existing underground drainage tiles that are removed or disturbed shall, to the extent reasonably possible, be replaced by City. City further agrees that all grassed areas disturbed by the construction shall be seeded within a reasonable time after construction is complete. Property Owner agrees that trees, shrubs and brush that are removed or disturbed will not be replaced by City. 8. Many thanks to the Iowa City Noon Rotary for the members’ work on the car raffle in 2015. The raffle was a great and successful partnership and showed the incredible support the Rotary gives to libraries and literacy. They kindly donated $6000.00 to the North Liberty Community Library (NLCL) from the income of the raffle. In addition, Scheels All Sports invited the NLCL to attend their Day of Giving at the end of December and awarded us with a $3000.00 donation check. The library hosted 369 programs in-house and out in the community from July 1 to Dec. 31, 2015 and had 6842 participants at those programs. This month, you should all be receiving your annual Friends of the Library contribution forms in the mail. I hope you’ll consider joining the Friends and supporting the library. Programming, Events and News Starting this month and going through April 30, the library has Library Lovers Club program going on. Similar to frequent shopper programs in local businesses, patrons of all ages can pick up a card that staff will initial each time they visit the library. After 10 visits, they’ll have a chance to earn a small prize ranging from a cool cup that changes colors with cold liquid to cocoa packets. Visitors will roll a single die and they get a prize from a bin with a corresponding number. If they are lucky enough to roll a six, they get a wild and can choose from any of the prizes. Fifteen families attended our Gingerbread House decorating program in December, which equaled about 50 people cozily making houses in in two of our meeting rooms because we also had a Friends of the Library Cookie Walk fund-raiser at the same time. It was a very busy day at the library. Fun was had by all. We also held our Gingerbread House contest with pictures posted on Facebook. We hosted a small group of seven elementary kids at Science Monday on December 7 where they made polymer gloop using glue and Borax. Beginning in January, Science Mondays are turning into Maker Mondays. There won’t be a set theme each time, but instead we will offer educational toys for grade school age kids to play with and create gadgets and robots. The library also hosted a Downton Abbey Tea and had fourteen adults attend. They watched a recap of the last season and preview of the final season, had a trivia contest, and had an afternoon tea with scones and sandwiches. Elaine, our Adult Services Librarian, is also seeking to expand our adult programming to include programs for adults with special needs. She has been talking with representatives from Goodwill and hopes to start this by summer. Join us on January 24th for a discussion with author Zachary Michael Jack about his latest novel, Corn Poll: A Novel of the Iowa Caucuses. This promises to be a very interesting program. The Ranshaw House at 515 Penn Street required boiler preventative maintenance by the Parks Department. We removed snow and ice from City parking lots, sidewalks and trails this past month. We picked up trash and pet waste stations as needed. With the mild weather this past month there was considerable usage of the dog stations. We maintained equipment as needed this month. We performed preventative maintenance and repaired winter equipment as time permitted. We continue to prepare for the upcoming growing season by performing preventative maintenance and repairs to ball field maintenance, mowing, trimming and landscaping equipment. The Tree City USA recertification application was received and approved by the State Forestry Department. We have received this award as a Tree City USA for the past 21 years. This helps us obtain other tree grant funding. Parks staff attended diversity training on December 16th. We were selected to receive a $1000 Trees Please Grant from MidAmerican Energy to plant additional trees at West Lakes Park next season. Three options/proposals were presented to the Parks Board for new playground equipment at Beaver Kreek Park this past month. The equipment has been ordered and will be here for installation this upcoming spring/summer. We continue to work on the Parks Master Plan with City Planner Dean Wheatley as time permits. The Penn Meadows Park Restroom/Concessions facility building arrived on December 15th and was completely installed by December 19th. In my opinion we have a very nice building. I would be more than happy to give anyone a quick tour of the building. December is a busy month in registering for programs that begin in January. Net revenue for December totaled $89,580.75. Various meetings took place at the beginning of the month such as the Joint Park Board / City Council Park Plan work session, FY budget meeting with City Administration, Rec Staff meetings, ICCSD meetings, Senior Council discussions and assisting Nick with Beat the Bitter event. As the holidays approached, this is the time that we scramble to make sure Part-time staff are scheduled when facility is open versus time off requests and holidays that FT Staff have off. This continues to be a challenge as we have part-time staff that either have other jobs, school, and number of staff to cover all hours of operation. We were busy over the holidays as many drop-ins for pickleball, basketball and track & weight/exercise area increased as patrons had time off. Special events included the Vendor Fair/Breakfast with Santa event and a Bingo Night. We had 28 vendors selling products and around 350 participated in Breakfast with Santa. Bingo Night had 24 participants. Pool Update: Pool use also increases over the holidays as we offer additional open swim hours and water aerobic classes and lap swimming continue on their normal schedules. We are cleaning storm intakes after rain events. Staff has been patching streets, blading shoulders and gravel roads. We have been cleaning low flow sewer mains before winter. Street Department staff has attended all safety meetings. Repaired and installed street signs in new developments. We have done snow and ice removal, this last storm has been hard to get removed. We had rain, sleet and then snow with cold temps. I have attended several construction meetings on all of our projects. We put up Holiday lights. Staff has been working on city owned street lights. Staff has been cleaning our shop area up. I have been working on budget items and having meetings with Ryan. Don Colony Street Superintendent Water Pollution Control Plant Iowa TO: City Council, Mayor and City Administrator FROM: Dave Ramsey DATE: January 4, 2016 SUBJECT: December 2015 Water Pollution Control Plant (WPCP) Report The following items were worked on at the WPCP during the month of December: 1. All scheduled preventative maintenance at the plant and lift stations was completed. 2. Staff stayed very busy with numerous operational jobs throughout the month. 3. This month’s safety training included ladder safety, driving safety course, and respiratory protection face mask testing. 4. We held our 6th construction meeting on the WPCP Phase 2 project. Items being worked on at the plant now are: • Contractors are setting the forms for the new solids handling area. • The new garage is 90% done with only a few items to be completed. • Staff is working with the contractors daily to make the entire process run smoothly without interfering with day to day treatment plant operations. • The east side of the MBR building expansion outside walls are being built. • New operational structures on the north side of current aeration basins are in various stages of completion. • The continued rain events have substantially slowed different areas of construction around the facility. 5. We had our laboratory certification inspection by the State Hygienic Lab and the IDNR. This was a three hour inspection detailing all lab operations. We are now certified to perform all wastewater testing that is required in our State of Iowa Permit and several new testing parameters for upcoming new regulations. This lab certification saves the wastewater department more than 10 thousand dollars in contractual lab fees. 6. One cost saving initiative for my department was that we needed 10 stainless steel shafts for two pieces of equipment. The manufacturer wanted $300 per shaft plus high shipping costs. We had a local machine shop make them for $87 each, which was a saving of over $2100 and no shipping costs. We had to re-read approximately 42 accounts. We delivered 184 shut off notices and shut off approximately 65 overdue accounts for nonpayment last month. In the month of December we treated a total of 32,325,000 gallons of water, our average daily flow was 1,043,000 gallons a day, and our maximum daily flow was 1,286,000 gallons. The total for the month was about 1.91% higher than last December. The Booster Station has been up and running for the last several weeks without any problems, we are still waiting on a new replacement jockey pump, hopefully it will arrive in the next week or so. We installed a new sink and hot water heater at the Booster Station and are repairing parts of the drywall were electrical conduit had to be removed, when that work is finished and the new jockey pump has been installed we will start painting all of the new piping, walls, and the floor . We removed the old soft-start drive from well number 5 and worked with Shay Electric and Pinnacle Engineering to install a new variable frequency drive. This drive will allow us to slow down the speed of the Jordan well and allow us to blend water from the Silurian wells this is very beneficial to the operations of the water system. The drive is up and running but we are having some intermittent alarms. Pinnacle Engineering is still working on changing some of the parameters in the drive to eliminate the alarm issue once they have that figured out we will start the replacement of well 6. We have a phone conference scheduled with Iseler Construction on January 20th. This will be our pre-construction meeting for the demolition of Tower I. Iseler Construction is planning on starting work on the Tower around the first week of February. We continue to stay busy collecting curb box location information, installing new meters and RF’s, we’ve had several meter change outs this month. Additions/Changes to the Agenda None Public Comment None Approval of Minutes It was moved by Nelson and seconded by Forbes that the November minutes be approved. Passed. Reports Budget The total budget is at 40.5% spent, on target for this time of year. Friends Jennie reported that there have been several fundraisers by the Friends and they have made over $1000. Director Jennie met with the city administration and her budget proposal was accepted for review by the council. She attended two NL City Council meetings and reports that the Council has no interest in adopting a no weapons policy in city buildings. There is a meeting on January 6 with the University Department of Public Affairs to discuss goal setting and organizational effectiveness. Jennie was asked to speak at the Arkansas Library Conference next year. They will pay her travel expenses and she may pay difference to stay for whole conference. This would be out of pocket if Arkansas doesn’t cover her stay for more than the speaking date. Policy Review The Library Access for Sex Offenders Against Minors Policy The Library Access for Sex Offenders Against Minors policy was reviewed. Offenders have to apply to be permitted at the library by US Mail, not by email. Forbes moved and Nelson seconded that the policy be approved. Passed. Old Business Conduct Policy The conduct policy was reviewed. We have to eliminate II, D,5 because the City Council chooses not to adopt a no weapons policy. Neal moved and Nelson seconded that we eliminate the sentence form our policy. The vote was 3 in favor, 2 against removing the sentence. The motion passed. Week 5 of Library Advocacy Unshushed was discussed. Members liked the Planning and Implementation presentation very much. New Business Planning for Results and Jennie’s evaluation will be discussed at our next meeting. Other Business None Our next meeting is scheduled for January 18, 2016. Fox Valley, Part 4 Revised Preliminary Plat Staff Presentation Wheatley presented the request of Fox Valley, Inc. to approve Fox Valley Part 4, a revised preliminary plat for property located south of Forevergreen Road, west of Jones Boulevard. Staff recommends approval with routine notes. Applicant’s Presentation Jeff Mekota was present to represent the developer and offered to answer questions. Public Comments No public comments were offered. Questions and Comments of the Commission The Commission discussed the proposed construction of Forevergreen Road with regards to right-of-way width, the trail adjacent to the roadway, and the timeline of roadway development. Staff Presentation Wheatley presented the request of Linn County REC to approve a site plan for Lot 2, Josephs Keep Second Addition, located east of Arlington Ridge, south of East Penn Street. Staff recommends approval. Applicant’s Presentation Duane Musser, MMS Consultants and representatives from Linn County REC were present for this issue. Public Comments Randy Belknap, adjacent property owner, spoke regarding the updated application and offered alternate locations for the substation. Musser responded to Mr. Belknap’s concerns. Kim Colberg, Linn County REC General Manager, spoke regarding the process for finding a location and construction of a substation. Questions and Comments from the Commission The Commission discussed the application relating to the contingency feed being dependent upon this substation, the timeline of transmission construction vs. substation construction and the capacity of the proposed substation. Wheatley provided information on landscape maintenance, drive locations and outside storage. The concrete driveway will not have curb and gutters. The need for water on the site for fire protection was discussed. Recommendation to the City Council Heisler moved, Covert seconded to recommend approval of the site plan application for Lot 2, Joseph’s Keep Second Addition with no conditions.
