Analysis of Impediments to Fair Housing Hertford County, North Carolina North Carolina Department of Commerce Community Investment and Assistance 2011 Hertford County Analysis of Impediments to Fair Housing (2011) INTRODUCTION: Relative to Title VIII of the Civil Rights Act of 1968 (Fair Housing Act), the Federal Fair Housing Amendments Act of 1988, and the North Carolina State Fair Housing Act, G. S. Chapter 41A, it is unlawful for any persons in a real estate transaction to conduct discriminatory housing practices based upon race, color, sex, religion, national origin, handicapped condition, or familial status. Hertford County is committed to the goal that every citizen be offered an opportunity to select the home of his or her choice. Hertford County is populated by more than 10,000 persons. Therefore as required by regulations set forth by the Department of Housing and Urban Development and the NC Department of Commerce, the recipients of Small Cities Community Development Block Grant (CDBG) program, must prepare and submit an Analysis of Impediments to Fair Housing within the County’s jurisdiction. BACKGROUND: Demographic Data: To date, Census 2010, the American Community Survey Demographic and Housing Estimates: 20052009, along with the accompanying data from Log Into North Carolina (LINC) and the North Carolina Office of State Budget and Management (NC OSBM), are the best available data to retrieve information for this Analysis of Impediments. Census 2010 data was released for North Carolina counties in March 2011. The 2010 Census population for Hertford County was 24,669, an 9.2% increase from the 2000 census data. The increase in population ratio is 9.3% less than the overall population increase for the state at 18.5%. Hertford County Census 2010 data indicates a race population of: 8,786 White (35.6%), 14,933 Black or African American (60.5%), 274 American Indian (1.1%), 131 Asian (.05%) and 235 claiming some other race (1%). Hispanic/Latino (of any race) account for 644 (2.6%) of the total population. The median income for a Hertford County family based on Census 2010 is $38,618. 15% of all families and 37.1% of all families with related children under 5 years old have income in the past 12 months below the poverty level. Poverty status for individuals equated to 23.5%. Unemployment in the County in 2008 was 7.4%, in 2009 9.0% and in 2010 9.4% according to the ProPublica Recovery website. The poverty rate of the US at that time was 13.3%, North Carolina, 14.8% and Hertford County 25.4%. As indicated by Census 2010, 26.3% of Hertford County population above 25 did not have a high school education or equivalency. 1,473 or 8.8% of the population 25 years and over had less than a 9th grade th education. 2,935 or 17.5% of the population 25 years and over had less than a 12 grade education. The total elderly population (persons age 62 years +) is 4,743 or 19.2% of the total population of Hertford County. Another point of concern towards impediments includes the number of grandparents living with their grandchildren of which 63.6% say they are responsible for their grandchildren. From 2000 to 2006 the State of North Carolina experienced an increase of 54.9% of Hispanic population. th North Carolina was listed as the 5 of the top five states in Hispanic growth rate during that time, according to a census.gov pdf (listed in sources). In Table DP-1. Profile of General Demographic Characteristics: 2000 there were 354 persons of Hispanic heritage in Hertford County. The 2010 Census lists 644 persons of Hispanic heritage out of a total population of 24,669 in Hertford County. That is an 82% increase in the total population for the County during that 10 years. Statistically the County has concentrations of low-moderate income residents in the south-west corner and northern section of the County. There are also pockets of low moderate income persons scattered throughout the County. Analysis to Determine Disproportionate Housing Need: According to the ACS 5-Year Estimate, Hertford County consists of 7,333 single-family dwelling units and 820 multi-family units. Mobile homes 1,879 units and 0 boats/RV/van(s). This data is compared to 2000 census data in which, Hertford County consisted of 6,339 single-family dwelling units, 659 multi-family dwelling units, and 2481 mobile homes and 7 boats/RV/van(s). Based upon the ACS, Hertford County’s housing tenure is 65.8% owner-occupied and 34.2% renteroccupied. Average size of households of owner-occupied dwellings in Hertford County is 2.44 and the average size of households of renter-occupied dwellings is 2.54. Hertford County homeowners with mortgages over 30% of their monthly earnings totaled 39%, 7.5% more than North Carolina (31.5%). Renters whose rent exceeds 30% of their gross monthly income in Hertford County account for 57.8%, which is 11.1% more than North Carolina (47.9%). ANALYSIS TO DETERMINE THE NATURE AND EXTENT OF DISCRIMINATION Step 1. Analysis of the Level of Segregation and Spatial Isolation: 1. Are there areas of minority concentration within your jurisdiction? The enclosed map outlines census tracts within Hertford County and their percentage of lowmoderate income. Due to changes in how income is now determined by the US Census and the American Community Survey, LMI is no longer determined by the number of residents with income below 80% of the median income. Low-moderate income is now determined based upon the ratio of the median income of the census tract to the median income of Hertford County. Total African American population for Hertford County is 13,873 persons (60%) which is a large percentage minority population, according to the 2009 ACS data. A second map depicts the tracts with Hispanic populations. The tracts with the highest Hispanic populations are located in the northern and eastern portions of the County as well. 2. Is your community located in a County that has been identified in Residential Segregation in North Carolina: a Barrier to African-American Opportunities as highly segregated by both the isolation and dissimilarity indexes? A copy of Residential Segregation in North Carolina: a Barrier to African-American Opportunities was not available in its entirety for review while compiling this report; however, excerpts from the book were evaluated and are quoted for reference: “As long as whites and minorities live in separate neighborhoods, the schools in those neighborhoods will have skewed racial memberships and financial resources. Despite efforts toward integration, many North Carolinians continue to live in segregated neighborhoods. In the average NC county, 74 percent of African-Americans would have to move to achieve the complete integration of ” neighborhoods. “Government agencies tend to build public housing projects in areas that are cheap and already largely minority. Furthermore, zoning regulations often keep African-Americans or other low-income citizens out of suburban neighborhoods by requiring certain styles of homes or large lots of land for ” homes. Hertford County has made conscious efforts in providing housing opportunities that are supportive for all income levels without the discrimination of color, race or creed. Applications for assistance under the Community Development Block Grants are ranked and rate on numerous categories including, but not limited to, persons per household, household income, disabilities, presence of children and the extent of services that can be treated under that specific grant imposed by the funding agency. Hertford County has taken a proactive approach in integrating the community with all sociologic and economic factors and will continue to pursue equality for all eligible participants. Step 2. Historical Incidences that Contribute to Current Housing patterns: 1. History of public policy decisions on segregation within the Community. The land that is now Hertford County was first populated by the Meherrin Indians for thousands of years. In the mid 1700’s English settlers from Virginia traveled to the area for its fertile soil. Agriculture is still the basis of Hertford County’s economy. Tobacco, cotton, peanuts, corn and soybeans are the most produced crops in the area. During the 1950’s industrial development efforts brought in manufacturers. The largest employers in the County are NUCOR Steel, which manufactures plate steel; Berry Plastics Corporation, which manufactures pharmaceutical closures; Freeman Metal Products, which manufactures metal caskets; Alfiniti Aluminum, which manufactures aluminum tubes; and Perdue Farms, Inc. which manufactures feed for stock. There is no discernable pattern of public policy decisions, which would have contributed to the cluster of minority households in a particular area of the County. 2. Number of farms that utilize migrant workers and its effects on housing patterns. The 2007 Agriculture Census indicates that there are 163 farms in Hertford County, compared to 136 farms in the 2002 Census. The 2007 Census indicates that there are 10 farm operations that use migrant workers. This number has not increased since the 2002 Census when there were 9 farm operations that used migrant workers. (Hertford County, NASS, 2007 Census of Agricultural; www.nass.usda.gov). 3. Industry contributions to current housing patterns (Ex. Development of mill housing for blacks and whites): According to the Hertford County website there are several large employers located within County the top five employers in the county are NUCOR Steel located in Cofield which makes plate steel, and employs 402 persons, Berry Plastics Corporation located in Ahoskie and produces pharmaceutical closures and employs 170 persons. Freeman Metal Products, located in Ahoskie makes metal caskets and employs 125 persons, Perdue Farms, Inc located in Cofield makes feed and employs 125 persons and Alfiniti Aluminum in Winton makes Aluminum Tubes and employs 105 persons. With this employment there has not been a significant impact on current housing patterns within the County. Older subdivisions located near former industrial operations tend to be occupied by lower income households of all races although minority concentrations are common. The County continues to use grant funds to improve housing in these aging neighborhoods. All eligible applicants are ranked based on a needs assessment. Based on data present in the EPA’s Environmental Justice EJView Mapper, it appears that most of the population of Hertford County speaks English well. The minority who speak English less than well are located in the Northern part of the County. Step 3. Fair Housing Enforcement 1. Do you have a fair housing ordinance? Hertford County does not have an adopted fair housing ordinance. However, the County does have a fair housing plan in place regarding Hertford County CDBG activities. This plan is active and ongoing based on the availability of grant funding and as a qualification of grant conditions, these elements of fair housing are being constantly updated and reviewed on a quarterly basis for compliance. 2. What mechanism exists for citizens to file complaints alleging illegal discrimination in programs or services funded by your jurisdiction? Hertford County has a written Fair Housing Plan and Complaint Procedure (published annually in the local newspaper), which states that persons wishing to file complaints can contact the County Manager. The procedure requires that the County Manager acknowledge within ten (10) days a receipt of a written complaint and that the County inform the North Carolina Human Relations Commission about the complaint. The County Manager will assist the North Carolina Human Hertford County Analysis of Impediments to Fair Housing 5 of 34 Relations Commission in the investigation and reconciliation of all housing discrimination complaints, which are based on events occurring in the County. 3. Do you have an Affirmative Marketing Plan? Hertford County has adopted Housing Rehabilitation Guidelines for use in its CDBG project areas. This fluid document is revised accordingly as new regulations and guidelines are imposed by the funding agency. 4. The number of discrimination complaints filed against your jurisdiction within the past two years and the results of any investigations. None disclosed by Human Relations Commission. 5. The number of discrimination complaints filed with North Carolina Human Relations Commission or HUD originating in your Jurisdiction and the results of this investigation: None disclosed by Human Relations Commission. 6. Number of findings related to Fair Housing or Equal Opportunity issued against your Jurisdiction and the corrective action taken. None disclosed by Human Relations Commission. Step 4. Education and Outreach Efforts: 1. Identify all resources available for the promotion of fair housing and equal opportunity. Fair Housing materials are distributed at the Hertford County government offices, County public bulletin board, County Human Resources bulletin board, the public library, local realtors, Ahoskie Housing Authority (Low Rent) and the Choanoke Area Development Association, Inc. (Section 8) and lending institutions. Fair Housing advertisements are published in The Roanoke-Chowan NewsHerald. Fair Housing materials obtained from the NC Human Resources Commission are posted in government offices. 2. How are citizens made aware of these activities? Through the above named sources. 3. List all such activities during the past two years. What were the results of these activities? Hertford County is just beginning the Fair Housing Activities for the 10-C-2121 Scattered Site Housing Project. So far the County has produced a Fair Housing Brochure related to the Hertford County project and has updated the related housing industries listing for Fair Housing and mailed out the new brochure. The County has also published a “news article” in The Roanoke-Chowan News-Herald. The County will make educational materials relative to fair housing available at public places. They will be posted at the Hertford County Office Building, the Hertford County Public Library, the Hertford County Courthouse, as well as realtor offices and local financial institutions. Step 5. Examination of Public Policy and Programs 1. Do current site selection policies have a disproportionate impact based upon a protected basis? If so, is there a nondiscriminatory reason for this policy and is there an alternative that would have a less discriminatory impact? Hertford County Analysis of Impediments to Fair Housing 6 of 34 Most of the County’s recent industrial sites are located in the larger towns of Hertford County. New industrial sites are typically selected by the owner and submitted to the Planning Board or the Zoning Board of Adjustment for zoning and/or site plan approval. Industrial zoning districts are not located in a way that would result in a disproportionate impact on protected classes. 2. Are municipal services equitably distributed throughout the community? All municipal services are available throughout the Towns. There is a Hertford County Rural Water System for use within the Northern and Southern Districts of the County. This system provides 328 miles of water lines that are interconnected. The Rural Water System only provides water to the Towns during an emergency. Hertford County Solid Waste offers a land fill, rental boxes, recycling There are seven (7) solid waste convenience sites and a landfill., seven collection centers and waste hauling. 3. Are there any zoning requirements that have the effect of limiting housing opportunities to protected groups? No. 4. Are there any Community Development or Public Housing Authority activities or programs that have the effect of perpetuating segregation? No. 5. Are the Boards and Commissions representative of the Community? It is the Board’s desire to reflect wide-range participation in appointments, including male and female, persons from all geographic areas of the county and persons representing diverse racial and age groups. Some boards and commissions are created by the authority of the NC General Statutes and may require designated skills or training as specified by regulation. In such cases, the Board of County Commissioners must appoint persons who meet those guidelines. Step 6. Discrimination in the Rental Market 1. Are there any zoning requirements that have the effect of limiting the availability of rental units within the jurisdiction? No 2. Where are rental units located? Are they located in areas of minority concentration? Rental units are located throughout Hertford County. Many of these units are single family dwellings which are subsidized through Section 8 rental assistance. 3. Where are the public housing units located? Public housing units are located in the Ahoskie area. 4. Determine what barriers exist for protected class members in the rental market. The major barrier would be the lack of available rental units, especially for large families and disabled persons. 5. Are vouchers and Section 8 certificate holders able to find housing throughout the community? If not, identify the barriers that face them. Hertford County Analysis of Impediments to Fair Housing 7 of 34 Section 8 vouchers are available for rental units throughout the County. However, there is a long waiting list at the Ahoskie Housing Authority 6. Is steering an issue for protected class members? No. 7. Is housing available for families with children and persons with disabilities? According to the Ahoskie Housing Authority they have two locations and a total of 100 units. Five percent or (5) of these units are fitted for use by elderly or handicapped renters. 28 of the total 100 units have 4 bedrooms for use by larger families. The spokeswoman for the Ahoskie Housing Authority explained that one unit is central to the Town of Ahoskie. The other unit is on the edge of Town and is within a mile (through the woods) to a glass making industrial site. The units are not placed into industrial zoned parcels. There is a need for more three and four-bedroom rental units. The 2009 ACS data states that the average household size for Hertford County is 2.4 and the average family size is 2.93. The average household size for owner occupied Hispanic families is 3.07 for renter occupied households is 3.21 and family size for Hispanics in Hertford County is 2.13. Hertford County Analysis of Impediments to Fair Housing 8 of 34 Since the majority of the single-family rental units are older housing stock, which is privately owned, few of these units are accessible to persons with disabilities. The County has found units located within its Community Development Block Grant (CDBG) areas, which contain persons with disabilities, and it has become necessary, through the scope of the CDBG funds, to rehabilitate these units to accommodate the occupants’ disabilities. Step 7. Discrimination in the Sales Market 1. Does the Local Association of Realtors have a MLS Service? Yes. 2. Is the Local Association of Realtors a VAMA signatory? They were in the past, but VAMA no longer exists. 3. Is there any evidence of racial steering or blockbusting within the local market? Yes. 4. What are the relative housing values for minority and non-minority communities of similar economic composition? It is estimated that the property values within primarily minority census tracts are lower than neighboring non-minority census tracts. This could be attributed to the age and condition of some of the dwelling units as well as the small size of these older lots. Older residential lots were established long before any zoning and subdivision regulations were adopted by the County. 5. Can nondiscriminatory reasons for these differences be identified? If yes, list them. The major nondiscriminatory reason for the minority census tracts having lower property values is that the homes are older and smaller. The lots are often small and not as desirable to homebuyers. This can be attributed to these older neighborhoods being established prior to planning, zoning, and subdivision requirements. 6. Identify any barriers to homeownership opportunities within your jurisdiction. Probably the largest barrier to homeownership within Hertford County is the lack of knowledge of the home-buying process. Poor credit histories make it difficult for low- and moderate-income persons to reach allowable debt-to-income ratios established by financial institutions. Persons with disabilities may encounter additional barriers when seeking to purchase a home. Few homes can be entered by a person in a wheelchair. Another is the process of adapting a home to meet the needs of a disabled person. Adaptations can be costly depending on the home and the needs of the person. Tax credits are available to homebuyers who want to make adaptations for persons with disabilities. This information needs to be provided to more potential homebuyers. There have been no complaints of racial steering filed with Hertford County or the N. C. Human Relations Commission. Step 8. Discrimination in Financing 1. Are local lenders signatories of HUD’s Best Practices Program? Hertford County Analysis of Impediments to Fair Housing 9 of 34 Yes 2. Examine the Home Mortgage Disclosure Act information in your area. Is there evidence of higher denial rates for minorities and low-income individuals? Information is not available from the Home Mortgage Disclosure Act for Hertford County. The information is only available for Metropolitan Statistical Areas (MSAs) and Hertford County is not associated with a MSA in North Carolina. The Community Reinvestment Act does provide aggregate tables by County, but only examines the originations of small business loans. This can be seen in Appendix C. The table shows that most small business loans were from those with upper income and were less than $100,000. The Home Mortgage Disclosure Act for Virginia beach-NorfolkNewport News, VA-NC is the closest MSA region. The findings for denials for home loans can be found in Attachment B. 3. Is there evidence of illegal redlining? No 4. Are banking services available on an equal opportunity basis? Banks and lending institutions are located in various locations throughout the County. A trend in the area is the rise of non-traditional banking services offered by mortgage corporations, check cashing businesses, and pawn shops. As banks increase their service costs, lower income persons are opting to manage their banking needs through these new types of cash management businesses. The overall costs of these types of businesses are more expensive, yet these institutions are often more willing to work with lower income clients. 5. Do local financial institutions participate in housing projects or in the funding of housing related Services sponsored by your jurisdiction? Not at this time. Step 9. Discrimination in the Building and Construction Industry. 1. Do local building codes include the requirements of the Federal Fair Housing Act of 1988? No. Hertford County has adopted the State of North Carolina Building codes. 2. If not, how are local builders and architects made aware of these requirements? Hertford County has the Roanoke Chowan Chapter of the National Association of Home Builders. This Association receives fair housing and accessibility information from HUD and in turn filters this information down to local members as necessary. 3. How many multifamily dwellings funded by local, state, or federal funds have been built since March, 1991? According to building permit data, a total of eight (8) 2-unit multi family structures permitted in 2002. Eight (8 )permits for 5+ unit multi family structure were obtained in 2002. In 2003, five (5) permits for 5+ unit multi family structure and in 2004 two (2) permits for 2-unit multi family Hertford County Analysis of Impediments to Fair Housing 10 of 34 structures were obtained. After 2004, no permits were obtained for building multifamily units. (http://socds.huduser.org/permits). 4. Are they in compliance with FFHA requirements? ADA requirements? Section 504? Yes. 5. Is the local Homebuilders Association a VAMA signatory? VAMA no longer exists. 6. Is there an identified community need for housing for persons with disabilities? Yes. 7. Is there an identified community need for the construction of more affordable housing? Yes. Step 10. Environmental Discrimination 1. Identify the location of hazardous materials within the community. Are they located disproportionately in areas of minority or low-income concentration? Hazardous material sites in Hertford County were those identified as sites reporting to the EPA for hazardous waste, air emissions, water dischargers, toxic releases and Superfund site. There are no Brownfields listed. The map below shows those sites reporting to the EPA in Hertford County with a minority percent by census tract overlay. The next map includes minority housing locations within the county. A list of these sites is attached in Appendix A. 2. Identify any superfund sites within your jurisdiction. Are they located disproportionately in areas of minority or low-income concentration? There is one superfund site in the County which is in the Town of Ahoskie. See map below 3. Identify any site selection policies or procedures that may contribute to the concentration of Environmental hazards in minority or low-income areas. There are no site selection policies are procedures that contribute to the concentration of environmental hazards in minority or low-income areas. Anyone proposing to construct a new site with hazardous materials would be required to obtain a special use permit from the County of Hertford Board of Adjustment regardless of where the proposed site is located.
