Not only is Property Management a well recognized discipline, it is definitely a practice that requires an additional, separate body of knowledge, over and above what was learned to be proficient in residential real estate brokerage and it is not for the faint of heart! It is, however, all too easy for REALTORS® to find themselves “helping out” a relocating friend by agreeing to take on the care of their property by renting it out for them while they are gone, and then there is another friend and then another, etc. These are just the first steps on the way to potential problems since your friends may have different expectations concerning the way you are taking care of their properties. Article 11 of our REALTOR® Code of Ethics is clear that, “The services which REALTORS® provide to their clients and customers shall conform to the standards of practice and competence which are reasonably expected in the specific real estate disciplines in which they engage; specifically, residential real estate brokerage, real property management, commercial and industrial real estate brokerage, land brokerage, real estate appraisal, real estate counseling, real estate syndication, real estate auction, and international real estate. Realtors® shall not undertake to provide specialized professional services concerning a type of property or service that is outside their field of competence unless they engage the assistance of one who is competent on such types of property or service, or unless the facts are fully disclosed to the client. Any persons engaged to provide such assistance shall be so identified to the client and their contribution to the assignment should be set forth.” It has been recognized that a relatively large number of salespeople, many who know nothing about section 92 of the Texas Property Code or Texas Real Estate Commission (TREC) rules that address Property Rentals, are managing properties for others, either without their broker’s knowledge or, if their broker is aware of their agent’s activities, he or she may not appreciate how they too could be affected if something goes awry. Both the Texas Association of REALTORS® (TAR) and TREC note that the vast majority of complaints they receive are property management related. So, to practice in the property management field education is critical and the activities in this field are very different from listing, selling, financing and closing real estate. There are courses directly related to property management that are offered through real estate schools in the San Antonio area and there are written materials available where you could learn the ins and outs of managing properties for other owners. It is, for example, important to be proficient in things like collecting and returning security deposits, maintaining the property, the process for eviction or ending leases, disbursing rental proceeds to the owner and the liability you and your owners may face, to name just a few. Property Managers, as well as the owners they serve, need to be aware of the rules and regulations of the Home Owners Associations (HOA) regarding rentals in the communities where they manage properties, and frequently those rules can present major problems. For example, privacy issues have been questioned by owners, manager and renters as more than one local HOA has been requiring that their board must approve any prospective tenant for a rental property in the community. Fortunately this issue has been recently resolved when newly enacted legislation in Texas prohibits HOAs from enforcing that requirement. One issue has been taken care of but there are a number of drawbacks that still exist in dealing with HOAs especially when inexperienced HOA boards insert requirements whose legalities may be subject to review. On the subject of education for those who wish to take on property management as a specialty there are basic courses such as Property Management 0811 that provides a perspective of major functions of property managers and CE courses like Property Management – The Property Code that addresses key elements in the Code relevant to property management and Property Management Policy and Procedure Manual which outlines what should be included and will serve as a guideline and model when you establish your business. There are also two certification courses, Texas Residential Leasing Specialist (TRLS) and Texas Residential Property Manger (TRPM). Requirements for TRLS are that you be a member of TAR and complete four three-hour leasing courses that include: Essentials of Residential Leasing, TAR Residential Lease Agreement, Agency Issues Impacting Property Managers and Leasing Agents, and Marketing and Leasing Residential Properties. The TRPM also requires that you be a member of TAR and you must complete six threehour courses including: TAR Residential and Leasing Property Management Agreement, Residential Evictions, Tenant and Owners Relations, Maintenance and Habitability of Residential Rentals, Statutory Acts and Contingency Planning, and Property Management Business Issues. While you may work on the TRPM courses before completing the TRLS you must have completed it before you will be awarded the TRPM. Probably the most important requirement for this Certification is that your application includes certification that you have completed 500 unit-years of experience acquired cumulatively over a minimum of five consecutive years (one unit-year equals management of one residential unit for one year). While the aforementioned education and subsequent certifications will certainly help, many local property managers will agree that membership in the National Association of Property Management (NARPM®) is what offers them the greatest help. In reality, a brokerage that combines residential real estate sales and real property management can be a very good business model since it addresses a fact that all REALTORS® recognize –real estate business is cyclical. When the market for property sales is down it seems the leasing business is riding high and provides the brokerage with a steady source of income from rentals, and in reverse, when property sales are hot, the rental market slows down. In today’s markets for San Antonio and its surrounding areas, where sales are running high the housing inventories are so low, having a large number of rental properties on hand have the potential to provide an additional source for properties available for sale. The extreme lack of inventory in the San Antonio area often means the best properties receive multiple offers. I am sure many of you have experienced the frustration of losing out on the perfect home. As we all know, properties newest to the market are the likeliest to get multiple offers so when showing properties you need to be prepared to act fast. You also need to prepare your buyer to pay list price or even more. The days of seller’s concession are quickly becoming a thing of the past. Also remember not only does the listing agent need to find someone ready to buy the seller’s house but they also have to make sure the deal sticks. You must do everything possible to give the impression that if the offer is accepted you will soon be sitting at the closing table. Consider putting more money down as earnest money or better yet, increase your amount of the option fee. As luck would have it, we have experts in our industry who will be part of a Panel Discussion at the Women’s Council of Realtors Business Resource Luncheon on August 5th. July 15, 2015 www.renewssource.com Industry Sound Off By Justin Landon, Governmental Affairs Director What Proposition 1 Means to Texas REALTORS® The 84th Legislative Session of the Texas Legislature was a landmark for property owners and REALTORS®. While many positive changes were made to state law, perhaps the most important will be up to Texas voters this November. Passed as part of SJR 1, the Texas legislature approved Proposition 1 for the November ballot. If passed, Proposition 1 will increase the homestead exemption and constitutionally ban real estate transfer taxes. In real terms, Proposition 1 boosts the homestead exemption from $15,000 to $25,000, the first increase in two decades. The increase will provide meaningful property tax relief immediately to Texas homeowners. Increasing the homestead exemption was a hotly contested item throughout the session. Some advocated only for business tax relief while others felt reducing property tax revenue would harm schools. Ultimately, the legislature agreed that increasing the exemption would make homes more affordable. Additionally, Proposition 1 was crafted to keep school districts whole. No cuts to education funding will come about as a result of Proposition 1. Proposition 1 also includes landmark language that would constitutionally protect the transfer of real estate from taxation. Many states and local jurisdictions tax a percentage of the home sale. Called a “transfer tax,” this fee is paid to a government entity and can reach as high as two percent of the sales price. Banning “transfer taxes” has been a top priority of REALTORS® for years. With Proposition 1, Texas voters have the opportunity to cement their state as the most attractive place in America to buy and sell property. Over the next few months there will be a lot written about Proposition 1, both positive and negative. There are some out there who believe that the homestead exemption is fine where it is. There are some who believe taxing real estate is a REAL ESTATE NEWS SOURCE great idea. The best way to counter that argument is to educate about the importance of a healthy real estate market to the Texas economy. The Texas Association of REALTORS® and the San Antonio Board of REALTORS® will do their part to get that message out. 7 But Texas REALTORS® have to do their part too. On Tuesday, November 3, Proposition 1 will go before the Texas voters for approval. Stewart recognizes that everyone wants to feel good about their company, who they work with and what they accomplish together as a team. Stewart’s associates know they have to be aware of and accountable for their own behaviors and that they have to do the absolute best for customers all the time. Stewart also recognizes that they have to be exceptionally visible in the community, need to encourage their associates' growth and development, and must be sure to recognize their achievements. It's the little things done consistently that make the difference and knowing that it’s important not to become complacent. The San Antonio Business Journal recently honored Stewart Title by naming them one of San Antonio’s Best Places to Work. This honor is telling as it results entirely from employee feedback on factors such as working with people they like and respect, work that challenges them to stretch and grow, having a strong positive culture that supports meaningful work and their access to learning and development opportunities. According to Debbie, employee attitude has to be set on positive so they are geared for positive outcomes. They need to make proper use of the many products, services and resources they have, stay engaged and have fun while they are at it! To prove that this attitude works, the 15 outcome for 2014 showed that they were able to not only attain their goals, but to exceed them, and most important to Stewart, maintain a high customer satisfaction index. The philosophy of Division President Eddie Gammill is that he wants Stewart associates to truly enjoy what they do every day. Now, well into 2015, Stewart Title is off and running again and is fortunate to be in a position to grow. In the past year they successfully expanded into the Alamo Heights market area and moved the existing office in Canyon Lake to larger facilities. For next year they are on track to add two more offices in viable areas. Armed with their success in 2014 and determined to continue the pace by setting new goals, while continuing to provide the services their customers require, Stewart aims to be recognized as the ultimate resource for information. For example, the upcoming CFPB TILA-RESPA integrated disclosure will bring about many changes and Stewart Title is well prepared and positioned to serve their customers. Spray an 8x8 inch baking dish with non stick spray and set aside. 2. Using a knife or mandolin slicer, thinly slice zucchini and squash to roughly 1/8 inch thick. 3. In a large skillet, heat olive oil over medium heat. Add garlic and shallots and sauté until aromatic, a few minutes. 4. Add zucchini and squash and sauté for about 5 minutes, tossing frequently with tongs, just to cook everything slightly. Season to taste with salt and pepper. 5. In a small bowl stir together Parmesan and bread crumbs. 6. Place half of the vegetables into the baking dish and top with half of the Parmesan and bread crumb mixture. Then top with remaining vegetables and remaining cheese/bread mixture. 7. Cover with tin foil and bake 20 minutes. Uncover and bake another 10 minutes, or until bubbly and golden. Enjoy!!
