I
want to thank everyone for making the past five years an amazing experience. We have accomplished a great deal! Most importantly we have
become a much more professional, closer and well-organized Association! I want to thank the Board of Directors, our amazing members
and especially, Kim, Bill and Jon for all of their help and advice along
the way! I know our next President, Tony DeMarco, will do a Great job!
We are currently working on our Legislation for next year that will make
all of us more money. Please read page 10.
I hope all of you have started making reservations for our Convention! It will be my last Convention as your President and I hope to see
all of you there! We have two amazing key-note speakers: Former Los
Angeles Councilman and good friend Dennis Zine along with Los Angeles County Supervisor Candidate Bobby Shriver. They are both great
speakers and I am very excited to have them join us. We also have
many educational sessions planed. Our Vendor hall will be larger than
ever! This will be the best Convention yet!!! See all the details beginning
on page 23.

H
igh school music was huge, back
in the day, to Michael Hyman.
He led the Pep Band for a time
at Montgomery High, played in school
musicals and jumped merrily from piano to saxophone to bassoon to whatever tickled his fancy. “Everything was
music for me,” said Hyman, who owns
downtown Santa Rosa’s nearly 60-yearold Pawn Advantage store.
So the news that the Analy High
band’s performance of the national anthem at a Giants game was marred by
the loss of a bin containing 14 woodwind

instruments spurred him to action.
Late last week he presented to
the Analy music department’s Kelly
Stewart and Dawn Johnson six clarinets from his store. Their gratitude
washed over Hyman like the stirring
strains of a Sousa march.
“It’s very important to me that the
music keeps going,” he said.

breathtaking to members of Analy’s
music scene already touched by the
community’s outpouring of donations
of instruments and cash.
“He took them right off the wall
(of the pawn shop) and gave them to
me,” said Stewart, the band and or-

She said it also has astounded her
and the students for another music
lover to donate a professional-quality
clarinet worth perhaps $6,000, and
for a Sebastopol Rotary Club to contribute all the cash from a special hatpassing, and for people as far away as
Lafayette to pitch in to help the band
recover from the loss of the instruments at AT&T Park.
As unfortunate as the incident at
the ballgame was, Stewart said, it and
the stunning public response to it “has
brought the band even closer together.”
Added the band maestro, “We’ve
barely missed a beat, if you will.” ■

More Revenue: 2015 - An Important
Year for CAPA Members
I
t looks like 2015 is going to be a very busy year for CAPA’s legislative committee.
Along with the legislative efforts described in CAPA Legislative Co-chair and President elect Tony DeMarco’s article, the CAPA Board of Directors, at the recommendation of the committee, has voted to run a revenue enhancement bill. This bill will
not only increase revenues in several categories, but also will decrease some of
our costs.
As you all are aware, pawnbrokers in California are 100% reliant upon what
the legislature allows us to charge in fees and interest on pawn loans. Only
through legislation are we able to increase what we are allowed to charge.
Our team has already completed the language for the bill and started
meeting with interested parties in order to smooth the way for passage. This bill is going to be the most aggressive compensation effort ever attempted by CAPA, and we are prepared to work hard
to get this legislation passed in its’ entirety.
The specifics of this legislation will be unveiled at the
CAPA Convention in Pomona in October. This is a
very exciting time for our industry, so don’t
miss out on being a part of it.

I
t has come to the attention of the CAPA Executive Committee that the California Department of Agriculture
has made the decision that all California Pawnbrokers
must become licensed weighmasters. Along with burdening the industry with additional compliance requirements,
the yearly fee for the license is $500, plus an additional requirement that our employees become “deputy weighmasters“, for which there is an additional fee! The penalties for
non-compliance are large.
The Department of Agriculture is not wasting any
time and has already contacted several pawnbrokers in
the state. CAPA will not stand for this new money grab
and is going to fight for our members on both the legal
and legislative fronts. In the interim, it is imperative that
none of us post signs, advertise or state that we sell or
loan based on weight, and that we do not use the word
“scrap” as an item descriptor in our programs.

Legislative Committee Update
State Legislature Passes CAPA SCR Resolution
T
he Department of Justice
is still dragging their feet
to implement the State’s
single, statewide database. They
continue to challenge the agreeTony DeMarco, CAPA Legislative Chair
ments of 2012 between prior leaders at DOJ, Law Enforcement and Industry. It is critical
that we protect these agreements. Not only will it protect our customer’s privacy but these agreements were
given to the State Legislators in order to pass AB 391.
DOJ’s unwillingness to bend on this issue has forced
CAPA to create language, in the form of a bill, that we
plan on running in 2015. This proposed legislation will
codify the intent of AB 391 and hopefully motivate DOJ
to activate the statewide system. It is imperative that
all pawnbrokers and secondhand dealers follow the
strict reporting laws of California. Namely, reporting
the next business day to LE on DOJ approved JUS123
PAPER FORMS. It is the law.
ACR 101 (Sawyer) was signed by the governor in
August. There was not one “No” vote (75 Ayes; 0 Noes):
Another amazing feat by CAPA, Mr. Duplissea and Mr.
Webster. ACR 101 requests that the DOJ meet with our
industry and Law Enforcement to come up with a solution for California with the emerging Internet Pawn

market. This resolution states to “fairly compete with
the out-of-state …pawnbrokers,” and CAPA will continue to explore the electronic transaction with the goal
(at the very least) of enabling pawnbrokers in California to accept payments and renew loans without the
customer having to be present. ■

send you greetings from the State Capitol. This Labor Day weekend we
will be wrapping up the 2013-2014 Legislative Session. CAPA has
once again had a very productive two year session. We passed SB
762 (Hill) and ACR 101 (Jones-Sawyer) with comfortable margins
of victory. Our most significant problem this two year session

springs from out 2012 legislation AB 391 (Pan). The DOJ is, as
expected, trying to do it their way and not our way. Your Board of Directors has been
steadfastly defending our position and progress is being made to foil their efforts to
make a system that works for them and not for us.
Your Board of Directors has also been very proactive in planning our 2015 legislative agenda. We will be introducing a major revenue enhancement bill in 2015. We
will also likely be introducing legislation to clarify some specifics on our responsibility as it relates to the DOJ database. By the time we leave the convention in October, we should also know if we will be introducing legislation in the electronic
transaction arena.
When the Legislature adjourns over the Labor Day weekend, several large
public policy issues will be decided. This session has already seen a landmark
agreement on Water Bonds, including the controversial above ground water storage fight. Your lives may be even more affected by the charade bill that seeks
to charge you for a bag at the market. You may now also ride in an Uber car
knowing that the driver has little insurance, and no background check,
and no drug testing requirement as the taxi driver parked next to him
must have to drive you around. Stay tuned since all these measures will
need the involvement of Governor Brown. ■

othing on reality television is real or completely accurate. If you thought you knew everything about
pawn shops courtesy of “Pawn Stars” unfortunately there is a lot more to the business than what is shown
on TV. However rather than have you running all over
trying to learn about how to shop pawn stores for great
fashion, decor and gifting finds, I did the leg-work for you!
Given that this post is right after the Emmys, here’s a

How different is it from what we see in the reality
shows on TV?
Very different. On the popular pawn shows, most people come in to sell their item(s). That is not the core business of a pawn shop. Our core business is loaning on peoples’ collateral to help them through a rough patch, start a
small business or go on a family vacation.
How did you end up owning and running a pawn shop?
Owning a pawn shop was unexpected. I was presented
with an opportunity to purchase Traders Loan and Jewelry
in 1997 through some friends. I have an extensive background in retail as former area manager for Mervyns department store and a buyer for Robinson/May, and I even
owned my own retail store in the Antelope Valley area for
several years. I’ve had success in retail in the past and I
have a head for business, so I knew I could apply that experience into the pawn industry.
What is owning a pawn shop like?
Owning a pawn shop is all about helping people. Most
people don’t realize this, but 95% of pawned items at Traders Loan and Jewelry are redeemed. We’re not in the business of keeping peoples’ sentimental items. That’s why we
ask them how much they need; this increases the likelihood
of them getting their item back and not borrowing more
than what’s feasible for them. It gives people a great chance
to succeed.
There are also two distinct sides to our business: the
first is the pawn aspect, where people get a short-term loan
on their valuable personal belonging(s) and when the debt
and interest are paid, they can redeem their item or renew
the loan.
The second is that we’re a jewelry store. We have hundreds of brand new jewelry pieces in our store that are high
quality and cost a fraction of retail. In fact, many jewelry

How does the consumer work with you if they want
to pawn something? Sell something? Buy something?
They simply come in with their item and we will ask
them what they’d like to do and how much they are looking
to get. Whether we’re loaning, selling or buying something,
we do our research so we know we are loaning or offering
to buy something at a fair price. The same goes for what we
sell in our store.
What would one find in your store that sets it apart?
Perception. Meaning many people have never been inside of pawn shop because movies, television and media
have portrayed of pawn shops as being located in a dark,
seedy alley where you walk in and it’s dank with burly men
covered in tattoos, smoking a cigar behind the counter.
Well, that isn’t the case at all. Our store is well lit, clean,
on a bright and busy street corner, has security and is,
frankly, beautiful and filled with fresh, clean, smiling faces
to welcome you when you walk through our doors.
Can anyone buy things from you? Is it possible for
people outside of LA to purchase from you?
Yes, they certainly can. We have an eBay store: http://

items that are not always on our eBay store.

It’s not a store in the typical sense because you aren’t
buying things in all sizes…so what should the average consumer know about “shopping” a pawn shop for gifts or for
items for themselves?
Not everything in our store is at a loss of someone else.
Much of our jewelry is brand new. Most items like watches,
musical instruments, tools, coins and more were sold to us
outright. Very little that we have for sale is something that
someone forfeited on a pawn loan. You can feel good about
shopping here. We have a lot of different things all the time,
so it’s good to check in often. You can find major deals on
items and brands such as Rolex, Cartier, diamonds, guitars,
tools, gemstones and much more.
You have to remember, when you pawn or sell an item
to us, we are only going to offer you a portion of what the
item is worth; not the retail value. It’s also important to understand that something is only worth what someone else
is willing to pay for it.

This is a great way to get through a cash crunch without losing your valuables. It’s the best of both worlds. Again,

we don’t report you to the credit bureaus.
Selling
If you want to sell us something, it’s a similar process.
But in this case, you don’t need to make any payments or
pay any interest on it because you sold us to it outright and
now we own it and you have the cash.
When people buy something from us, they will find that
both our new jewelry and anything else pre-owned in our
store is sold at a fraction of retail. We also offer layaway,
have sales and more. I highly recommend that people come
see what we have to offer before they purchase at someplace like a jewelry store in the mall. Knowledge is power.
What would be of interest for most fashion-obsessed
women from your store?
A lot of people don’t know that we have some furs for
sale, along with some vintage dresses and purses. Again,
we’re always getting new and interesting items in, so it’s
good to keep checking.
What’s the price range of items in your store?
Prices can range from $1.99 to $50,000, and everything
in between. In other words, we can fit into most peoples’
price range.
You have custom designed pieces in your store– who
does the designs and how does that work out?
Yes we do. We have a gemologist on staff, who designs
one-of-a-kind pieces like rings, necklaces and more. He will
work closely with you to get the design you’re envisioning.
What items or categories have the most demand? (Or
is there any category that is “in demand”?)
Pawning:
Pawning an item is a great option for people who don’t
have a bank account, are under-banked, have bad credit,
don’t want to pay traditional bank loan fees or can’t get a
traditional loan. A pawn loan is strictly based on your item
and nothing else. Not you, not your credit score or bank
account. When someone is pawning an item, we appraise
them item and make them an offer. The offer is usually a
percentage of what the item is worth; not what it can be

racing vehicles — nearly 50 at the
Grand Opening — along with photographs, trophies, helmets and
driving uniforms, artifacts, paintings, and other memorabilia chronicling more than 50 years of American motorsports.

Where has the time gone? Summer is over, the kids are back in

school and now we are preparing for our best selling months. Unbelievable. On a side
note, I will be having a sale in October celebrating 40
years in business. Over all this time there have been
many ups & downs. However, there is nothing I would
rather be doing except maybe being the head of a large
Hedge Fund. Laugh, laugh. As I think Fernando Valenzuela once said “Pawnbroking has been very, very good
to me” Maybe it was “baseball” he said not Pawnbroking, but it’s similar. And speaking of baseball, during
my sale I will most likely have to cut my store hours
down because I will probably be attending the World
Series in Anaheim. - sorry Jan.

and remember CAPA is working hard on your behalf.
