Greetings!
I hope everyone had a Merry Christmas
and a Happy New Year. Christmas at
our place was very good this year. I am
so thankful that my family is in good
health and I was able to spend some
good quality time with most of them.
It is hard to believe that the holidays
are already over and it is kind of sad to
be taking down all the decorations and
lights. It seems the older I get, the faster time goes by.
There has not been a lot of activity on the local level in trucking.
The turnout at the West River legislative reception was not bad. I
wish we would have had a few more participants, but the legislator
head count was down as well. So thank you to all who showed up.
The food was good and the conversations even better.
It looks as though we are starting the new year off with a bang. Oil
prices are at a record low and the stock market started out with its
worst beginning ever, getting everyone’s attention as to whether we
are slipping further into our recession. I say slipping further because I don’t believe we have even recuperated from 2008 yet. The
feds want to blame the Chinese, but we don’t depend on them for
much of our exports anyway. ISIS is still raising havoc around the
world and I don’t think our administration has a clue what to do
about it. President Obama believes if we just have stricter gun laws
we would be safer. The truth be told, he is probably the best gun
salesman this country has ever seen! The more threats he makes
to limit what kind of guns we can buy, how many we can have and
who can sell them, the more Americans are buying them. I believe
everyone should go through gun training when they are 16 years old
or before they can get a drivers’ license. We should all be carrying
guns. The bad guys would think twice about shooting someone if
those someone’s could shoot back. When will these close minded
thinkers realize that guns don’t kill people, people kill people!! Just
to remind everyone, the second amendment is the right to bear
arms. This is not so we can go out and shoot rabbits. We have the
right to defend ourselves even against our own government if necessary. Please everyone, stay on the right side of this and support our
rights.
On a happier note, this weeks’ power ball winnings are expected to
exceed 1.3 billion dollars. Is that insane or what? I am a numbers
guy, so this is how this breaks down. The winner would take home
about 700 million dollars. If you were to invest that even at todays

As I board a commercial flight from Tampa, Florida (from a warm vacation) headed back to the frozen tundra
in South Dakota, I will make use of the down time and write my first article for 2016.
South Dakota’s Legislative session starts on Tuesday, January 12th. According to what I hear and read, education funding and Medicare expansion will occupy a great time of the debate. Although I do not anticipate
any legislation specific to the trucking industry, I am very confident that vigilant watch for bills that have an
effect on this industry and the membership as residents will keep me running around the State Capitol Building as I do every year. I already know there will be a Worker’s Compensation Bill that will take up a great deal
of my floor lobbying time. As in past years, I will be preparing weekly updates to those that have given me an
email address. If you have not received these updates in past years and wish to have them, please provide
your email address to your SDTA Office. Also, as in past years, if you need to talk to me while I am in Pierre,
please contact your SDTA Office and have a member of my staff send me a message; I typically return calls
as soon as I can.
Now that we have a federal highway funding bill signed by the President, it is time to implement the provisions of the bill. One provision is of particular interest to trucking companies that operate longer combination vehicles (LCVs) in South Dakota. Thanks to about 20 years of hard work and specific kudos to United
States Senator John Thune, we can finally fix our LCV routing issues. In my opinion these routes can be fixed
through administrative rules that are promulgated by the South Dakota Transportation Commission which is
something else I hope to get the ball rolling on while I am at “Winter Camp” in Pierre.
The SDTA Board of Directors Winter Meeting is scheduled for Monday, January 25th at the Ramkota River
Centre in Pierre. That evening, the SDTA along with the South Dakota Automobile Dealers Association will be
hosting a dinner and dessert bar for the legislators. As always, every SDTA Member is invited and encouraged
to attend. Not only do you get a free social and dinner, this event also gives everyone an opportunity to visit
with our state lawmakers. Please join us for the board meeting and the evening gathering!
In closing, I encourage everyone to review the “Dates to Remember” contained in this edition of the Trucking
News. We have a lot on the calendar in 2016!

Hope everyone had an enjoyable and Happy Holiday Season. I know I sure did!
Thanks to everyone for their holiday ads in December’s issue of the Trucking News. That is my
favorite issue every year - it is so colorful and cheery.
Plans have started for the Annual Log Haulers Seminar so PLEASE KEEP APRIL 5TH OPEN.
Dave Parker, attorney for Great Western Casualty out of Denver, CO will be returning also. We’ve planned an open discussion with
Myron Rau too. So bring any and all of your questions and comments. Hopefully SDTA Chairman and ATA Vice President Mike Habeck will be returning also. Captain John Broers from the South Dakota Highway Patrol, Motor Carrier Division, out of Pierre SD will
also be there. If you have any topic or speaker you would like to see or hear, please let us know ASAP so that we may get it arranged.
I have spent the last few months trying to get a blanket contract with all the logging contractors listed on one document that each
individual log hauler could use as an independent contractors certificate. However the State of South Dakota will not accept this.
They maintain under South Dakota laws and regulations that you have to have a separate contract with each logging contractor.
You can submit as many individual contracts as you want for a certificate. But if you have other logging contractors at later dates
that want your certificate, you will need to submit another contract for an additional certificate. As redundant as this all sounds, in
order to have a contract with someone you don’t work for, this is the procedure you must follow to address workman’s compensation
issues. I am not sure if this can be changed, but we won’t give up yet! You must remember you as a Log Hauler are not the one
being audited for workman’s compensation and you have to prove your independence. It will be in your best interest to produce
this contract if they are asking for a certificate from you.
In November’s article I addressed the issue of log yard rules for safety standards. I agree and support a safety program with a
high set of standards. We are expected to follow a list of guidelines regarding safety standards by the forest service, mills and logging contractors to protect a list of assets. However we have never set any standards regarding our safety. Due to the increase of
incidents and the severity of those incidents, it is the feeling of the group that the issues of deck heights and the grades in which
decks are sometimes located need to be revisited. The idea is to set standards for a maximum deck height and a maximum grade
at which a deck can be located. I believe if we set these standards and communicate them to everyone involved that everything
possible will be done to meet those standards. Our safety not only begins with us, but it is ultimately our responsibility!

WASHINGTON – The U.S. Department of Transportation’s Federal Motor Carrier Safety Administration
(FMCSA) today announced the adoption of a Final
Rule that will improve roadway safety by employing
technology to strengthen commercial truck and bus
drivers’ compliance with hours-of-service regulations
that prevent fatigue.
“Since 1938, complex, on-duty/off-duty logs for truck
and bus drivers were made with pencil and paper, virtually impossible to verify,” said U.S. Transportation
Secretary Anthony Foxx. “This automated technology
not only brings logging records into the modern age,
it also allows roadside safety inspectors to unmask
violations of federal law that put lives at risk.”
The Final Rule requiring the use of electronic logging
devices (ELD) will result in an annual net benefit of
more than $1 billion – largely by reducing the amount
of required industry paperwork. It will also increase
the efficiency of roadside law enforcement personnel
in reviewing driver records. Strict protections are included that will protect commercial drivers from harassment.
On an annual average basis, the ELD Final Rule is
estimated to save 26 lives and prevent 562 injuries
resulting from crashes involving large commercial motor vehicles.
“This is a win for all motorists on our nation’s roadways,” said FMCSA Acting Administrator Scott Darling. “Employing technology to ensure that commercial drivers comply with federal hours-of-service rules
will prevent crashes and save lives.”
An ELD automatically records driving time. It monitors engine hours, vehicle movement, miles driven,
and location information.
Federal safety regulations limit the number of hours
commercial drivers can be on-duty and still drive, as
well as the number of hours spent driving. These limitations are designed to prevent truck and bus drivers from becoming fatigued while driving, and require
that drivers take a work break and have a sufficient
off-duty rest period before returning to on-duty status.
The four main elements of the ELD Final Rule include:
• Requiring commercial truck and bus drivers who
currently use paper log books to maintain hours-
of-service records to adopt ELDs within two years.
It is anticipated that approximately three million
drivers will be impacted.
• Strictly prohibiting commercial driver harassment.
The Final Rule provides both procedural and technical provisions designed to protect commercial
truck and bus drivers from harassment resulting
from information generated by ELDs. [A separate
FMCSA rulemaking further safeguards commercial drivers from being coerced to violate federal
safety regulations and provides the agency with
the authority to take enforcement actions not only
against motor carriers, but also against shippers,
receivers, and transportation intermediaries.]
• Setting technology specifications detailing performance and design requirements for ELDs so that
manufacturers are able to produce compliant devices and systems – and purchasers are enabled to
make informed decisions.
• Establishing new hours-of-service supporting
document (shipping documents, fuel purchase
receipts, etc.) requirements that will result in additional paperwork reductions. In most cases, a
motor carrier would not be required to retain supporting documents verifying on-duty driving time.
The ELD Final Rule permits the use of smart phones
and other wireless devices as ELDs, so long as they
satisfy technical specifications, are certified, and are
listed on an FMCSA website. Canadian- and Mexicandomiciled drivers will also be required to use ELDs
when operating on U.S. roadways.
Motor carriers who have previously installed compliant
Automatic On-Board Recording Devices may continue
to use the devices for an additional two years beyond
the compliance date.

County Commission extends workforce grant
The Minnehaha County Commission on Thursday,
November 17 voted unanimously to extend the life of
a work force development grant for commercial driving license training.
Fewer, applicants then anticipated applied for training through Southeast Technical Institute. This left
about $52,000 in unused money after that grant
expired on October 31.
The grant covers the class and instruction for students.
The following year, the state provided another
$110,850 to train another 30 students. So far, 41 students have completed the program.
“It’s a program designed to create jobs, so it s good
for the county,” Commissioner Dick Kelly said.
The commission extended the life of the grant for a
year, which could provide training to 12 more students.
Myron Rau, president of the South Dakota Trucking
Association, said the trucking industry is seeing the
largest shortage of drivers ever.
“We are thrilled that they’ve partnered with us and
are allowing us to do that,” said Roxanna McKenna,
marketing director for training solution for STI. “The
jobs they are filling are in desperate need.”
Indeed, the shortage of trucking drivers has grown to
nearly 48,000 and could expand further due to industry growth and a retiring workforce, according to the
new analysis by the American Trucking Associations.
The grant was given to the state by the Southeastern
Council of Governments.
The trucking industry will need about 890,000 new
drivers over the next decade to address the shortage
the study says.
Minnehaha County in 2012 received the $129,500
grant from the state to assist STI in expanding its
commercial driver’s license program.
The grant was used to add another semi-tractor for
training for 20 students to complete the program
over 18 months. Only four students take the fourweek class at a time. McKenna said this ensures
ample driving time.
Mike Habeck, owner of Habeck Trucking Inc. and
chair of the South Dakota Trucking Association, said
the grant helps attract potential workers amid an
increasing shortage.
“Anything we can do to enhance getting more people
into our industry would be good,” Habeck said.
